Grand Terrace City Council Mayor Pro Tern Sylvia Robles October 27, 2015 Mayor Pro Tern Robles reported that she attended the Omnitrans Committee Fuel Conversation items discussed were electric vehicles and potential Buses Members sitting on AQMD discussed the barriers with Edison on electric car use in mass scale She also attended the Chamber meeting on SANBAG and future improvements of local freeways There was a good discussion on toll road options and limits of current funding to add lanes without a toll option Toll revenue would be used for local system upgrades Mayor Pro Tern Robles requested that Mayor McNaboe inform SANBAG that the V 13 Metrolink ticket kiosk at the San Bernardino station was at an unacceptable level of service San Bernardino was home base of SANBAG and other West Valley cities had excellent kiosk system d N Mayor Darcy McNaboe `o 0 Mayor McNaboe reported that she attended the SANBAG Metro Valley Study Session a on October 15, 2015 the items and City Manager lunch event at the Senior Center on Monday, November 9, 2015 at noon Mayor McNaboe requested that the noticing area for the roads and streets discussion be increased to reach additional residents City Attorney Adams requested that he be excused from attending the November 10, 2015 City Council meeting and to have Deputy Attorney Ivy Tsai attend in his absence By Council Dog Park Committee for a Waiver of Filing Fees PRESENTED BY Sandra Molina, Community Development Director RECOMMENDATION Waive the Filing Fees in the Amount of Ninety Seven Dollars ($97 00) for the Dog Park Committee Fund Raiser 2030 VISION STATEMENT This item supports Goal 4 to "Develop and Implement Successful Partnerships" BACKGROUND The Foundation of Grand Terrace Dog Park Committee is a 501(c)(3) non-profit organization that has held various activities to raise money to fund equipment for the City's Dog Park on Vista Grande Way, including an annual rummage sale fund raiser i This year, the Committee will hold a rummage sale on Saturday, November 14th at the Barton Plaza Commercial Center where Walgreens is located at 22456 Barton Road With their application submittal, the Committee has also asked for a waiver of the $97 00 filing fee A check covering the filing fee has been submitted and is being held pending the outcome of the request Attachment 1 includes the fee waiver request The Dog Park Committee has been raising funds through fund raising activities to pay for Dog Park equipment such as agility courses and benches The Zoning Code allows rummage sales subject to a temporary land use permit The land use permit has a $97 00 filing fee This volunteer effort is greatly appreciated, and staff recommends that the City Council waive the City's land use the City Council regarding Project funding and scheduling Funding Recently, the SANBAG Board acted on SANBAG Staff's recommendation to reallocate of existing Barton Road Interchange Project construction funds to another project While the construction funding reallocation was approved, reflecting the current project schedule, the SANBAG Director and staff gave their commitment that should the STIP funding for this Project become at risk, they have numerous other funding sources that could be applied Schedule The Project schedule has been delayed from the original construction start of the City of Grand Terrace's history and will address area safety and traffic capacity concerns In addition to the freeway improvements, the Project includes several new local street re- alignments, acquisition of property within the City Limits and many business relocations Moreover, the proposed improvements are viewed to be critical to the City's economic vitality The Project is funded through the San Bernardino Associated Governments (SANBAG), and the California Department of Transportation (Caltrans) has the lead role on the design and right of way phases Given the critical importance of this Project, the City Council approved an Agreement with Interwest for Project Management of the 1-215/Barton Road Interchange Project DISCUSSION This staff report will provide an update on the progress of the project and highlight some potential issues that need Council direction Schedule/Funding The Project schedule has been delayed from the original construction start of the summer of 2016 This is mainly due to longer right of way acquisitions than anticipated The current schedule projected by Caltrans is as follows Packet Pg 41 Enhancements (Please refer to the attached exhibits The current design for the bridge abutments and retaining walls propose a very attractive rail/agriculture themed motif These thematic elements will be cast into the concrete with form liners On the structure exterior girder, form liners will be used to create mountain ranges reminiscent to the Grand Terrace Mountains The bridge fencing will be a black vinyl coated chain link with arching semi -circles across the structure From the Barton Road view, the mountain form liners will be repeated in the bridge barrier rails The City has inquired if SANBAG will fund the addition parapet walls to be placed at the all four corners of the bridge abutments The parapet walls would have the mountain shape that is similar to the shape proposed in the roundabout with Grand Terrace logo facing outward and inward Please