RESOLUTION NO. 90-21
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, APPROVING
SP-90-02, TTM-0-02 (TRACT 14944) AND E-90-03
(NEGATIVE DECLARATION)
WHEREAS, the Applicant, Mike Raven has applied for approval of SP-90-02 and
TTM-90-02 (Exhibit A) to be located at 22872 Main Street; and
WHEREAS, a Negative Declaration has been prepared for this project in accordance
with the California Environmental Quality Act (Exhibit B); and
WHEREAS, the Planning Commission of the City of Grand Terrace, on July 24, 1990
-- recommended approval of this application and its associated negative declaration subject
to various conditions of approval; and
WHEREAS, a properly noticed public hearing was held by the City Council on
August 09, 1990, regarding this application; and
WHEREAS, said Negative Declaration was reviewed by the City Council at the time
of said Public Hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Grand
Terrace, California that the following findings have been made:
1. That the site is physically suitable for the proposed type of
development. The project has been designed to develop only that
portion of the subject site that is suitable for development and is,
preserving a large percentage of the site for permanent open space.
2. That the site is physically suitable for the proposed density of
development. The project has been designed to produce a maximum
of 21 units on an area of land zoned for a potential of 67 units. The
project has been designed to develop only that portion of the property
suitable for the number of units and is comparable to surrounding
,' properties and zoning districts with regards to density and lot
dimensions.
3. That the design of the subdivision and the proposed improvements are
not likely to cause substantial environmental damage or substantially
and avoidably injure fish or wildlife or their habitat. The project is
herein conditioned to mitigate any and all environmental impacts as
identified in the project's environmental review.
4. That the design of the subdivision or type of proposed improvements
are not likely to cause serious health problems or cause threat to life
and property from a wildland conflagration. The project has been
conditioned herein by the California Department of Forestry.
5. That the proposed subdivision and specific plan together with
their provisions for its design and improvements are consistent
with the General Plan.
6. That the proposed subdivision is within the goals of the City's Housing
Element with regards to housing availability.
NOW,THEREFORE,BE IT FURTHER RESOLVED that the Negative Declaration
for SP-90-02 (Exhibit B, E-90-03) is hereby approved; and
BE IT FURTHER RESOLVED that SP-90-02, including TTM-90-02 is hereby
approved by the City Council of the City of Grand Terrace, California subject to the
following conditions:
1. The applicant shall meet all of the requirements recommended by the City
Engineer in his memorandums dated May 7, 1990 and June 5, 1990 attached
as Exhibit C.
2. The applicant shall meet all of the requirements recommended by the
Forestry and Fire Warden Department in their memorandums dated May 15,
1990 and June 18, 1990 attached as Exhibit D.
3. The applicant shall meet all of the requirements recommended by the
Riverside Highland Water District in their memorandum dated May 23, 1990
attached as Exhibit E.
4. The applicant shall meet all of the recommendations included in the Specific
Plan's Soils Report dated April 10, 1990.
5. All portions of the subject site identified in the Specific Plan to remain in its
natural state (no grading) shall be restricted to open space and natural
vegetation, all grading, development,use and/or construction of any type shall
be prohibited.
6. Each individual lot shall be subject to independent Site and Architectural
Review per the Grand Terrace Municipal Code prior to the issuance of
building permits.
7. The subject property shall be annexed to the City's existing Lighting and
Landscaping District.
8: The proposed project shall be constructed in accordance with the Specific
Plan as approved by the City Council on August 09, 1990 attached as Exhibit
A.
9. The open space area (Lot 22) shall be offered for dedication to the City for
purpose of inclusion in the City's Lighting and Landscaping District.
10. If the area identified in Condition #9 is not included in the Lighting and
Landscaping District then a Home Owner's Association shall be established
and shall at a minimum be responsible for the ownership and maintenance of
the open space lot (Lot 22) in accordance with the property maintenance
standards of the City of Grand Terrace.
11. Covenants, Conditions and Restrictions shall be established, reviewed and
approved by the Planning Director and City Attorney prior to recordation of
the Tract Map. The Covenants, Conditions and Restrictions shall include a
copy of the approved Specific Plan and all Conditions of Approval and shall
be recorded at the County Recorder's Office.
12. A detailed landscaping and irrigation plan for all man-made slopes shall be
submitted to the Planning Department for approval.
13. There shall be no curb cut provided from Court A for access to Lot 22. The
vehicular access to Lot 22 shall be restricted by natural means such as rock
formations subject to approval by the Planning Department.
14. A scaled Grading Plan shall be incorporated with the landscaping and
irrigation plan and if feasible, crib wall design shall be utilized, if not feasible,
other appropriate wall treatment may be used. The grading/landscaping/wall
treatments shall be reviewed by the City Engineer and recommendations
brought back to the Planning Commission for approval.
PASSED AND ADOPTED by the City Council of the City of Grand Terrace,
California at a regular meeting held on the 09th day of August, 1990, by the following vote:
