This staff report supports City Council Goal #1, "Ensure Our Fiscal Viability," through
the continuous monitoring of revenue receipts and expenditure disbursements against
approved budget appropriations
BACKGROUND
On January 17, 2017 the City Council retained the services of Lagerlof, Senecal,
Gosney & Kruse LLP as special counsel ("Special Counsel") to review and advise the
City Council with regard to obtaining a water pipeline franchise agreement with the
Riverside Highland Water Company ("RHWC") The City Council now wishes to further
engage the services of Special Counsel to take all necessary legal steps to obtain a
water pipeline franchise agreement with the RHWC

The attached First Amendment to the Agreement for Legal Services with Special
Counsel, amends and expand the scope of services to take all necessary legal steps to
obtain the aforementioned water pipeline franchise agreement with RHWC and it
amends the compensation for the legal services from a not to exceeds amount of
$7,500 00 to a total not to exceeds amount of $23,500 00 to include the expanded
scope of services
FISCAL IMPACT
Funds for Amendment #1 to the contractual agreement between the City and Lagerlof,
Senecal, Gosney & Kruse LLP are in the FY2016-17 Approved Budget

THIS FIRST AMENDMENT ("FIRST AMENDMENT") to the Agreement for
Legal Services with Lagerlof, Senecal, Gosney, & Kruse, LLP ("AGREEMENT") is
entered into by and between the CITY OF GRAND TERRACE, hereinafter referred to as
the "CITY," and LAGERLOF, SENECAL, GOSNEY & KRUSE, LLP, a law firm,
hereinafter referred to as "ATTORNEY", is entered into the 28th day of March, 2017
RECITALS
WHEREAS, the CITY entered into the AGREEMENT with ATTORNEY on r
to perform services as special counsel for the CITY,
WHEREAS, CITY and ATTORNEY wish to amend the AGREEMENT in order c

2030 VISION STATEMENT
A compliant Housing Element supports Goal #1, Ensuring Fiscal Viability and Goal #3,
Promote Economic Development by providing an internally consistent General Plan
BACKGROUND/DISCUSSION
On January 28, 2014, the City Council adopted the 2013-2021 Housing Element The
Element was forwarded to the California Department of Housing and Community
Development (HCD) for their determination on its compliance with state housing law
HCD determined the Element was noncompliant On September 27, 2016 the Council
adopted a revised 2013-2021 Housing Element, which was certified by HCD
State law requires each city to prepare and file Annual Progress Reports (APRs)
describing housing production and the status of Housing Element program
implementation, and forward to HCD on April 1 APRs must be prepared using the
format established by the HCD
Attached are the APRs for calendar years 2015 and 2016 The reports contain the total
number of units constructed and also the progress in implementation of the City's
Housing Programs
Housing Construction
A total of 15 homes have been built in 2015 and 2016 In 2015 there were 10 homes
built Of these 10, one home was deed restricted for moderate income households for a
period of 10 years In 2016 five homes were completed, and two were deed restricted to
moderate income households for a period of 10 years The three deed restricted homes
are from the Preston Project

2030 VISION STATEMENT
This staff report supports Goal #5, Engage in Proactive Communication
BACKGROUND
On February 14, 2017, the City Council directed Staff to return with a professional
services contract for planning services related to 40 acres north of Vivienda Avenue
The Council will recall that this discussion stemmed from a request from a resident that
the City consider initiating applications to have the area re -zoned to allow "ranchette"
residential uses and to allow urban farming/agriculture uses, such as farms or ranches
for the grazing, breeding or raising of animals, boarding horses, growing of orchards,
groves, crops, flowers, and allowing the on -site sale of those crops, animals or animal
products
DISCUSSION
Attached is a contract with J H Douglas & Associates to perform the planning analysis
needed to evaluate the request, evaluate the project area and make recommendations
on changes to the Zoning Code This analysis would also include a obtaining input from
the subject property and surrounding property owners At the February 14, 2017,
meeting the property owner and possible buyer of approximately 20 acres expressed
opposition to any rezoning These concerns would also be considered during this
planning process
Staff reached out to John Douglas of J H Douglas & Associates John Douglas is the
planning consultant that also prepared the City's amendment to the Housing Element
The cost proposal is for $20,000, which includes $5,000 contingency The contingency
would be used if changes to the general plan or additional meetings are required

