WHEREAS, organ, tissue, marrow and -blood -donation are life-giving acts recognized worldwide as expressions of
compassion to those in need, and `
WHEREAS, more -than 119',000 individuals nationwide, and more than 20,000 in California are currently on the
national organ transplant waiting list, and on, average, 22 people die each day while waiting due to the shortage of
donated organs, and
WHEREAS, the need for donated organs is especially urgent in Hispanic and African American communities, and
WHEREAS, more than 600,000 units of blood per year are needed to meet the need in California, and at any given
time, 6,000 patients are,in need of volunteer marrow donors, and

WHEREAS, imilhons of lives„each year are saved and healed by donors of organs, tissues, marrow and blood, and the
sport of giving and decision to donate are'not,restricted by age or medical condition, and
WHEREAS,' afsingle individual"s donation of the heart, lungs; fiver, kidneys, pancreas, and small intestine can save
up to eight lives, donation of tissue can save and heal the lives of up to 50 others, and a single blood donation can help
three people in need, and

WHEREAS, over twelve rnillton Californians have signed up with,the state -authorized Donate Life California Donor
Registry,to ensure their wishes to be organ, eye and tissue donors are honored, and -
WHEREAS, California residents can sign up with ,the Donate Life California Donor, Registry when applying for or
renewing their driver's licenses or ID cards at the California Department of Motor Vehicles,

This staff report supports Goal #1, "Ensuring Our Fiscal Viability", through the
continuous monitoring of expenditure budgets, allocations and operational costs
BACKGROUND
The check register, for the period ending March 31, 2017, has been prepared in
accordance with Government Code §37202 and is hereby submitted for the City
Council's approval
The check register lists all vendor payments for the preceding month, along with a brief
description of the type of goods or services purchased and the account code(s)
associated with each payment Check Register No 03312017 lists all payments made
to vendors and employee reimbursements during the month of March
The attached index to the Check Register is a guideline account list only and is not
intended to replace the comprehensive chart of accounts used by the City and CRA
Successor Agency Expenditure account number formats are XX-XXX-XXX [Fund -
Department -Account] Expenditures may be made from trust/agency accounts (Fund

continuous monitoring of expenditure budgets, allocations and operational costs
BACKGROUND
The Treasurer's Report of funds held as cash or invested by the City and the Successor
Agency to the Community Redevelopment Agency should be presented to the
governing body periodically
DISCUSSION
The purpose of the Treasurer's Report is to provide the governing body with the
following information
\ Current cash position of the City and Successor Agency
• Identify where all cash is held and, if invested, provide information regarding the
Book Value, PAR Value, Market Value, yield, and maturity
■ Book Value is the value of an asset as it is listed in the City's balance
sheet or statement of financial position The book value of the City's cash
is the amount listed in the City's bank statement as of September 30, 2016
and recorded in the City's financial system
■ PAR value or face value is the value listed on an invested stock or bond
Had the City invested the cash in stocks or bonds, the PAR value would
be the current value of the stocks or bonds
■ Market value of an investment is the amount that someone will pay for it
now, or the sale price The investment value calculates what the
investment will earn and likely will be worth in the future Had the City
invested the cash in stocks or bonds, the investment would have both a
PAR value and'a Market value
■ Yield describes the amount in cash (in percentage terms) in the form of
interest or dividends received from an investment in stocks or bonds

■ As shown in Table 2, the current cash position compared to a year ago on
December 31, 2015, shows a decrease of $1,751,459 This decrease was
due to the following reasons
➢ Full settlement of the City's loan obligation to Zions bank for
$1,040,090 in July 2017, and
➢ Purchase of property at 22273 Barton Road for $842,606
Cash Balance by Fund
The attached Treasurer's Report at December 31, 2016 shows that 79 6% of the total
cash and investments ($19,842,016) are Successor Agency funds, while the remaining
20 4% or $5,076,304 are City funds City funds include the General Fund, Child Care
Fund and other Special Revenue funds such as the Gas Tax Fund and the Measure "I"

