Pg A Minutes Grand Terrace City Council July 14, 2015 Council Member Mitchell requested confirmation that the City would be receiving $3,500 from the sale of the fireworks City Manager Duffey, stated that he would anticipate about $2,000 this year The $3,500 figure was for the aggregate of two separate years Council Member Mitchell reported that she told her neighbors to write a letter to the firework manufacturer informing them of the various problems encountered with the fireworks She also asked the procedure to bring the fireworks back to the residents for their vote as the residents by Initiative voted to allow safe and sane fireworks to be sold in the City City Clerk Jacquez-Nares provided the citizen initiative process and stated that a signature petition with a minimum of 650 registered voters would need to be submitted to the City and the Council would need to approve to consolidate with the County by August 7, 2015 for the November 3, 2015 ballot Mayor Pro Tern Robles stated that she was taken back with the strong push for an initiative on the fireworks because it was approved by a 2 to 1 margin and there was a cost to put this on the ballot She was out of town on the Fourth of July but every single year there had been illegal fireworks and it seemed from her vantage point to be around Richard Rollins Park There seems to be a lack of dissemination of information on the City's part on the allowed fireworks zones Mayor Pro Tern Robles believed there was an opportunity for improvement by providing an educational campaign, additional patrolling that evening, and also limiting the 'dates of discharge to only the Fourth of r l July She did not know if the fundraising groups would support moving the fireworks to the High School City Attorney Adams reminded the Council that this item was not on the agenda for discussion If the Council Members wanted to discuss this it should be placed on a future agenda City Manager Duffey stated that this item would be put on the Council Report Back Log for an agenda item at a future meeting B CONSENT CALENDAR APPROVED ALL CONSENT CALENDAR ITEMS RESULT APPROVED [UNANIMOUS] MOVER Sylvia Robles,, Mayor Pro Tern 2 4" SECONDER Jackie, Mitchell, Council Member AYES - McNaboe, Robles, Mitchell, Wilson, Hussey' Waive Full Reading of Ordinances on Agenda WAIVED FULL READING OF ORDINANCES ON THE AGENDA City of Grand Terrace Page 3 F Packet" 9- -2 2 Minutes Grand Terrace City Council July 14, 2015 Eric Robles, Grand Terrace Resident, stated his concerns with the street sweeping ordinance and citatiops He requested clarification on the spirit and letter of the law and if he could park his car after the street sweeper had gone by Mike Auld, Foundation of Grand Terrace Member and Chairman of the Dog Park Committee, thanked everyone involved in the transfer of the property on 22720 Vista Grande Way for the Dog Park He further stated his support for item number four on the agenda and asked that the Council approve said item Mayor McNaboe informed Mr Auld that item number four on the agenda had been approved on the consent calendar vote She also thanked Mr Auld and the committee for all their hard work R c Sarah Wright, Field Representative for Congressman Pete Aguilar, announced their upcoming events on Saturday, July 18, 2015 at the Food Connection Coffee with a Congressman from 9 00 - 10 00 a m and on Friday, August 21, 2015 Senior Fair at N Abundant Living Family Church in Rancho Cucamonga from 9 00 - 12 00 p m for any c additional information you may contact their office D CITY COUNCIL COMMUNICATIONS Council Member Bill Hussey 0 N ~` Council Member Hussey thanked City staff and the members in the audience for attending the meeting He had his comments on fireworks and stated them during that presentation He thanked the Fire Department for their quick response for putting out c the fire on the Fourth of July Council Member Hussey congratulated the City of Colton d for celebrating their 128th birthday Mayor De La Rosa extended an invitation to the Grand Terrace residents to join in the celebration Council Member Hussey attended the League of California Cities Executive Board meeting on June 29, 2015 from 11 30 to 1 30 p m they approved the minutes and discussed the new League President, Dennis Mitchell, who was from Southern California He thanked City Manager Duffey for fixing a numerous potholes throughout the City He reported that he and his wife assisted a transient with food and asked the Sheriff's to assist this person but he was no longer in a H the area r � c Council Member Doug Wilson 2 Council Member Wilson thanked City Manager Duffey for getting the AM Radio station and the Emergency Operations Committee back on the air He further thanked the members of the Committee for their vital link in the survival of the community Council Member Wilson stated that it was up to each individual to make sure of what they and their family needed to survive an emergency such as a 10 0 earthquake He further reported that on Saturday, July 11, 2015 he called the Sheriffs dispatch to report a noise complaint on a party near his home at 8 00 p m and had to call the dispatch again at 9 45 p m because they had not responded they finally responded at 11 00 p m City of Grand Terrace Page 5 Packet Pg 11 M'42 Minutes Grand Terrace City Council July 14, 2015 observed that people walk in the street She told him that people walked on the street bec9use the pavement is easier on their backs and thie sidewalk was an obstacle course She requested that the City partner with the water company as in the past to send out a public information campaign on the fireworks and this and other initiatives She would also like to have the City partner with the trash company to have a campaign on courtesy with the animals and perhaps a pet dropping receptacle to make our City more friendly to people walking their pets Mayor Darcy McNaboe Mayor McNaboe reported on the various boards and committee meetings she attended as follows SANBAG Board of Directors Meeting - NONE G NEW BUSINESS 9 Introduce an Ordinance to Repeal