AGREEMENT FOR CONSULTANT SERVICES
THIS AGREEMENT ("Agreement") is made as of this 28th day of March, 2017 by
and between the CITY OF GRAND TERRACE ("City") and J H Douglas and
Associates ("Consultant")
CONSULTANT'S SERVICES Consultant agrees to perform during the term of
this Agreement, the tasks, obligations, and services set forth in the "Scope of
Services" attached to and incorporated into this Agreement as Exhibit A (the
"Services")
2 TERM OF AGREEMENT The term of this Agreement shall be from the effective
date pursuant to Paragraph "38" of this Agreement and shall end on September
30, 2017 or when the work is satisfactorily completed, whichever occurs first,
unless extended by the City Manager, not to exceed an additional six months, by
an amended agreement
3 FAMILIARITY WITH WORK By execution of this Agreement, Consultant
warrants that

(1) It has thoroughly investigated and considered the work to be
performed, based on all available information
(2) It carefully considered how the work should be preformed, and
(3) It fully understands the difficulties and restrictions attending the
performance of the work under this Agreement
(4) It has the professional and technical competency to perform the

manner with respect to the schedule included in the scope of
services
4 PAYMENT FOR SERVICES City shall pay for the services performed by
Consultant pursuant to the terms of this Agreement, the compensation set forth
in the "Proposed Budget" included in Exhibit "A" to this Agreement The fees for
services shall not exceed the authorized amount of $20,000 (Twenty Thousand
Dollars), as set forth in Attachment "B," which is attached and incorporated into
this Agreement, unless the CITY has given specific advance approval in writing

Million available for urban greening projects The Agency anticipates only one funding
cycle and there are no minimum or maximum grant amounts for the Program
A minimum of 75% of the available fund will be awarded to projects located within and
benefitting disadvantaged communities In addition, 50% or more of the project should
be in a publicly accessible area in the disadvantaged community The City has identified
disadvantaged communities within its boundaries and the project would benefit this
community
All projects are required to show a net GHG benefit and provide multiple other benefits
In order to quantify GHG emission reductions, projects must include at least one of the
following project activities
1 Sequester and store carbon by planting trees
2 Reduce building energy use by strategically planting trees to shade buildings
3 Reduce commute vehicle miles traveled by constructing bicycle paths, bicycle
lanes or pedestrian facilities that provide safe routes for travel between residences,

DISCUSSION
Staff is bringing this item forward to obtain Council approval to submit a grant
application for the Urban Greening Program
The project, as contemplated, includes greenway bike and pedestrian trails primarily
within the northwest portion of the City with local and regional connections The project
focuses on this portion of the City because it meets the criteria of serving a
disadvantaged community It would make connections between residential and
commercial areas, parks and the Santa Ana River Trail (SARI) utilizing city streets,
repurposing segments of railroad lines, and creating open spaces Paths that lead to the
SART and incorporate the Gage Canal would create local and regional connections
In addition, staff has received a cost proposal from Evan Brooks Associates, Inc (EBA)
in the amount of $12,500 for preparation and,submittal of and Urban Greening Program
grant application EBA has provided grant writing services to the City for other grant
funding opportunities EBA has secured more than $118 million in grant dollars for
municipal clients Most recently, EBA prepared the City's application to the Habitat
Conservation Fund related to the Blue Mountain trailhead and trail improvements and

Notwithstanding any other agency, state or federal policy, rule, regulation, law or "'

