PUBLIC COMMENT Susan Grooms, Grand Terrace submitted a written comment opposing the Condor Battery Energy Storage System due to her concerns regarding the health and safety of the community. John Gallo, Grand Terrace commented on the upcoming Grand Terrace Cars & Coffee Santa Clause Toy Drive Becky Giroux, Grand Terrace commented on the 50th Anniversary of the Grand Terrace Lions Club and all of the accomplishments the organization has made throughout the city. An invitation is being provided to attend the Lion’s Club open house on October 4, 2023, at 6:00 p.m. Adolph Lucero, Grand Terrace complained about receiving a letter from the Public Works Department requesting that he clean up the storm drain on his property. Establish a Citizen Committee to Research Ways to Secure Additional Funding for Enhanced Law Enforcement Services Konrad Bolowich, City Manager gave the staff report for this item. PUBLIC COMMENT John Gallo, Grand Terrace supports the creation of a citizen committee to secure additional funding for enhanced law enforcement services. Edward Giroux, Grand Terrace shared that there are all sorts of grants available to assist with law enforcement services. Discussion ensued by the City Council that the citizen committee consist of as many members of the community as possible and that the city manager will have the authority to appoint those members to the committee. Councilmember Sylvia Rodriguez-Robles moved, with a second from Council Member Jeff Allen, to establish an ad hoc committee to research ways to secure additional funding for enhanced law enforcement services for a period of five (5) months and to bring back the committee’s report at the first regular meeting of the City Council in March 2024. Code Enforcement Compliance Activities Konrad Bolowich, City Manager gave the staff report and PowerPoint presentation for this item. PUBLIC COMMENT Bobbie Forbes, Grand Terrace believes that the City and Caltrans need to clean up their weeds before citing the residents. She also believes that residents may report code violations as long as they can do it anonymously. Johan Gallo, Grand Terrace suggested that the City Council speak at the next Chamber of Commerce meeting to encourage businesses to sponsor areas of the city to keep clean. Approve a change order to the contract with Goodman & Associates for additional work for 2023-24 Capital Improvement Program (CIP) Project 2024-1 in the amount of $20,000. 2. Authorize the City Manager to Execute the Change Order subject to City Attorney Approval as to Form. 2030 VISION STATEMENT: This staff report supports Goal #2 "Maintain Public Safety" by investing in critical improvements to infrastructure BACKGROUND: On June 27, 2023, the City Council approved a comprehensive 5-Year Capital Improvement Plan (CIP) spanning Fiscal Years 2023-24 through 2027-28. Concurrently, a contract was awarded to Goodman & Associates for the design phase of the 2023-24 CIP project. DISCUSSION: In the past two years, our city has realized significant cost savings, totaling approximately $400,000, from various CIP resurfacing projects. Staff has explored the possibility of incorporating additional streets into the ongoing 2023-24 CIP project, which is currently in the design phase. The streets under consideration for inclusion are as follows: Main Street: Extending from 500 feet west of Michigan to the eastern endpoint. Barton Road: Stretching from Mt. Vernon to Palm. Attached to this report is a proposal from Goodman & Associates detailing the integration of these additional streets into the existing project. C.4 Packet Pg. 13 RECOMMENDATION: Staff recommends that the City Council take the following actions: 1. Approve Amendment No. 1 to the Agreement with Goodman & Associates for the incorporation of the additional work related to CIP 2024-1. 2. Authorize the City Manager to execute Amendment No. 1, contingent upon approval from the City Attorney as to its form. The proposed cost for Amendment No. 1 is $20,000, which reflects a judicious allocation of resources in light of the potential savings and benefits associated with this amendment. CEQA FINDING: Paving projects are categorically exempt from review under the California Environmental Quality Act pursuant to Section 15301 (Existing Facilities) of Title 14 of the California Code of Regulations. (“Amendment No. 1”) by and between the CITY OF GRAND TERRACE (“City”) and GOODMAN AND ASSOCIATES, INC., a Sole Proprietor (“Consultant”) is effective as of the 26th day of September, 2023. RECITALS A. The City and Consultant entered into that certain Agreement for Contract Services By and Between the City of Grand Terrace and Goodman And Associates, Inc. for Engineering Services for CIP 2023-24, dated July 25, 2023, with a total compensation (“Contract Sum”) of $52,000.00, and for a term of one (1) year (“Agreement”). B. The