installation of landscaping, lighting and appurtenant facilities is a condition of approval for development and is a requirement of issuance of a permit for the construction of any residential, commercial, industrial and planned unit development Landscaping and appurtenant facilities generally include trees, shrubs, plants, turf, irrigation systems, and necessary appurtenances including curbs, hardscape, monumentations, fencing located in public right-of-ways, medians, parkways, and/or easements adjacent to public nght-of- ways, in and along public thoroughfares and certain designated primary and secondary artenals Lighting and appurtenant facilities includes poles, lighting fixtures, conduits and the necessary equipment to maintain, operate and replace a lighting system at designated intersections, in medians, parkways and adjacent to certain public facilities in and along certain streets, right-of- ways and designated lots The installation of landscaping and lighting systems and the construction of the necessary appurtenant facilities is the responsibility of the property owner/applicant, as conditions of approval of a development application The City may signs enhance, rather than detract from, a community, that approved signage safeguards and protects public and private investment in structures and open spaces, that improves the appearance of a community as a place in which to live and work and serves as an attraction to non- residents who come to visit or trade Finally, a sign ordinance is developed and enacted for the purpose of avoiding excessive and confusing sign displays (also known as sign pollution) A City's appearance is a major component of its economic viability Aesthetically pleasing roadways and business districts are critical to attracting new investment and to maintaining and enhancing the local economy To ensure the City's success in this area, some level of sign control is necessary for economic, as well as aesthetic, reasons In accomplishing this objective, the proper balance must be struck between a City's desire to promote aesthetically pleasing, Vision -compliant signage and a business' desire to effectively promote itself by retaining existing patrons and attracting new customers Many cities encounter difficulty in finding this balance, so this staff report is the first of a number of steps required to ensure Grand Terrace can emulate the success of other communities that have developed effective solutions to a problem that negatively impacts City/business community relationships if left unattended DISCUSSION A sign is, typically, defined as any card, cloth, paper, metal or painted characters visible from outside a structure for advertising purposes, mounted to the ground or any tree, Packet Pg 127 0 M Portable signs Portable signs consist of A -frame signs, menu signs or other convenience -type signs which can be carried and are movable from place to place on an everyday basis These signs can be used on a temporary basis to complement existing signs or advertise special events The Community Development Department may issue permits for portable signs not to exceed 45 days out of a 90 day period, to a maximum of 120 days per year Each business may apply for a maximum of one portable sign at a time, with the exception of gas stations, which are allowed four such signs at a time Portable signs shall not be located on the public right-of-way and shall be located not to obstruct vehicular access, ingress and egress from property The size and colors of such signs are to be proportional and compatible with the building Table 18 80 for C2 zone Additional regulations for temporary signs 1 Temporary signs are limited to temporary messages such as sales or special events No business identification is permitted except when new businesses are awaiting construction of permanent new or replacement signs, by temporarily announcing arrival of new businesses 2 A sign permit is required for a temporary sign which may be displayed for no more than 45 days within any 90 day period, not to exceed a total of 120 days out of the calendar year A review of nearby cities, including Loma Linda, Colton, Riverside, and San Bernardino revealed that those cities also require permits for temporary signs Riverside only permits them with a special event All the cities limit the display period, require permits and, in most cases, allow only one temporary sign Window Signs (Permanent) The Sign Code allows permanent window signage that does not exceed 25% of the window area The regulations of this chapter shall apply in the event any of the following actions occur A The construction or placement of any new sign and/or sign structure, B Any change to an existing sign, including any change to its sign structure, copy, size, height, illumination or location, C Reestablishment or reuse of a sign after its associated business or use has been discontinued for more than sixty days, The regulations of this chapter shall also apply to all illegal nonconforming signs (signs constructed prior to the adoption of this chapter without an approved sign permit) All illegal nonconforming signs shall be made to immediately comply with this chapter (Ord 126 § 2, Exh Apart) 1990) 18.80.030 Definitions The following definitions are as listed in Chapter 18 06 of this title and are included in this chapter for convenience purposes "Advertising area" means the total square foot area of all signs facing (except double signs, which shall be computed as one face), and includes only that portion of the supporting structure or trim which carries any wording, symbols or pictures "Advertising structure" means an on -site or off -site structure of any kind or character other than the main business identification signs, erected or maintained for outdoor advertising purposes, upon which any poster, bill, printing, painting or other advertisement of any kind whatsoever may be placed, including statuary for advertising purposes "Animated sign" means a sign which uses movement or changing lighting to depict action or to create a special effect or scene "Area of sign" includes the entire area within any type of perimeter or border which may enclose the outer limits of any writing, representation, emblem, figure or character, together with any other material or color forming an integral part of the display or used to differentiate such sign from the background in which it is placed The "area" of a sign having no such perimeter shall be computed by enclosing the entire area within parallelograms, triangles or circles in a size sufficient to cover the entire area and computing the size of such area In the case of a two-sided sign the "area" shall be computed as