30 COVENANTS AND CONDITIONS Each term and each provision of this

32 EFFECT OF TERMINATION Upon termination as stated in Paragraph "31" of

The Consultant shall maintain throughout the duration of the term of the Agreement,
liability insurance covering the Consultant and, with the exception of Professional
Liability Insurance, designating City and City including its elected or appointed officials,
directors, officers, agents, employees, volunteers, or consultants, as additional insured
against any and all claims resulting in injury or damage to persons or property (both real
and personal) caused by any aspect of the Consultant's work, in amounts no less than
the following and with such deductibles as are ordinary and reasonable in keeping with

bike and pedestrian trail will connect the residents to the Santa Ana River Trail north of the City, and
eventually the County of Riverside and its amenities located south of the City This project will provide
pedestrians and cyclists a safe buffer from motorized vehicles to travel to and from these activity centers,
community amenities and their homes without having to use their motorized vehicles
The project is located in Grand Terrace (San Bernardino County) and will encompass the community
located from Barton Road north to the Santa Ana River Trail, and between Mt Vernon Avenue to the west
at La Cadena Drive The project scope includes providing a bike and pedestrian path where there currently
is none with open rest areas and green spacesthat may provide restrooms, wayfinding signage, pedestrian
level lighting, picnic areas, hydration stations, and bike repair hubs In addition, these rest areas may have
a plant palette that includes carbon sequestration trees and shrubs, and water conservation elements
that may include bioswales for stormwater and run-off capture, filtration and groundwater recharge
The expected benefits are to encourage more cycling and walking as a choice mode of transportation by
providing a safe walking and cycling path, reduced car trips, reduced Greenhouse Gas emissions, increase
physical activity and reduce public health issues including obesity and diabetes rates affecting this
disadvantaged community Connectivity this project can potentially provide is to local k-12 schools for
students and parents, the Omnitrans OmniGo bus system which will connect residents to employers and
retail centers in Grand Terrace and the region, and educational institutions in the region
About the Grant Proaram
Over the years, the Agency has administered a suite of programs including the California River Parkways
Program, Environmental Enhancement and Mitigation Program, and the Strategic Growth Council's
Urban Greening Program under Proposition 84 These programs funded projects that provided a wide
variety of benefits such as environmental, health, and community revitalization throughout the State
The Urban Greening Program, funded by the GGRF, continues the legacy of these programs but with a
specific focus of achieving greenhouse gas reductions Consistent with AB 32, the Urban Greening
Program will fund projects that reduce greenhouse gases by sequestering carbon, decreasing energy
consumption and reducing vehicle miles traveled, while also transforming the built environment into
places that are more sustainable, enjoyable, and effective in creating healthy and vibrant communities
These projects will establish and enhance parks and open space, using natural solutions to improving air
and water quality and reducing energy consumption, and creating more walkable and bike -able trails
Approximately $76 million is available for urban greening projects The Agency anticipates one funding
cycle, however, funding cycles are contingent upon the number of competitive applications There are
no minimum or maximum grant amounts for this program Match funds are not required for this
program However, projects that leverage other sources of funds may be more competitive
A minimum of 75% of the available fund will be awarded to projects located within and benefitting
disadvantaged communities per SB 535 In addition, 50% or more of the project should be in a publicly
accessible area in the disadvantaged community

CONTRACT AGREEMENT
THIS CONTRACTORS AGREEMENT ("Agreement") is made and entered into this 28th day of
March 2017, ("Effective Date") by and between the CITY OF GRAND TERRACE ("City"), a
public entity, and St Francis Electric, LLC ("Contractor"), a California Corporation
1 Scope of Services Contractor shall perform all the services as described as follows
a) For and in consideration of the payments and agreements hereinafter mentioned to be
made and performed by said City, said Contractor agrees with said City to perform and
complete in a workmanlike manner all work required under the Bidding Schedule of the
City's Specification, in accordance with the Specifications and Drawings therefor, to
furnish at his own expense all labor, materials, equipment, tools and services necessary
therefor, except those materials, equipment, tools and services as may be stipulated in
said specification to be furnished by said City and to do everything required by this
Agreement and the said Specifications and Drawings
b) The Notice Inviting Bids, Instructions to Bidders, Proposal, Information required of
Bidder, Specification, Drawings, Exhibits and all addenda issued by the City with respect
to the foregoing prior to the opening of bids, are hereby incorporated in and made a part
of this Agreement
c) In entering into a Public Works Contract for a subcontract to supply goods, services or
materials pursuant to a Public Works Contract, the Contractor or subcontractor offers and
agrees to assign to the City all rights, title, and interest in and to all causes of action it
may have under Section 4 of the Clayton Act (15 U S C Sec 15) or under the Cartwright
Act (Chapter 2 commencing with Section 16700) of Part 2 of Division 7 of the Business
and Professions Code, ansmg from purchases of goods, services, or materials pursuant to
the Public Works Contract or the subcontract This assignment shall be made and
become effective at the time the City tenders final payment to the Contractor without
further acknowledgment by the parties
2 Term This Agreement shall be effective on the date first written above and the Agreement
shall remain in effect for a three (3) year period or until terminated as provided herein A
maximum of two (2) one year extensions may be granted by the City
3 Compensation/Payment Contractor shall perform the Services under this Agreement for
the total sum not to exceed $10,000 annually Payment shall be made in accordance with
City's usual accounting procedures upon receipt and approval of an itemized invoice setting
forth the services performed The invoices shall be delivered to City at the address set
forth in Section 4, hereof
4 Notices Any notices required to be given hereunder shall be in writing and shall be
personally served or given by mail Any notice given by mail shall be deemed given when
deposited in the United States Mail, certified and postage prepaid, addressed to the party to be
served as follows