see the example attached to this staff report It is felt that these elements added to the project would create a fitting entry statement to the City Staff will report back to the City Council on this issue On June 23, 2015, the City Council approved Modified Concept #1 for the Roundabout that established the hard and landscaping themes At that time an irrigation system and landscaping was included Due to the Governor's recent directive because of the drought, plantings cannot be installed with the entire project City staff is working with Caltrans for the opportunity to have the irrigation and landscaping which is minimal installed However, if Caltrans cannot install the plant material, then dry irrigation including water meters should be installed by Caltrans, and the plans forwarded to the City This would allow landscape to be installed and funded by the City after the project is complete Given the minimal landscape material that is proposed, the cost of plant installation and on -going maintenance would be minimal Staff will report back to the City Council on this issue The street lighting proposed is currently the standard metal Caltrans poles, and no lighting is proposed across the bridge Staff has inquired if a decorative street light could be used thought-out the project The installation and maintenance costs would be borne by the City A preliminary estimate for eight decorative street lights is $80,000 Barton Road Overlay Project The City has a proposed an overlay of Barton Road between the interchange project limits, just west of Vivienda Avenue and Canal Street Staff has inquired if this overlay could be incorporated into the interchange project in order to realize the cost savings of the work being in a larger project Interwest crews have calculated the Pavement Condition Index (PCI) for Barton Road between within these limits The street has a PCI of 58 This is in the fair range The Packet Pg 43 various necessary agreements for the project These are • Updated Freeway Maintenance Agreement with Caltrans - Establishes the understanding between Caltrans and the City relating to the access control for the proposed improvements, indicating which streets may be closed and/or connected to the freeway and will be relocated and otherwise modified It also establishes the maintenance responsibilities between the City and Caltrans for pavement, lighting and landscaping • Right of Way Agreement with SANBAG - Establishes the understanding between SANBAG and the City relating to the process and funding for Right of Way acquisitions and business relocations Utility Agreements - As discussed, these agreements will address the sewer relocations and potential undergrounding of aerial electrical power poles These agreements will be brought before the City Council for execution once the final conditions are resolved FISCAL IMPACT None at this time However, staff will report back on the costs associated with the Council an update DISCUSSION Pavement Management Plan Index Study On October 5, 2015, the City Council received an overview from Interwest Project Manager Theron Roschen on the pavement management plan The detailed presentation provided an overview of the field assessment, how roadways are graded ("indexed") to establish a maintenance schedule, the StreetSaver software program and also possible funding sources The following is a status of the project, to date Pavement management ➢ The StreetSaver Software has been purchased and the system set up, tailored to Grand Terrace Preliminary mapping of the City was prepared and provided to Interwest field review team The visual pavement condition assessment of approximately 42 road -miles began on October 10, 2015 For safety, a 2-person crew was used for the arterials and major collector streets, as these streets are wider and carry higher levels of vehicle traffic Pavement assessments conducted along these streets generally takes more time and has been completed Approximately 55% of the City's pavements have been assessed to date StreetSaver database inputs continue in parallel with the field assessment, which includes verification of anticipated funding sources, funding amounts and project phasing where appropriate The CPNAs also demonstrate the availability of development mitigation fair share funds for projects included in the Needs Analysis CPNAs for Valley jurisdictions include projects for the Valley Freeway Interchange and Major Street Programs SANBAG staff will use these submittals, along with similar information from SANBAG departments, in a cash -flow analysis DISCUSSION Measure I revenue can only be used for transportation improvement and traffic management programs authorized in the Expenditure Plans set by Ordinance No 04-01 and Ordinance No 89-1 of the authority The Strategic Plan and Expenditure Plan require each local jurisdiction applying for revenue from the Valley Major Street and Freeway 2015, the City Council conducted a public hearing on the introduction of an ordinance establishing a new Sign Code The City Council conducted a comprehensive review of the proposed ordinance, provided comment and direction, and voted to continue the public hearing to October 13, 2015, which was continued to November 10tn The draft Sign Code has been revised pursuant to Council comments, and is currently