including only the maximum single display surface which is visible from any ground position at one time The supports or uprights on which any sign is supported should not be included in determining the sign area unless such supports or uprights are designed in such a manner as to form an integral background of the sign In the case of any cylindrical sign, the total area shall be computed on the total area of the surface of the sign "Banner, flag, pennant or balloon sign" means any cloth, bunting, plastic, vinyl, latex, paper or similar material used for advertising purposes securely attached to or pinned on or from any structure, staff, pole, line or framing T t!! r N C P i 0 W Co d c. s vi d 0 v 0 w C 0 E w a "Business directory sign" means a sign located in a multitenant complex which lists each Packet, Pg 133 "Outdoor uses/displays" means display or selling of merchandise or operation of services outside in front of associated business on site in accordance with this title's requirements "Political sign" means a sign erected prior to an election to advertise or identify a candidate, campaign issue, election proposition or other related matters "Portable sign" means a sign not designed to be permanently attached to a structure or to the ground "Public right-of-way" means "any street, alley or similar parcel of land eventually unobstructed from the ground to the sky which is deeded, dedicated or otherwise permanently appropriated to the public for public use and having a clear width of not less than 10 feet" (UBC Chapter 33, Section 0 3301,b) Projection, occupation and construction on public right-of-way is regulated by the UBC, more C, specifically Chapters 44 and 45 These chapters restrict activities in the right-of-way to protect y pedestrians, protect existing utilities from construction activity, and protect the city from unnecessary d liability "Real estate sign" means a temporary sign advertising the sale, lease or rent of the property a upon which it is located, and the identification of the firm handling such sale, lease or rent c� w 0 "Revolving sign" means a sign which all or a portion of may rotate either on an intermittent or constant basis 0 "Roof sign" means a sign erected, constructed or placed upon or over a roof or parapet of a c 0 budding and which is wholly or partly supported by such budding NJ "Sign" means the same as "advertising structure", any card, cloth, paper, metal or painted o Icharacters visible from outside of a structure for advertising purposes, mounted to the ground or any V tree, wall, bush, rock, fence or structures, whether privately or publicly owned "Sign" means any LO graphic announcement, declaration, demonstration, display, illustration or insignia used to advertise c or promote the interest of any person when the same is placed out-of-doors in view of the general L public This definition shall not include the display of the American flag or the flag of the state o 00 "Special event sign" means a temporary sign which advertises special events and activities such as grand openings, charitable events, Christmas trees Such signs are limited to the provisions c. listed in this title "Temporary sign" means a sign erected for a temporary purpose attracting attention to an d i o activity as provided for within this ordinance "Vehicle sign" means a sign which is attached to a vehicle or trader and placed on any property, on- or off -site, so as to attract attention to a product, activity or business which is in addition E to the main business identification sign "Wall sign" means a sign attached to or erected against the wall of a building or structure with Q the exposed face of the sign parallel to the plane of the wall "Window sign" means a sign painted, attached, glued or otherwise affixed to a window, or otherwise easily visible from the exterior of a building l) (Ord 149 § 1(part), 1994, Ord 148 § 1(part), 1994 Ord 126 § 2 Exh A(part), 1990) 18.80.040 Submittal process. Packet Pg 135 9.a ' A An appeal of a planning director decision shall be made in the following manner 1 Filing with the planning department a completed application for appeal, 2 Payment of the appropriate appeal fee B After accepting an application for appeal, the planning department shall set a date for the planning commission to hear the appeal Notices of the appeal shall be given to the applicant and the appellant C The planning director shall submit a report to the planning commission containing the reasons for the Director's decision D The planning commission shall hear the appeal and make its own determination .- regarding the application and its consistency with this title and the general plan Upon d c such determination, the planning commission shall uphold, modify or reverse the planning commission's decision N The planning commission's determination may be appealed to the city council per the procedure established in Section 18 83 060 of this title L d F- (Ord 126 § 2 Exh A(part), 1990) V ea 18 80.070 Budding permit process. ,Ln V c % r After the planning department has approved an application, the application, including two sets 5 of the site plan, elevations, landscape plan (if required), and construction specification plans each c approved and signed by the planning department and any conditions of approval required by the o planning department shall be submitted to the department of budding and safety The third set shall 0 be kept on file in the planning department The department of building and safety shall then prepare H the appropriate permits in accordance with all applicable state and local codes j `- (Ord 126 § 2, Exh A(part), 1990) LO v 18 80 080 Enforcement. H It shall be the responsibility of the city's code enforcement officer to enforce all the provisions co of this chapter Additionally, illegal signs within the public right-of-way may be summarily abated by 00 the city and held, pending notification of the owner by the city The owner may obtain the sign from L a the city upon payment to the city of any storage and removal charge that may have been incurred by s the city (Ord 126 § 2, Exh A(part) 1990) V _0 _ 18.80.090 Architectural compatibility Each sign shall be designed with the intent and purpose to be compatible with the architectural d s style and should include at least one design feature of the main building or buildings upon the site it is located and within the general area Q (Ord 126 § 2, Exh A(part), 1990) 18 80100 Construction and maintenance A Construction Every sign and all parts, portions and materials shall be manufactured, assembled and erected in compliance with all applicable state, federal and city regulations and the Uniform Budding Code B Packet' Pg 137 J I121 L 3 Freeway sign, One square foot of landscaped area for each square foot of sign area (one side only) Signs which have historical significance to the community, but do not conform to the provisions of this chapter, may be allowed to remain, provided that the planning commission makes the following findings 1 The sign has historical significance for the community 2 The sign does not create nor cause a traffic hazard 3 The sign does not create a visual nuisance to the character of the community 4 The sign is properly maintained and structurally sound .