2030 VISION STATEMENT
This staff report supports Goal #2 "Maintain Public Safety" by providing access to
facilities where residents can safely dispose of household hazardous waste
BACKGROUND
The California Public Resources Code requires cities and counties to prepare a
Household Hazardous Waste Element, which identifies a program for the safe
collection, recycling, treatment and disposal of hazardous wastes which are generated
by households in the city or county and which should be separated from the solid waste
stream The County of San Bernardino and each of the cities in the County have
developed Household Hazardous Waste Elements (HHWE), which identify a county-
wide cooperative program for the management of Household Hazardous Waste The
existing Household Hazardous Waste program operated by the San Bernardino County
Fire Protection District is consistent with the adopted HHWE
On August 9, 2012 the City of Grand Terrace entered into a five-year agreement with
the San Bernardino County Fire Protection District for Household Hazardous Waste
Collection The agreement is set to expire on June 30, 2017 County Fire is requesting
authorization of a new five-year agreement from the City that they will in turn submit for
approval to the San Bernardino County Board of Supervisors
DISCUSSION
The City desires for the protection, health and welfare of the public to provide for the
removal of hazardous waste from homes so that such materials pose no danger to the
City in the event of fire, and allow for the prevention of potential environmental
degradation and the conservation of resources through recycling The City does not
have a Household Hazardous Waste Collection facility within its borders Therefore, the
Fire District shall continue to provide a program based on a Central Processing Facility

it relates the regulation of accessory dwelling units Last year the State legislature
adopted Senate Bill 1069, which limits city authority to regulate accessory dwelling
units This action is intended to'address California's housing shortage The Bill replaces
city building, parking and use standards, and requires ministerial review of such
accessory uses
Presently, the City's Zoning Code permits secondary dwelling units subject to an
Administrative Site and Architectural Review and its findings, and the development
standards and findings contained in Chapter 18 69 (Secondary Dwelling Units) This
type of review is considered discretionary

SECTION 1 Findings The City Council finds that all the facts, findings, and
conclusions set forth above in this Ordinance are correct
SECTION 2 Amending Section 18 06 082 Section 18 06 082 ("Second -family units")
of Chapter 18 06 ("Definitions") of Title 18 ("Zoning") is hereby repealed and replaced
with the following
18 06 082 — Accessory dwelling unit
"Accessory dwelling unit" means an attached or detached residential dwelling unit which
provides complete independent living facilities for one or more persons It shall include
permanent provisions for living, sleeping, eating, cooking, and sanitation on the same
parcel that the single-family dwelling is situated "

The purpose of this Chapter is to establish regulations for the ministerial placement of
accessory dwelling units and to ensure such units are compatible with the surrounding
neighborhood and single-family units `
18 69 020 - Definition
"Accessory dwelling unit" means an attached or detached residential dwelling unit which
provides complete independent living facilities for one or more persons It shall include
permanent provisions for living, sleeping, eating, cooking, and sanitation on the same
parcel that the single-family dwelling is situated

18 69 030 - Permitted location

Accessory dwelling units are permitted by right in any single-family or multi -family w
residential zone district The Director shall approve such units ministerially if they meet a
all requirements of this code