contributions for PERS benefits on behalf of Contractor or its employees, agents, or
subcontractors, as well as for the payment of any penalties and interest on such contributions,
which would otherwise be the responsibility of City
Notwithstanding any other agency, state or federal policy, rule, regulation, law or
ordinance to the contrary, Contractor and any of its employees, agents, and subcontractors
providing service under this Agreement shall not qualify for or become entitled to, and hereby
agree to waive any claims to, any compensation, benefit, or any incident of employment by City,
including but not limited to eligibility to enroll in PERS as an employee of City and entitlement
to any contribution to be paid by City for employer contribution and/or employee contributions
for PERS benefits
12 Indemnifications
12 1 Indemnity Except as to the sole negligence or willful misconduct of the City,
Contractor shall defend, indemnify and hold the City, and its officers, employees and
agents, harmless from any and all loss, damage, claim for damage, liability, expense or
cost, including attorneys' fees, which arises out of or is in any way connected with the
performance of work under this Agreement by Contractor or any of the Contractor's
employees, agents or subcontractors and from all claims by Contractor's employees,
subcontractors and agents for compensation for services rendered to in the performance
of this Agreement, notwithstanding that the City may have benefitted from their services
This indemnification provision shall apply to any acts or omissions, willful misconduct or
negligent conduct, whether active or passive, on the part of Contractor or of Contractor's
employees, subcontractors or agents
— , 12 2 Attorney's Fees The parties expressly agree that any payment, attorneys' fees,
costs or expense that the City incurs or makes to or on behalf of an injured employee
under the City's self-adnunistered workers' compensation is included as a loss, expense
or cost for the purposes of this Section, and that this Section shall survive the expiration
or early termination of the Agreement
13 Insurance
13 1 General Provisions Prior to the City's execution of this Agreement, Contractor
shall provide satisfactory evidence of, and shall thereafter maintain during the term of
this Agreement, such insurance policies and coverage's in the types, limits, forms and
ratings required herem The rating and required insurance policies and coverage's may be
modified in writing by the City's Risk Manager or City Attorney, or a designee, unless
such modification is prohibited by law
13 1 1 Limitations These minimum amounts of coverage shall not constitute any
limitation or cap on Contractor's indemnification obligations under Section 12 hereof
13 12 Ratings Any insurance policy or coverage provided by Contractor as
required by tlus Agreement shall be deemed inadequate and a material breach of tlus
Agreement, unless such policy or coverage is issued by insurance companies
authorized to transact insurance business in the State of California with a policy
holder's rating of A- or higher and a Financial Class of VII or higher
13 13 Cancellation The policies shall not be canceled unless thirty (30) days prior
written notification of intended cancellation has been given to City by certified or
registered mail, postage prepaid
1314 Adequacy The City, its officers, employees and agents make no
representation that the types or limits of insurance specified to be carried by