-. d 5 The sign does not adversely affect adjacent properties 0 The site and architectural review board may approve a sign which does not strictly adhere to the provisions of this chapter in "Painted vehicle sign" means A sign on a properly registered and operable vehicle, in accordance with L d California Vehicle Code, with professionally painted letters or signs on the body of the vehicle, including sides, front or rear The vehicle shall be regularly and customarily used for transport of persons or goods for the business The intent of the sign ordinance is to allow a vehicle with messages, but not a vehicle used as a structure for a 0 sign or advertising, parking in the parking lot or street 0 The sign shall be an integral part of the vehicle and shall not be required to be o removed from the vehicle or parts of the vehicle for the vehicle to operate Vehicles N advertising shall only be allowed if subject vehicles are operable and are used primarily N as vehicles in the furtherance of the business being advertised (Please refer to Design o Guidelines for Painted Vehicle Signs for specific information on materials, techniques �r recommended) v Painted vehicle signs can be parked on the parking lot or street When in the H LM parking lot, they shall occupy no more than one parking stall When on the street, they N shall be parked adjacent to the curb, directly in front of the respective property 00 co Painted vehicle signs parked on the parking lot are exempt from permit, provided; they meet these regulations and related design policies Otherwise, they will be considered a sign structure and will be prohibited Ui Painted vehicle signs parked on the street require a permit and have specific as a regulations to function as banners or temporary signs in terms of time and fees These restrictions do not apply to painted vehicle signs parked on other transportation corridors outside of the Barton Road specific plan area (Please refer to Design Guidelines for Specifics on Number and Time for these signs) E t R Exemptions a Full-time delivery vans or trucks parked or stored away from public view are exempt from this section Full-time delivery vans or trucks temporarily parked on publicly visible areas of parking lot or loading areas for no longer than one and one-half hours per day and/or overnight are also exempt Customer vehicles not related to center businesses and parked only Packet Pg 139 9a One temporary to sixty-four square feet total for o A on -site subdivision sign, not exceed sides, or thirty-two square feet for one side, and a total overall height of fifteen feet, may be permitted on each main street frontage of the property being subdivided, not to exceed two signs for all phases of any subdivision (interior streets of the subdivision are not recognized as main street frontage) B Such sign shall be for the identification of a subdivision, price information and the developer's name, address and telephone number C Temporary banners, flags and pennants may be used for advertising the sale or lease of the tract, subdivisions or development and models therein However, no banner, flag or pennant used for advertising or identifying purposes shall be displayed, erected, .Q hung, attached or affixed to any pole, staff, structure or other appurtenance without a prior approval of the city community development director C 1 Such temporary banners, flags and pennants may not be moved, altered, d changed or otherwise differ from the approval given by the city community L development director without the additional approval by the director of the move, 0' alteration, change or approval difference c 2 The temporary banners, flags and pennants shall remain only as long as the property, tract, subdivision or development remains unsold or unleased for the CD - first time, but not to exceed one year The city community development director 217 shall have the authority to extend the one-year period, not to exceed a total of eighteen months total or an extension period of up to six months 0 c C All signs other than those referred to in subsection C of this section shall be removed 2 within ten days from the date of the final sale or lease of the land and/or residences, or 05 within twelve months, whichever comes first Extensions of the twelve months' time can o be approved by the city community development director in case of hardship E Signs shall be maintained in good repair at all times F A cash deposit of five hundred dollars per sign shall be deposited with the sign N application to ensure compliance with this chapter and removal of such sign The a, deposit shall be refunded to the applicant upon sign removal by the applicant If subdivision signs. 0 Off -site subdivision signs shall be permitted in any district as follows A Panel and sign structure design shall be approved by the community development director, pursuant to city council resolution setting forth design criteria 0 B A sign structure shall be located not less than six hundred feet from an existing or previously approved sign site Further, each sign may only contain the name of the a subdivision and a directional arrow C The placement of each sign structure shall be reviewed and approved by the community development director D All signs are to be placed on private property or city right-of-way with written consent of the property owner or a city encroachment permit obtained and filed with the department of building and safety prior to issuance of a permit E Any such sign approved for a particular subdivision within the city shall not be changed to advertise another subdivision without approval of the community development Packet Pg 141 s ten 4 B Display time for business banners for purposes other than grand openings or for commercial uses shall be permitted for a period not to exceed thirty consecutive days and not more than four times in one calendar year There shall be a minimum period of thirty days N between banner displays As an alternative, specific non-consecutive dates can be identified in writing to allow a business banner to be displayed no more than one hundred and twenty days per calendar year Z.
