On June 15, 2021, the City of Grand Terrace reopened its public meetings. Therefore, the regular meeting of the City
Council for July 27, 2021, is open to the public.
Please note that Pursuant to Section 3 of Executive Order N-29-20, issued by Governor Newsom on March 17, 2020,
the regular meeting of the City Council for July 27, 2021, will also be conducted telephonically through Zoom and
broadcast live on the City’s website.
COMMENTS FROM THE PUBLIC
The public is encouraged to address the City Council on any matter posted on the agenda or on any other matter
within its jurisdiction. If you wish to address the City Council, please complete a Request to Speak Card located at the
front entrance and give it to the City Clerk. Speakers will be called upon by the Mayor at the appropriate time and
each person is allowed three (3) minutes speaking time.

D. PUBLIC COMMENT
Johan Gallo, Grand Terrace spoke on behalf of his mother-in-law, Mona Henry. Due to
her disability she is unable to place her trash containers at the curb. Since the date
changed in trash pickup, retrieval of her trash is missed every time. She has to call
every trash day to request pick up and she is frustrated with customer service’s
response to her requests.
Mike Aragon, Vice President of Burrtec Waste Industries apologized for the customer
service received by Ms. Henry however he will be sure to rectify that situation.
Additionally, if a resident is disabled or has difficulty placing cans at the curb, please
notify Burrtec and they will have staff place the resident's cans at the curb and the cans
will be returned to the stored location at the end of service as long as the cans are
accessible at the front of the residence.

Mayor Darcy McNaboe announced that the San Bernardino Transportation Authority, in
cooperation with Caltrans and the City of Colton, proposes to construct improvements to
Mt. Vernon Avenue. Caltrans has studied the effects this project may have on the
environment. Their studies show it will not significantly affect the quality of the
environment. The report explaining the effects of the project is called an Initial Study.
This notice is to advise the public of the preparation of the Draft Initial Study with
Proposed Mitigated Negative Declaration and of its availability to the public. A virtual
open house will be hosted online on Thursday, July 15, 2021, from 6:00 pm to 7:00 pm

2021, through the tentative contract start date of the Interim City Manager of
Wednesday, July 28, 2021. City Council has increased Mr. Weiss’ salary to Step A of
the City Manager’s salary for the duration of the Acting City Manager term stated above.

2030 VISION STATEMENT:
This staff report identifies the monthly tasks associated with the delivery of projects to
support City Council’s Goals 1) Ensure Our Fiscal Viability - Explore Creative Means to
Provide Services and 4) Develop and Implement Successful Partnerships - Work with
Local, Regional and State Agencies to secure Funding for Programs and Projects.
BACKGROUND:
The City Council of Grand Terrace established a 2030 Vision for the City of Grand
Terrace and followed up with a 2014-2020 Strategic Plan. The Strategic Plan is a
roadmap to ensure that the City remains on target and reaches its overall goals. The
2030 Vision and Strategic Plan will be achieved as staff accomplishes tasks and
projects that are aligned with the 2030 Vision goals. The goals include:
• Ensure Our Fiscal Viability
• Maintain Public Safety
• Promote Economic Development
• Develop and Implement Successful Partnerships
• Engage in Proactive Communications
DISCUSSION:
This Monthly report includes May 2021 data for each department in the City. The
number of projects and activities reported do not reflect everything staff is doing but
rather highlights things they have worked on in the past month which may be of interest
to City Council and the public. This report is updated monthly and posted to the City’s
website on the fourth week of each month.
FISCAL IMPACT:
The Monthly report has no fiscal impact. The monthly reports do not provide budgetary
status. The Finance Department will continue to produce individual monthly financial
reports which are separate from the Department monthly reports.

This monthly report is presented to the City Manager to keep him informed of the activities and responsibilities within the City Clerk’s Department over the last six (6) months.
The City Clerk’s Office is staffed with one position that includes the City Clerk. The primary responsibilities for this department are Council Support Services, Records Management, Administrative Processing, Board Administration and Election Services. Each of these functions require a collaborative effort between the department staff to ensure that all components within the process are completed from origin to file. As the official records manager for all City
documents it is imperative that this process be accurate to ensure the preservation of the City’s history. AGENDAS/POSTINGS The City Clerk is responsible for preparing agendas and postings for all City Council Regular
and Special Meetings, as well as for the Housing Authority and Successor Agency to the Community Redevelopment Agency. The total number of agendas processed for the month of May 2021 is three (3) , spending a total of twenty-four (24) hours preparing the agenda packet producing 693 pages.

