RECOMMENDATION Approve Attached Check Register for the period ending May
31, 2014, as submitted, which includes the Check Register
Account Index and Voucher Listings for Fiscal Year 2013-14
BACKGROUND
The check register for the period ending May 31, 2014 is presented in accordance with
Government Code §37202 and is hereby submitted for the City Council's approval
On May 13, 2014, City Council approved the City's Fiscal Policies, which included
Policy 2 01 — Accounts Payable Policy 2 01 states that a "check register will be
prepared by the Finance Department and submitted to City Council for review and
approval on a monthly basis during a regularly scheduled City Council meeting The
check register will list all vendor payments for the preceding month along with a brief
description of the type of goods or services purchased and the account code(s)
associated with each payment "
During the month of May, two (2) check registers were submitted and approved by City
Council Check Register No 05-13-2014 and No 05-27-2014 Both check registers
included payment to vendors for the period May 1, 2014 to May 27, 2014 The attached
check register includes the remaining period in May, from May 28, 2014 to May 31,
2014
Also stated in Policy 2 01, the check register will be "submitted to City Council on a
monthly basis listing payments made to various City vendors for the preceding month"
The check register for the month of June, 2014 will be submitted for City Council's
review and approval at the July 22, 2014 Council meeting
The attached index to the Check Register is a guideline account list only and is not
intended to replace the comprehensive chart of accounts used by the City and CRA
Successor Agency Expenditure account number formats are XX-XXX-XXX [Fund -
Department -Account] Expenditures may be made from trust/agency accounts (Fund
23-XXX-) or temporary clearing accounts which do not have a budgetary impact
A total of $56,817 45 in accounts payable checks were issued during the period for
services, reimbursements, supplies and contracts and are detailed in the attached

San Bernardino Sheriff Lieutenant Mahoney informed Council and the public there would be a Town Hall
meeting regarding public safety and Neighborhood Watch programs on Thursday June 12, 2014 in the
Community Room, starting at 6 p m He noted department personnel would be addressing Neighborhood
Watch, and other subjects such as greeters, schedule new and re-training, response times, and crime
statistics and include a question and answer period

Agency to the City of Grand Terrace
PUBLIC COMMENT
Mr Robert Souter spoke regarding the changes in parking allowed on Westwood Street versus
Westwood Lane, which would not allow for access for emergency vehicles He addressed the impact of a
gate recently installed and the problems this has caused residents, noting the result has caused a Health
and Safety Issue He submitted written comments for the record

Council Member Jackie Mitchell stated she had attended the Grand Terrace High School graduation,
noting the importance of graduation and growth of our youth She also commented on the fun and
success of all involved in the Grand Terrace Community Days

An Ordinance Establishing New Speed Limits on Certain Streets Based on Speed Zone Survey
Community Development Director Sandra Molina gave an overview of the recent Engineering and Traffic
Survey for the City She noted California statutes require a local agency to perform speed zone studies
at least every five years to enable speed limits to be enforced by radar and other electronic means The
result of the Survey recommends changes on portions of three streets in the City DeBerry Street, Mt
Vernon, and Van Buren Avenues On DeBerry and Van Buren the proposed limits would be increased by
5 miles per hour (m p h ) and on Mt Vernon Avenue, the proposed limit would decreased by 5 m p h
Director Molina noted a Public Hearing Notice was published and posted in connection with this item
She requested Council approve the first reading of the Ordinance to revise the Municipal Code, Title 10,
Chapter 10 08 and move the item forward to a second reading for proposed adoption

was a tie between Tara Cesena and Paul Aguilar It was determined by City Attorney Adams the Council
should vote again to break the tie vote, Tara Cesena received the majority of votes and was appointed to
the position with the term ending in 2016

DISCUSSION
There have been no changes to the proposed Ordinance since the first reading on June
10, 2014 Staff recommends the adoption of the proposed Ordinance The Ordinance
will go into effect 30 days after it is adopted by the City Council
FISCAL IMPACT
Fund 20, Measure I funds, account number 20-200-723, City-wide striping Program will
be impacted by approximately $4,500 00 to change the street markings, and, Fund 16,
Gas Tax Funds, account number 16-900-220, Special Departmental expense, will be
impacted by approximately $500 00 to purchase new speed limit signs The cost for
street markings and signage have been accounted for in the existing budget

WHEREAS, the City of Grand Terrace, through its Traffic Consultant, has
conducted an Engineering and Traffic Survey for the City of Grand Terrace, which
included speed zone and field surveys on Barton Road, DeBerry Street, Main Street,
Michigan Street, Mount Vernon Avenue, Palm Avenue, and Van Buren Avenue, and
WHEREAS, the Traffic Consultant evaluated traffic conditions and street hazards

The City of San Bernardino currently provides animal control and shelter services for
$121,629 per year The current Agreement is set to expire on June 30, 2014 Grand
Terrace City Council approved a new three-year Agreement scheduled to begin on July
1, 2014 for a total cost of $ 12,461 25 per month (not to exceed 149,535 00)
DISCUSSION
The City of Grand Terrace was notified on May 27, 2014 that the City of San Bernardino
is exploring options for its animal control shelter and services and, therefore, will not be
entering into the aforementioned agreement at this time In the meantime, San
Bernardino presented Amendment No 3 to Grand Terrace, which would continue to
provide Animal Control services at the current cost and service level
The current cost for services is $10,135 75 per month (not to exceed $121,629 00
annually) Provisions in Amendment No 3 would continue existing services on a month
to month basis and provides the City with a savings of $2,325 50 per month, over the
three year agreement previously mentioned herein All services and costs will remain
the same and Grand Terrace would continue to provide animal licensing services and
respond to barking dog complaints Grand Terrace requested a 60 day notice of
cancellation which was approved by the City of San Bernardino City Attorney This
language is included in the attached Amendment No 3
Grand Terrace City Attorney, Richard Adams, spoke with the City of San Bernardino
Deputy City Attorney and both parties have agreed to a mutual understanding that
Grand Terrace will move forward with recommendations for approval on June 24, 2014,
while San Bernardino City Council will approve in July, 2014 The City of San
Bernardino requires Grand Terrace to approve and sign the Amendment prior to its
approval The City of San Bernardino's last Council meeting for this fiscal year is
scheduled for June 16, 2014, preventing approval and signature prior to June 30, 2014
This new Agreement promotes Goal No 2, "Maintain Public Safety", of the City's 2030

AMENDMENT NO 3 TO THE ANIMAL CONTROL AND HOUSING AGREEMENT
BETWEEN THE CITY OF SAN BERNARDINO AND THE CITY OF GRAND
TERRACE
THIS AMENDMENT ("Amendment 3") is made and entered into this day of
2014, by and between the CITY OF GRAND TERRACE ("City"), a public entity, and the CITY
OF SAN BERNARDINO ("Service Provider"), a public entity
WHEREAS, the City and the Service Provider entered into an Agreement for animal
control and housing services ("Agreement") on or about April 1, 2010 as evidenced by
Resolution 2010-62, and
WHEREAS, the City and the Service Provider Amended the Animal Control and
Housing Agreement Between the City of San Bernardino and the City of Grand Terrace
("Amendment No 2") on or about March 3, 2014 as evidenced by Resolution 2014-47
WHEREAS, the parties wish to further amend Sections 2, 3, 23 1, 23 2, 23 2 1 and
23 2 2 of the Agreement
NOW THEREFORE, in consideration of the foregoing and for other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto
agree as follows
Section 2 TERM is hereby amended to read as follows
This Agreement shall remain in effect from its effective date (April 5, 2010) and
beginning July 1, 2014 shall continue to remain in effect on a Month to Month basis for a period
not to exceed the extension period, as originally provided in the Agreement

THIS PROFESSIONAL SERVICES AGREEMENT ("Agreement") is made and entered
into this 5th day of April, 2010, ("Effective Date") by and between the CITY OF GRAND
TERRACE ("City"), a public entity, and the CITY OF SAN BERNARDINO, a public entity

1 ;Scope of Services. City agrees to retain and does hereby retain Service Provider and
Service Provider agrees to provide the services more particularly described in Exhibit "1",
"Scope of Services and Fees', attached hereto and incorporated herein by reference, in
conjunction with Animal Control and Housing Services ("Services")
2 'Term. This Agreement shall be effective on the date first written above unless
otherwise provided in Exhibit "1" and the Agreement shall remain in effect until April 1, 2013,
unless otherwise terminated pursuant to the provisions herein This Agreement may be extended
up to two years at the,discretion of the City Manager and the acquiescence of Service Provider
3 Compensation/Payment. Service Provider shall perform the Services under this

7 Standard of Performance While performing the Services, Service Provider shall
exercise the reasonable professional care and skill customarily 'exercised by reputable members
of Service Provider's profession practicing in the Metropolitan Southern California Area, and
shall use reasonable diligence and best judgment, while exercising its professional, skill and
expertise
8 Personnel Service Provider shall furnish all personnel necessary to perform the
Services and shall be responsible for their performance and compensation Service Provider
recognizes that the qualifications', and experience of the personnel to be used are vital to
professional and timely completion of the Services
9 Assignment and Subcontracting. Neither party shall transfer any right, interest, or
obligation in or under this Agreement to any other entity without prior written consent of the
other party In any event, no assignment shall be made unless the assignee expressly assumes the
obligations of assignor under this Agreement, in a writing satisfactory to the parties Service
Provider shall not subcontract any,portion of the work required by this Agreement without prior
written approval by the City's Contract Administrator Subcontracts, if any, shall contain a
provision making them subject to all provisions stipulated in this Agreement, including without
limitation, the insurance obligations set forth in Section 12 Service Provider acknowledges that
any transfer of rights may require City Manager and/or City Council approval
10� Independent Contractor. In the performance of this Agreement, Service Provider,
and Service Provider's employees, subcontractors and agents, shall act in an independent
capacity as independent contractors, and not as officers or ;employees of the City of Grand
Terrace Service Provider acknowledges and agrees that City has no obligation to pay or
withhold state or federal taxes or to provide workers' compensation or unemployment insurance
to Service Provider, or to Service Provider's employees, subcontractors ,and agents Service

Service Provider agrees and promises to indemnify, defend and hold harmless City, its
officers, elected officials, employees and agents, from and against all actions, causes of action,
claims, demands, lawsuits, costs and expenses and liability for damages to persons or property
that may be asserted or claimed by any person, firm, entity, corporation, political subdivision, or
other organizations ansing out of, or in connection with, the performance of this Agreement,
excluding such actions, claims demands, lawsuits and liability for damages to persons or
property ansing from gross or willful misconduct of City, its officers, employees or agents Said

12 3 Automobile Insurance. Prior to City's execution of this Agreement, Service
Provider shall obtain, and shall thereafter maintain during the term of this Agreement,
automobile liability insurance as required to insure Service Provider against damages for
personal injury, including accidental death, as well as from claims for property damage, which
may anse from or which may concern operations by anyone directly or indirectly employed by,
connected with, or acting for or on behalf of Service Provider The City, and its officers,
employees and agents, shall be named as additional insureds under the Service Provider's
insurance policies
12 3 1 Service Provider's automobile liability policy shall cover both bodily injury and
property damage in an amount not less than $500,000 per occurrence and an aggregate limit of
not less than $1,000,000 All of Service Provider's automobile and/or commercial general
liability insurance policies shall cover all vehicles used in connection with Service Provider's
performance of this Agreement, which vehicles shall include, but are not limited to, Service
Provider owned vehicles, Service Provider leased vehicles, Service Provider's employee
vehicles, non -Service Provider owned vehicles and hired vehicles
12 3 2 Prior to City's execution of this Agreement, copies of ,insurance policies or
original certificates and additional insured endorsements evidencing the coverage required by
this Agreement, for automobile liability insurance, shall be filed with the City and shall include
the City and its officers, employees and agents, as additional insureds Said policies shall be in
the usual form of commercial general and automobile liability insurance policies, but shall
include the following provisions
It is agreed that the City of Grand Terrace and its officers, employees and agents,
are added as additional insureds under this policy, solely for work done by and on
behalf of the named insured for the City of Grand Terrace
12 4 Errors and Omissions Insurance. Prior to City's execution of this Agreement,
Service Provider shall obtain, and shall thereafter maintain during the term of this Agreement,
errors and omissions professional liability insurance in the minimum amount of $1,000,000 to
protect the City from claims resulting from the Service Provider's activities
12 5 Subcontractors' Insurance. Service Provider shall require all of its Subcontractors
to carry insurance, in an amount sufficient to cover the risk of injury, damage or loss, that may

be caused by the subcontractors' Scope of work and activities provided in furtherance of this
Agreement, including, but without limitation, the following coverages Workers Compensation
(except for a Sole proprietor), Commercial General Liability, and Automobile liability Upon
City's request, Service Provider shall provide the City with satisfactory evidence that
Subcontractors have obtained insurance policies and coverages required by this section
126 Certificate of Self -Insurance. In lieu of the foregoing policy(ies) of insurance,
Service ,Provider may file a Certificate of Self-insurance with City to satisfy the insurance
requirements under this Agreement
13 Business Tax Service Provider is a municipal government and exempt from the
City's Business Tax
14 Time of Essence Time is of the essence for each and every provision of this
Agreement
15- City's Right to Employ Other Service Providers City reserves the right io
employ other Service Providers in connection with the Services
16 Accounting Records Service Provider shall maintain complete and accurate
records with respect to costs incurred under this Agreement All such records shall be clearly
identifiable Service Provider shall allow a representative of City during normal business hours
and upon reasonable notice to examine, audit, and make transcripts or copies of such records and
any othef,documents created pursuant to this Agreement Service Provider shall allow inspection
of alf work, data, documents, proceedings, and activities related to the Agreement for a ppnod of
three (3) ,years from the date of final payment under this Agreement
17, Confidentiality. All ideas, memoranda, specifications, plans, procedures, drawings,
descnptions,,computer program data, input record data, written information, and other materials
either created by or provided to Service Provider to ,connection with the performance of this
Agreement shall be held confidential by Service Provider, except as otherwise directed.by City's
Contract Administrator, or as provided by law Nothing furnished to Service Provider which is
otherwise known to the Service Provider or is ,generally known, or has become known; to the
related industry shall be deemed confidential Service Provider shall not use City's name or
insignia, photographs of the Services, or any pubhcity pertaining to the Services in any
magazine, trade paper, newspaper, television or radio production, website, or other similar
medium without the prior written consent of the City
18 Ownership of Documents All contracts and invoices prepared under this
Agreement by Service Provider .shall be and remain the property of City upon City"s
compensation to Service Provider for its services as herein provided Service Provider shall not
release to others information furnished by City without prior express written approval of City

19 Conflict of Interest Service Provider warrants that if Service Provider has any real
property, business interests or income interests that will be affected by this project it will notify
City, or, alternatively, that Service Provider will file with the City an affidavit disclosing any
such interest
20 Solicitation. Service Provider, warrants that Service Provider has not employed or
retained any person or City to solicit or Secure this Agreement, nor has it entered into any
agreement or understanding for a commission, percentage, brokerage, or contingent fee to be
paid to secure'this Agreement For breach of this warranty, City -shall have the right to terminate
this Agreement without liability and pay Service -Provider only for the ,value of work Service
Provider has actually performed, or, in its sole discretion, to deduct from the Agreement price or
otherwise recover from Service Provider the full amount of such commission, percentage,

21 General Compliance with Laws Service Provider shall keep fully informed of
federal, ,state and local laws and ordinances and regulations which in any manner affect those
employed by Service Provider, or in any way affect the performance of services by Service
Provider pursuant to this Agreement Service,Provider shall at all times observe and comply with
all such laws, ordinances and regulations, and shall be solely responsible for any failure to
comply with all applicable laws, ordinances and regulations
22 Amendments This Agreement may be modified or amended only by a written
Agreement and/or change order executed by the, Service Provider and City
23_ Termination. City and the Service Provider, by notifying the other party in writing,
shall have the right to terminate any or all of Service Provider's services and work covered by
this Agreement at any time In the event of such termination, Service Provider may submit
Service Provider's final written statement of the amount of -Service Provider's' services as of the
date of such termination based upon the ratio that the work completed bears to the total work
required to make the `report complete, subject to the City's rights under Sections 15 and 24
hereof In ascertaining the work actually rendered Through the termination date, City shall
consider completed work, work in progress and complete and incomplete reports and other
documents only after delivered to City
23 1 Other than as stated below, City and`Service Provider shall provide the other party

25 Venue and Attorneys' Fees. Any, action at law or in equity brought by either of the
parties hereto for the purpose of enforcing a right or rights provided for by this Agreement shall
'be tried in a court of competent jurisdiction in the County of San Bernardino, State of California,
or, if applicable, the United States District Court, Central District of California, and the parties
hereby waive all provisions of law providing for a change of venue in such proceedings to any
other county In the event either party hereto shall bring suit to enforce any term of this
Agreement or to recover any damages for and on account of the breach of any term or condition
of this Agreement, it is mutually agreed that the prevailing party in such action shall recover all
costs thereof, including reasonable attorneys' fees, to be set by the court in such action
26 Nondiscrimination During Service Provider's performance of this, Agreement,
Service Provider shall not discnnunate on the grounds of race, religious creed, color, national
origin, ancestry, age, physical disability, mental disability, medical condition, including the
medical condition of Acquired Immune Deficiency Syndrome (AIDS) or any condition related
thereto, marital status, sex, or sexual orientation, in the selection and retention of employees and
subcontractors and the procurement of materials and equipment, except as provided in Section
12940 of the California Government ,Code Further, Service Provider agrees to conform to the
requirements of the Americans with Disabilities Act in the performance of this Agreement
27 Severability. Each provision, term, condition, covenant and/or restriction, in whole
and in part, of this Agreement shall be considered severable In the event any provision, term,
condition, covenant and/or restriction, in whole and/or in part, of this Agreement is declared
invalid, unconstitutional, or void for any reason, such provision or part thereof shall be severed
from this Agreement and shall not affect any other provision, term, condition, covenant and/or
restriction of this Agreement, and the remainder of the Agreement shall continue in full force and
effect
28 Authority The individuals executing this Agreement and the instruments referenced
herein on behalf of Service Provider each represent and warrant°that they have the legal power,
right and actual authority to bind Service Provider'to the terms and conditions hereof and thereof
29 Entire Agreement This Agreement constitutes the final, complete, and exclusive
statement of the terms of the agreement between the parties pertaining to the subject matter of
this Agreement, and supersedes all prior and contemporaneous understandings or agreements of
the parties Neither party has been induced to enter into this Agreement by, and neither party is
relying on, any representation or warranty outside those expressly, set torth in this Agreement

