BACKGROUND:
The Check Register for March 12, 2013 is presented in accordance with Government
Code §37202 and is hereby submitted for the City Council’s approval.
The attached index to the Check Register is a guideline account list only and is not
intended to replace the comprehensive chart of accounts used by the City and CRA
Successor Agency. Expenditure account number formats are XX-XXX-XXX [Fund-
Department-Account]. Expenditures may be made from trust/agency accounts (Fund
23-XXX-) or temporary clearing accounts which do not have a budgetary impact.
A total of $955,171.86 in accounts payable checks was issued during the period for
services, reimbursements, supplies and contracts and are detailed in the attached

A.Historical and Cultural Activities Committee Update, Priorities and Plans for 2013
Pauline Grant, Chairman Historical and Cultural Activities Committee
Gave an overview of the events that the Historical and Cultural Activities hold throughout the year. She
announced that the Art Show will be held on May 5, 2013, the Country Fair will be held on November 2,
2013 and the City Anniversary Pot-Luck Dinner celebration will be held in December. They tend to
matters concerning the history of Grand Terrace collecting photos, clippings from newspapers and
magazines. Interviews have also been held of many old-time residents regarding the history of Grand
Terrace.
Council requested the following of the committee with regard to the City Anniversary Pot-Luck Dinner:
To be held on a different evening other than a Council Meeting night.
Update the VIP List and those invited to attend the event.
Make sure the entire public is invited.
Change the location to be able to accommodate a larger crowd such as the Lion's Community Center.

4.PUBLIC COMMENT
Gregory Young, Field Representative for Congressman Gary Miller
Indicated that he will be serving as the Congressman's Liaison with Grand Terrace. They are excited with
the new districts. Their office is up and running. They are excited to represent Grand Terrace and to
serve the Council and the residents. Their local address is 8300 Utica Avenue, Suite 105, Rancho
Cucamonga. Their phone number is 909 980-1492. They plan on having mobile offices as well. They
are available for any services that they can assist with.
Patricia Farley
Stated that it has been hard to focus on Blue Mountain with all of the things that have been going on in
Grand Terrace. She is interested in Blue Mountain and would like more information on the purchasing of
wilderness land to preserve Blue Mountain for people to hike on and ride their horses on. She feels that it
wouldn't be hard to raise $40,000.00. She questioned what the plan is and is there a cost to maintain it.
She would like to see a presentation so that the residents can see the importance of the project and will
be willing to donate funds.

Indicated that the City will not be responsible for maintaining the park.

Requested that the Friends of Blue Mountain put together a presentation.

Once again requested that the Grand Terrace Soccer Club be allowed to use the community meeting
room for their Board Meetings. They meet on the third Wednesday of the month. They would like a
permanent home.
The Council requested that this be agendized for discussion at a future Council Meeting.
5.COUNCIL REPORTS
Council Member Jackie Mitchell
Reported that she attended the League Conference and that it was a great experience. She is filled with
mixed emotions this week with the ground breaking of the new Grand Terrace Fitness Park and the
closing of Mr. T.V, Video. Her heart goes out to all of the Law Enforcement families and is praying for all
of them. She encouraged everyone to support the Girl Scouts by purchasing cookies.
Council Member Sylvia Robles
She extended her condolences to the families of the men and woman who protect our families and
thanked those who protect us. She feels that we are a global community and all family.
Council Member McNaboe
Encouraged the community to attend the following events:
Ground Breaking - Grand Terrace Fitness Park
Newport Bridge community meeting
Budget Workshop
She feels that it is important to attract new businesses. She indicated that the Spring Mountain Ranch
will be developed at some point. There is a new owner and they are serious about building the new
development. This will mean an opportunity for more people to travel through Grand Terrace which
would be good for local businesses and hopefully bringing new businesses to town. She attended
Assembly Member Cheryl Brown's open house. She has a beautiful office and her staff seems tentative
and ready to help. The Assembly Member is working on Grand Terrace's issues with the Department of
Finance. She questioned all of the marks on Barton Road. Her heart goes out to the victims of the law
enforcement officers that were killed in the line of duty and requested that the meeting be adjourned in
their honor. She wished everyone a Happy Valentine's Day.
Community Development Director Richard Shields
Responded that the marks are for the Newport Bridge Project and those marks are indicating utilities.
Mayor Pro Tem Bernardo Sandoval
Reported that the Raves have been moved from the National Orange Show to Glen Helen. This move
was a result of a lot of pressure that was applied by different agencies. City Staff pushed hard and made
things happen. The interest of Grand Terrace is not just protected within our boundaries. If we need to
go outside the boundaries to protect our City we will to do the right thing. Assembly Member Cheryl
Brown is aware of our issues and she is working on them. There is a reduction in funding for skilled
nursing facilities, this will have an impact on seniors having a place to go. He is saddened over Mr. TV
Video going out of business. His heart also goes out to the fallen officers. He wished everyone a Happy
Valentines Day.

From 4:30 to 6:30 p.m. in the community meeting room a public meeting will be held to outline the I-215

arrival times, this and other bus stop arrival time information will be available on the City's website. CERT
is getting ready to do training at the Loma Linda Fire Department in March. CERT will be key in keeping
the City together in the event of an emergency. Anyone interested should contact a member of CERT or
the City. The training is free. His heart goes out to the fallen officers. He is proud of what the Sheriff's
Department has done and the meeting will be adjourned in memory of the fallen officers.