RECOGNITION ACTIVITY
Its purpose is to recognize individuals, groups, and events of significance to the Grand Terrace
community by the issuance of Certificates, Recognition, Acknowledgment and Commendation
Pins. It is the responsibility of the City Clerk to ensure that all signatures of City Council are
obtained on the document, coordinate attendance at Council meetings for the individual, group, or event representative to accept the recognition, as well as prepare Council with all necessary information to present the recognition if presentation will be held at another venue. HISTORICAL & CULTURAL COMMITTEE ACTIVITY
The Historical and Cultural Activities Committee preserves the history of Grand Terrace and facilitates cultural activities for the benefit of all citizens in the City. The City Clerk serves as a liaison facilitating communication between the committee and City Manager and City Council, maintains the committee minutes of its proceedings and provides support for the Annual Art Show, Country Fair and City Birthday Party. CORE SERVICES The Finance Department has 4 core services: Accounting, Purchasing, Revenue Management and Treasury. The Finance Department works in partnership with other departments to effectively develop,
manage and safeguard the City’s fiscal resources to enable and enhance the delivery of City services and projects. 1. Disbursements – to facilitate timely and accurate payments of the City’s financial obligations which includes vendor payments, employee and resident reimbursements, and payroll. 2. Financial Reporting – to provide accurate and meaningful reporting on the City’s financial condition through the City’s monthly and annual financial reports. 3. Purchasing – to authorize the purchase of quality products in a cost-effective manner.
4. Revenue and Treasury Management – to bill and collect revenue while providing cost- effective financing, investments, and cash collection of the City’s resources to enhance the City’s financial condition.

This monthly report is presented to the City Manager to keep him informed of the activities within the Planning and Development Services Department, comprised of Planning, Building and Safety, Code Enforcement, Animal Control, and Public Works. OUR MISSION To preserve and protect our community and its exceptional quality of life through thoughtful planning, within the constraints of a fiscally responsible government.

Application Summary
The Planning Division received 12 new applications in May and carried over 27 from the previous month. Action was taken on 18 of them. Minor applications such as a new business, patio cover, or small room additions are handled as a Land Use application and typically processed within 2-3 days. Larger additions over 500 square feet or second
dwelling units are handled administratively by staff with noticing, and those projects that
are either new development or exceed the Director’s administrative authority are handled
as Major Permits and are reviewed by the Planning Commission. Home occupation
permits are for home based business, such as consulting, housekeeping, and small craft businesses.

Planning Commission
The Planning Commission reviews new construction, subdivisions, variances and conditional use permits. They also make recommendations on zone changes, zoning code amendments, and general plan changes. One Planning Commission Meeting was held in the month of May and the following actions occurred:
May 10, 2021:
• Action Item: Recommendation to adopt a Resolution finding that the General Plan conformity finding pursuant to Government Code Section 65402 for the proposed sale of successor agency property located at 22747 Barton Road (APN 0276-202-54) to the City of Grand Terrace is not a project and exempt from CEQA,
pursuant to CEQA Guidelines Sections 15060 (c)(3), 15378(B)(5), and
15061(B)(3); and finding General Plan Conformity Pursuant to Government Code
Section 65402 for such proposed sale of successor agency property located at
22747 Barton Road (APN 0276-202-54) to the City of Grand Terrace.
Conforming Uses and Grants
The City was awarded funding for its Blue Mountain Trailhead and Trail application and
continues to implement the grant. Staff was informed that through the efforts of Assembly Member Reyes, the City is the
recipient of a $1.2 Million Dollar Specified Grant for the acquisition and development of
the Blue Mountain Trail and Trailhead. This grant is funded through the State Budget and
is non-competitive. Staff met with State representatives on August 15, 2019.

The Building and Safety Division is budgeted for one full time Permit Technician and one full time Building Official. The Building Official position is currently being filled through a
contract with Interwest Consulting Group. These two positions constitute up to 240
monthly service hours.
Additionally, the Department budgets for plan checking and inspection services.
Inspection services are conducted daily. The cost of these services is offset through the collection of fees and deposits.

ANIMAL CONTROL AND CODE ENFORCEMENT DIVISION

The Division is budgeted for one full time Officer, Specialist, and Office Specialist. On-call coverage is provided to manage after hour emergency animal control calls.
The City is divided into seven zones, including commercial centers, and the zones are inspected on a continual rotating basis over a two-week period. A set route is driven each day in addition to the zones. The route includes Mount Vernon Avenue, Main Street, Michigan Street, Barton Road, Preston Street, Palm Avenue, Observation Drive, and Van Buren Street.
Activity Summary for Code Enforcement
Code Enforcement had 67 cases carried over from the previous month, 32 new cases
opened, and 52 cases were closed. The Division closed out May with 47 open cases.