undergoing legal review Additionally, in light of recent case law, the City Attorney's office has recommended an updated comprehensive review Pursuant to Council comments, staff has prepared provisions relating to temporary signs, human advertising signs, special event/temporary use signs and off -site temporary residential subdivision signs These new provisions will be reviewed for consistency with the most recent case law DISCUSSION While the revised sign code undergoes comprehensive review, staff would like the Council to consider and provide input on potential changes relating to Freeway Signs, and allowances for electronic sign copy ' The existing sign code allows commercial and industrial properties within 250 feet from Interstate 215 to have a freeway sign Signs area is between 75 to 100 square feet, and between 50 to 75 feet high The impetus for the proposed language stems from a meeting between the City Manager and a local business owner The business owner put into place DISCUSSION This contract does not change the cost to the City of purchasing the foods, but is intended to memorialize the transactions already occurring Bidding was not required for this agreement because there are no other sources for delivery of the bulk perishables and non -perishables required by the Child Care services Sysco's only other competitor, U S Foods is buying out Sysco which will leave no competitors able to bid There is no other company with better prices and who could deliver the items needed The only other possiblity is Shamrock, which does not carry the the procedures established by this section, and shall further require periodic reports from the department on the purchases and contracts made under such written authorization 3 24 060 - Public Projects Exemptions This chapter is expressly made inapplicable to bids for public projects governed by the procedures in Public Contract Code Section 20100 et seq The provisions contained in Public Contract Code Section 20100 et seq establish the contract procedures the city shall follow regarding public projects 3 24 070 - Purchases under Ten Thousand Dollars Purchase of supplies, materials, equipment or services not exceeding an estimated value of ten thousand dollars ($10,000) may be made by a city Department in the open market, pursuant to the procedure prescribed in this ordinance, provided, however, all quotation may be dispensed with in an emergency, or where said goods and/or services can be obtained from only one source A using department is responsible for insuring there is a sufficient appropriation in the budgetary account against which said purchase is to be charged A Using Department shall follow the following procedure when making an open market purchase 1 Purchases under ten thousand dollars shall, whenever possible, be based on at least three (3) informal quotations and shall be awarded to the vendor submitting the lowest responsible quotation Chapter 3 24 — lowest bidder is awarded the contract and he fails or refuses to execute the contract, he shall forfeit his entire bid security C Bid Opening Procedure Sealed bids shall be submitted to the city clerk, and shall be identified as bids on the envelope Bids shall be opened in public at the time and place stated in the public notices A tabulation of all bids received shall be open for public inspection during regular business hours for a period of not less than thirty (30) calendar days after the bid opening D Rejection of Bids At its discretion, the city council may reject any and all bids a presented, and re -advertise for bids E Award of Contracts Contracts shall be awarded by the city council to the lowest responsible bidder except as otherwise provided herein A master copy Ln of the contract is to be on file in the city clerk's department upon execution of the contract 06 F Award of Contracts by City Manager The city manager is authorized to award contracts to the lowest responsible bidder when the city council has budgeted funds for the item(s) and the amount of the award is not more than the budgeted amount All contracts awarded pursuant to this section shall require issuance of a purchase order G Tie Bids If two or more bids received are for the same total amount or unit price, quality, service and delivery being equal, and if the public interest will not permit the delay of re -advertising for bids, the city council may accept the one it chooses, or accept the lowest bona fide offer by negotiation with the tie bidders at the time of the bid opening H Performance Bonds The city shall have authority to require a performance R bond before entering a contract, in such amount as it shall be found c reasonably necessary to protect the best interests of the city If the city requires a performance bond, the form and amount of the bond shall be described in the notice inviting bids I Single Source Purchases Single source purchase of goods or services cooperative purchasing agreement(s) or programs entered into between the city and the state, county, and other municipalities situated within the boundaries of the county, and the purchasing agent is empowered and authorized to act o under the provisions of this section, to procure for the city supplies and equipment in = conjunction with such voluntary cooperative purchasing agreement(s) or