30 Interpretation City and Service Provider ackno% ledge and agree that this

City Ordinance
The -City of San Bernardino ("San Bernardino") will provide a comprehensive animal care
and control program for the City of Grand Terrace ("Grand Terrace") under the
provisions of the Municipal Code of Grand Terrace which prescribes procedures and
standards for licensing, impounding, regulation and control of dogs, cats and other
domestic and wild animals San Bernardino Animal Control Department and its" 'officers
have the authonty to enforce those codes relating to all matters of animal control
contamed'm the Municipal Code of Grand Terrace, including any,codes contained in any
supplemental documents to Municipal Code rof Grand Terrace related to zoning and
development code that also affect animals Further, Grand Terrace will consult with San
Bernardino on any proposed new ordinance or ordinance change dealing with animal
control matters

Consideration
Grand'Terrace agrees to compensate San Bernardino $8,682 00 per month for services
and work products as defined in this exhibit for the period April 1, 2010 through April 1,

Impound, Care and Disposal'of Dogs and other Domestic and Wild Animals
Subject to any exclusions, San Bernardino will operate an animal care and "control
program for Grand Terrace consisting of the following activities field services, and
shelter services In the conduct of this program, San Bernardino will perform the
following specific functions
(a) Enforce all provisions of Grand Terrace City Ordinances pertaining to animals, to
include issuing warning notices or citations as :necessary Sari Bernardino may
also file citations directly with the Court The City Attorney for Grand Terrace will
process any legal action and appear in court, as necessary, on animal related
cases ,
(b) Impound all animals°caught at large and collect all impound fees assessed
(c) Remove dead animals from the public right-of-way, except state freeways

Bernardino will offer advice in setting a trap in any enclosed space, and will
remove wild animals (not including rodents or insects) caught in a trap or found
inside any human dwelling Animal Control employees shall not be required to

Control or designee there is a direct, clear and present danger to human life
San Bernardino will provide traps for nuisance animals upon request
(e) Investigate reported animal bites and quarantine, as prescribed by law, all biting
animals and animals suspected to be rabid San Bernardino shall take
appropriate steps consistent with the circumstances of each separate incident to
locate and impound the suspect animal or animals and or assist the complainant
,and or injured party, or parties to trap the suspected animal or animals
(f) Provide°euthanasia services as required for animals held for the state -mandated
legal holding period if these animals are not reclaimed by their owners and are
deemed unsuitable or unavailable by San Bernardino for adoption, All
impounded animals will be scanned for microchips Animals with identification,
licenses or microchips will be held up to ten (10) days and attempts will be made
to contact the owner
(g) Respond to every call for service either by animal control officer, letter or phone,
except for excluded items
(h) Cats San Bernardino will not be, required to respond to calls of cats running at
large, confined stray cats or trapped cats Traps for the purpose of capturing
cats shall be remade available to the residents of Grand- Terrace Unless
exceptional circumstances,exist, residents of Grand Terrace shall be responsible,
for obtaining, monitoring and returning all traps used for,this purpose
(i) ' All services available to San Bernardino residents for which there is a fee 'shall
be made available to Grand Terrace residents for the same fee
�) Grand Terrace residents may bring stray, un-owned animals to the San
Bernardino shelter at no charge to the resident
5 Dog Licensing
Grand Terrace residents redeeming their dog(s) will be required to pay a license deposit
prior to the dog's release All licensing deposits generated by Grand'Terrace'residents
will be accounted for in monthly accounting statements provided to Grand Terrace by
San Bernardino andhremitted,by San Bernardino to Grand Terrace on a monthly,basis
6 Animal Care Education and Information Program
San Bernardino will provide public educational/information programs to Grand Terrace
Schools, City employee groups, service groups and other organizations, upon request

RECOMMENDATION 1) Increase the Roquet Paving purchase order by $30,000 to
offset the cost of unanticipated emergency roadway repair
and to allow a balance for the remainder of the contract year,
and
2) Amend the Roquet Paving contract to reflect the change
in the purchase order
BACKGROUND
Because of limited maintenance staffing and equipment to make repairs to City streets
and right-of-way facilities, City staff went out to bid for on -call maintenance services
The City street maintenance contract involves asphalt paving throughout the City, along
with emergency service standby for street repairs that may vary in size for street paving
to sidewalk repair, street stripping and sealing pavement cracks The work can also
include maintenance of other right-of-way facilities, such as repairs to storm drains, curb
gutter and disabled access ramps Minor patching of pot holes and sidewalk repairs,
along with many other minor repairs, are performed by City Staff
Because there are not many cities that have the same staffing limitations, it was difficult
to create bid specifications that would cover all the possibilities for street maintenance
or repair situations, therefore, for bidding purposes, the City Engineer designed a
sample bid schedule with different types of work that could be performed Each bidding
contractor provided a unit price for each category These categories are typical duties

maintenance would vary depending on the specifics of the repair and, because there
are no specifications for line items, cost will vary to some degree depending on possible
unknown conditions
City Council approved a contract with Roquet Paving in the amount of $40,000 annually
for on call street maintenance service The contract was executed on August 27, 2013
DISCUSSION
The work that Roquet Paving has done for the City includes general maintenance

activities, such as pot hole repairs that cannot be filled by cold patching due to size and
depth, and general street maintenance due to deteriorating conditions Due to such
deteriorating road conditions, emergency repairs have had to be performed and such
repairs have been extremely costly Recent repairs include Vivienda Avenue where the
road was undermined, and Mount Vernon Avenue south of Grand Terrace Road This
road failure was caused by a perforated storm drain, which also needed to be repaired
As a result, the annual contract amount of $40,000 has been exceeded, however, it was
necessary in order to respond quickly to emergency roadway repairs and limit the
impact of related road closure on the community at -large
Staff is requesting an increase of $30,000 to the first year contract amount to allow
payment of completed emergency work and to allow a balance to remain until the end of
the first contract year This will allow Staff to respond to any repair needs that may
occur during that time period There are sufficient funds in budget account 16-900-257
to accommodate this increase On September 28, 2014 a new contract year will begin
with a new annual allocation of $40,000 and monies have been budgeted in the next
fiscal year to account for street maintenance
This item relates to Goal #2 "Maintain Public Safety" of the City's Vision 2030 and 2014-
2020 Strategic Plan
FISCAL IMPACT
A fiscal impact of $30,000 will be realized, however, there are sufficient funds in budget
account 16-900-257 to cover the increased contract amount for the current fiscal year

AMENDMENT NO 1 TO THE PROFESSIONAL SERVICES AGREEMENT FOR STREET
MAINTENANCE REPAIRS BETWEEN THE CITY OF GRAND TERRACE AND ROQUET
PAVING, INCORPORATED
THIS AMENDMENT ("Amendment 1") is made and entered into this day of June
_, 2014, by and between the CITY OF GRAND TERRACE ("City"), a Municipal
Corporation, and Roquet Paving, Incorporated ("Professional"), a California Corporation
WHEREAS, the City and the Professional entered into an Agreement for street
maintenance services, in conjuction with Street Maintenance Program ("Services") on or
about August 27, 2014, and
WHEREAS, the parties wish to amend Section 3 (Compensation/Payment) of the
Agreement by Thirty Thousand Dollars ($30,000) occasioned by the need for
unanticipated emergency repair work
NOW THEREFORE, in consideration of the foregoing and for other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the parties
hereto agree as follows
Section 1 Section 3 COMPENSATION/PAYMENT is hereby amended to read as
follows
Professional shall perform the Services under this Agreement for the total sum not to
exceed Seventy Thousand Dollars ($70,000) for the first 12 months (this reflects an
increase of Thirty Thousand Dollars over the original Agreement amount of Forty
Thousand Dollars), and shall not exceed Forty Thousand Dollars ($40,000) for each
subsequent 12-month term Payment shall be made in accordance with City's usual
accounting procedures upon receipt and approval of an itemized invoice setting forth
the services performed The invoices shall be delivered to City at the address set forth
in Section 4, hereof
Section 3 All other terms, provisions and conditions of the Original Agreement, to the
extent not modified by this Amendment, shall remain in full force and effect

condition of Acquired Immune Deficiency Syndrome (AIDS) or any canditioh related thereto,
mantal status, sex, or sexual orientation, in the setdcfon and retention of employees and
subcontractors and the,procurenient of materials and equipment, except, as,prcvided in Section
12940 of the California Government Code, Further, Professional agrees to conform to the
requirements of the Americans with Disabilities Act in the perfomiarice of this Agreement
26 Severability. Each provision, term, condition, covenant,andfor restriction, 4in whole
and in part, of this Agreement shall be considered-seyerable. In the event any provision, tern,
condition, covenant and/or restriction, in whole and/or in part, of this Agrteemertt is, q clared
invalid, unconstitutional, or void for any reason, -such provision or part thereof shall be severed
from this Agreement and shall not affect any other provision, term, condition, covenant and/or
restriction of this Agreement, and the remainder of the Agreement'shaii continue in full force and
effect
27 Authority The individuals executing this Agreement, ,and the instruments
referenced herein on behalf of Professional each represent .and warrant that they have,th6legai
power, right and actual authority to bind professional to the terms and conditions hereof and