Weekend Code Enforcement Activities
The Weekend Animal Control/Code Enforcement Specialist patrols the weekends and conducts zone inspections and scheduled re-inspections. Weekend code enforcement also handles code violations such as unpermitted yard sales, open
house signs, and parking violations. The table below demonstrates weekend code
enforcement activities by type for this fiscal year.
The Animal Control/Code Enforcement Specialist coordinated a triple agency homeless camp abatement which took place on Monday, May 3, 2021. The site location was
under the Barton Road railroad access bridge on the west end of the city at the Colton
City limits. With the assistance of the City of Colton’s Code Enforcement and Public Works Departments and the assigned San Bernardino County Sheriff’s Department Homeless Outreach Deputy, two and a half dump truck loads of debris, trash, and other various items were removed from the site. The Deputy and Specialist were able to
salvage and return nine shopping carts to Grand Terrace businesses; the project took approximately four hours.

Parking Citations:
In May , 327 vehicle related citations were issued; 283 of the citations issued were related to street sweeping enforcement. Street Sweeping in residential areas occurs on the first, second, and third Thursdays of each month.
As of June 4, 2020, Code Enforcement resumed issuing street sweeping citations for vehicles parked on the street during street sweeping hours which was suspended due to COVID-19.
Other parking citations include expired registration, parking on unpaved surfaces, and commercial vehicles in residential areas. Parking citations are issued by Code Enforcement Staff, as well as Sheriff Deputies.

Graffiti/Vandalism/Illegal Dumping
There was 5 cases of illegal dumping and 4 cases of graffiti reported in May; all cases have been resolved.
Non-Owner Occupied/Rental Property Program
There are approximately 379 properties in the Program (number is subject to change as properties get sold or becomes owner occupied) consisting of both single-family units and multiple family units (i.e. apartments, duplexes, triplexes, and quadruplexes). 115 properties are enrolled in the Good Landlord/Tenant Program signifying they have
kept well-maintained properties and have passed inspections for 3-4 consecutive years. Property owners in the Good Landlord Program also receive reduced inspection fees and windshield inspections. In August, Code Enforcement issued an Application for Non-Owner Occupied/Rental
Inspection to current rental property owners to add additional rental properties, renew information, or if qualified, opt out of the program. Owners may currently opt out of the program if their entire home is owner/family occupied (as a courtesy), if they no longer own the property, or if the property is a condominium in which ownership consists of the interior only. As a result of the notices 14 properties have been approved to opt out
of the program. In October, all of the rental properties were inventoried to determine whether they passed the 2020 Annual Inspection on the first try or if they failed because it determines whether properties will continue to be in the Good Landlord Program or be removed.
Also, properties entering their 11th year in the program are removed from the Good Landlord Program and revert to first year status. There are 115 properties in the Good Landlord Program for 2021 which is a 30.6% increase from 88 in 2020. In December, Code Enforcement issued annual Non-owner Occupied/Rental renewal
notices for all properties enrolled in our program and renewal fees were due January
1st. Starting May 1st Code Enforcement began conducting their annual rental inspections and this will continue until June 30th.
Animal Control Services
With the implementation of Animal Control Services, the City has instituted the practice of first making every effort to return stray dogs to its owner, by checking it for tags
or microchip. If the owner cannot be identified, the City will place a photograph of the impounded animal on the City’s Facebook page so that owners can reclaim their pet. Animal Control is also working to identify animals via Facebook who have been sent to the animal shelter and have since been returned to their owner so their status can be updated for the public. If the dog is unlicensed the owner will be given a citation,
but the fine is dismissed if the dog is licensed within 7 days.

Dog Licensing Revenue
In the beginning of May, Animal Control began canvassing properties with outstanding dog licenses and leaving a door hanger with renewal information to ensure we have the most accurate count of dogs in our system. Often times individuals move away from the
City and we are not notified and annually those properties are issues renewal notices as
typical protocol. During this time there was an influx of individuals renewing their dog licenses and licensing new dogs. The door hanger indicated they had a month and half to renew the
license or they may risk receiving a citation. The deadline was extended from February
12th to April 1st due to COVID related issues.