Chapter 9 32 (Regulation of Registered Sex Offenders) To Conform with the Law Set by Recent Court Decisions City Attorney Adams provided the staff report for this item Mayor Pro Tern Robles wondered how to get the information out to the public and if the City would be liable if it used an informational billing insert to promote the use caution over children because this law had passed City Attorney Adams stated that the City would not be liable in telling the populous to be cautious There was Megan's Law that listed where the sex offenders live Mayor Pro Tern Robles would like to reiterate Megan's Law and this new law on a flyer and on the City's website City Attorney Adams informed the Council that the legislature was looking at this subject and there may be additional laws to come out in the future He stated that their office would be monitoring this subject Council Member Wilson thought it interesting and tragic how the citizenry passed this by initiative and then once again we see the relaxed court stance that relative laws applied to common sense which was really impossible If we bow to the State statue do we also bow to the pariah that inflicted this situation? if this was the price to also install a camera at Richard Rollins Park Mike Allagas, High Tech Security Owner, answered that at Rollins Park the camera would be placed on the building which would lower the price to approximately $2,200 to $2,500 per camera Mayor McNaboe asked Mr Allagas if he looked at both parks and recommended this license plate reader for Pico Park Mr Allagas answered he did look at both parks but he did not make the decision on which park to place the camera that decision was made by City staff > Mayor McNaboe asked staff what went into the determination to place discussion about what the goal was with this item Council had approved the update of the secunly system and the inclusion of the LPR for Karger Park because it made sense with the traffic volume She understood there was a value to have LPR at the park but she was not convinced that it was something Council was remised to leave off this item She agreed that she did not want to add cameras incrementally Mayor McNaboe asked whether there was good coverage at the park with the items that the Council had approved before and why were the additional cameras at the other parks not recommended at that time Mr Allagas stated that when he met with the Sheriffs Department there was a concern with the Council regarding LPRs because they felt it was a violation of the privacy of the citizens He further explained that the Sheriff's Department LPRs feed into their R computer systems and the City's LPRs only recorded and saved the information for a period of time of approximately three weeks in which time the Sheriffs Department could potentially review the recordings r d Community Development Director Molina provided a brief summary of the assessment c done on the park cameras She further stated that staff was comfortable with the coverage of the cameras that had been placed and approved by Council City Manager Duffey stated that Pico Park would potentially be getting heavy traffic GRAND TERRACE REPEALING CHAPTER 15 36 (SOLAR WATER HEATING SYSTEMS) IN ITS ENTIRETY AND REPEALING AND REPLACING CHAPTER 15 24 (UNIFORM SOLAR ENERGY CODE) OF TITLE 15 OF THE GRAND TERRACE MUNICIPAL CODE RELATING TO PERMITTING PROCEDURES FOR SMALL RESIDENTIAL ROOFTOP SOLAR ENERGY SYSTEMS WHEREAS, as set forth in Government Code Section 65850 5(a) it is the policy of the State of California that local agencies encourage the installation of solar energy systems by removing obstacles to, and minimizing the costs of, permitting such energy systems, and WHEREAS, as set forth in Government Code Section 65850 5(g), cities must adopt an ordinance on or before September 30, 2015 that creates an expedited and streamlined permitting process for small residential rooftop solar energy systems, and WHEREAS, the ordinance must substantially conform with the recommendations set forth in the California Solar Permitting Guidebook, including the use of a checklist of all requirements that, iftcomplied with, requires cities to approve the application and issue the applied for permits, and WHEREAS, the City Council of the City of Grand Terrace finds that it is in the interest of the health, welfare and safety of the public to provide an expedited permitting process to encourage the effective development of solar technology, and WHEREAS, the City Council of the City of Grand Terrace finds that the following ordinance will have the effect of encouraging the installation of small residential rooftop solar energy systems and minimizing barriers, obstacles, and costs of obtaining permits for their installation NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES HEREBY ORDAIN AS FOLLOWS Section 1 Chapter 15 36 "Solar Water Heating Systems" of Title 15 "Buildings and Construction" of the Grand Terrace Municipal Code is hereby repealed in its entirety Section 2 Chapter 15 24 "Uniform Solar Energy Code" of Title 15 "Buildings and c Construction of the those restrictions that do not significantly increase the cost of the system or significantly decrease its efficiency or specific performance, or that allow for an alternative system of comparable cost, efficiency, and energy conservation benefits K "Restrictions that do not significantly increase the cost of the system or decrease its efficiency or specified performance" means For water heater systems or solar swimming pool heating systems E an amount exceeding 10% of the cost of the system, but in no case w more than $1,000 00, or decreasing the efficiency of the solar energy system by an amount exceeding 10%, as originally specified and proposed y 2 For photovoltaic systems an amount not to exceed $1,000 00 over the system cost as originally specified and proposed, or a decrease rin system efficiency of an amount exceeding 10% as originally specified and proposed L "Small residential rooftop solar energy system" means all of the following A solar energy system that is not