28 Entire Agreement: This Agreement constitutes the final, complete, and exclusive

RECOMMENDATION 1) Increase the TEP purchase order by $15,000 for
increased traffic engineering consulting services and to
provide funding for the extended initial Term, and,
2) Extend the initial contract Term to June 30, 2015 to
coincide with fiscal year budgeting cycles
BACKGROUND
On October 8, 2013, the City Council approved on -call traffic engineering services with
Transportation, Engineering, Planning, Inc (TEP) and Albert A Webb Associates
(Webb) Webb, primarily, provides consulting services to the City for development
related projects, and was instrumental in obtaining approvals through Caltrans for the
Stater Brother's project Webb also performed project reviews for Barton Plaza and,
most recently, for McDonald's
By contrast, the consulting services from TEP have focused on regional San Bernardino
Associated Governments (SANBAG) issues, such as representing the City at ongoing
Transportation Technical Advisory Committee meetings, assisting with SANBAG
Interchange projects, assisting with preparation of the Regional Transportation Plan
(RTP) and related growth forecasts, and preparing the Measure I Capital Projects
Needs Assessment and Measure I Capital Improvement Plan
DISCUSSION
The contract with TEP was executed for an initial one-year term, with two one year
extensions The contract amount was $10,000 for the initial term There is
approximately $200 remaining in the account Staff is recommending an increase of
$15,000 to the contract amount, to cover the remainder of this fiscal year and next fiscal
year There are sufficient funds in the account between fiscal years 2013-2014 and
2014-2015 to cover the increase, however, the contract must be amended via Council
action because the amount exceeds $10,000
There have been increased traffic engineering costs related to regional traffic
engineering needs The Consultant (TEP) has spent considerable time in assisting the
City with its response to the RTP and related growth forecasts, has attended meetings,
assisted in planning efforts, and prepared documents and correspondence on the City's

behalf related to the 1-215/Washington Street Interchange, and, consulted on traffic -
related issues with neighboring jurisdictions
On May 27, 2014, the City Council approved a Senior Civil Engineer position in the
Community Development Department It is likely the Senior Engineer will be conversant
in the traffic engineering discipline so the potential exists that these functions can be
brought in house This question cannot be answered, however, until the Senior Civil
Engineer incumbent is in place Although staff is requesting an increase, we anticipate
the new Senior Civil Engineer will handle most of the regional traffic engineering issues,
thereby reducing expenditures in this area Staff expects a transition period between
the Consultant Traffic Engineer and the new Senior Engineer before these functions are
brought in-house, necessitating the need for additional funds
The initial term of the original Agreement expires October 7, 2014, and Amendment 1
would extend the initial term to June 30, 2015, to coincide with the City's fiscal year for
budgeting and accounting purposes The Agreement could be extended for two (2)
one-year extensions, thereafter, and if that were to occur, the annual contract amount
would be $10,000, as originally established
FISCAL IMPACT
A fiscal impact of $15,000 will be realized, however, there are sufficient funds to cover
the increased contract amount in Account Number, 10-175-250 in both Fiscal Year
2013-2014 and Fiscal Year 2014-2015

AMENDMENT NO 1 TO THE PROFESSIONAL SERVICES AGREEMENT FOR TRAFFIC
ENGINEERING SERVICES BETWEEN THE CITY OF GRAND TERRACE AND
TRANSPORTATION ENGINEERING AND PLANNING, INC
THIS AMENDMENT ("Amendment 1") is made and entered into this day of June
_, 2014, by and between the CITY OF GRAND TERRACE ("City"), a Municipal
Corporation, and Transportation Planning and Engineering, Inc ("Professional"), a
California Corporation
WHEREAS, the City and the Professional entered into an Agreement for transportation
engineering services ("Agreement") on or about October 8, 2013, and
WHEREAS, the parties wish to Amend Section 2 (Term) of the Agreement to extend the
initial term of the agreement to June 30, 2015 so that the Agreement terms will coincide
with the fiscal year for budgeting purposes, and
WHEREAS, the parties wish to amend Section 3 (Compensation/Payment) of the
Agreement to cover increased services during the initial term of the Agreement and to
provide funding for the extension of the initial term of the Agreement
NOW THEREFORE, in consideration of the foregoing and for other good and valuable
consideration, the receipt and sufficiency of which are hereby acknowledged, the parties
hereto agree to amend the Agreement as follows
Section 1 Section 2 TERM is hereby amended to read as follows
This Agreement shall be effective and shall commence on the date first written in the
initial contract and continue for an initial period of one year, except that Initial Term shall
be extended to June 30, 2105, unless terminated earlier pursuant to the provisions
herein ("Initial Term") A maximum of two one year extensions, from the June 30, 2015
date, may be granted by the City
Section 2 Section 3 COMPENSATION/PAYMENT is hereby amended to read as
follows
Professional shall perform the Services under this Agreement for the total sum not to E
exceed Twenty Five Thousand Dollars ($25,000) for the Initial Term (which reflects an Q
increase of $15,000 over the original contract amount of $10,000), and Ten Thousand
Dollars ($10,000) for each subsequent term Payment shall be made in accordance E

8 Personnel. Professional shall furnish all personnel, necessary toipe8orm the Services and
shall be responsible for their performance and compensation Professional recognizes that the
qualifications and experience of the personnel to' be used are vital to _professional and timely completion
of the Services The key,personnel listed in Exhibit `B" attached hereto and incorporated herein by this
reference and assigned to perform portions of the Services shall remain assigned through completion of
the Services, unless otherwise mutually agreed by -die parties in writing, or caused by'hardship or
resignation in which case substitutes shall be subject to City approval
9 Assignment and Subcontracting. Neither party shall transfer any right, interest, or obligation
in or under this Agreement to any other entity without prior written consent, of the,other party In any
event, no assignment shall be made illness the assignee expressly assumes the obligations of assignor
under this Agreement, in writing satisfactory to the parties Professional'shall not subcontract any
portion of the work required by this Agreement without prior written approval by the responsible City's
Contract Administrator Subcontracts, if any, shall contain a ,provision making them subject to all
provisions stipulated in this Agreement, including without limitation,"the insurance obligations set.forth in

10 Independent Contractor. In the performance of this Agreement, Professional and his
employees, subcontractors and agents, shaft act in an independent -capacity as independent contractors,
and not as officers or employees of the City or the City of Grand Terrace Professional acknowledges and
agrees that the City has no obligation to pay or withhold ,state or federal taxes or to provide workers'
compensation or unemployment insurance to Professional or to professional's employees, subcontractors
and agents Professional as an independent contractor shall be responsible for any and all taxes that apply
to professional as an employer
11 Pers Eligibility Indemnity In the event that Professional or any ,employee, agent, or
subcontractor of Professional providing services under this Agreement claims or is determined by a court
of competent jurisdiction of the California Public'Employees_ Retirement System ("PERS") to be eligible
for enrollment in PERS as an employee of the City, Professional shall indemnify, defend, and hold
harmless City for the payment of any employee and/or employer contnbutions for PERS benefits on
behalf of Professional or its employees, agents, or subcontractors, as well as for the payment of any
penalties and interest on such contributions, which would otherwise be the responsibility of City
Notwithstanding any other agency, state or federal policy, rule, regulation, law or ,ordinance to the
contrary, Professional and any of its employees, agents, and subcontractors providing service under this
Agreement shall not qualify for or become entitled to, and hereby agree to waive any claims to, any
compensation, benefit, or any incident of employment by City, including but not limited to eligibility to

13.2 Workers' Compensation Insurance By executing this Agreement, certifies that
Professional is aware of and will comply with Section 3700 of the Labor Code of the State of California
requiring every employer to be insured against liability for workers' compensation, or to undertake self-
insurance before commencing any of the work Professional shall carry the insurance or provide for self-
insurance required by California law to protect said Professional from claims under the Workers'
Compensation Act Prior to City's execution of this Agreement, Professional shall file with City either (1)
a certificate of insurance showing that such insurance is in effect, or that professional is self -insured for
such coverage, or (2) a certified statement that Professional has no employees, and acknowledging that if
Professional does employ any person,'the necessary certificate of insurance will immediately be filed with
City Any certificate filed with City shall provide that City will be given ten (10) days prior written
notice before modification or cadcellation thereof
13 3 Commercial General Liability and Automobile insurance. Prior to City's execution of
this Agreement, Professional shall obtain, and shall thereafter maintain during the term of this Agreement,
commercial general liability insurance and automobile liability insurance as required to insure agamst
damages for personal injury, including accidental death, as well as from claims for property damage,
which may arise from or which may concern operations by anyone directly or indirectly employed by,
connected with, or acting for or on behalf of Professional. The City and the City, and its officers,
employees and agents, shall be named as additional insureds under the Professional's insurance policies

13.4 Subcontractors' Insurance. Professional shall require all of its subcontractors to carry
insurance, in an amount sufficient to covet the risk of injury, damage or loss -that may be caused by the
subcontractors' scope of work and activities provided in furtherance of this Agreement, including, but
without limitation, the following coverages Workers Compensation, Commercial General Liability,
Errors and Omissions, and Automobile liability Upon City's request, Professional shall provide City with
satisfactory evidence that Subcontractors have obtained insurance policies and coverages required by this
section
14 Business Tax. Professional understands that the Services performed under this Agreement
constitutes doing business in the City of Grand Terrace, and Professional agrees that Professional will
register for and pay a business tax pursuant to Chapter 5 04 of the Grand Terrace Municipal Code and
keep such tax certificate current during the term of this Agreement
15 Time of Essence Time is of the essence for each and every provision of this Agreement
16 City's Right to Employ Other. City reserves the right to employ other in connection with
the Services
17 Solicitation. Professional warrants that they have not employed or retained any
person or City to solicit or secure this Agreementnor has it entered into any agreement or understanding
for a commission, percentage, brokerage, or contingent fee to be paid to secure this Agreement For
breach of this warranty, City shall have the right to terminate this Agreement without liability and pay
only for the value of work has actually performed, or, in its sole discretion, to deduct from the Agreement
price or otherwise recover from Professional the full amount of such commission, percentage, brokerage
of commission fee The remedies specified in this section shall be in addition to and not in lieu of those
remedies otherwise specified in this Agreement_
19 General Compliance with Laws. Professional shall keep fully informed of federal, state
and local laws and ordinances and regulations which in any manner affect those employed by
Professional, or in any way affect the performance of services by professional pursuant to this Agreement
Professional shall at all times observe and comply with all such laws, ordinances and regulations, and
shall be solely responsible for any failure to comply with all applicable laws, ordinances and regulations
19 Amendments. This Agreement may be modified or amended only by a written Agreement
and/or change order executed by the Professional and the City
20 Termination. City, by notifying professional in writing, shall have the right to terminate any
or all of professional's services and work covered by this Agreement at any time, with or without cause.
In the event of such termination, professional may submit s final wntten statement of the amount of's
services as of the date of such termination based upon the ratio that the work completed bears to the total
work required to make the report complete, subject to the City's rights under Sections 16 and 21 hereof
In ascertaming the work actually rendered through the termination date, City shall consider completed
work, work in progress and complete and incomplete reports and other documents only after delivered to
City

penalties thereon, utility charges, invoiced fee or other debt which professional owes or may owe to the

given to by City in witting In the event of a dispute as to the amount owed or whether such amount is