requirements of Chapter 18 66 of this Title
I The accessory dwelling unit shall conform to the color, materials, architectural
style, and detailing of the main residence and shall meet all other applicable
building code, requirements and development standards of the zone for single-
family residential structures and accessory structures
J An accessory dwelling unit shall not be located on a parcel upon which there is
located more than one dwelling unit
K The accessory dwelling unit may be rented but shall not be sold, transferred or
assigned separately from the main single-family dwelling
L A maximum of one accessory dwelling unit shall be permitted on a lot
M If one of the two dwellings occupied by a party who is not the owner for any
period longer than 60 days, one of the two dwellings must be converted to
accessory living quarters or a guest house, and kitchen facilities shall be
removed from one of the units
N Prior to the issuance of a building permit for the accessory dwelling unit, a
covenant on the property shall be recorded with the County of San Bernardino
Recorder's Office, subject to City approval, to restrict the property with the
requirements of this Section This use restriction shall be binding upon any
successor in ownership of the property
18 69 060 - Off-street parking
In addition to the requirements of Chapter 18 60 for the main single-family residence,
one parking space shall be provided for the accessory dwelling unit or one per each
bedroom in the unit, whichever results in the greatest number of spaces being required
The required parking space for the accessory dwelling unit shall be enclosed and
located on the same lot as the second -family unit, and may be provided as tandem
parking on an existing driveway or in setback areas unless the Director finds that

This staff report supports the following City Council Goals
• Goal #1 - Ensure Our Fiscal Viability, through the continuous monitoring of
revenue receipts and expenditure disbursements against approved budget
appropriations, and
• Goal #4 — Develop and Implement Successful Partnerships through productive
collaboration with community groups, youth programs and senior organizations
BACKGROUND
On June 23, 2015, City Council approved the use of $25,000 from the City's General
Fund Reserve Balance, to establish a Community Benefits Fund (CBF), on August 11,
2015, City Council approved the CBF Program Guidelines, Application and authorized
the City Manager to implement the program In FY2015-16, City Council approved 10
applications totaling $14,546 00
City Council has approved the Community Benefits Fund to continue in FY2016-17 with
an adopted budget of $25,000 The Community Benefits Fund's purpose is to provide
funding for local youth programs, community events, community fee waivers, and be
used as an economic development tool for small business development in the City
In the 21016-17 year, City Council has approved three applications and authorized the
transfer of $5,000 from the Community Benefits Fund to fund the Holiday Tree Lighting
Ceremony in December-2016

The Grand Terrace Lions Club, as a part of Lions International provides help where help

organization with many numerous activities that include the provision of vision
screenings and recycled eye glasses, and scholarships to students to further their
education The Grand Terrace Lions Club is applying for community benefits funding on
behalf of Boy Scout Troop 40, for Asthawar Randhawa's Eagle Project

BACKGROUND
During the 2014-15 Fiscal Year, City staff applied for the City/County Payment Program
Grant from the Department of Resources Recycling and Recovery (Cal Recycle) The
City was awarded a grant of $5,000 to be used for the purchase of picnic tables and
benches made of recycled beverage containers These purchases will be made to
replace the picnic tables, and if budget allows, benches at Veterans Freedom Park The
grant has a two-year term
DISCUSSION
On March 1, 2017, the City Clerk issued a Notice Inviting Bids for Recycled Plastic
Picnic Tables and Benches The notice was posted to the City website, published by the
Grand ,Terrace City News and sent directly to a bidder's list By the time of the bid
opening on March 20, 2017, one (1) bid was submitted The company and their bid as
follows

R J Thomas Mfg Co , Inc was the lowest, responsive bidder All references provided
positive feedback The references included U S Department of the Interior National
Park Service of El Portal, CA, East Bay Municipal Utility District of Oakland, CA, and Big
Bear Lake of San Bernadino County
The scope of work included pricing of 13 picnic tables, including shipping cost, that
meet the following specifications
• Tables must be made of recycled beverage containers

by working collaboratively with private sector agencies to deliver services benefiting
our community
BACKGROUND
On May 24, 2011, the former Community Redevelopment Agency ("CRA") adopted
Resolution No CRA 2011-07 approving a Purchase and Sale Agreement and Grant
Deed and Affordability Covenant between the former CRA and Habitat for Humanity
San Bernardino Area, Inc ("Habitat") to sell a 0 50-acre parcel to Habitat and requiring
the construction of the two owner -occupied affordable homes before June 30, 2014
Affordability of the two homes is earmarked for very low and low income households
The affordability covenant runs with the land for a period of forty-five years, and any
change in ownership when the homes are completed will not release it If the homes are
not constructed by June 30, 2014, the land automatically reverts back to the
redevelopment agency, or as is the case, the Successor Agency
In 2013, Habitat requested an extension to the construction completion date Based on
the request, the Successor Agency adopted resolutions transferring the housing
interests to the Housing Agency and granting a construction extension for a period of
three years The Oversight Board ("OB") adopted resolutions on December 4, 2013
approving the Successor Agency's actions
On March 25, 2014, the Housing Successor adopted a resolution accepting an
Assignment and Assumption Agreement accepting the housing interests and granting a

Attached for the Council's consideration is Addendum No 2 extending the construction
completion date to June 30, 2018

This letter is a follow up to my letter dated February 16, 2017 where we requested the City of Grand
Terrace to waive the Development Impact Fees on this project (totaling $31,453 84) We would like to
retract that request and ask for a deferral of the Development Impact Fees to homeowner occupancy
We also kindly ask for a Construction Extension until June 2018
Our desire is to work with the City of Grand Terrace to get this project started, and completed, as soon
as possible Habitat for Humanity San Bernardino will pay for the Plan Check and Building Permit Fees
totaling $4,741 19 We have also submitted a deposit check of $6,000 00 to cover the initial Plan Check
and TPM Fees We understand that the fees due to the Riverside Highland Water Company and the City
of Colton Sewer fees are also our responsibility and we will pay those We do not have exact figures for
those at this time HFHSB has also already paid fees of $6,213 00 covering Admin Site & Architectural
Review, Tent Parcel Map, Environmental Exemption, Major Subdivision Deposit, and Minor

This staff report supports Goal #3, "Promote Economic Development"
BACKGROUND
On December 13, 2016, the City Council and Lewis Land Developers, LLC
("Developer") entered into a Disposition and Development Agreement ("DDA") providing
for Developer's purchase and development of approximately 53 acres of real property
previously owned by the Redevelopment Agency("Properties") The DDA establishes
the terms of the purchase and tasks in which Developer must undertake The DDA
identifies purchase price, terms of escrow, performance timelines, and an option for the
City to repurchase the land should Developer fail to develop the Properties
In accordance with the DDA, Developer has a 60-day feasibility period set to expire on
April 14, 2017 The purpose of the feasibility period is to allow the Developer time to
determine whether development of the Properties is feasible If they determine it is
feasible, then they are to deposit the balance of the purchase price no later than the
close of escrow scheduled 30 days thereafter If Developer determines it is not feasible,
the DDA will terminate and the Properties will be returned to City
Developer's feasibility determination is dependent on Developer and City entering into a
Memorandum of Understanding ("MOU") identifying, anticipated mitigation measures
and allocating Developer's fair share of responsibility for the various infrastructure
improvements that are anticipated to be necessary under the Specific Plan to be
submitted Without the guidelines provided by the MOU, Developer may not otherwise
proceed with the purchase of the Properties
DISCUSSION
The MOU does not supersede or modify the provisions of the DDA As identified in the
DDA, Developer is required to use commercially reasonable efforts to obtain all land
use entitlements required for the development of the Properties, including a Specific

measures and fair share allocations for the Project The points include
Streets/Circulation, Storm Drainage, Parks & Open Space, Utilities and Other (CEQA
and use of railroad property to be acquired)
It is important to note, that no improvements, infrastructure, or mitigation measures are
being imposed by this MOU Such impositions will be part of the Specific Plan
However, Developer must determine whether development of the Properties is feasible
and this MOU will provide Developer assurance of such feasibility Nothing in this MOU
reduces or eliminates the City's ability to approve, reject, or condition the Project at the
proper time
FISCAL IMPACT
The City will, upon close of escrow, receive 20% of the sales price ($856,000) of the
53 16 acres, which is approximately $171,000 And receive an additional $1,712 00 in
property taxes annually until the property is developed Once the property is developed,

F Developer's approval of its feasibility review for its acquisition of the City Property under
the DDA and its decision to proceed with the acquisition of the Railroad Property are
dependent on Developer and City entering into the understandings and agreements set
forth in this MOU for the purposes of identifying certain anticipated Mitigation Measures
and allocating fair share responsibility for the various infrastructure improvements that
are anticipated to be necessary for the development of the Project and the Other
Properties Without the certainty provided by this MOU, Developer would not otherwise
proceed with the purchase of the City Property or the Railroad Property
G The Parties understand that full environmental review under CEQA and/or other state,
federal, and local environmental laws must be completed as part of the City's evaluation
of whether to approve the Project The Parties further understand that CEQA review
must be completed early enough in the planning process that environmental
considerations can properly influence project design, but late enough that meaningful
information is available for environmental assessment (State CEQA Guidelines, §
15004 ) Here, the Project description is still being developed and does not yet include
sufficient information to enable meaningful environmental review, such that CEQA review
of the broad, potential terms included in this MOU would be premature Because of this,
and as set forth in greater detail below, the Parties understand and agree that nothing
set forth herein commits or otherwise requires the City or any other government agency
to approve, in whole or in part, the Project, and that this MOU does not govern federal,
state or other local agency approvals required for the Project
H Nonetheless, as a gesture of good faith and to memorialize the Parties' discussions and
understandings to date, the Parties are willing to enter into this MOU which will
memorialize their understanding regarding the reasonable allocation of responsibility for
the Mitigation Measures that are anticipated to be necessary for the development of the
Project in relation to the Other Properties
OPERATIVE PROVISIONS
NOW, THEREFORE, in consideration of the agreements set forth herein, and other
valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the
Parties agree as follows
Incorporation of Recitals The recitals above are true and correct and are hereby
incorporated herein among the operative provisions of this MOU
2 Identity of Parties The legal identities of the parties to this MOU and their addresses
are as follows
a City is the City of Grand Terrace, a public body, corporate and politic The
principal office of the City for purposes of this MOU is 22795 Barton Road, Grand

c Extension by Mutual Agreement of the Parties The Parties may agree to extend
the Termination Date beyond the seven (7) year base term by written agreement
signed by Developer and City The City Manager, on behalf of the City, is hereby
authorized to extend the Termination Date for up to four six-month periods The
City Manager shall provide notice of the extension to the City Council
4 No Approval or Commitment to Approval of Project Notwithstanding any other
provision of this MOU, nothing herein shall commit or otherwise require the City, or be
interpreted as committing or requiring the City, to approve the Project, or any portions
thereof, including the Project Entitlements Further, the Parties acknowledge and agree
that the City retains full discretion with respect to the Project Entitlements, and may deny p

5 Fair Share Allocation of Infrastructure Requirements and Mitigation Measures
After due analysis and consideration, City and Developer agree that the Mitigation
Measures, the fair share allocations and the understandings set forth on Exhibit "B"
attached hereto for the Project are roughly proportionate to the Project's impacts and do
not exceed its fair share in relation to the Other Properties that either are benefiting from
or would be expected to benefit from any such improvements
6 Development Agreement The Developer has proposed to negotiate a statutory
Development Agreement pursuant to Government Code section 65864 with the City as
one of the Project Entitlements to be considered by the City following the completion of
the CEQA and land use review process described above The Development Agreement
shall be one of the Project Entitlements If a Development Agreement is approved, the
Development Agreement is anticipated to be a separate document from the DDA
discussed above The Parties anticipate that any such Development Agreement, if such
a Development Agreement is approved by the City and entered into between the Parties,
would include a vesting term for the Project Entitlements, all subsequent entitlements for
the Project, and all applicable land use regulations of not less than fifteen (15) years
7 Defaults A Party shall be in default of this Agreement if it (i) fads to fulfill its obligations u.
when due, which failure is not caused by the other Party, or otherwise violates any
covenant, restriction or obligation contained in this Agreement, (ii) does not negotiate the
DA to good faith and upon the terms stated in this Agreement, or (iii) does not
reasonably cooperate with the other in fulfilling the other's obligations under this
Agreement The defaulting Party shall have thirty (30) days to cure the default Should a
the defaulting Party fad to cure the default within that thirty (30) day period, the non -
defaulting Party may, as its sole remedy at law or in equity, terminate this Agreement by
written notice to the defaulting Party This 30-day period in no way, manner or form
extends, continues, tolls or modifies the Outside Date under this Agreement
Notwithstanding the terms of this section, if City defaults in its obligations under this
Agreement, Developer may seek injunctive relief or specific performance to enforce its
rights under this Agreement After termination of this Agreement for default of Developer,
subject to cure rights, Developer shall have no rights under this Agreement