RECOMMENDATION: Approve the Check Register No. 06302021 in the amount of
$1,058,965.58 as submitted, for the period ending June 30,
2021.
2030 VISION STATEMENT:
This staff report supports Goal #1, “Ensuring Our Fiscal Viability”, through the
continuous monitoring of expenditure budgets, allocations and operational costs.
BACKGROUND:
The check register for the month of June-2021 has been prepared in accordance with
Government Code §37202 and is hereby submitted for City Council’s approval.
The check register lists all vendor payments for the respective month, along with a brief
description of the type of goods or services purchased and the account code(s)
associated with each payment. The check registers list all payments made to vendors
and employee reimbursements during the month of June-2021.
The attached index to the Check Register is a guideline account list only and is not
intended to replace the comprehensive chart of accounts used by the City and Grand
Terrace Successor Agency. Expenditure account number formats are XX-XXX-XXX
[Fund-Department-Account]. Expenditures may be made from trust/agency accounts
(Fund 23-XXX-) or temporary clearing accounts which do not have a budgetary impact.

TITLE: Approval of Interim City Manager Employment Agreement

and Authorize the Mayor to Execute Subject to City Attorney

2030 VISION STATEMENT:
This staff report supports Our Mission, Our Vision, Our Core Values and Goals 1-5 of
the City’s 2030 Vision, through the recruitment and selection of a City Manager,
responsible for the effective implementation of the City of Grand Terrace’s 2030 Vision.
BACKGROUND:
On June 22, 2021, City Manager G. Harold Duffey announced his resignation. His
resignation became effective July 20, 2021.
On July 13, 2021, the City Council selected an executive search firm, Ralph Anderson &
Associates, to conduct an open recruitment to permanently fill the City Manager
position. The search is active and ongoing. Until such time as an individual is appointed
to fill the permanent position, the City will require the services of an Interim City
Manager.
DISCUSSION:
Following interviews of potential candidates, the City Council directed the City Attorney
to negotiate and prepare an agreement for interim city manager services with G.
Michael Milhiser. Mr. Milhiser brings a breadth of professional experience to the City of
Grand Terrance through his service in the public and private sectors. Of note:
• He holds a Master’s Degree in Government from the Claremont Graduate
University, and a Bachelor's in Political Science from Chapman University.
• He brings nearly thirty (30) years of experience serving as the City
Administrator/City Manager for the cities of Montclair, Upland and Ontario during
the period of 1978 through 2005.
• He recently served as Interim City Manager for two local cities - Adelanto and
Fontana.

• In the private sector, Mr. Milhiser served ten (10) years as Chief Administrative
Officer (CAO) for the Morongo Band of Mission Indians, and as Interim Executive
Director for the Tri-City Mental Health Agency in Pomona.
• Mr. Milhiser also brings extensive community service experience as a current
Board Member for the Monte Vista Water District, and as a former Board
Member for the White Foundation, and the YMCA Metro. Additionally, he has
served as past president of the Montclair Kiwanis Club, and West End United
Way.
The proposed agreement with Mr. Milhiser is now presented for City Council
consideration. If approved, the agreement becomes effective July 28, 2021, with an
automatic termination date of June 30, 2022. However, the Agreement will be
terminated earlier upon the City Council's appointment of a permanent replacement for
the City Manager position. Under this Agreement, the Interim City Manager is
considered an at-will, limited duration employee and shall work at the direction of the
City Council.
The Agreement requires the Interim City Manager to work during normal business hours
from Monday to Friday 8:00am to 5:00pm as well as the occasional time outside of
normal office hours. The Interim City Manager cannot work more than 960 hours per
fiscal year.
The Agreement states the Interim City Manager shall be compensated at $17,916.67
per month, which translates into an hourly rate of one hundred and three dollars and
fifty-six cents ($103.56.) This is the same salary as the prior City Manager. The Interim
City Manager will not be eligible to receive any benefits other than the monthly salary
outlined within the Agreement.
Recommendation
Based upon the foregoing, the City Council is recommended to approve the attached
Interim City Manager Employment Agreement and authorize the Mayor to execute the
agreement subject to City Attorney approval as to form.
FISCAL IMPACT:
Funding for the Agreement with Mr. Milhiser for the Interim City Manager Services will
be derived from salary savings of the newly vacated City Manager position. No
additional appropriation is required, and there will be some savings for benefits that will
not be paid under this Agreement.

