This staff report supports all adopted Goals of the City Council's 2030 Vision and
supports all adopted Core Values
BACKGROUND
The City of Grand Terrace consolidated with the San Bernardino County Registrar of
Voters its November 4, 2014 Statewide General Municipal Election for the positions of
Mayor and one Council Member In accordance with the Elections Code, the San
Bernardino County Registrar of Voters completed the official canvass and issued the
certified results on November 24, 2014
DISCUSSION
The Elections Code requires the City Council to adopt a resolution reciting the fact of
the election and declare the results not later than the next, regular, scheduled City
Council meeting following the presentation of the canvass of the returns, or at a Special
Meeting called for this purpose
Adoption of the attached Resolution will satisfy the requirements to declare the results
and authorize the presentation of the Oath of Office to the elected Mayor and Council
Member

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, RECITING THE FACT OF
THE GENERAL MUNICIPAL ELECTION HELD ON
NOVEMBER 4, 2014, DECLARING THE RESULT AND SUCH
OTHER MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of Grand
terrace, California, on Tuesday, November 4, 2014, as required by law, and
WHEREAS, notice of the election was given in time, form and manner as provided by
law, that voting precincts were properly established, that the election officers were appointed and
that in all respects the election was held and conducted and the votes were cast, received and
canvassed and the returns made and declared in time, form and manner as required by the
provisions of the Elections Code of the State of California for the holding of elections in general
law cities, and

WHEREAS, the County Registrar of Voters canvassed the returns of the election and has
certified the results to this City Council, the results are received, attached and made a part hereof
as "Exhibit A "
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS
SECTION 1 Per Election Code 10264, the City Clerk shall enter on the records of the
City Council of the City, a statement of the result of the election showing (1) The whole number
of ballots cast in the City, (2) The names of the persons voted for, (3) The measure voted for, (4)
For what office each person was voted for, (5) The number of votes given at each precinct to
each person, and for and against the measure, (6) The total number of votes given to each person,
and for and against each measure
(a) That the whole number of ballots cast in the precincts except vote by mail voter
ballots was 1,206 That the whole number of voter by mail voter ballots cast in the City was
1,602, making a total of 2,808 ballots cast in the city
(b) The names of persons voted for at the election for Mayor of the City Council are as

BACKGROUND
Council Member Darcy McNaboe was elected Mayor in the November 4, 2014 Election,
thus creating a vacancy on the City Council, effective December 9, 2014 The term for
this Council seat expires in November 2016 Grand Terrace has had eight prior Council
seats vacated Six Council seats were filled by appointment, one by special election,
and one was left vacant as summarized below

DISCUSSION
California Government Code Section 36512(b) requires a general law city to fill a City
Council vacancy within 60 days of the seat becoming vacant The Code currently reads
as follows
36512 (b) If a vacancy occurs in an elective office provided for in this
chapter, the council shall, within 60 days from the commencement of the
vacancy, either fill the vacancy by appointment or call a special election to
fill the vacancy The special election shall be held on the next regularly
established election date not less than 114 days from the call of the
special election A person appointed or elected to fill a vacancy holds
office for the unexpired term,of the former incumbent
To comply with Section 36512 (b), the Council needs to decide, and take appropriate
actions depending on the decision, to appoint or call for a special election to fill the
vacancy by February 6, 2015 Additional timeline information is included later in this
staff report
In addition to the Government Code, Section 4004 of the Elections Code provides for a
mailed ballot election The Code reads as follows
4004 (a) "Small city" means a city with a population of 100, 000 or less, as
determined by the annual city total population rankings by the
Demographic Research Unit of the Department of Finance
(b) "Eligible entity" means a school district or a special district
(c) Notwithstanding Sections 1500 and 4000, an election in a small city or
an eligible entity may be conducted wholly as an all -mail ballot election,
subject to the following conditions
(1) The legislative body of the small city or the governing body of the
eligible entity, by resolution, authorizes the use of mailed ballots for the
election
(2) The election is a special election to fill a vacancy in the legislative body
or governing body
(3) The election ►s not held on the same date as a statewide primary or
general election
(4) The election is not consolidated with any other election
(5) The return of voted mail ballots is subject to Section 3017
Section 1500, referred to in Section 4004 of the Elections Code shown above, specifies
the dates on which a mail ballot election may be conducted The Code reads as
follows

1500 The established mailed ballot election dates are as follows
(a) The first Tuesday after the first Monday ►n May of each year
(b) The first Tuesday after the first Monday in March of each even -
numbered year
(c) The last Tuesday ►n August of each year
Information for each of the options to fill the Council vacancy is provided below
Fill Vacancy by Appointment
The first step in filling the vacancy by appointment would be to establish the selection
process The City's past practice has been to accept applications from interested
residents and, during a Council Meeting, conduct interviews and make the appointment
A copy of the application previously used is included as an attachment to the staff
report Staff has reviewed the application and recommends, if Council decides to fill the
vacancy by appointment, three changes as follows (1) amend the date application
needs to be submitted to the City Clerk to January 5, 2015, (2) add line for cell phone
number, and (3) add line for email address If the Council desires other changes to the
application, they would also be incorporated into the application form
Below is a tentative timeline if the vacancy is filled by appointment It does not include
any special meeting dates

Either before or during the January 13th Council Meeting, the Council will need to
determine the order in which the applicants are interviewed The City's past practice has
been for the Mayor to draw names to determine the order of the interviews The
applicants adjourned to the Community Room until each individual was asked to return
to the Council Chambers for his or her interview
Questions to be asked by the Council at the interview will need to be developed Staff
recommends the members of the Council submit potential interview questions to the
City Clerk by January 5tt', to be compiled into a single list (excluding redundant

Fill Vacancy by Special Election
The San Bernardino County Registrar of Voters (ROV) has conducted the City's
municipal elections since incorporation If the Council decides to fill the vacancy by
special election, the Council would need to adopt resolutions calling and giving notice
for the election, requesting the ROV's services, and setting regulations for the candidate
statements The special election for a Council Member to fill the vacancy would be held
on June 2, 2015 At a Council Meeting in January, it would be necessary for the City
Council to adopt the needed resolutions calling the special election and allow for the
candidate filing period
Fill Vacancy by Special Election by Mail Ballot
The Elections Code provides for two dates each calendar year for a special election by
mail ballot Since 2015 is an odd year, the dates will be May 5th and August 25th
Since the Council will likely adopt the needed resolutions to call the Special Election by
Mail Ballot in January, Government Code 36512(b) requires a special election be "not
less than 114 days from the call of the special election" and, therefore, the Special
Election by Mail Ballot must be held on August 25, 2015
FISCAL IMPACT
There is no fiscal impact to filling the Council vacancy by appointment The City Clerk
has requested cost estimates from the San Bernardino County Registrar of Voters
(ROV) for filling the vacancy by a special election and a special election by mail ballot
At the time this staff report was prepared, these estimates were not yet available and
will likely not be available at the time this matter is taken up by Council on December 9,
2014 In December 2010, the ROV provided an estimate of $45,000 to $50,000 for a
special election and $31,000 for a special election by mail ballot The Council would
need to make a budget appropriation from the undesignated fund balance of the
General Fund for the cost of either a special election or a special election by mad ballot

BACKGROUND
The City of Grand Terrace has the opportunity to participate on various boards,
commissions, and committees as a member of various municipal organizations and
associations Historically, these assignments are reviewed every two years following
the regular municipal elections date, or as necessary
DISCUSSION
Staff has provided a list of the various boards, commissions, and committees that the
Council was appointed to, effective December of 2012 Staff recommends that the
Mayor appoint representatives to fill both the delegate and alternate positions
In addition, given the January 14, 2015 expiration date of the City's agreement with
Willdan Financial Services, staff recommends the Mayor appoint an Ad Hoc Committee
to negotiate a new agreement with Willdan
FISCAL IMPACT

Historically, every two years following the regular municipal election date, the City
Council has selected one of its Members to serve as Mayor Pro Tempore The City of
Grand Terrace has been without a Mayor Pro Tempore since January of this year It is,
therefore, necessary and appropriate to select a Mayor Pro Tempore from among the
Members of the City Council

Government Code Section 36804 provides the following
36804 The city council shall meet at the meeting at which the declaration
of the election results for a general municipal election is made pursuant to
Sections 10262 and 10263 of the Elections Code and, following the
declaration of the election results and the installation of elected officials,
choose one of its number as mayor, and one of its number as mayor pro
tempore
It is staffs recommendation that the Council select amongst themselves a Mayor Pro
Tempore from a member of the City Council who is not the directly elected Mayor The
term of office for the selected Mayor Pro Tempore will be for two years until the next
regular election