15 Severability The provisions of this MOU are intended by the Parties to be severable
and divisible and the invalidity or unenforceabdity of a provision or term herein shall not
invalidate or render unenforceable the remainder of this MOU or any part thereof
16 Signed in Counterparts This MOU may be executed simultaneously or in counterparts,
each of which shall be deemed an original, but all of which together shall constitute one
and the same MOU
17 Indemnification Developer shall, and hereby does, indemnify, defend, protect and hold
harmless City, and each of its managers, officers, directors, employees, agents,
affiliates, representatives, attorneys, successors, and assigns (collectively with City, the
"City Parties"), from and against all third party losses, liabilities, claims, demands, costs,
damages (including liens, fines, or penalties), obligations, causes of action,
disbursements, or expenses of any kind or nature whatsoever, including actual
attorneys' fees, court costs, costs of arbitration, and litigation expenses (collectively,
"Claims") resulting from any governmental approval or determination made by City in
relation to this Agreement The foregoing indemnity and defense obligations do not apply
to any Claims to the extent arising from or related to the negligent acts or willful
misconduct of City or the breach or default of the City's obligations under this
Agreement

I STREETS/CIRCULATION
1 Developer shall be responsible for the full width street improvements (pavement, curb,
gutter, sidewalk, median, bicycle path, landscaping and lighting) for the planned 88' wide
right-of-way arterial as shown on Exhibit "B-1" attached hereto, Taylor Street and
Commerce Way, to the extent that Commerce Way meets Taylor Street at or south of
the northerly property line of APN 1167-151-22, from Main St to the northern property 0
line of APN 1167-151-22 ("Taylor/Commerce"), as more particularly depicted on Map
#3 attached hereto 3

responsible for all costs and expenses associated with Taylor/Commerce north of the

Project's connectivity to backbone services in the area shall be required No land
acquisition shall be required beyond the Protect Property
2 Developer will underground electric lines on Taylor Street between southern property

V OTHER
Developer, at its sole expense, will manage and process a Specific Plan and a CEQA
application for the Protect Property and the Other Properties whose owners elect to be
included so long as such Other Property owners cooperate in a timely manner and their
inclusion does not materially increase the expense of or materially delay the process
CEQA technical studies will be conducted at the program level If and when a protect is
submitted to the City for approval by any such property owner, such property owner, not
Developer, shall be responsible for conducting further protect level studies The expense
of such protect level studies and entitlement applications, including protect level CEQA
and additional studies for their respective protects due to a change in assumptions or not
being addressed by prior studies, would be the responsibility of the property owner and
shall not be the responsibility of Developer, unless Developer is the applicant
Developer intends to acquire the Railroad Property, which extends from Main Street on
south to 1-215 (CALTRANS) on the north The area within the Railroad Property north of
APN 1167-151-22 as shown on Map #2 is intended to be used in some commercial
application, potentially including electronic signage or a cell tower City is amenable to