INTERIM CITY MANAGER
EMPLOYMENT AGREEMENT
BETWEEN THE CITY OF GRAND TERRACE AND G. MICHAEL MILHISER
This Interim City Manager Employment Agreement (“Agreement”) is made and entered
into on July 27, 2021 by and between the City of Grand Terrace, a municipal corporation
(“City”) and G. Michael Milhiser (“Employee”). The City and Employee may be referred to
individually as a “Party” or collectively as the “Parties.”
RECITALS
WHEREAS, Government Code Sections 21221(h) and 7522.56 permit retired annuitants
under the California Public Employees’ Retirement System (“CalPERS”) to be employed
without reinstatement from retirement upon appointment by a governing body to fill a vacant
position on an interim basis during the recruitment to permanently fill the vacant position; and
WHEREAS, the City’s City Manager recently announced his resignation effective July
20, 2021; and
WHEREAS, the City is currently conducting an open recruitment to permanently fill the
position of City Manager, which is active and ongoing; and
WHEREAS, the City has hired an executive search firm, Ralph Anderson & Associates,
to conduct the open recruitment; and
WHEREAS, the City anticipates that the City Manager position will be filled with a
permanent replacement within twelve (12) months after the effective date of this Agreement; and
WHEREAS, as a CalPERS retired annuitant under Government Code Section 21221(h),
Employee possesses extensive experience as a City Manager and possesses the specialized skill
set to perform the required duties of Interim City Manager and desires to perform the duties of,
and assume responsibility for, the position of Interim City Manager and acknowledges that such
employment is at-will and of a limited duration for a definite period of time, as described below;
and
WHEREAS, since retirement, Employee has not previously served as the Interim City
Manager for the City; and
WHEREAS, the City desires to hire Employee as an at-will, limited duration employee
for the position of Interim City Manager, which is a position that requires specialized skills, for a
definite period of time, effective July 28, 2021; and
WHEREAS, pursuant to Grand Terrace Municipal Code §2.08.010, “[t]he city manager
shall be appointed by the city council wholly on the basis of his administrative and executive
ability and qualifications and shall hold office for and during the pleasure of the city council[;]”

WHEREAS, the Parties wish to establish the terms and conditions of Employee’s
services to the City, as described in this Agreement.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, City
and Employee hereby agree as follows:
AGREEMENT
SECTION 1. TERM. The term of this Agreement shall commence on July 28, 2021 and shall
automatically terminate on June 30, 2022 (“Term”). The City shall terminate this Agreement in
accordance with Section 4(B) of this Agreement upon the City’s appointment of a permanent
replacement for the position of City Manager. July 28, 2021 shall be Employee’s “Hire Date” for
purposes of this Agreement. In no event shall Employee work more than 960 hours per fiscal
year during the Term.
SECTION 2. DUTIES, RESPONSIBILITIES AND WORK HOURS.
A. Employee shall be appointed to the position of Interim City Manager, the duties
of which are set forth in Grand Terrace Municipal Code Chapter 2.08 and in the
City’s job classification for the position of City Manager. Employee
acknowledges that the position of Interim City Manager requires specialized skills
and expert professional services for a definite period of time, as described above
in Section 1 of this Agreement.
B. Employee acknowledges proper performance of the duties of Interim City
Manager will generally require Employee to observe normal business hours
(Monday through Friday, 8:00 a.m. to 5:00 p.m.) as well as work occasional time
outside of normal office hours. Employee shall work under the direction of the
City Council. Subject to the Term as stated in Section 1 of this Agreement,
Employee shall work the number of hours each week as directed and authorized
by the City Council.
C. All data, studies, reports and other documents prepared and/or reviewed by
Employee while performing his duties during the Term of this Agreement shall be
furnished to, and become the property of the City, without restriction or limitation
on their use. All ideas, memoranda, specifications, plans, procedures, drawings,
descriptions, computer program data, input record data, written information and
other materials either created by, or provided to, Employee in connection with the
performance of this Agreement shall be held confidential by Employee to the
extent permitted by applicable law. Such materials, without the prior written
consent of the City Council, shall not be used by Employee for any purpose other
than the performance of his duties. Nor shall such materials be disclosed to any
person or entity not connected with the performance of services under this
Agreement, except as required by law.