behalf of the named insured for the City of Grand Terrace
13 4 Subcontractors' Insurance Contractor shall require all of its subcontractors to
carry insurance, in an amount sufficient to cover the risk of injury, damage or loss that
may be caused by the subcontractors' scope of work and activities provided in
furtherance of this Agreement, including, but without limitation, the following
coverage's Workers Compensation, Commercial General Liability, Errors and
Omissions, and Automobile liability Upon City's request, Contractor shall provide City
with satisfactory evidence that Subcontractors have obtained insurance policies and
coverage's required by this section
14 Business Tax Contractor understands that the Services performed under this Agreement
constitutes doing business in the City of Grand Terrace, and Contractor agrees that Contractor
will register for and pay a business tax pursuant to Chapter 5 04 of the Grand Terrace Municipal
Code and keep such tax certificate current during the term of this Agreement
15 Time of Essence Time is of the essence for each and every provision of this Agreement
16 City's Right to Employ Other City reserves the right to employ other in connection with
the Services
17 Solicitation Contractor warrants that they have not employed or retained any person or
City to solicit or secure this Agreement, nor has it entered into any agreement or understanding
for a commission, percentage, brokerage, or contingent fee to be paid to secure this Agreement
For breach of this warranty, City shall have the right to terminate this Agreement without
liability and pay only for the value of work has actually performed, or, in its sole discretion, to
deduct from the Agreement price or otherwise recover from Contractor the full amount of such
commission, percentage, brokerage or commission fee The remedies specified in this section
shall be in addition to and not in lieu of those remedies otherwise specified in this Agreement
18 General Compliance with Laws Contractor shall keep fully informed of federal, state and
local laws and ordinances and regulations which in any manner affect those employed by
Professional, or in any way affect the performance of services by Contractor pursuant to this
Agreement Contractor shall at all times observe and comply with all such laws, ordinances and
regulations, and shall be solely responsible for any failure to comply with all applicable laws,
ordinances and regulations
19 Amendments This Agreement may be modified or amended only by a written Agreement
and/or change order executed by the Contractor and the City
20 Termination City, by notifying Contractor in writing, shall have the right to terminate any
or all of professional's services and work covered by this Agreement at any time, with or without
cause In the event of such termination, Contractor may submit s final written statement of the
amount of Contractor's services as of the date of such termination based upon the ratio that the
work completed bears to the total work required to make the report complete, subject to the
City's rights under Sections 16 and 21 hereof In ascertaining the work actually rendered
through the termination date, City shall consider completed work, work in progress and complete
and incomplete reports and other documents only after delivered to City

25 Nondiscrimination During Contractor's performance of this Agreement, Contractor shall
not discrumnate on the grounds of race, religious creed, color, national origin, ancestry, age,
physical disability, mental disability, medical condition, including the medical condition of
Acquired Immune Deficiency Syndrome (AIDS) or any condition related thereto, marital status,
sex, or sexual orientation, in the selection and retention of employees and subcontractors and the
procurement of materials and equipment, except as provided in Section 12940 of the California
Government Code Further, Contractor agrees to conform to the requirements of the Americans
with Disabilities Act in the performance of this Agreement
26 Severability Each provision, term, condition, covenant and/or restriction, in whole and in
part, of this Agreement shall be considered severable In the event any provision, term,
condition, covenant and/or restriction, in whole and/or in part, of this Agreement is declared
invalid, unconstitutional, or void for any reason, such provision or part thereof shall be severed
from this Agreement and shall not affect any other provision, term, condition, covenant and/or
restriction of this Agreement, and the remainder of the Agreement shall continue in full force and
effect
27 Authority The individuals executing this Agreement and the instruments referenced herem
on behalf of Contractor each represent and warrant that they have the legal power, right and
actual authority to bind Contractor to the terms and conditions hereof and thereof
28 Entire Agreement This Agreement constitutes the final, complete, and exclusive statement
of the terms of the agreement between the parties pertaming to the subject matter of this
Agreement, and supersedes all prior and contemporaneous understandings or agreements of the
parties Neither party has been induced to enter into this Agreement by, nor is neither party
relying on, any representation or warranty outside those expressly set forth in this Agreement
29 Interpretation City and Contractor acknowledge and agree that this Agreement is the
product of mutual arms -length negotiations and accordingly, the rule of construction, which
provides that the ambiguities in a document shall be construed against the drafter of that
document, shall have no application to the interpretation and enforcement of this Agreement
291 Titles and captions are for convenience of reference only and do not define,
describe or limit the scope or the intent of the Agreement or any of its terms References
to section numbers are to sections in the Agreement unless expressly stated otherwise