Gave the background on how the fireworks stand came to be and how it affects the Soccer League and
Little League. The profit pays for the light bill. He does not support an additional stand.
Ken Boardman
Indicated that he participated in the process of getting the fireworks stand in Grand Terrace. He is
requesting that the Council support an additional fireworks stand for the Grand Terrace High School
Football Booster. He stated that funds raised will help provide food and beverages for the players during
the season.

The Council met in closed session to hold a conference with legal counsel regarding significant exposure
to litigation pursuant to Government Code 54956.9 (b) - one potential case. It was unanimously agreed to
enter into an agreement with Andrew Turner from Lagerlof, Senecal, Gosney & Kruse, LLP., to provide
legal services relative to the exposure to litigation.
ADJOURN
The Meeting was adjourned at 8:20 p.m. in honor of the fallen officers in the Inland Empire and those who
go above and beyond to protect the communities.

3.GENERAL FUND BUDGET PREVIEW - FY 2013-2014
Council Priorities
A Special Meeting of the City Council was held for a General Fund Budget Preview for Fiscal Year 2013-
2014 and for Council to discuss their priorities. The following is a list that Council indicated are their core
priorities:
Fiscal Sustainability
Public Safety
Economic Development
From the core priorities discussion other priorities branched out, however, without fiscal sustainability
none of them would be possible. Council had discussion regarding a tax measure being brought forward
to the voters as a fiscal enhancement. As a result of the discussion Council directed staff to agendize the
consideration of establishing a Budget Advisory Committee to assist the Council with evaluating the
proposed budget alternatives for Fiscal Year 2013-14. It was also requested that staff look into the
possibility of having a Volunteer Coordinator Director that can be in charge of the volunteers that would
assist staff with day to day functions.

Indicated that he would be interested in serving on the Ad-Hoc Committee. He feels that it is important to
get the traffic counts up in town so that we are able to attract business.
Sally McGuire
Reminded staff that the Chamber of Commerce Blue Mountain Outlook can be used for advertising
committee vacancies and other City related information. She indicated that she would be interested in
serving on the Ad-Hoc Committee. She also indicated that Ryan Stephens is very interested in Economic
Development and that he too would be interested in the Ad-Hoc Committee.

A.Community Emergency Response Team (C.E.R.T.) Update
Tom Roberts, Commander
Reported that the CERT Executive Board has made small strides and he is unsure that there is a need for
a CERT Program. He stated that the CERT Team can continue to be what it is and what it was designed
to be, a grassroots group of community volunteers who have been trained to do the best good for the
most people in disastrous situations. He gave the suggestion that CERT can be re-structured to fall
under the Emergency Operations Committee. He indicated that not all of the members of CERT agree
with him and that they would like to continue on as they have.
City Manager Betsy Adams will meet with the CERT Executive Board with regard to what Mr. Roberts has
reported.

4.PUBLIC COMMENT
Jim Robinson, Caltrans
Gave an update on the Bi-County High Occupancy Vehicle (HOV) Gap Closure Project.
Melissa Bush
Reported that several children from Grand Terrace will be performing in Peter Pan from the Riverside
Theatre Center. The performance will be held at Ramona High School. It is her hope that one day Grand
Terrace will have a community theatre. The Wizard of Oz will be an upcoming performance that will be
held at Colton High School.
Bobbie Forbes
Thanked the Council for the Ground Breaking Ceremony for the new Grand Terrace Fitness Park. The
contractor is being very considerate. She is hopeful that the use of proper signage will help control traffic.
She reported that there is not a lot of real estate inventory in Grand Terrace and housing prices are
stabilized, which is good news for Grand Terrace.
Jeffrey McConnell
Indicated that he was chosen by SANBAG to participate in a Citizen's Advisory Group. They are tasked
with receiving input and to solicit information and feed back on the three options a HOV, express lanes or
nothing. There will be an article in the BMO and they will also come out and make presentations to the
group. He indicated that he heard that the Newport Bridge will be coming down some time in May.
5.COUNCIL REPORTS
Council Member Jackie Mitchell
Thanked those who attended the Budget Workshop. She reported that there are vacancies on the Crime
Prevention Committee and the CERT Executive Committee. Applications are available in the City Clerk's
Department. She reminded everyone that the hike on Blue Mountain will be held on March 10, 2013 at
9:00 a.m. She thanked all of the residents that participated in the Ground Breaking Ceremony at the new
Grand Terrace Fitness Park. She thanked the Chamber of Commerce for placing the volunteer
opportunities in the BMO. She also requested that the CERT issue be agendized at a future Council
Meeting.