SECTION 3. COMPENSATION AND BENEFITS.
A. The City agrees to compensate Employee within the salary range for the City
Manager position, with a salary of Seventeen Thousand Nine Hundred Sixteen
Dollars and Sixty Seven Cents ($17,916.67) per month, to equal an hourly rate of
One Hundred and Three Dollars ($103.56; $17,916.67 divided by 173.333). That
calculated hourly rate is simply to show compliance with CalPERS’ requirements
(Government Code Section 21221(h)) and not to be construed as designating the
City Manager position as hourly employment and anything other than salaried and
exempt pursuant to the Fair Labor Standards Act (“FLSA”).
B. Employee shall not be eligible for any other benefits, incentives, compensation in
lieu of benefits or any other forms of compensation.
SECTION 4. RESIGNATION/TERMINATION.
A. Employee may resign at any time; provided, however, Employee shall reasonably
provide the City Council with at least three (3) weeks advance written notice.
B. Employee is an at-will employee and serves at the will and pleasure of the City
Council and may be terminated at any time, with or without cause, and with or
without notice. Employee expressly waives any rights provided for the City
Manager under the City’s Personnel Rules, Municipal Code, or under other state
or federal law to any other form of pre- or post-termination hearing, appeal or
other administrative process pertaining to termination.
C. In accordance with state law and the requirements of the California Public
Employees’ Retirement Law, Employee may not be reappointed to this position
following the expiration of this Agreement, nor may this Agreement be modified
to extend the term of the Agreement.
D. After notice of resignation or termination, Employee shall cooperate with the
City, as requested by the City, to affect a transition of Employee’s responsibilities
and duties and to ensure that the City is aware of all matters being handled by
Employee.
E. Employee shall not be entitled to severance pay and Employee expressly waives
any and all rights with respect to severance pay.
SECTION 5. NOTICES. Notices required to be served pursuant to this Agreement shall be
served in person or by first-class U.S. mail addressed as follows:

SECTION 6. GENERAL TERMS AND CONDITIONS. The General Terms and Conditions
of this Agreement are described as follows:
A. Indemnification. To the extent mandated by the California Government Code, the
City shall defend, hold harmless, and indemnify Employee against any tort,
professional liability, claim or demand, or other legal action arising out of an
alleged act or omission occurring in the performance of Employee’s services
under this Agreement. This section shall not apply to any intentional tort or crime
committed by Employee, to any action outside the course and scope of
Employee’s employment, or any other intentional or malicious conduct or gross
negligence of Employee.
B. Entire Agreement. The text of this Agreement shall constitute the entire and
exclusive agreement between the Parties. All prior oral or written
communications, understandings or agreements between the Parties not set forth
herein shall be superseded in total by this Agreement. No amendment or
modification to this Agreement may be made except by a written agreement
signed by the Employee and the Mayor and approved as to form by the City
Attorney.
C. Assignment. This Agreement is not assignable by either the City or Employee.
D. Severability. In the event any provision of this Agreement is finally held or
determined to be illegal or void by a court having jurisdiction over the Parties, the
remainder of this Agreement shall remain in full force and effect unless the parts
found to be illegal or void are wholly inseparable from the remaining portions of
this Agreement.
E. Effect of Waiver. The failure of either Party to insist on strict compliance with
any of the terms, covenants or conditions in this Agreement by the other Party
shall not be deemed a waiver of that term, covenant or condition, nor shall any
waiver or relinquishment of any right or power at any one time or times be
deemed a waiver or relinquishment of that right or power for all or any other time
or times.
F. Governing Law and Jurisdiction. This Agreement shall be governed by and
construed in accordance with the laws of the State of California, which are in full
force and effect as of the date of execution. Any action to interpret or enforce the
terms of this Agreement shall be held exclusively in a state court in San
Bernardino County, California. Employee expressly waives any right to remove
any such action from San Bernardino County.
G. Effective Date. This Agreement is effective July 28, 2021.

H. Effect of Agreement on Employee’s CalPERS Retirement Benefits. The City
makes no representation on the impact, if any, this Agreement shall or may have
upon Employee’s CalPERS retirement benefits, status, duties and/or obligations.
Employee acknowledges that in entering into this Agreement, he has not relied
upon any such representations (none of which being in existence) in assessing the
CalPERS-related impact of his employment. Therefore, Employee releases the
City from any and all CalPERS-related claims or liabilities that may arise in
connection with his employment pursuant to this Agreement.
I. No Unemployment Insurance Benefits Received By Employee. Employee
expressly certifies and warrants to the City that he has not received any
unemployment insurance payments for retired annuitant work for any public
employer within the 12 months prior to his appointment date.
J. Compliance With 960 Hours Per Fiscal Year Limit. Employee further certifies
and warrants to the City that he will not exceed the 960 hours per fiscal year limit
pursuant to Government Code Section 21221(h), including work for any other
CalPERS employer during the current fiscal year.
K. Conflicts Prohibited. During the term of this Agreement, Employee shall not
engage in any business or transaction or maintain a financial interest which
conflicts, or reasonably might be expected to conflict, with the proper discharge
of Employee’s duties under this Agreement. Employee shall comply with all
requirements of law, including but not limited to, Sections 1090, 1125 and 87100
et seq. of the Government Code, and all other similar statutory and administrative
rules.
L. Independent Legal Advice. The City and Employee represent and warrant to each
other that each has received legal advice from independent and separate legal
counsel with respect to the legal effect of this Agreement, or has at least had the
opportunity to do so, that each has carefully reviewed this entire Agreement, that
each and every term thereof is understood, and that the terms of this Agreement
are contractual and not a mere recital. This Agreement shall not be construed
against the Party or its representatives who drafted it or who drafted any portion
thereof.