City desires to amend the contract by expanding the scope of services to include additional services as per Exhibit A1 for additional compensation of $20,000. C. Based thereon, by this Amendment No.1, dated September 26, 2023, the City and Consultant desire to adjust the Contract Sum to a not to exceed amount of $72,000. C. Except as amended hereby, this extension is subject to the same terms and conditions as provided in the Agreement. TERMS 1. Contract Amendments. Payment of 50% of contract amount upon presentation of 50% status report and plans. B. Payment of 40% of contract amount upon presentation of 90% status report and plans. C. Payment of 10% of contract amount upon presentation of Final Plans, Specifications and Estimates. 2. Continuing Effect of Agreement. Except as amended by this Amendment NO. 1, all provisions of the Agreement shall remain unchanged and in full force and effect. From and after the date of this Amendment, whenever the term “Agreement” appears in the Agreement, it shall mean the Agreement, as amended by Amendment NO. 1. 3. Affirmation of Agreement; Warranty Re Absence of Defaults. City and Consultant each ratify and reaffirm each and every one of the respective rights and obligations arising under the Agreement. Each party represents and warrants to the other that there have been no written or oral modifications to the Agreement other than as provided herein. Each party represents and warrants to the other that the Agreement is currently an effective, valid, and binding obligation. Consultant represents and warrants to City that, as of the date of this Amendment NO. 1, City is not in default of any material term of the Agreement and that there have been no events that, with the passing of time or the giving of notice, or both, would constitute a material default under the Agreement. City represents and warrants to Consultant that, as of the date of this Amendment NO. 1, Consultant is not in default of any material term of the Agreement and that there have been no events that, with the passing of time or the giving of notice, or both, would constitute a material default under the Agreement. 4. Adequate Consideration. The parties hereto irrevocably stipulate and agree that they have each received adequate and independent consideration for the performance of the obligations they have undertaken pursuant to this Amendment NO. 1. 5. Authority. BACKGROUND: In past fiscal years, the City Council has approved the use of funds for the establishment of the Community Benefits Fund Grant Program. The purpose of the Community Benefits Fund Grant Program is to provide funding for local youth programs, community events, community fee waivers, and be used as an economic development tool for small business development in the City. For Fiscal Year 2023-24, the City Council has approved the use of $20,000 toward community benefit funded programs and activities. Various youth and senior program activities have benefited from the Community Benefits Fund including the Foundation of Grand Terrace, the REC Center, several youth sports leagues, and the Friends of the Grand Terrace Library. Attachment A provides a summary of awarded grants by fiscal year and the recipients of said grants awarded in each fiscal year. DISCUSSION: I. Application received from Christ the Redeemer Catholic Church C.5 Packet Pg. 22 Christ the Redeemer Catholic Church’s mission is to proclaim our belief in the message and mission of Jesus Christ. We live out these beliefs in our worship at mass, through prayer, faith sharing services and works of charity. Below summarizes the current application submitted by the Church: Project Title: Christ the Redeemer Car Show Project Activity: Christ the Redeemer Catholic Church is seeking funding to offset permit fees for a fundraiser car show. Public Purpose: This event will provide safe, family fun and entertainment of a completely secular nature to the entire community of Grand Terrace. Open to the public, all are welcome to share the spirit of community and family in Grand Terrace. Funds raised will be used to offset debt and ensure the viability of future community events benefitting the people of Grand Terrace. Amount Requested: $310.00 Utilization of Funds: Funds from the Community Benefits Fund will be used to offset permit fees for a fundraising event for our non-profit church community. Burrtec charges rates to recover costs associated with providing those services to customers. Refuse bills compensate Burrtec for the costs of providing refuse services, including all labor, equipment, material, supplies, program compliance, supervision, cost increases (including passthrough cost), and all other items necessary to perform the work and provide the services described in the Franchise Agreement. DISCUSSION: RESIDENTIAL For Residential Service, during FY 2023-24 the proposed