Stated that it was an honor to represent Grand Terrace at the memorial service for the fallen officer
Jeremiah MacKay. It was a lovely and somber event. She attended the Ground Breaking Ceremony for
the Grand Terrace Fitness Park which was a nice event and it is very exciting to see the progress of the
park.
Council Member Darcy McNaboe
Also attended the Ground Breaking Ceremony for the Grand Terrace Fitness Park. It was a wonderful
ground breaking. This is different for Grand Terrace and special for the residents in the area. The
residents are excited about the project. The developer that the land was purchased from has given
money to go towards the maintenance of the property. The Grand Terrace Veteran's would like to donate
a POW flag to be flown at City Hall and they would like to hold a ceremony on June 11, 2013. At the
Special Meeting that was held discussions were had on revenue enhancements and or a measure. She
indicated that her priorities are fiscal sustainability, public safety, road maintenance, economic
development and access to parks. She is looking forward to the preview of the budget and the
alternatives that will be given with the projections of the next five years so that they can make decisions
moving forward.
Mayor Pro Tem Bernardo Sandoval
Requested that the Council meeting be closed in honor of Jeremiah Mackay. The memorial service that
was held for him was very moving. The sacrifice that his family has made will not be forgotten. He
thanked Bobbie Forbes and the other residents for all of their efforts with the new park. He stated that the
community will have to come together to face the challenges that Grand Terrace faces financially to
preserve the City. He challenged the residents to come together and take an interest.

Attended the memorial service of Jeremiah MacKay, which was very moving. He encouraged everyone
to participate in the fundraisers when possible for this family. He reported that the Raves have moved to
Glen Helen, with the help of many individuals, so there may be hope that Grand Terrace will no longer
have to deal with the noise.

A.County of San Bernardino Board Representative Seat Appointment to the Oversight Board of the Grand
Terrace Successor Agency
Recommend that the County of San Bernardino Board of Supervisor's appoint Bobbie Forbes to fill the
Board Representative seat on the Oversight Board of the Grand Terrace Successor Agency of the former
Community Redevelopment Agency.

RECOMMENDATION:Approve the first reading, introduce and read by title only,
Ordinance No. 2013-___, setting forth amendments to Title
8, Chapter 8.04 and 8.108, of the Grand Terrace Municipal
Code and direct City Staff to schedule a second reading and
adoption.
BACKGROUND:
Over the past year, Grand Terrace citizens have been disturbed by loud booming
noises that are generated from a nearby neighboring community that allows "Raves"
also known as concerts. The Rave music produces loud booming sounds and
vibrations that are heard and felt throughout portions of the City. City law enforcement
personal have attempted to discourage the loud music with the Rave promoters and the
neighboring community officials with little resolve.
Numerous laws such as the California Constitution, Health and Safety Code, Civil Code,
and the Government Code allow cities to adopt laws to enforce noise regulations. The
City has a duty to protect its citizens from these booming noises that produce vibrations
through adoption of laws that define and prohibit noise and provides exceptions to
certain noises in and out of the City.
DISCUSSION:
Our City Attorney has suggested amendments to Chapter 8.04.020, (A), "Declaration of
Nuisance" to include a new Subsection (26), to help define a public nuisance to read as
follows; "When excessive noise, as defined in Section 8.108.020 and 8.108.050 occurs
or is allowed to occur on any property within the City or outside the City".
The Grand Terrace Municipal Code, Title 8, Chapter 8.108, Section 8.108.020,
8.108.030 and 8.108.040 is also amended to make it unlawful for any person to make
continued noise (with exceptions) or cause loud noises to disturb citizens within the City
and outside the City. The amended code allows the law enforcement officers, code
enforcement officers or other officers designated by the City Manager to access the
noise or sounds. The amended code allows the detection of noise to be determined by
means of the official’s normal hearing faculties, and not artificially enhanced. The
amended sections of the Municipal Code will assist City officials in the court of law in
efforts to abate continued noise that is produced from neighboring jurisdictions.
Staff is recommending that the City Council approve the first reading of the proposed

FISCAL IMPACT:
There is minimal fiscal impact to bring forth the revisions to the Municipal Code section
and publish the new code sections for its reading in the local newspaper.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, CALIFORNIA, AMENDING SUBSECTION (A) OF SECTION
8.04.020 (DECLARATION OF NUISANCE),WITH THE ADDITION OF A
SUBPART 26;REPEALING AND REPLACING SECTIONS 8.108.020
(UNLAWFUL NOISE), 8.108.030 (EXEMPTIONS), AND 18.108.040
(SPECIAL ACTIVITIES)OF CHAPTER 8.108 (NOISE)OF TITLE 8
(HEALTH AND SAFETY) OF THE GRAND TERRACE MUNICIPAL
CODE PERTAINING TO UNLAWFUL NOISE AND PUBLIC
NUISANCES.
WHEREAS,Article XI, Section 7 of the California Constitution permits cities to make
and enforce within its limits all local, police, sanitary and other ordinances and regulations not in
conflict with general laws; and
WHEREAS, the Legislature,in Health and Safety Code Section 46000, has classified
excessive noise as a serious hazard to the public health and welfare; and
WHEREAS,the Legislature,in Health and Safety Code Section 46000, has declared
that all Californians are entitled to a peaceful and quiet environment without the intrusion of
noise which may be hazardous to their health or welfare; and
WHEREAS,cities are empowered to declare what constitutes a nuisance under
Government Code Section 38771; and
WHEREAS,cities are empowered to abate public nuisances under Civil Code Section
3494; and
WHEREAS, all legal prerequisites prior to the adoption of this ordinance have
occurred.
NOW THEREFORE, THE CITY COUNCIL OF THE GRAND TERRACE DOES
ORDAIN AS FOLLOWS:
SECTION 1: The City Council finds that all the facts, findings, and conclusions set
forth above in this Ordinance are true and correct.
SECTION 2:The City Council hereby finds that the proposed Code amendment will
not have a direct and significant impact on the environment, and thus is exempt under
Section 15061(b)(3), General Rule. The general rule states that the California Environmental
Quality Act (CEQA) applies only to projects that have the potential for causing a significant
effect on the environment.
SECTION 3: Subsection (A) of Section 8.04.020 (Declaration of Nuisance)of Chapter
8.04 (Nuisance Abatement) of Title 8 (Health and Safety) of the Grand Terrace Municipal
Code is hereby amended with the addition of a Subpart 26 as follows:

26. When excessive noise, as defined in Sections 8.108.020 and 8.108.050, occurs
or is allowed to occur on any property within the City or outside the City.
SECTION 4:Section 8.108.020 (Unlawful Noises) of Chapter 8.108 (Noise) of Title 8
(Health and Safety)of the Grand Terrace Municipal Code is hereby repealed and replaced
with the following:
Section 8.108.020 –Loud, Annoying, Excessive and Unnecessary Noises
Prohibited.
A.It shall be unlawful for any person to willfully make or continue, or cause to be
made or continued, any excessive or unreasonable noise that disturbs the
peace or quiet of any property within the City or which causes discomfort or
annoyance to any reasonable person of normal sensitivities residing in the
area.
B.Irrespective of whether the noise originates within the City or outside the City,
the standard that may be considered in determining whether excessive noise
exists may include, but not be limited to, the following:
1. Whether the noise can be heard over one hundred (100) feet from the
property line where the source of the noise is located;
2. The level of the noise;
3. Whether the nature of the noise is usual or unusual;
4.Whether the origin of the noise of natural or unnatural;
5. The level and intensity of the background noise, if any;
6. The proximity of the noise to residential sleeping facilities;
7. The nature and zoning of the area within which the noise emanates;
8.The density of the inhabitation of the area within which the noise
emanates or is heard in;
9.The time of the day and night the noise occurs;
10. The duration of the noise, including whether it is of a temporary or short-
term nature;
11.Whether the noise is recurrent, intermittent, or constant;
12.Whether the noise is produced by a commercial or noncommercial
activity; and
13.Whether the noise produces vibrations that are felt or heard.

C.Any law enforcement officer, code enforcement officer, or other employee or
official designated by the City Manager who hears excessive noise or sound as
defined in this Chapter that is plainly audible, in violation of this Chapter, may
enforce this chapter and shall assess the noise or sound according to the
following standards:
1.The primary means of detection shall be by means of the official’s
normal hearing faculties, not artificially enhanced.
2. The official shall first attempt to have a direct line of sight and hearing to
the vehicle or real property from which the sound or noise emanates so
that the official can readily identify the offending source of the sound or
noise and the distance involved. If the official is unable to have a direct
line of sight and hearing to the vehicle or real property from which the
sound or noise emanates, then the official shall confirm the source of the
sound or noise by approaching the suspected vehicle or real property
until the official is able to obtain a direct line of sight and hearing, and
confirm the source of the sound or noise that was heard at the place of
the original assessment of the sound or noise.
3.The official need not be required to identify words, song titles, artists, or
lyrics in order to establish a violation.
SECTION 5: Section 8.108.030 (Exemptions) of Chapter 8.108 (Noise) of Title 8
(Health and Safety) of the Grand Terrace Municipal Code is hereby repealed and replaced
with the following:
Section 8.108.030 Exemptions.
There is exempted from the provisions of this chapter the use of horns, sirens or other
signaling or warning devises by persons vested with legal authority to use the same
and in pursuit of their lawful duties, such as on ambulances, fire, police and other
governmental or official vehicles.
SECTION 6:Section 8.108.040 (Special Activities) of Chapter 8.108 (Noise) of Title 8
(Health and Safety) of the Grand Terrace Municipal Code is hereby repealed and replaced
with the following:
Section 8.108.040 Special activities.
In addition to the exemptions provided for in Section 8.108.030, the following activities
shall be exempted from the provisions of this chapter:
A.City or school approved activities conducted on public parks,public
playgrounds and public or private school grounds including but not limited to
athletic and school entertainment events between the hours of seven a.m. and
eleven p.m.

B.Noises produced by mechanical devices, apparatus or equipment used, related
to, or connected with emergency machinery, vehicles, work or warning alarm or
bell, provided the sounding of any bell or alarm on any building or motor vehicle
shall terminate its operation within thirty minutes in any hour of its being
activated.
C.Noises sources associated with or vibration created by construction, repair or
remodelling or grading of any real property or during authorized seismic
surveys, provided said activities do not take place between the hours of eight
p.m, and seven a.m. on weekdays, including Saturday, or at any time on
Sunday or a national holiday.
D.All devices, apparatus or equipment associated with agricultural operations
provided as follows:
1.Operations do not take place between eight p.m. and seven a.m.
2. Such operations and equipment are utilized for protection or
salvage of agricultural crops during periods of potential or actual
frost damage or other adverse weather conditions.
3. Such operations and equipment associated with agricultural pest
control through pesticide application provided the application is
made in accordance with permits issued or regulations enforced
by the California Department of Agriculture.
E.Noise sources associated with the maintenance of real property provided the
activities take place between the hours of eight a.m. and eight p.m. on any day
except Sunday or between the hours of nine a.m. and eight p.m. on Sunday.
SECTION 6: If any section, subsection, sentence, clause, phrase or portion of this
Ordinance, is for any reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining portions
of this Ordinance. The City Council of the City of Grand Terrace hereby declares that it
would have adopted this Ordinance, and each section, subsection, sentence, clause or
phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences,
clauses and phrases may be declared invalid or unconstitutional.
SECTION 7:The City Clerk shall certify to the passage and adoption of this Ordinance
and shall cause the same to be published in the same manner required by law. This
Ordinance shall become effective thirty (30) days from and after its passage.

8.108.010 -Intent.
It is the intent of this chapter to protect properties within the city and the
health and safety of persons from environmental nuisances and hazards and provide
a pleasing environment throughout the city.
8.108.020 -Unlawful noises.Loud,Annoying,Excessive and Unnecessary
Noises Prohibited
It is unlawful for any person to make,continue or cause to be made or
continued any loud,unnecessary and excessive noise which disturbs,offends,
injures or endangers the peace,quiet,comfort,repose,health or safety of any
neighborhood or person within the limits of the city.
A.It shall be unlawful for any person to willfully make or continue, or cause to
be made or continued, any excessive or unreasonable noise that disturbs
the peace or quiet of any property within the City or which causes
discomfort or annoyance to any reasonable person of normal sensitivities

8.108.040 -Special activities.

8.108.050 -Prohibited noise.
The following noises are prohibited and declared to be nuisances:
A.Peddlers Use of Loud Noise to Advertise Goods.No peddler or mobile
vendor or any person on their behalf shall shout,cry out or use any
device or instrument to make sounds for the purpose of advertising in
such a manner as to create a noise disturbance.
B.Animal Noises.No person owning or having the charge,care,custody or
control of any dog or other animal or fowl shall allow the same to howl,
bark,yelp or make other noises in such a manner as to create a noise
disturbance.
C.Loud and Boisterous Yelling,Shouting,Whistling or Singing.No person
shall yell,shout,whistle or sing in a loud and boisterous manner on the
public streets so as to disturb the quiet,comfort,or repose of persons in
any office,dwelling,hotel or other type of residence or neighborhood.
D.Radios,Television Sets,Musical Instruments,Phonographs and Similar
Devices.No person shall use,operate or permit to be played,used or
operated any radio receiving set,television set,musical instrument,
phonograph or other machine or device for producing or reproducing
sound in such a manner as to disturb the peace,quiet or comfort of
neighboring persons,or at any time with louder volume than is necessary
for the convenient hearing of the person or persons who are in the room,
vehicle or other enclosure in which such machine or device is operated,
and who are voluntary listeners thereto.The operation of any such set,
instrument or device between the hours of ten p.m.and seven a.m.in
such a manner as to be loud or excessive at a distance of fifty feet from
the building,structure or vehicle in which it is located shall be prima facie
evidence of a violation of this section.

created loud and excessive noise in connection with the loading or
unloading of motor trucks and other vehicles,so as to disturb the peace
and quiet of adjacent residential neighborhoods,between the hours of
ten p.m.and seven a.m.The loading or unloading in such a manner as to
be loud or excessive at a distance of fifty feet from the trucks or vehicles
being unloaded shall be prima facie evidence of a violation of this
section.
G.Operation of Equipment.The operation or use between the hours of ten
p.m.and seven a.m.of any pile driver,steam shovel,pneumatic
hammers,derrick,steam or electric hoist,power driven saw,fork lifts,
milling equipment,other tools or apparatus the use of which is attended
by loud and excessive noise,or the movement of tractors,tractor trucks,
or large trucks on property adjacent to residences is prohibited.The
operation of such equipment between the hours of ten p.m.and seven
a.m.in such a manner as to be loud or excessive at a distance of fifty
feet from the equipment being operated shall be prima facie evidence of
a violation of this section.However,it is not the intent of this section to
prohibit the direct movement of trucks on or off property,at any time;
provided,however,that such movement directly on or off the property
shall not be within fifty feet of an occupied residence.
H.Automotive Repair Works.No person shall do automotive repair,
automotive body or fender or other work on metal objects and metal parts
between the hours of ten p.m.and seven a.m.,in or adjacent to any
residential district,so as to cause loud and excessive noise which
disturbs the peace and quiet of the residential neighborhood.The doing
of such activities as are prohibited in this subsection in such a manner as
to be loud or excessive at a distance of fifty feet from where such

8.108.060 -Violations to be an infraction.
A.It is determined that every violation of this chapter is an infraction punishable
as follows:
1.A fine not exceeding fifty dollars for a first violation;
2.A fine not exceeding one hundred dollars for a second violation within a
one-year period;
3.A fine not exceeding two hundred dollars for each additional violation
within a one-year period.
B.Any person creating any noise as prohibited in this chapter is in violation of
this chapter;in addition,any person in possession of property who directly or
indirectly allows the creation of prohibited noises on such property is in
violation of this chapter.

TITLE:Potential Budget Advisory Committee
PRESENTED BY:Betsy Adams, City Manager
RECOMMENDATION:Determine whether to establish a Budget Advisory
Committee to assist the City Council with evaluating
proposed budget alternatives for Fiscal Year 2013-14, along
with the possible need for a local revenue measure to
maintain or enhance municipal service levels.
If the Council establishes the Budget Advisory Committee
then provide direction on the following items:
1. Whether the Committee will be ad hoc or on-going.
2. Number of members the Committee will be comprised of.
3. Method by which members of the Committee will be
appointed.
4. When and how frequently the Committee will meet.
5. Whether revisions are needed to the draft Committee
application.
BACKGROUND:
On April 7, 1988, the Council adopted an updated Policy Manual for the City’s Boards,
Commissions and Committees. A copy of the staff report for this action is included as
an attachment.
At the Council Priorities Workshop on February 23, 2013, the idea of the City Council
establishing a Budget Advisory Committee was discussed. Staff was directed to bring
the possibility of forming such a committee forward for Council consideration at the
Council Meeting of March 12, 2013.
DISCUSSION:
The Council needs to first determine whether to establish a Budget Advisory Committee
to assist the Council with evaluating proposed budget alternatives for Fiscal Year (FY)
2013-14. If the Council decides to establish this Committee then direction needs to be
provided on the following items:

Ad Hoc or On-going Committee
Although not mentioned in the Policy Manual, the Council has the discretion of creating
an ad hoc Budget Advisory Committee for a specific purpose (e.g. evaluating the FY
2013-14 budget) versus an on-going Committee (e.g. evaluating the budget each fiscal
year). An ad hoc Committee could be established by Council resolution at the Council
Meeting on March 26, 2013. Reasons why the Council may wish to consider an ad hoc
status for this Committee are detailed in the appointment process, residency
requirement,and meeting day, time and frequency sections below.
Committee Size
When a possible Budget Advisory Committee was discussed at the Council Priorities
Workshop, a range of seven (7) to 11 members was suggested. The Council needs to
determine the number of members for this Committee.
Appointment Process
It was suggested at the Workshop that each member of the Council appoint his or her
own members to the Committee (e.g. Council Members each appoints two members
and the Mayor appoints three members). The Policy Manual provides only for
committee appointments by the full Council. If the Council desires to use an alternative
appointment method for the Budget Advisory Committee this can be most easily
accomplished by establishing an ad hoc status for this Committee. Using an alternative
appointment method for an on-going Committee would require the Council to amend the
Policy Manual prior to adopting a resolution to establish the Committee. Interviews of
the applicants for the Budget Advisory Committee are tentatively planned for a Special
Meeting on April 16, 2013.
Residency Requirement
It was suggested at the Workshop that non Grand Terrace residents could be
considered for appointment the Budget Advisory Committee. This idea was refined
further to consider non Grand Terrace residents who own a business in Grand Terrace.
The Policy Manual requires committee members to be a Grand Terrace resident. If the
Council desires to waive the residency requirement for this Committee then establishing
it with an ad hoc status is the simplest was to allow members to be non residents.
Committee Meeting Day, Time and Frequency
The Policy Manual requires the Council to set the meeting day, time and frequency for a
Council established committee. It also requires that a City employee be assigned to act
as a liaison for the committee. Since all professional level positions in the Finance
Department have been outsourced to Willdan Financial Services,the City Manager will
serve in the liaison role. It is recommended that Budget Advisory Committee meetings
be held on Thursday evenings. This will prevent potential conflicts with meetings of the
City Council and Oversight Board. Staff recommends that the meeting time be
established no later than 6:30 pm to allow adequate time for the Committee to consider
complex financial information. An advantage of establishing the Committee with an ad
hoc status is that more flexibility can be allowed for when it meets. Also, an ad hoc
Committee status could allow the City Manager and staff from Willdan Financial
Services to share the liaison role.

Committee Application
A draft application for appointment to the Budget Advisory Committee is included as an
attachment to this staff report. If the Council establishes this Committee, revisions to
the application may be needed depending on the Council’s decision on whether the
Committee is ad hoc or on-going, along with the appointment process,residency
requirement, and meeting schedule.
Next Steps
There are no next steps if the Council does not establish a Budget Advisory Committee.
If the Council desires to establish an ad hoc Budget Advisory Committee, a resolution
for this will be brought forward for the Council Meeting on March 26, 2013. After the
adoption of this resolution, the City Clerk will notice the vacancies for this ad hoc
Committee.
If the Council desires to establish an on-going Budget Advisory Committee, the Policy
Manual will need to be updated by staff and amended by formal Council action.
Depending on the number of amendments, it may be possible for this to happen by
March 26, 2013. The Council may note when reviewing the existing Policy Manual that
additional revisions beyond the areas discussed in this staff report could be needed. A
resolution establishing an on-going Budget Advisory Committee can be adopted at the
same meeting as an updated Policy Manual.
Timeline
The Council will have two months to consider what may be the most difficult budget in
the City’s history. Staff recommends if the Council establishes a Budget Advisory
Committee that it has an ad hoc status so that it can be formed quickly and has
flexibility in its meeting schedule.Even with an ad hoc Committee, a Special Meeting
will be needed for the Council to interview and appoint the members of the Committee.