22 Successors and Assigns. This Agreement shall be binding upon City and its successors and
assigns, and upon Professional and its permitted successors and assigns, and shall not be assigned by,
Professional either in whole or in part, except as otherwise provided in paragraph 9 of this Agreement
23 Governing Law, Venue, Dispute Resolution and Attorneys' Fees. This Agreement shall
be governed by and construed in accordance with laws of the State of California Prior to commencing
suit in a court of competent jurisdiction, any controversy, dispute or claim arising out of the Agreement
shall first be submitted to an alternative dispute resolution process as set forth in Section 24 herein Any
action at law or in equity brought by either of the parties hereto for the purpose of enforcing a right or
rights provided for by this Agreement shall be teed in a court,of competent jurisdiction in the County of
San Bernardino, State of California, and the parties hereby waive all provisions of law providing for a
change of venue in such proceedings to any other county In the event either party hereto shall bring suit
to enforce any term of this Agreement or to recover any damages,for and on account of the breach of any
term or condition of this Agreement, it is mutually agreed that the prevailing party in such action shall
recover all costs thereof, including reasonable attorneys' fees, to be set by the court in such action
24 Alternative Dispute Resolution. In the event of any controversy, dispute or claim arising
out of or relating to this Agreement, the parties hereto shall consult and negotiate with each other and,
recognizing their mutual interest, attempt to reach a solution satisfactory to both parties If they do not
reach settlement within a period of 60 days, the matter shall be submitted to an alternative dispute
resolution process, either nonbinding arbitration or mediation, C'Process') by written notice from either
party to the other The parties shall meet and confer in good faith and select a Process and an arbitrator or
a mediator that is agreeable to both sides The selected Process shall bg completed no later that 120 days
("Process Period') after tender of the aforementioned written notice, unless the Parties mutually agree to
an extension of the Process Period If the matter is not successfully resolved by the selected Process,
within the Process Period, the parties are free to commence litigation in a court of competent jurisdiction
as defined in Section 23 herein Any litigation commenced without both parties' consent prior to the end
of the Process Period, shall be subject to a stay until the end of the Process Period The Parties further
agree to equally bear the cost of the Process

25 Nondiscrimination. During Professional's performance ,of this Agreement, Professional
shall not discriminate on the grounds of race, religious creed, color, national origin, ancestry, age,
physical disability, mental disability, ,medical condition, including the -medical condition of Acquired
Immune Deficiency Syndrome (AIDS) or any condition related thereto, marital status, sex, or sexual
orientation, in the selection and _ retention of employees and subcontractors and the procurement of
materials and equipment, except as provided in Section 12940 of the California Government Code
further, Professional agrees to conform to the requirements of the Americans with Disabilities Act in the
performance of this Agreement.
26 Severability. Each provision, term, condition, covenant and/or restriction, in whole and in
part, of this Agreement shall be considered severable In the event any provision, term, condition,
covenant and/or restriction, in whole and/or in part, of this Agreement is declared invalid,
unconstitutional, or void for any reason, such provision or part thereof shall be severed from this
Agreement and shall not affect any other provision, term, condition, covenant and/or restriction of this
Agreement, and the remainder of the Agreement shall continue in full force and effect.
27. Authority' The individuals executing this Agreement and the instruments referenced herein
on behalf of Professional each represent and warrant that they have the legal power, right and actual
authority to bind professional to the terms and conditions hereof and thereof
28 Entire Agreement This Agreement constitutes the final, complete, -and-exclusive statement
of the terms of the agreement between the parties pertaining to the subject -matter of this Agreement, and
supersedes all prior and contemporaneous understandings or agreements of the `parties Neither party has
been induced to enter into this Agreement by, nor is neither ,party reiymg on, any representation or
warranty outside those expressly set forth in this Agreement.
29 interpretation. City and Professional acknowledge and agree that this Agreement is the
product of mutual arms -length negotiations and accordingly, the rule of construction, which provides that
,the ambiguities in a document shall be construed against the drafter of that document, shall have no
application to the interpretation and enforcement of this Agreement
291 Titles and captions are for convenience of reference only and do not define, describe or
limit the scope or the intent of the Agreement or any of its terms. References to "section numbers are to
sections in the Agreement unless expressly stated otherwise.
292 This Agreement shall be governed by and construed in accordance with -the laws of the
State of California in effect at the time of the execution of this Agreement
29`3 In the event of a conflict between the body of this Agreement and Exhibit "A" ("Scope of
Services") hereto, the terms contained,in Exhibit "A" shall be controlling

BACKGROUND
As requested by Council, on June 10, 2014, Child Care staff provided the City Council
with additional information regarding rate increases for the City of Grand Terrace Child
Care Services After review and deliberation, Council supported a 6% rate increase for
Grand Terrace Child Care for Fiscal Year 2014-2015 Council directed Child Care staff
to submit the new, proposed rates on June 24, 2014 for final approval
DISCUSSION
As directed by Council at its June 10, 2014 meeting, a rate increase of 6% will generate
added revenue of $68,300, with $47,900 of such revenue to be allocated to Child Care
Services Department reserves The attachment provides the increased rates at 6%
applied per age level, as well as per program
The information below shows the effects of a 6% increase in child care rates on the
proposed Child Care budget for FY 2014-15

needing a contribution from the General Fund when unanticipated expenses are

The City Council was presented with the 2014-15 Proposed Budget and proposed
budget requests for the General Fund and Child Care Services Fund

During budget deliberations, the City Council approved all proposed budget requests for
both funds for FY2014-15 The FY2014-15 Budget that is now presented to City Council
for adoption includes the budget requests approved by Council on May 27, 2014
It is important to note for Council and the Community that, unlike the recent past, the
FY2014-15 General Fund Budget is structurally balanced and does not require a

contribution from fund balance for this purpose As such, the use of the fund balance
presented to Council at Mid -Year is preserved for FY2014-15 as follows

2030 Vision and 2014-2020 Strategic Plan
On April 11 and 12, 2014, the City Council participated in a visioning workshop to
establish a mission, vision and core values for the City On May 13, 2014, the City
Council approved the City of Grand Terrace 2030 Vision and 2014-2020 Strategic Plan
The Plan's purpose is to help the City prioritize its efforts and work programs, allocating
both fiscal and human resources to achieve a shared vision and goals The Plan
identified five (5) main goals as follows
- Ensure our fiscal viability, by
+ committing to a balanced budget,
+ identifying additional revenue sources,
+ reviewing expenditures and seek savings,
+ exploring creative means to provide services, and
+ ensuring appropriate cost recovery for services
Maintain public safety by
+ ensuring staff levels for police services are adequate for the
community, and
+ investing in critical improvements to infrastructure
Promote economic development, by
+ developing a proactive economic development plan to attract new
businesses,
+ investing in infrastructure needed to support business attraction
and retention, and
+ preparing for development by updating zoning and development
codes
Develop and implement successful partnerships, by
+ working collaboratively with Community Groups, Private and Public
Sector Agencies, Local, Regional and State Agencies
- Engage in Proactive Communication, by
+ developing and implementing a cost effective Proactive
Communication Program,
+ utilize technology and Web -based tools to disseminate information,
and
+ engage the community by participation

The Proposed Budget addresses these goals in the City's Vision and Strategic Plan to
balance the budget and maintain core services in a positive manner as summarized
below
- Maintain sheriff contract staffing level, preserving public safety,
- Minimally increase staffing to provide adequate levels of service in core
function areas (no lay-offs),
- Provide necessary resources to implement the Economic Development
Strategic Plan, develop successful partnerships and an effective
communications program, and,
- Maintains General Fund reserves
FISCAL IMPACT
The FY2014-15 Budget provides the funding and expenditure plan for all funds As
such, it serves as the City's financial plan for the upcoming fiscal year The City Council
will be kept apprised regarding actual operating results for its major funds through a
monthly financial report and the Mid -Year Budget Review The mid -year budget review
will include an update of the FY2014-15 projected revenues and any recommended
adjustment for that fiscal year budget at that time
Adoption of the Proposed Budget for FY2014-15 will enable the General Fund balance
to be preserved