sought to provide greater transparency in local government and institute certain
limitations on compensation paid to local government executives. Those statutes
also require that contracts between local agencies and their employees include
provisions requiring an employee who is convicted of a crime involving an abuse
of his/her office or position to provide reimbursement to the local agency. Those
statutes are incorporated herein by reference. Accordingly, the Parties agree it is
their mutual intent to fully comply with the cited Government Code sections and
all other applicable law as it exists as of the date of execution of this Agreement
and as such laws may be amended from time to time thereafter. Specifically, the
following Government Code sections are called out and hereby incorporated by
this Agreement:
§53243. Reimbursement of paid leave salary required upon conviction of crime
involving office or position.
§53243.1. Reimbursement of legal criminal defense upon conviction of crime
involving office or position.
§53243.2. Reimbursement of cash settlement upon conviction of crime involving
office or position.
§53243.3. Reimbursement of noncontractual payments upon conviction or crime
involving office or position.
§53243.4. “Abuse of office or position” defined.
Employee represents he has reviewed, is familiar with and agrees to comply fully
with each of these provisions if any of these provisions are applicable to
Employee.

employee and that his rights to employment with the City are governed by the terms and
conditions of this Agreement rather than the ordinances, resolutions and policies of the City of
Grand Terrace which might otherwise apply to classified or other employees of the City.

prior to signing this Agreement.

2030 VISION STATEMENT:
This staff report supports Goal #4 to develop and implement successful partnerships;
work collaboratively with community groups, private and public sector agencies; to
facilitate the delivery of services benefitting youth, seniors, and our community; work
with local, regional, and state agencies to secure funding for programs and projects.
BACKGROUND:
On July 28, 2015, the City Council approved Resolution No. 2015-30 establishing
policies and procedures for the naming of City-owned land, buildings, and facilities
(Attachment 1). The procedure establishes the guidelines and processes the Council
will use for naming or renaming City-owned land, buildings, and facilities.
The procedures calls for the Mayor to send any request for the naming or renaming of
City-owned land, buildings and facilities to the appropriate City Council subcommittee or
establish especial Council subcommittee called (Facility Naming Committee).
DISCUSSION:
City staff received a request on June 22, 2021, from resident Cheri Freund to officially
name Veteran’s Freedom Park’s T-Ball field (Attachment 2). Because this was a
renaming request, staff needed to conduct due diligence and review City records to
ensure that the renaming would not jeopardize previous funding restrictions. In addition,
staff would normally review renaming request to review original name’s historical or
emotional significance to the community before the request is forwarded to the Mayor
along with the request for the name change.
The City Clerk reviewed all records associated with the t-ball field and was unable to
discover any significant reason why not to officially name the t-ball field. Resident Cheri
Freund indicated in her email that the objective for the official naming of the t-ball field
would honor local resident Kyle Robert Garcia Bacon who grew up in the community but

sadly lost his battle with brain cancer several years ago.
The process calls for the Mayor to send the official request to the appropriate Council
committee or establish a Council Facility Naming Subcommittee. The committee will
hold a public meeting 30 days after the request has been submitted to the Mayor and no
later than 3 meetings from the original assignment date.

RESOLUTION NO. 2015-30
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE STATE OF CALIFORNIA ESTABLISHING
POLICIES AND PROCEDURES FOR THE NAMING OF CITY-
OWNED LAND, BUILDINGS, AND FACILITIES
WHEREAS, on October 8, 2013 , the City Council adopted a Facility Use Policy
establishing policies, procedures and regulations for the use of parks, sports fields, and facilities;
and
WHEREAS, the City has determined the need to establish formal guidelines for the
naming of City-owned land, buildings and facilities; and
WHEREAS, the Community Development Department has prepared a Policy to
determine appropriate names for City-owned land, buildings and facilities; whether, and under
what circumstances, such land, buildings, and facilities should be named or renamed; and the
duration of naming rights of City-owned land, buildings and facilities.
NOW THEREFORE, BE IT RESOLVED THAT CITY COUNCIL OF THE CITY OF
GRAND TERRACE DOES RESOLVE, DETERMINE, FIND AND ORDER AS FOLLOWS:
Section 1. The City Council finds that all of the above recitals are true and correct
and are incorporated herein by reference.
Section 2. The City Council hereby establishes Policies and Procedures for the
Naming of City-owned Land, Buildings and Faculties, attached hereto as Attachment A.