rate adjustments include a E.6 Packet Pg. 28 CPI increase for service costs as well as pass through cost increases in the refuse disposal, organic waste processing and recyclables processing components of the rate. Other rate component adjustments include: • A maximum of $0.03 increase in Pavement Impact Fees per service address • A maximum of $0.12 increase in Franchise Fees per service address The proposed rate adjustment for the Standard 96-gallon barrel service is $0.80 per month. The proposed rate adjustment for the 64-gallon barrel service is $0.93 per month. Please see the attached rate table for all proposed rates. COMMERCIAL AND MULTI-FAMILY HOUSING For businesses and apartment complexes, the rate adjustments depend on the selections made by the customer regarding container size and how often waste is collected. The proposed rate adjustments include a CPI increase for service costs as well as passthrough cost increases in the refuse disposal, green waste processing, food waste processing, and recyclables processing components of the various service rates. Other adjustments include increases in Pavement Impact Fees (3.5%) and Franchise Fees (15%). Please see the attached rate table for all proposed rates. The public hearing will also include consideration of adopting a resolution that will authorize estimated rate increases for solid waste collection services for a five-year (5-year) period commencing October 1, 2023, and each July 1st thereafter, through and including July 1, 2027. and WHEREAS, the City Council has by previous action entered into a franchise agreement with Burrtec Waste Industries, (hereinafter “Burrtec”), for the collection and disposal of residential and commercial waste within the City (“Franchise Agreement”); and WHEREAS, Section 19 of the Franchise Agreement permits the City Council to adjust the rates for residential, commercial, and multi-family housing solid waste collection, recycling and disposal and service rates by resolution; and WHEREAS, on August 11, 2023, notices were mailed to the record owners of each parcel, and to all refuse collection service customers, in accordance with the requirements of Proposition 218, the “Right to Vote on Taxes Act”, Articles XIIIC and XIIID of the California Constitution, and California Government Code Section 53750 et seq.; and WHEREAS, as proposed, the rate increase will take effect on or after October 1, 2023; and WHEREAS, pursuant to California Government Code 53756, an agency providing refuse collection services may adopt a schedule of fees or charges authorizing automatic adjustments that pass through increases for adjustments for inflation, if it complies with all of the following: (1) The agency adopts the schedule of fees or charges for a property- related service for a period not to exceed 5 years pursuant to California Government Code Section 53755; (2) The schedule of fees or charges may include a schedule of adjustments, including a clearly defined formula for adjusting for inflation, and any inflation adjustment to a fee or charge for a property-related service shall not exceed the cost of providing that service; and (3) Notice of any adjustment pursuant to the schedule shall be given pursuant to California Government Code Section 53755(a) (which may be provided in the regular billing statement for the fee), not less than 30 days before the effective date of the adjustment; and WHEREAS, a public hearing to consider the proposed rates, was held on September 26, 2023, before the City Council, which meeting and public hearing was held more than 45 days after the mailed notice of proposed increased refuse collection service charges; and WHEREAS, written protests to the proposed increased refuse collection service charges have not been presented by a majority of the owners or tenant/rate payers of the identified parcels in the City; and WHEREAS, the City Council has held a public hearing on this matter and considered all documentation in the record (including the staff report and all attachments and exhibits, Notice Of Public Hearing Regarding Proposed Solid Waste Rate Increase, and all prior actions and Resolution(s)); and WHEREAS, the City Council deems it in the public interest to adopt increased fees or charges for residential, commercial, and multi-family housing solid waste collection, recycling and disposal services for Fiscal year 2023-2024 commencing October 1, 2023; and the estimated rate increases for solid waste collection services for a five-year (5-year) period commencing October 1, 2023 through July 1, 2027, in an amount not to exceed more than ten percent of the previous year’s rates, pursuant to California Government Code Section 53755, as further identified in Exhibit “A” to this Resolution; and WHEREAS, the adoption of this resolution is exempt from the requirements of the California Environmental Quality Act (“CEQA”) pursuant to Public Resources Code Section 21080(b)(8) and Section 15273 of the State CEQA Guidelines codified at 14 CCR §15273 because the resolution pertains to the adoption of charges necessary to maintain services within the City’s existing service area. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1: The preceding recitals are true and correct and incorporated herein by reference. SECTION 2: The City Council hereby finds that the proposed rate increases, meets the substantive requirements of Proposition 218 (Cal. Const. Art. XIIID) as follows: a. Fee for Service Provided Only: Revenues derived from the fee may not be used for any purpose other than that for which the fee was imposed. Fee not to Exceed Cost of Service: Revenues derived from the fee may not exceed the funds required to provide Refuse Service. The City’s cost for Refuse Service is established by the Franchise Agreement it negotiated with Burrtec as the lowest- cost contractor for refuse collection and disposal services available. Refuse bills compensate Burrtec for the costs of providing refuse services, including all labor, equipment, material, supplies, program compliance, supervision, cost increases (including passthrough cost), and all other items necessary to perform the work and provide the services described in the Franchise Agreement. RESIDENTIAL For Residential Service, during FY 2023-24 the proposed rate adjustments include a CPI increase for service costs as well as pass through cost increases in the refuse disposal, organic waste processing and recyclables processing components of the rate. Other rate component adjustments include: • A maximum of $0.03 increase in Pavement Impact Fees per service address • A maximum of $0.12 increase in Franchise Fees per service address The proposed rate adjustment for the Standard 96-gallon barrel service is $0.80 per month. The proposed rate adjustment for the 64-gallon barrel service is $0.93 per month. The attached rate table for all proposed rates is incorporated herein as though set forth in full. ESTIMATED ANNUAL RATE INCREASES FOR SOLID WASTE SERVICES FOR A FIVE-YEAR PERIOD COMMENCING OCTOBER 1, 2023 THROUGH JULY 1, 2027 The proposed rate schedule also includes estimated rate increases for solid waste collection services for a five-year (5-year) period commencing October 1, 2023, and each July 1st thereafter, through and including July 1, 2027. For the years 2023-2027, beginning October 1, 2023, the annual maximum rates shall not exceed more than ten percent of the previous year’s rates. The City Council hereby finds that the proposed increases do not exceed the cost required to provide the service. c. Passthrough costs may include but only to the extent necessary to provide actual services: a. Service fees b. Landfill/disposal fees charged to the hauler for and vary based on type and weight of material c. Environmental fees charged to dispose of hazardous waste d. Regulatory fees imposed by local or state governments to cover the cost of waste management regulation and oversight d. Fee not to Exceed Proportional Cost: The amount of the fee may not exceed the proportional cost of the Refuse Service attributable to the parcel. The City’s rate analysis concluded that the proposed rates are reasonably proportional and cost- based and meet the general requirements of fairness and equity under Proposition 218. SECTION 3: The City Council has fully considered this matter and has: a. Reviewed the submittal, notice and the information submitted herewith regarding the proposed increase, the parcels to which the proposed fee increase would apply, and the reasons and basis for the increase and the fees; b. Provided notice of the proposed fee increase to the record owners (or tenants responsible for payment of the fee) of all parcels to which the proposed fee increase would apply in accordance with Article XIIID of the California Constitution; c. Heard and received all written protests from any owners (or renters) of real property subject to the fee; d. Taken and received oral and documentary evidence pertaining to the proposed fee increase; and e. Been fully informed of this matter. Therefore, the City Council hereby adopts the increased residential, commercial, and multi-family housing solid waste collection, recycling and disposal service charges as identified in Exhibit “A.” Said solid waste collection, recycling, and disposal services rates for residential customers, for commercial customers, and for multi- housing customers are to take effect as indicated in Exhibit “A.” SECTION 5: The City Clerk shall certify to the passage and adoption of this Resolution. SECTION 6: Any Resolution in conflict herewith relating to the increased refuse rates described herein is hereby repealed to the extent of such conflict and of no further effect to the extent of such conflict.