At the City Council meeting on March 24, 1988, Council directed
staff to prepare a policy for alternate members serving on a
committee. Since a Policy Manual already exists pertaining to
Commissions and Committees, it was decided to update that Policy
Manual to include alternate members and revise it to what is
happening at the present time. (NOTE: THIS DOES NOT INCLUDE
THE PLANNING COMMISSION.)
After reviewing the purpose of alternate members on a committee,
it was concluded that it should be an optional position that the
respective committee could decide on (some committees may not
desire alternate members). During their incumbency as such,
alternate members shall have no vote in the proceedings of the
committee. In the event of one or more interim vacancies in a
committee as declared by the City Council, alternate members to
such committee shall automatically assume the vacated seat or
seats for the unexpired portion of the term of the member re-
placed, thereby precluding the advertising/posting process. The
alternate member to the committee first appointed as such by the
City Council shall assume a vacant regular membership in advance
of any later appointed alternate member.
It was concluded that an Associate Member position was not need-
ed on the committees, since it was a non-voting position and had
no special privileges. Any resident, non-resident, business
owner/operator has the right to attend any meeting and offer
suggestions, therefore, it was felt that position was ambiguous.
STAFF RECOMMENDS:
THAT COUNCIL ADOPT THE ATTACHED POLICY MANUAL RELATING TO COMMIS-
SIONS AND COMMITTEES AND DIRECT THE DEPUTY CITY CLERK TO FOLLOW

SUBJECT: Grand Terrace City Boards, Commissions and Committees
The City Council establishes local advisory and regulatory Boards, Commissions
and Committees for the purpose of assisting in the effectiveness of City
government and services. The City Council will consider for appointment all
persons willing to serve and whose interests, background, experience,
perspective and talents may significantly contribute to the purpose of
these various boards, commissions and committees.
POLICY AMPLIFICATION
A. General
1.For the purpose of this Policy, the word Commission(s) will mean
Board(s), Commission(s) and/or Committee(s).
2.This Policy pertains to Commissions established and appointed by
the City Council.
3.Each Commission shall have assigned a specific City employee to
act as "Liaison Officer" for the Commission.
4.The conduct of all Commission affairs shall be in accordance with
this Policy unless otherwise prescribed by State statute or specific
City Council action.
B. Establishment of Boards, Commissions and Committees
1.Each Commission shall be established for a specific purpose.
2.All Commissions, other than those related to Planning Commission,
shall be reviewed every four years for potential continuation
by the City Council.
3.The number of officers, the terms of office, qualifications for
appointments and the appointment authority shall be set by the
City Council.
4.Unless otherwise prescribed by State statute or City ordinance,
the powers and responsibilities of a Commission shall be to provide
the City Council advice on matters pertaining to the purpose of the
Commission.

5. The powers and responsibilities of a Commission shall not be
amended, changed or redirected without specific approval of the
City Council.
C. Terms of Appointments
The following provisions pertain only to members and alternate members
of those Commissions established by the City Council.
1.Unless prescribed by statutory requirements, no appointment shall
exceed four years in length.
2.The terms of office shall be staggered so that one-half of the
members terms shall expire on June 30 of even-numbered years.
3.Terms shall expire on June 30 of the appropriate year and subse-
quent new terms shall begin July 1 of that year unless otherwise
specified by the City Council.
4.Each Commission may elect to appoint two non-voting alternate
members to serve in a reserve position.
5; In the event that an unscheduled vacancy occurs, an alternate
member may fill the unexpired term, pending Council approval,
thereby precluding the advertising/posting process.
6.In an emergency, an unscheduled vacancy-may be filled by an "Acting
Appointee" if an Alternate Member does not exist, but a final
appointment cannot be made until at least ten working days after a
"Notice of Unscheduled Vacancy on Board, Commission or Committee"
has been posted.
7.All final appointments shall be made for either a full term or
completion of an unexpired term.
8.Any appointment to fill an unexpired term of office shall expire
on the normal date of the appointee being replaced.
9.Members of a Commission who have served two consecutive full terms
shall not be reappointed to that Commission for a period of two
years.
10.All Commissions shall elect a chairperson and vice-chairperson at
the first meeting in July of even-numbered years and he/she shall
serve for a period of two years.
11.Chairpersons shall have the right to monitor the participation and
attendance of appointees. In cases where the chairperson deems
advisable, these cases shall be reviewed with City Staff and/or City
Council.

D. Qualifications for Appointment

1.Appointees by the City Council shall be residents of the City of
Grand Terrace.
2.Specific qualifications, if any, for each Commission shall be
set by the City Council.
E. Standards of Ethic and Conduct
1.In order to avoid the necessity of filing of disclosure statements
pursuant to the Conflict of Interest Guidelines, with the exception
of the Planning Commission, all City Commissions are advisory only
and do not participate in the decision making process. The City
Council has recognized the need to have citizen and special interest
input for consideration of the City Staff and the City Council in
order to arrive at orderly and logical decisions.
2.The duties of these advisory groups shall be fact finding, fact
gathering, trend determination and shall include evaluation of
citizen attitude on given subjects.
3.In no event shall any advisory group be involved in directing
City employees, authorizing expenditures or approving projects.
These advisory groups shall be limited to advisory input to the
City Staff and the City Council.
4.The City Council has recognized the great importance of these
advisory groups in providing information that is necessary to
arriving at good decisions for the benefit of the City of Grand
Terrace, but recognizes, in addition, the necessity of limiting
participation of advisory groups in order to confine the deci-
sion making process and to avoid the necessity of subjecting groups
that are advisory in nature only to the conflict of interest
disclosure process.
5.Appointees shall not use their position to speak publicly for or
contrary to the City Council.
F. Appointing Commission Members
1.Candidates for appointment to a Commission should be submit-
ted to the City Council for consideration and recommendation.
2.A City Council member shall nominate a candidate for appointment
to the Commission in accordance with established procedures.
G. Reimbursement of Commission Members
The reimbursement of expenses to Commission members shall be in accor-
dance with City salary and fee resolutions.