larger than 10 kilowatts alternating current nameplate rating or 30 kilowatts thermal 2 A solar energy system that conforms to all applicable state fire, structural, electrical, and other building codes as adopted or amended by the City of Grand Terrace and all State of California health and safety standards 3 A solar energy system that is installed on a single or duplex family dwelling 4 A solar panel or module array that does not exceed the maximum legal building height as defined by the City of Grand Terrace w M "Solar energy system" means either of the following d E s 1 Any solar collector or other solar energy device whose primary purpose is to provide for the collection, storage, and distribution of a solar energy for space heating, space cooling, electric generation, `j or water heating Packet Pg 84 applications, and other documents in lieu of a wet signature i D The Building Department shall adopt a standard plan and checklist of all requirements with which small residential rooftop solar energy systems shall comply with to be eligible for expedited review E The small residential rooftop solar system permit process, standard plans, and checklist shall substantially conform to the recommendations for expedited permitting, including the checklist and standard contained in the most current version of the California Solar Permitting Guidebook adopted by the Governor's Office of Planning and Research F All fees prescribed for the permitting of small residential rooftop solar energy systems must comply with Government Code Sections 65850 55 and 66015 and Health & Safety Code Section 17951 Section 15 24 060 Expedited permit review and inspection requirements -" 0 LO A The Building Department shall adopt an administrative, nondiscretionary review process to expedite the approval of small residential rooftop solar E energy system applications within 30 days of adoption of this chapter For an N application for a small residential rooftop solar energy system that meets the y requirements of the approved checklist and standard plan, the Building Department shall issue a building permit or other non -discretionary permit within 3 business days for over-the-counter applications or within 5 business w days for electronically filed applications A building official may require an applicant to apply for an administrative conditional use permit if the official u finds, based on substantial evidence, that the solar energy system could o have a specific, adverse impact upon the public health and safety Such c decisions may be appealed to the Planning Commission W B Review of the application shall be limited to the building official's review of whether the applicant meets local, state and federal health and safety requirements C If an administrative conditional use permit is required, a building official may n deny an application for the use permit if the official makes written findings based upon substantive evidence in the record that the proposed installation would have a specific, adverse impact upon public health or safety and there is no feasible method to satisfactorily mitigate or avoid the specific, adverse o impact Such BACKGROUND Street lights in the City are owned and serviced by Southern California Edison (Edison) Street lighting utility bills, including maintenance, are paid by the City, at an average approximately $65,000 a year Edison presently has a program whereby cities can purchase the Edison owned street lights It was just learned that Edison will discontinue accepting applications for the program after August 15, 2015 The process involves a valuation of the Edison street lights, performed by Edison at a cost of $10,000 If the City Council wants to consider acquisition of the street lights, then it would be necessary to deposit $10,000 with Edison before the end of the business day on August 15, 2015 Once Edison receives the $10,000 deposit, the City will be placed in the queue for valuation According to Mr John King, Streetlight Project Manager, once in the queue it may be 4 to 6 months before Edison can begin the valuation process If the City decides to abandon the process before Edison begins the valuation of its street lights, then the $10,000 deposit would be refunded to the City Once Edison begins the Packet Pg 90 lights to LED will over time will result in enough savings to eventually recoup the initial expense for the LED retrofit i FISCAL IMPACT If the City Council wants to pursue an evaluation of acquiring Edison street lights at this time, then it is recommended that the City Council authorize payment of $10,000 to Edison for its valuation of street lights and direct staff to request proposals from utility consulting firms to perform an evaluation, including cost and benefit analysis, of acquiring the Edison street lights The Gas Tax Fund, as of June 30, 2015, has an estimated fund balance of $436,117 Staff is recommending that City Council adopted Resolution 1979-49, "Adopting an Employees' Defined Contribution Retirement Plan " This resolution created an employee retirement trust which was administered by the City of Grand Terrace The resolution was later replaced by Resolution 1987-26 which amended the trust On October 26, 1989, the City Council then adopted Ordinance 119, authorizing a contract with CalPERS for retirement services The contract included the following provision "Assets heretofore accumulated with respect to members in the local retirement system shall be transferred to the Public Employees' Retirement System upon the effective date of this contract and applied against the liability for prior service incurred hereunder That portion of the assets so transferred which represent the accumulated contributions (plus interest thereupon) required of the employees under said local system shall be credited to the individual membership account of each such employee under the Public Employees' Retirement System " DISCUSSION This action effectively defunds the retirement trust covered by Resolution 1987-26 No further action was ever taken with regard to the old retirement trust