Policy on Place Nam es and Name Changes
I. PURPOSE
A. To establish formal policies as a guide to the City Council in considering:
1. Appropriate names for City-owned land, buildings and facilities; and
2. Whether, and under what circumstances, such land, buildings, and facilities
should be named or renamed in honor of individuals; and
3. The duration of naming rights of City-owned land, buildings and facilities.
II. SCOPE
A. This regulation is applicable to all City departments and offices responsible directly to
the City Manager.
B. It is also requested that elective offices and other independent offices and departments
of the City comply with these procedures in the interest of administrative uniformity.
III. POLICY
A. In determining the names to be given to City-owned land, buildings and facilities, the
City Council will give particular consideration to the following policy guidelines:
1. The City Council will consider candidate names for facilities whether submitted by
Council members, City staff, City agencies, civic organizations, and/or the general
public including names incorporating the name of Grand Terrace where it is deemed
important for civic or other reasons for a building or facility to be identified with the
City.
2. Names that have recognizable geographic, topographic or historical significance
associated with Grand Terrace. In assessing this type of name, the City Council will
take into consideration the recommendations from different bodies such as the
Planning Commission or Grand Terrace Historical Society.

City-owned land, buildings and facilities may be named in honor of persons who
have served the nation, the State of California and/or the City of Grand Terrace in
an exceptional and distinguished manner; and, where such action is warranted by a
contribution or service which is deemed to be of major significance.
3. The naming of City-owned land, buildings and facilities in honor of a deceased
person shall generally not take place until after a minimum of one-year waiting
period unless the City Council determines that there are overriding considerations
deviating from this policy guideline. This particular policy guideline is not intended
in any way to reflect on the merits of any deceased individual who may have been a
prominent civic leader. However, it is felt appropriate to establish some type of
waiting period to ensure that an individual's accomplishments or contributions will
stand the test of time; and that a decision shall not be made on an emotional basis
immediately following a person's death.
4. City-owned land, buildings and facilities may be named after individuals or families
who have donated the land or funds for the capital project, particularly if such
naming is set forth as a condition of the donation.
5. The City Council may approve the naming of City-owned land, buildings, or
facilities based on an organization or individual's monetary contribution to the City
for that purpose. The funds from that contribution may be used for any purpose
deemed appropriate by the City Council unless there is a specified use as a condition
of the contribution. The duration of the name is on a case-by-case basis at the
discretion of the City Council unless otherwise set forth as a condition of the
contribution approved by the Council.
6. The names of City-owned land, buildings and facilities shall not normally be named
in honor of individuals when they have previously been named for other individuals.
However, if the Council deems it appropriate, they may vary from this guideline on
a case-by-case basis.
IV PROCEDURES
A. Requests for naming or renaming of City-owned land, buildings and facilities shall be
filed with the City Clerk for transmittal to the Mayor in writing, accompanied by a
statement summarizing the justification for the recommended name(s).
B. The Mayor will forward the request to the appropriate Council subcommittee or may
establish a special Council subcommittee called the Facility Naming Committee. Such
committee shall meet within 30 days of receiving a name request and return to the City
Council with a recommendation, no later than 3 meetings from the original assignment
date. The meeting is open to the public and gives members of the community an
opportunity to give input to the process.

BACKGROUND
•The City of Grand Terrace contracts with Burrtec to provide
refuse hauling services.
•Burrtec has requested various rate increases on the basis it’s
absorbing rising cost.
•Rate increases will be proposed for both residential, multi-family,
and commercial customers.
•The last rate adjustment was approved August 2019 and went
into affect September 1, 2019.
•This proposed rate increase is a standard annual increase and
does not include legislation SB 1383 Organic Waste Reduction
which will soon be implemented by the City.

City Staff and Greens Group worked diligently to
advance the project.

Amendment #1
In March, 2020 the Greens Group
contacted the City to reiterate its
commitment to the project but expressed
concerns as the economy began to shut
down, because of COVID-19.
Amendment #1
Under the proposal presented to the Council, the current
$150,000 in deposit will be re-allocated as follows:
$100,000 will be returned from escrow to Greens Group
to provide Greens Group additional liquidity for the
development of the project.
$15,000 will be retained in deposit in escrow.
$35,000 will be provided to the City as consideration for
this amendment, including the extensions, additional
carry costs, and, due to the delay.

The amendment made no other changes
to the original PSA, including the purchase
price. Additionally, the Reimbursement
and Indemnification Agreement is not
affected and, therefore, remains in effect
as originally approved by the City and