area to take many forms (attachment 1) No matter what form (parkway and sidewalk,
sidewalk or no sidewalk) the easement takes, it is not legal to build anything in the area
without an encroachment permit Residents can put flatwork in the easement, such as
concrete, brick pavers, or grass and plants of limited height It is illegal to place trees,
raised brickwork, fences and mailboxes, stairs and light fixtures that may obstruct
drivers view or that may cause extensive harm or damage if hit, or impede pedestrian or
ADA access If structures are placed within the public right of way and are hit and or
are the cause of an incident, the property owner may be liable
Grand Terrace, like many other cities must deal with structures built by residents in the
public right of way These encroachments are often completed without a permit
Although the majority of the structures add value to homes, they may increase road
hazards, hinder utility companies from replacing or repairing service and may impede
pedestrian and ADA access Currently any request to build in the public right of way is
denied On May 24, 2016 the City Council reaffirmed the City's practice of denying
encroachments in the Public Right of Way
DISCUSSION
Although the City Council reaffirmed the City's existing process of denial of budding
certain improvements in the public right of way, the City still receives requests from
licensed contractors, as well as residents Applicants consistently point to existing
structures in the public right of way and ask why they can't legally be granted the right to
place their structures in the right of way Residents are frustrated because they are
trying to invest money in their property, which will beautify the neighborhood and the
City
In response to continuous inquiries, staff consulted with various professionals in the
building and public works arena and landed on the following alternative process to allow
both new and existing encroachments to be permitted legally There are many cities
that address these issues with a Revocable Encroachment Permit process and have put
together some guidelines to help address the issues as well as help the public to deal
with encroachments Staff researched various cities within the Country to see how cities
handle resident's encroachments in the right of way The City received a universal
response that stated that most agencies do not allow encroachments in the public right
of way However, some agencies are dealing with existing illegal structures within the
public right of way Those agencies created a Revocable Encroachment Permit
process (attachment II) The permit attempts to legalize existing structures in the public
right of way that meet the following criteria
• Are not located on a street that is scheduled for expansion in the near future by
the City or a utility company

This staff report supports Goal #2 "Maintain Public Safety" by investing in critical
improvements to infrastructure
BACKGROUND
On November 15, 2016, the City Council approved a 5-Year Capital Improvement
Program (CIP) that includes a Pavement Management System (PMS) The PMS
evaluates existing road conditions and assigns a Pavement Condition Index (PCI)
number to the streets The PCI is categorized numerically as follows 0-25 (Very
Poor/Failing), 26-50 (Poor), 51-70 (Fair/At Risk), 71-90 (Good), and 91-100 (Excellent)
The Pavement Management System provides methods to improve the road system with
a cost-effective balance of preventative maintenance and reconstruction/rehab
To maximize use of existing funding sources, the PMS includes slurry seal of streets
with a PCI of 40-70 to preserve the life of those streets an additional seven years, on
average Providing slurry seal for streets is less expensive and more cost-effective than
rehabing/reconstructing streets that have already failed For example, in Year 1 of the
Capital Improvement Plan, the City proposes to slurry seal 83 streets for $900,000
whereas only 8 streets will be able to undergo rehab/reconstruction for $900,000 in
Year 2 of the Capital Improvement Plan For Fiscal Year 2016-17, or Year 1 of the CIP,
Council approved slurry seal for streets For years 2-5 of the CIP, Council approved the
remaining funding sources to be used for reconstruction/rehab of streets that have
failed

Attached is a revised Scope of Work for Item G 9 The Urban Greening Program
encourages applicants to submit a one -page concept proposal, prior to formal grant
submittal National Resource Agency Staff will review the concept to determine if the
project is a good fit for the grant program
The revised Scope of Work includes a Phase 1 Concept Submittal This will tell us if the
project is a "go" or "no go" If it's a "no-go" then the application will not be submitted and
additional costs will not be incurred
