DEPARTMENT: CITY MANAGER AGENDA REPORT MEETING DATE: August 22, 2017 Council Item TITLE: Extend Interim Child Care Service Agreement with Family Services Association PRESENTED BY: Cynthia Fortune, Assistant City Manager RECOMMENDATION: 1. Approve an Amendment to the Interim Child Care Services Agreement to Extend the Agreement with Family Services Association from August 31, 2017 to September 30, 2017; 2. Authorize the City Manager to execute the Amendment to the Agreement; and 3. Authorize the City Manager to execute an additional one- time 30-day extension of the Agreement to October 31, 2017, only if necessary. 2030 VISION STATEMENT: This staff report supports City Council Goal #1 “Ensure our Fiscal Viability” through the continuous monitoring of revenue receipts and expenditure disbursements against approved budget appropriations. BACKGROUND: On May 30, 2017, City Council approved the following: 1.A lease agreement with Family Services Association (FSA) for child care services; and 2.The conclusion of City-provided child care services by June 30, 2017. On June 27, 2017, City Council approved a 30-day child care services agreement (from July 1, 2017 to July 31, 2017 and subsequently extended the same agreement another 30 days to August 31, 2017. The terms of the agreement contained the following: CITY OF GRAND TERRACE (City) 1.The City will receipt and record all revenues for the period of July 1, 2017 through August 31, 2017; and 2.The City will turn over all revenues, less any incurred expenditures to Family Service Association in return for FSA providing the Child Care services for the City during the interim period from July 1, 2017 to August 31, 2017. FAMILY SERVICES ASSOCIATION (FSA) G.11 Packet Pg. 158 3.FSA will take over the management of the program effective July 1, 2017 4.FSA will hire the child care services personnel effective July 1, 2017; 5.FSA will pay rent to the City, as stated in the lease agreement, $10,000 for the months of July and August. DISCUSSION: Since approval of the above items, the City and Family Services Association have been working closely together to complete the necessary documents required with the lease agreement, including the transfer of the State License for child care services from the City to Family Services Association. Part of the requirements from the State Department of Social Services includes a Fire Inspection and a State Licensing Inspection. In addition to the minor repairs that have been made to the Child Care Center in preparation for the inspections and transfer of the State License, several other items have necessitated the need for additional upgrades: 1.Playground Resurfacing: the existing playground surface has deteriorated overtime and needs to be upgraded to comply with State requirements and industry standards. City Council approved the use of $25,000 in bond proceeds for this upgrade. 2.Playground Canopy/Tarp: the existing playground has three (3) sails (canopies/tarps) that covers the majority of the playground area. Each sail is approximately 20 X 40 in size. One canopy has a three-foot tear in 3 of its 4 corners and has to be replaced. City Council approved $5,000 in bond Proceeds to be used for the replacement of the canopy. As City Council has been notified, FSA has employed almost all of the City childcare employees and they have been operating the child care program over the past two months. Both parties believe that this partnership will be a successful one and benefits the community of Grand Terrace. Staff is requesting another extension to the Interim Child Care Services Agreement with FSA to September 30, 2017 with hopes that both parties are able to execute the transfer of the State license; however, in the event that September 30, 2017 is not sufficient time, staff if also requesting that City Council authorize the City Manager to execute a one-time additional 30-day extension to the agreement until October 30, 2017, only if necessary. FISCAL IMPACT: The agreement will carry out the same terms as stated in the prior staff reports approved by City Council regarding the lease agreement with Family Services Association and the conclusion of child care services effective June 30, 2017. A. WHEREAS, City and FSA have negotiated a Lease Agreement ("Lease") in which FSA will lease from City the property located at 22400 Barton Rd, Grand Terrace, California ("Property"), which is one of the sites of City's child care program; B. WHEREAS, the Lease provides that FSA will operate a child care program at the Property, and offer employment to City's child care employees; C. WHEREAS, City has also agreed to transfer its license, issued by the California Department of Social Services, Community Care Licensing Division, ("State License") for the Child Care Program to FSA; D. WHEREAS, City and FSA wish to maintain continuity of the Child Care Program and toward that end City and FSA entered into an Interim Child Care Agreement ("Agreement") on June 29, 2017 to have FSA operate the Child Care Program under the City's current State License during the term of the Agreement which was originally scheduled to end on July 31, 2017; and E. WHEREAS, City and FSA extended the term of the Agreement an additional 30 days to August 30, 2017; and F. WHEREAS, though substantial progress has been made in transferring the Child Care Program and State License to FSA, additional time is required to complete the license transfer. NOW THEREFORE, in consideration of the foregoing and for other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties hereto agree to amend the Agreement as follows: 1.Section 2 (TERM OF AGREEMENT) of the Agreement is hereby amended to read as follows: 2.TERM OF AGREEMENT. FSA shall pay rent for the use of the property for the term of this Agreement in the amount set forth in Section 2.1 of Lease, Exhibit "A" attached hereto (to the Agreement), due on the first of each month of the term of the Amended Agreement. 3. All other terms, conditions, and provisions of the Agreement, to the extent not modified with this Amendment, shall remain in full force and effect.