RESOLUTION NO 2014-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, CALIFORNIA, ADOPTING THE ANNUAL BUDGET
FOR FISCAL YEAR 2014-15
WHEREAS, A Proposed Budget for Fiscal Year 2014-15 was introduced during a
regularly scheduled City Council meeting on May 27, 2014, and
WHEREAS, the City Manager has heretofore submitted to the City Council a
Proposed Budget for the City for Fiscal Year 2014-2015, a copy of which, as may have
been amended by the City Council, is on file in the City Clerk's Department and is
'available for public inspection, and
WHEREAS, the said Proposed Budget contains estimates of the services,
activities and projects comprising the budget, and contains expenditure requirements
and the resources available to the City, and
WHEREAS, the said Proposed Budget contains the estimates of uses of fund
balance as required to stabilize the delivery of City services during periods of
operational deficits, and
WHEREAS, the City Council has made such revisions to the Proposed Budget
as so desired, and
WHEREAS, the Proposed Budget conforms with the City's 2030 Vision and
2014-2020 Strategic Plan, and
WHEREAS, the Proposed Budget, as herein approved, will enable the City
Council to make adequate financial plans and will ensure that City officers can
administer their respective functions in accordance with such plans
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE VALLEY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS

1 The Proposed Budget, as Attachment A to this Resolution and as on file in
the City Clerk's Department and as may have been amended by the City
Council, is hereby approved and adopted as the Annual Budget of the City of
Grand Terrace for Fiscal Year 2014-2015
2 The amounts of proposed expenditures, which include the uses of fund
balance specified in the approved budget, are hereby appropriated for the
various budget programs and units for said fiscal year
BE IT FURTHER RESOLVED that this Resolution shall take effect immediately
upon the date of its adoption

TITLE Freeway Agreement Between the State of California, Acting
through the Department of Transportation, And the City of
Grand Terrace Regarding the 1-215/Barton Road
Interchange Project

RECOMMENDATION Adopt the attached Resolution approving a Freeway
Agreement between the State of California, acting by and
through the Department of Transportation, and the City of
Grand Terrace
BACKGROUND
The State of California has Freeway Agreements with those jurisdictions that have
freeway improvements within their limits The previous Freeway Agreement is from
1954, before incorporation Because of the new 1-215/Barton Road Interchange
improvements, a new Freeway Agreement is necessary
DISCUSSION
The San Bernardino Associated Governments (SANBAG), in cooperation with the
California Department of Transportation and the City of Grand Terrace, proposes to
improve the Interstate 215-Barton Road Interchange (Bridge No 54-0528, PM 1 31)
The project will implement improvements consistent with the circulation element of the
City of Grand Terrace General Plan, to enhance traffic operations and reduce existing
traffic congestion
The project includes the following improvements
• Replacement of the existing Barton Road Over -crossing
• Reconstruction and widening of Barton Road
• Realignment of the existing entrance and exit ramps
• Local street improvements to support the realignment
• Traffic signal modifications
• The addition of a round -about intersection at La Crosse Avenue and Barton Road
to facilitate truck maneuvering
The project completed the Project Approval and Environmental Document phase in
February 2014 Work has commenced on detailed design and Right -of -Way
assessments
The state has a large financial investment in access control to ensure safety and

operational Integrity of the highways The legislative Intent for requiring Freeway
Agreements is to (I) obtain the local agency's support of local road closures and
changes to the local circulation system, (ii) to protect property rights, and, (III) to assure
adequate service to the community Access control is necessary on the freeway or
expressway so current and future traffic safety and operations are not compromised
The Freeway Agreement documents the understanding between Caltrans and the City
relating to the planned traffic circulation features of the proposed facility Exhibit A of
the Agreement includes a geometric depiction of Modified Alternative 7, the preferred
design alternative for this project
Agreements are often executed many years before construction is anticipated and they
form the basis for future planning, not only by the State but by public and private
interests in the community It does not bind the State to construct on a particular
schedule or staging Financial obligation or participation by the State or City is not
included It should be noted that, although the Agreement references a separate
Cooperation Agreement between City and State for purposes of funding, construction
and acquisition, no Cooperation Agreement is being considered That is because the
Interchange Project is a fully funded Measure I Project and responsibility lies with
SANBAG to complete the project The City Attorney has reviewed the Agreement and
recommended certain changes, which have been accepted by Caltrans
Additionally, an agreement is needed for acquisition of Right of Way Section 100 21 of
the Streets & Highways Code prohibits Right -of -Way acquisition prior to execution of
Freeway Agreements The Rights of Access of property owners must be acquired in a
manner provided by law, which requires that other reasonable provisions be provided
for access to local roads
On March 5, 2014, the California Department of Transportation approved the Initial
Study and adopted a Negative Declaration and Finding of No Significant Impact for the
Interstate 215/Barton Road Interchange Project, and identified Modified Alternative 7 as
the Preferred Alternative for the project To execute the Agreement, the State requires
the City to certify the Agreement by resolution, minute order, or other decree adopted by
the governing body The Agreement must be executed by the party authorized to do so
As this item relates to Goal #3 "Promote Economic Development" of the City's Vision
2030 and 2014-2020 Strategic Plan, staff recommends that the City approve and
execute the Freeway Agreement with the State in order to facilitate the Right -of -Way
acquisition and construction of the 1-215 Barton Road Interchange Improvement Project
'Freeway means a highway in respect to which the owners of abutting lands have no right or easement of access to or from their
abutting lands or in respect to which such owners have only limited or restricted right or easement of access If in the judgment of
the commission or the director the public interest would be advanced thereby a freeway as defined herein may be denominated a
'controlled access highway In all other respects said controlled access highway shall be subject to all provisions of this code
pertaining to freeways

separate Cooperation Agreement would, typically, deal with funding and construction
obligations, however, this is a Measure I Project through SANBAG and it is fully funded

RESOLUTION 2014-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE APPROVING A NEW FREEWAY AGREEMENT BETWEEN
THE STATE OF CALIFORNIA, ACTING BY AND THROUGH THE
DEPARTMENT OF TRANSPORTATION AND THE CITY OF GRAND
TERRACE AND MAKING A FINDING THAT THE AGREEMENT AND
THE PROJECT WILL NOT HAVE A SIGNIFICANT IMPACT ON THE
ENVIRONMENT
WHEREAS, Interstate 215 traverses the City of Grand Terrace from the Riverside
County Line to just north of Newport Road,
WHEREAS, the City incorporated in 1978 and included said portion of Interstate 215
covered by a Freeway Agreement dated June 7, 1954 with the County of San
Bernardino,
WHEREAS, a plan map for such freeway has been prepared showing the proposed
plan of the State of California as it affects streets of the City of Grand Terrace,
WHEREAS, an Initial Study with Negative Declaration/Environmental Assessment
with Finding of No Significant Impact was prepared for the Interstate 215/Barton Road
Interchange Project, which was circulated for public review from November 27, 2013
through December 30, 2013,
WHEREAS, On March 5, 2014, the California Department of Transportation
approved the Initial Study with Negative Declaration/Environmental Assessment with
Finding of No Significant Impact and adopted the Negative Declaration and Finding of
No Significant Impact for the Interstate 215/Barton Road Interchange Project, and
identified Modified Alternative 7 as the Preferred Alternative for the project, and
WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway
Agreement in accordance with the revised plan of said freeway,
NOW THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE DOES RESOLVE, DETERMINE, FIND AND ORDER AS
FOLLOWS
Section 1 The City Council finds that all of the above recitals are true and
correct and are incorporated herein by reference

FREEWAY AGREEMENT
THIS AGREEMENT, made and entered into on this day of
20 , by and between the STATE OF CALIFORNIA, acting by and through the
Department of Transportation (herein referred to as "STATE"), and the City of Grand
Terrace (herein referred to as "CITY"),
WITNESSETH
WHEREAS, the highway described above has been declared to be a freeway by
Resolution of the California Transportation Commission on August 20, 1953, and
WHEREAS, STATE and the County of San Bernardino have entered into a Freeway
Agreement dated June 7, 1954, relating to the portion of State Highway Route 215 between
Riverside county line and Colton Avenue, and
WHEREAS, STATE and San Bernardino County Transportation Authority (herein
referred to as "SAN13AG") entered into a Cooperative Agreement dated May 30, 2012 for
the Plans, Specifications and Estimate and Right of Way Phases of the I-215/Barton Road
Interchange Project, and
WHEREAS, CITY has subsequently annexed certain areas including portions of such
freeway covered by said Freeway Agreement dated June 7, 1954 with the County of San
Bernardino, and
WHEREAS, a plan map for such freeway has been prepared showing the proposed plan
of the STATE as it affects streets of the CITY, and
WHEREAS, it is the mutual desire of the parties hereto to enter into a new Freeway
Agreement in accordance with the revised plan of said freeway,
NOW, THEREFORE, IT IS AGREED
1 This Agreement supersedes that portion of said Freeway Agreement dated June 7,
1954, from 0 1 mile north of Barton Road to 0 1 mile south of Newton Road

2 CITY agrees and consents to the closing of CITY streets, relocation of CITY streets,
construction of frontage roads and other local streets, and other construction affecting CITY
streets, all as shown on the plan map attached hereto, marked Exhibit A, and made a part
hereof by this reference
3 The obligations of STATE and CITY or CITY's agent(s) with respect to the funding
and construction of the freeway project will always be dealt with in separate Cooperative
Agreement(s), if any The parties responsible for the construction of the freeway shall make
any changes affecting CITY streets only in accordance with the plan map attached hereto,
marked Exhibit A
4 The obligations of STATE and CITY or CITY's agent(s) with respect to the
acquisition of the rights of way required for the construction, reconstruction, or alteration of
the freeway and CITY streets, frontage roads, and other local roads will always be dealt with

6 CITY will accept control and maintenance over each of the relocated or reconstructed
CITY roads, any frontage roads, and other local roads constructed as part of the project, on N
receipt of written confirmation that the work thereon has been completed, except for any
portion which is adopted by STATE as a part of the freeway proper If acquired by STATE,
CITY will accept title to the portions of such roads lying outside the freeway limits upon =