H. Meetings
1. Each Commission shall meet a minimum of one time per month unless
otherwise specified.
2. All City Commissions are subject to the provisions of the Ralph M.
Brown Act (refer to California Government Code Section 54950
et.seq.).
I. Records
1.The City Clerk shall maintain a record of all Commissions and
their members, including the expiration dates of their terms of
office and mailing addresses and telephone numbers. Each Com-
mission shall report unscheduled vacancies to the City Clerk on
a timely basis.
2.Each Commission shall keep current up-to-date minute records on
file and forward copies of all minutes to the City Clerk for filing.
3.Financial records, if appropriate, shall be made available to
the City Finance Officer.
J. Functions of the Liaison Officer
1.The assigned Liaison Officer shall insure that the City Clerk
is advised of any unscheduled vacancies in accordance with the
established procedure.
2.The City Manager will make recommendations as to the con-
tinuation or role of the Commission pursuant to this policy.
3.The Liaison Officer shall be responsible for coordinating and
communicating the activities of Commissions to and with City Staff
and City Council.

BUDGET ADVISORY COMMITTEE
On April 9, 2013, the City Council established the Budget Advisory Committee to assist the
Council in evaluating alternatives to maintain a balanced budget through budget reductions,
revenue enhancements, or a combination of both. The Council desires to have
representation from a wide range of community stakeholders on the Budget Advisory
Committee. Individuals interested in being appointed to the Committee by the City Council
need to complete and submit the attached application to the City Clerk by 5:00 pm on
March 28, 2013. The Council will interview applicants for the Committee at a Special
Meeting on April 9, 2013 and will make the Committee Member appointments that evening.
All Committee Members will be required to attend the Fiscal Year 2013-14 Budget
Workshop Meeting scheduled for 6:00 pm on April 22, 2013.
Budget Information
In response to the economic recession, the City has implemented numerous budget and
service level reductions in order to maintain a balanced budget. The most significant of
these reductions includes the following:
§Removed Traffic Deputy from law enforcement services agreement.
§Removed Sheriff’s Service Specialist from law enforcement services agreement.
§Eliminated Crossing Guard Program.
§Outsourced Parks Maintenance and 2/3 of Finance Department staff.
§Defunded 17.5 non Child Care positions reducing the City employee workforce at City
Hall from 29 positions in FY 2009/10 to 11.5 positions in FY 2012/13 (60.3% reduction).
§Suspended employee cost of living adjustments (6 years) and merit increases (5 years);
reduced City Hall employee work week from 40 to 36 hours (3 years, 10% reduction in
wages); and reduced employee cafeteria benefit by 10% (3 years, City Hall and Child
Care employees).
On December 29, 2011, the California State Supreme Court upheld the dissolution of
redevelopment agencies. The rapid wind-down of the former redevelopment agency
placed additional stress upon the City’s budget along with adding extensive reporting
requirements and an additional appointed governing body (Oversight Board of the
Successor Agency of the City of Grand Terrace Redevelopment Agency) which must
review and approve all wind-down activity. The Oversight Board’s actions are then
reviewed by the State of California’s Department of Finance (DOF) and the State
Controller’s Office. The DOF rejected items in the Successor Agency’s Recognized
Obligation Payment Schedule (ROPS) for the period of January 1 through June 30, 2013
which negatively impact the City’s General Fund budget by $737,848 on an on-going basis.
The General Fund is the source of funds for all governmental services except those for
which special revenue sources are available. The General Fund budget for Fiscal Year
(FY)2012-13 is $3.67 million.

General Information
There are several items which the Budget Advisory Committee will need to keep in mind as
it assists the City Council in evaluating various budget solutions:
¡The Committee will be required select a Chairperson to conduct committee meetings.
¡All committee meetings will be open to the public and conducted in a manner consistent
with the Ralph M. Brown Act. Training will be provided to committee members on this.
¡Members of the City Council or City Staff may attend the Committee meetings.
¡The Committee will be required to prepare minutes from its meetings to be submitted to
the City Clerk for inclusion on the City Council’s agenda.
¡The City is a legal sub entity of the State (not the County) and must follow all applicable
State and Federal laws/regulations which apply to municipalities including governmental
accounting standards which differ significantly from the private sector.
¡The City Council is legally required to adopt a balanced budget prior to the start of the
fiscal year (July 1).
¡Funds legally designated for a specific use cannot be expended other than for that
purpose. The General Fund is the only fund for which there is much discretion in how
the funds can been expended.
¡The proposed budget for FY 2013-14 to be presented at the Budget Workshop meeting
on April 22, 2013 will include multiple budget alternatives along with recommendations
for establishing reserves. With the dissolution of the City’s former redevelopment
agency, creating and funding reserves will be a critical component in the fiscal
sustainability of the City.
¡The DOF is currently reviewing the Successor Agency’s ROPS for the period of July 1
through December 31, 2013 and the Due Diligence Review (DDR) for the Successor
Agency’s funds other than its affordable housing funds. The DOF is legally required to
make its determinations on these items in April. It is possible that the DOF may make
determinations which could include additional impacts to the General Fund beyond the
$737,848 already identified.