7 This Agreement may be modified at any time by the mutual consent of the parties

Adopt Parking Restrictions on Westwood Lane

RECOMMENDATION Adopt the attached Resolution approving San Bernardino
County Fire recommendation to designate and post "No
Parking - Fire Lane" on the West side of Westwood Lane
and the entire turn -around area at the end of the cul-de-sac
BACKGROUND
In April, 2014, City staff received calls from residents living on Westwood Lane (a cul-
de-sac), expressing concern that emergency service vehicles may not be able to
respond directly to their homes due to the narrowing access of Westwood Lane when
vehicles are parked on both sides of the street
DISCUSSION
Staff conducted a site inspection and observed vehicles were parking on both sides of
Westwood Lane, narrowing the entrance to the street Staff contacted the San
Bernardino County Fire Department and requested an investigation of emergency
services apparatus accessibility when vehicles are parked on both the east and west
sides of Westwood Lane
Individuals and groups park on Westwood Street and Westwood Lane to gain access to,
and hike up, Blue Mountain Westwood Street was posted with "No Parking" signs
several years ago in response to restricted emergency service access when vehicles
were parked on both sides of the street Westwood Lane has experienced an increase
in on -street parking due to the "No Parking" restriction on the west side of Westwood
Street
Per the City's request, the San Bernardino County Fire Department conducted a site
investigation of Westwood Lane Westwood Lane is a cul-de-sac, requiring a standard
forty-five (45) foot radius when parking is permitted on both sides of the street Upon
inspection by County Fire Department personnel, it was determined Westwood Lane did
not meet the standard requirement
Based on its investigation, street width measurements and access requirements, the
San Bernardino County Fire Official's determination is to restrict parking on the north
side of Westwood Lane, including the entire cul-de-sac area as indicated on the
attached aerial view map The County Fire Official's letter and Fire Safety Standards
are attached for the Council's reference

Staff has reviewed the map and recommended restricted area and would like to note
the restricted parking recommendation is actually located on the west side of Westwood
Lane, including the entire cul-de-sac
Per Grand Terrace Municipal Code 15 18 010 and its adoption of the California Fire
Code, the provisions of the California Fire Code shall be applicable within the City
California Code of Regulations Title 24, Part 9, Chapter 5, section 503 03 of the
California Fire Code states "Where required by the fire code official, approved signs or
other approved notices or markings that include words NO PARKING -FIRE LANE shall
be provided for fire apparatus access roads to identify such roads or prohibit the
obstruction thereof California Fire Code Chapter 5, section 503 4 , "Obstruction of fire
apparatus access roads" states " Fire apparatus access roads shall not be obstructed in
any manner including the parking of vehicles "
In order, therefore, to insure adequate emergency accessibility, Staff recommends
adoption of the attached Resolution, approving the recommendation of San Bernardino
County Fire Department to prohibit parking on the west side of Westwood Lane
including the entire cul-de-sac
The prohibited parking designation incorporates goal number two, "Maintain Public
Safety" of the City's 2030 Vision and Strategic Plan
FISCAL IMPACT
The estimated cost for City staff to purchase and install six (6) "No Parking - Fire Lane"
signs is approximately $1200 All costs will be charged to the General Fund Public
Works account

RESOLUTION NO 2014-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE
AUTHORIZING THE FIRE CODE OFFICIAL TO PROHIBIT PARKING OF VEHICLES
ON THE WEST SIDE AND ENTIRE CUL-DE-SAC AREA OF WESTWOOD LANE
WHEREAS, vehicles are parking on the west side and entire cul-de-sac area of
Westwood Lane obstructing emergency services and fire apparatus accessibility on
Westwood Lane,
WHEREAS, the Fire Code Official for the City of Grand Terrace has investigated
this street and intersection and has provided a report and a recommendation to prohibit
parking at this location to the City Council, and
WHEREAS, pursuant to the Grand Terrace Municipal Code, Section 15 18 010,
the City Council may determine upon the basis of the Fire Code Official's investigation,
that it is necessary to prohibit stopping, standing or parking of vehicles on fire access
roads and portions thereof
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Grand
Terrace, as follows
SECTION 1 The City Council finds and determines that the foregoing recitals are true
and correct
SECTION 2 The City Council finds and determines the attached Fire Code Official's
recommendation to insure fire apparatus accessibility on Westwood Lane is reasonable
and necessary to insure the safety of residents residing on and adjacent the street
SECTION 3 The City Council hereby directs the Fire Code Official to prohibit parking
on the west side and entire cul-de-sac on Westwood Lane by posting or painting "No
Parking — Fire Lane" as shown in Exhibit 1 Fire Code Official's Report attached hereto

With regards to Westwood Lane it has been determined after site visit that it does
not meet the present standard of 45 foot radius when parking is allowed on both
sides of the street, so it was the decision of the Fire Department to reduce the
parking on one side of the access of the cul de sac It has been determined that the
north side of the street and entire cul de sac will be designated as NO PARKING
FIRE LANE This will allow the Fire Department radius to be maintained, and also
have room for additional traffic If we can be of any other assistance please let us

RECOMMENDATION RECOMMENDED ACTION
That the City Council
1 Adopt a Resolution calling and giving notice of a
General Municipal Election on Tuesday, November 4, 2014,
for the election of certain officers and requesting the San
Bernardino County Board of Supervisors to consolidate the
General Municipal Election with the Statewide General
Election to be held pursuant to Elections Code Section
10403 relating to General Law Cities, and
2 Adopt a Resolution establishing regulations for
candidates for elective office pertaining to candidate's
statements submitted to the voters at an election to be held
on Tuesday, November 4, 2014
BACKGROUND
The City of Grand Terrace will conduct a General Municipal Election on Tuesday,
November 4, 2014 to elect two seats at large for the position of Mayor and to fill the
existing vacant City Council seat which expires in November 4, 2014 The procedures
for conducting a General Municipal Election are established by state law and printed in
the California Elections Code The two Resolutions before the City Council for approval
are required to initiate this year's election process and must be adopted and submitted
to the County for consolidation by June 27, 2014 The Resolutions call and give notice
of the election, requests San Bernardino County services, and sets regulations for
candidate statements
DISCUSSION
The City proposes to consolidate its Municipal Election efforts with the San Bernardino
County Registrar of Voters, which conducts the election, tallies the results, and supplies
the City with certified election results The County then bills the City for its pro-rata
share of the costs

The nomination period for the election is July 14, 2014 through August 8, 2014 Should
any of the incumbents choose not to run for re-election, the nomination period for that
particular office will be extended an additional five days to August 13, 2014, when
candidates, other than incumbents, may file The costs for printing the candidates'
statement in the sample ballot are recovered from the candidates A candidate's
statement is optional If a candidate decides to submit a statement, a deposit of
$253 00 is required when the candidate submits his / her nomination papers to the City
Clerk When the City is billed from the County, if the actual printing costs vary from the
deposited amount, the candidate will either be billed for the owed balance or receive a
refund
FISCAL IMPACT
The estimated cost for the City of Grand Terrace November 4, 2014 General Municipal
Election is approximately $10,500 00 Costs for these services have been included in
the Fiscal Year 2014-2015 budget

TERRACE, CALIFORNIA, CALLING AND GIVING NOTICE OF THE
HOLDING OF A GENERAL MUNICIPAL ELECTION ON TUESDAY,
NOVEMBER 4, 2014, FOR THE ELECTION OF CERTAIN OFFICERS
AND REQUESTING THE BOARD OF SUPERVISORS OF THE COUNTY
OF SAN BERNARDINO TO CONSOLIDATE THE GENERAL MUNICIPAL
ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD
PURSUANT TO ELECTIONS CODE SECTION 10403 RELATING TO
GENERAL LAW CITIES
WHEREAS, under the provisions of the laws relating to general law cities on the
State of California, a Regular Municipal Election shall be held on November 4, 2014, for the
election of municipal officers, and
WHEREAS, it is desirable that the General Municipal Election be consolidated with
the Statewide General election to be held on the same date and that within the city, the
precincts, polling places and election officers of the two elections be the same, and the
county election department of the County of San Bernardino canvass the returns of the
General Municipal Election and the election be held on all respects as if there were only one
election, and
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS
SECTION 1 Pursuant to the requirements of the laws of the State of California
relating to General Law cities, there is called and ordered to be held in the City of Grand
Terrace, California, on Tuesday, November 4, 2014, a General Municipal Election for the
purpose of electing two members (one elected Mayor and one Council Member at large) of
the Grand Terrace City Council for the full term of four years
SECTION 2 The ballots to be used at the election shall be in the form and content as
required by the law
SECTION 3 The City Clerk is authorized, instructed and directed to procure and
furnish any and all official ballots, notices, printed matter and all supplies, equipment and
paraphernalia, which may be necessary in order to properly and lawfully conduct the
election
SECTION 4 The polls for the election shall be open at seven o'clock a m the day of
the election and shall remain open continuously from that time until eight o'clock p m of the
same day when the polls shall be closed, except as provided in Section 14401 of the
elections code

SECTION 5 In all particulars not recited in this Resolution, the election shall be held
and conducted as provided by law for holding municipal elections
SECTION 6 That pursuant to the requirements of Section 10403 of the Elections
Code, the Board of Supervisors of the County of San Bernardino is hereby requested to
consent and agree to the consolidation of a General Municipal Election with the Statewide
General election on Tuesday, November 4, 2014, for the purpose of the election of two
members (one elected Mayor and one Council Member at large) of the City Council each for
full terms of four years
SECTION 7 The County Registrar of Voters is authorized to canvass the returns of
the Regular Municipal Election The election shall be held in all steps necessary for the
holding of the consolidated election and shall comply with Section 10418 of the Elections
Code
SECTION 8 The Board of Supervisors is requested to issue instructions to the
County Registrar of Voters to take any and all steps necessary for the holding of the
consolidated election
SECTION 9 The City of Grand Terrace recognizes that additional costs will be
incurred by the County by reason of this consolidation and agrees to reimburse the County
for any costs
SECTION 10 Notice of the time and place of holding the election is given and the
City Clerk is authorized, instructed and directed to give further or additional notice of the
election, in time, form and manner as required by law Notwithstanding the generality of the
foregoing, the City Clerk is hereby instructed to act in conformance with California Elections
Code Section 10403 and to file this Resolution with the Board of Supervisors of San
Bernardino County and to transmit a copy of the same to the San Bernardino County
elections official
SECTION 11 The City Clerk shall certify the adoption of this Resolution and enter it
into the Book of Resolutions

REGULATIONS FOR CANDIDATES FOR ELECTIVE OFFICE
PERTAINING TO CANDIDATES STATEMENTS SUBMITTED
TO THE VOTERS AT AN ELECTION TO BE HELD ON
TUESDAY, NOVEMBER 4, 2014
WHEREAS, Section 13307 of the Elections Code of the State of California
provides that the governing body of any local agency adopt regulations pertaining to
materials prepared by any candidate for a municipal election, including costs of the
candidate's statement
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND
ORDER AS FOLLOWS
SECTION 1 General Provisions That pursuant to Section 13307 of the
Elections Code of the State of California, each candidate for elective office to be
voted for at an Election to be held in the City of Grand Terrace on November 4, 2014,
may prepare a candidate's statement on an appropriate form provided by the City
Clerk The statement may include the name, age and occupation of the candidate
and a brief description of no more than 200 words of the candidate's education and
qualifications expressed by the candidate himself or herself The statement shall not
include party affiliation of the candidate, nor membership or activity in partisan
political organizations The statement shall be filed (in typewritten form) in the office
of the City Clerk at the time the candidate's nomination papers are filed The
statement may be withdrawn but not changed, during the period for filing nomination
papers and until 5 00 p m of the next working day after the close of nomination
period
SECTION 2 Foreign Language Policy
a Pursuant to the Federal Voting Rights Act, candidate's statements will c

share as a condition of having his or her statement included in their
voter's pamphlet In the event the estimated payment is required, the
estimate is just an approximation of the actual cost that varies from one
election to another election and may be significantly more or less than
the estimate, depending on the actual number of candidates filing
statements Accordingly, the clerk is not bound by the estimate and
may, on the pro rata basis, bill the candidate for additional actual
expense or refund any excess paid depending on the final actual cost
In the event of underpayment, the clerk may require the candidate to
pay the balance of the cost incurred In the event of overpayment, the
clerk shall prorate the excess amount among the candidates and
refund the excess amount paid within 30 days of the election
SECTION 4 Additional Materials No Candidate will be permitted to include additional
materials in the sample ballot package
SECTION 5 The City Clerk shall provide each candidate or the candidate's
representative a copy of this Resolution at the time nominating petitions are issued
SECTION 6 All previous Resolutions establishing Council policy on payment for
candidate's statements are repealed
SECTION 7 This Resolution shall apply only to the election to be held on Tuesday,
November 4, 2014, and shall then be repealed
SECTION 8 Certification The City Clerk Shall certify to the passage and adoption of
this Resolution and enter it into the Book of Resolutions

Fiscal Year 2014-15 Appropriations Limit Calculation, and,
(3) Adopt Resolution Establishing Appropriations Limit of
$11,399,967 for the City of Grand Terrace for Fiscal Year
2014-15
BACKGROUND
On November 6, 1979, California voters approved the Gann Spending Limitation
Initiative (Proposition 4) establishing Anccle XIIIB of the State Constitution Article XIIIB
sets limits on the amount of tax revenues that the State and most local governments
can appropriate within a given fiscal year Its basic provisions are as follows
• Each year, the State and local governments must adopt a resolution establishing
an Appropriations Limit, also known as the "Gann Limit" Fiscal Year 1984-85
appropriations serve as the base for this limit, with adjustments being made
annually to reflect increases in population, the cost of living, and financial
responsibility transfers
• Only tax proceeds are subject to the limit Charges for services, regulatory fees,
grants, loans, donations and other non -tax proceeds are not subject to the limit
Exemptions are also made for voter -approved debt, debt that existed prior to
January 1, 1979, and for the cost of compliance with court or Federal
government mandates
• All tax revenues received in excess of the Appropriations Limit must be refunded
to taxpayers within a two-year period
• The voters may approve an increase in the Appropriations Limit For the
increase to remain in effect, however, it must be re -approved by voters at four-
year intervals

On June 5, 1990, California voters approved the Traffic Congestion Relief and Spending
Limitation Act (Proposition 111), which made various amendments to Article XIIIB of the
State Constitution The major changes, which became effective July 1, 1990, are as
follows
• The change in the cost of living is defined to be either the change in California
per capita personal income or the change in assessed valuation due to the
addition of non-residential new construction Previously, the change in the cost
of living was defined as the lesser of the change in the U S Consumer Price
Index or the change in California per capita personal income
• The change in population is defined as either a change in the City's population or
a change in the County's population, whichever is greater
• "Qualified capital outlay projects" were added to the items exempted from the
Appropriations Limit Qualified capital outlay projects must have a useful life of
ten or more years and a cost that equals or exceeds $100,000
• Tax revenues received in excess of the Appropriations Limit must be refunded to
taxpayers only if the limit is exceeded over a two-year period
The annual calculation of the Appropriations Limit must be reviewed as part of the City's
annual financial audit

As indicated above, Proposition 111 made several changes to the method used to
calculate the Appropriations Limit The change in the cost of living (or "price factor") is
defined to be either the change in California per capita personal income or the change
in assessed valuation due to the addition of non-residential new construction Following
are the two options for the City's FY 2013-14 Appropriations Limit calculation
1) Change in California per capita personal income (provided by California
Department of Finance) -0 23% (decrease)
2) Change in Grand Terrace assessed valuation from 2013 to 2014 due to the
addition of non-residential new construction This information is not yet available
from the County Assessor's office When the data is available, if it is greater than
the change in California per capita personal income, the Appropriations Limit will
be revised and resubmitted to the City Council for approval
Based on the above information, the change in California per capita personal income
has been used as the price factor for the FY 2014-15 Appropriations Limit calculation
The "population factor' to be used in calculating the Appropriations Limit is defined by
Proposition 111 as either a change in the City's population or a change in the County's
population, whichever is greater Per information provided by the California Department
of Finance, following are the population changes from 2013 to 2014

recommended price and population factors Exhibit B identifies the revenues that are
classified as tax proceeds and those that are classified as non -tax proceeds for

Appropriations Limit calculation
The City's Appropriations Limit for FY 2013-14 was $11,337,610 The recommended
change factor, as allowed by Proposition 111 due to cost of living and population
changes, is 1 0055 This results in a FY 2014-15 Appropriations Limit of $11,399,967
The FY 2014-15 Proposed Budget contains appropriations subject to the Appropriations
Limit of $2,864,631, which is $8,535,336 below the City's legal limit
The Appropriations (Gann) Limit for FY2013-14 incorporates Goal #1, "Ensure Our
Fiscal Viability" of the City's 2030 Vision and Strategic Plan
FISCAL IMPACT
There is no fiscal impact associated with adoption of the FY 2014-15 Appropriations
Limit, as the City is safely within its legal appropriations limit for FY 2014-15

RESOLUTION NO 2014-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, ESTABLISHING THE
APPROPRIATIONS LIMIT FOR FISCAL YEAR 2014-15
WHEREAS, Article XIIIB of the California Constitution and Section 7910 of the
California Government Code require that each year the City of Grand Terrace shall by
resolution, establish an Appropriations Limit for the fiscal year, and
WHEREAS, the City Council has prepared a Proposed Budget for Fiscal Year
2014-15, a copy of which is on file in the Office of the City Clerk and available for public
inspection, and
WHEREAS, the said Proposed Budget contains the estimates of the services,
activities and projects comprising the budget, and contains expenditure requirements
and the resources available to the City, and
WHEREAS, the City's Finance Department has prepared calculations and
documentation required for and to be used in the determination of certain matters and
for the establishment of an Appropriations Limit for the City for Fiscal Year 2014-15 and
such data and documentation has been available to the public for at least fifteen (15)
days prior to the adoption of this Resolution, and
WHEREAS, the City Council has considered pertinent data such as price and
population factors and made such determinations as may be required by law, and has
adopted this Resolution as a regularly scheduled meeting of the City Council and
WHEREAS, the Appropriations Limit for the City of Grand Terrace for Fiscal Year
2014-15 is hereby established at $11,399,967 and the total annual appropriations
subject to such limitation for Fiscal Year 2014-15 are determined to be $2,864,631
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS
1 That $11,399,967 is hereby established as the Appropriations Limit for the City of
Grand Terrace for Fiscal Year 2014-15
2 The City Council hereby adopts the findings and methods of calculation set forth 0
in Exhibit A (Appropriations Limit Calculation) and Exhibit B (Proceeds of Tax
Calculation)

3 The City of Grand Terrace reserves the right to revise the factors associated with a
the calculation of the limit established pursuant to Article XIIIB of the California a
Constitution if such changes or revisions would result in a more advantageous
Appropriations Limit in the future

Population Certification
The population certification program applies only to cities and counties. Revenue and Taxation
Code section 11006 6 mandates Finance to automatically certify any population esbmd4that

the higher estimate to the'State Controller by June 1, 2014
