RECOMMENDATION:
Accept the Grand Terrace Parks & Recreation Advisory Committee's Recommendation
for the Grand Terrace Dog Park

8. Community Benefit Fund Grant Award to the Grand Terrace Foundation of Grand
Terrace Youth in the Amount of $2,000.00
RECOMMENDATION:
Deny the Community Benefit Fund grant application in the amount of $6,000 to the
Foundation of Grand Terrace, Youth. In order to assist high school students with their
senior activities, Staff recommends that interested Grand Terrace High School Seniors
participate in a fellowship with the City to earn up to $320.00 ($16.00/hr. for 20 hours of
fellowship), for these activities.

9. Establishment of a Transactions and Use Tax
RECOMMENDATION:
Provide direction to City staff whether to prepare necessary resolutions and an
ordinance to establish a Transactions and Use Tax as a Ballot Measure for Voter
Approval or provide other direction.

2030 VISION STATEMENT:
This staff report supports Goal #5, Engage in Proactive Communication.
BACKGROUND:
Beginning with the November 14, 2017, City Council meeting, the City Manager directed
the City Clerk to provide Council with a copy of the Planning Commission, Historical &
Cultural Activities Committee, and Volunteer Emergency Operations Committee minutes
to keep Council up-to-date on those Commission/Committee activities and on January
16, 2018, the City Manager requested that the Parks & Recreation Advisory minutes be
included in the Committee/Commission Report.
DISCUSSION:
Planning Commission – No meeting minutes update.
On October 12, 2023, the Parks & Recreation Advisory Committee held its Regular
Meeting and approved its September 14, 2023, Regular Meeting minutes. On
November 9, 2023, the Committee held its Regular Meeting and approved its
October 12, 2023, Regular Meeting minutes. On December 14, 2023, the Committee
held its Regular Meeting and approved its Nover 9, 2023, Regular Meeting minutes. The
minutes for these meetings are included as attachments to this report. The Committee’s
next Regular Meeting is scheduled for January 11, 2024.
Historical & Cultural Activities Committee – No meeting minutes update.

RECOMMENDATION: Approve the Check Register No. 11302023 in the amount of
$676,339.18 as submitted, for the month ending November
30, 2023.
2030 VISION STATEMENT:
This staff report supports Goal #1, “Ensuring Our Fiscal Viability”, through the
continuous monitoring of expenditure budgets, allocations, and operational costs.
BACKGROUND:
The check register for the month of November-2023 has been prepared in accordance
with Government Code §37202 and is hereby submitted for City Council’s approval.
The check register lists all vendor payments for the respective month, along with a brief
description of the type of goods or services purchased and the account code(s)
associated with each payment. The check registers list all payments made to vendors
and employee reimbursements during the month of November-2023.
The attached index to the Check Register is a guideline account list only and is not
intended to replace the comprehensive chart of accounts used by the City and Grand
Terrace Successor Agency. Expenditure account number formats are XX-XXX-XXX
[Fund-Department-Account]. Expenditures may be made from trust/agency accounts
(Fund 23-XXX-) or temporary clearing accounts that do not have a budgetary impact.

RECOMMENDATION: Approve the Check Register No. 12312023 in the amount of
$842,004.13 as submitted, for the month ending December
31, 2023.
2030 VISION STATEMENT:
This staff report supports Goal #1, “Ensuring Our Fiscal Viability”, through the
continuous monitoring of expenditure budgets, allocations, and operational costs.
BACKGROUND:
The check register for the month of December-2023 has been prepared in accordance
with Government Code §37202 and is hereby submitted for City Council’s approval.
The check register lists all vendor payments for the respective month, along with a brief
description of the type of goods or services purchased and the account code(s)
associated with each payment. The check registers list all payments made to vendors
and employee reimbursements during the month of December-2023.
The attached index to the Check Register is a guideline account list only and is not
intended to replace the comprehensive chart of accounts used by the City and Grand
Terrace Successor Agency. Expenditure account number formats are XX-XXX-XXX
[Fund-Department-Account]. Expenditures may be made from trust/agency accounts
(Fund 23-XXX-) or temporary clearing accounts that do not have a budgetary impact.

RECOMMENDATION: The adoption of the proposed amendments to Chapter 12.08
Street Excavations aims to enhance clarity, streamline
content, and align language with current standards, with a
specific focus on implementing a new pavement moratorium
and eliminating redundant language
BACKGROUND:
The City of Grand Terrace introduced Ordinance No. 64, incorporating Chapter 12.08
into the Grand Terrace Municipal Code (GTMC). This addition aimed to establish
regulations governing excavations and trenching within public rights of way by project
applicants, residents, and utility companies. Subsequent amendments occurred in 1990
with Ordinance No. 125, addressing cash deposits and public service companies. In
2005, Ordinance No. 218 imposed fines for non-compliance, and in 2020, Ordinance
No. 330 granted the City Council authority over fees and deposits.
DISCUSSION:
The City is currently in the process of amending Chapter 12.08 (Street Excavations) of
the GTMC with the primary goal of streamlining content, updating language to align with
prevailing standards, introducing a new street pavement moratorium, and removing
"Attachment A: Specifications for Construction Within the Right of Way." Henceforth,
construction specifications will be diligently adhered to as directed by the City Engineer,
eliminating redundant language and ensuring conformity with the latest engineering
standards and guidelines.
The proposed amendments include the addition of Section 12.08.330, introducing a new
pavement moratorium. This section is designed to mitigate pavement degradation,
uphold street structural integrity, ensure a smooth surface for all transportation modes,
and minimize negative visual impacts. The key provisions are outlined below:
A. Notice Prior to City-Initiated Construction:
The City Engineer will make efforts to notify all owners of substructures and facilities
adjacent to public places or streets, potentially affected six months before the
anticipated date of City-initiated construction.
B. Limitations on Excavation for Recently Constructed Streets:

Post-Construction Moratorium: The pavement surface cannot be excavated for five
(5) years following completion or the recordation of a notice of completion. On slurry-
sealed streets, this moratorium extends to three (3) years from completion unless the
applicant agrees to cover the cost of resurfacing the street with a minimum one-inch-
thick asphaltic concrete cap. This resurfacing must span 50 feet on either side of the
proposed excavation on a longitudinal basis from the centerline of the street.
FISCAL IMPACT:
A fiscal impact will not occur as a result of the ordinance adoption.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, STATE OF CALIFORNIA, ADOPTING AMENDMENTS AND
ADDITIONS, AND RENUMBERING TO CHAPTER 12.08 (“STREET
EXCAVATIONS”) OF TITLE 12 (“STREETS, SIDEWALKS AND PUBLIC
PLACES”) OF THE GRAND TERRACE MUNICIPAL CODE BY
ESTABLISHING EXCAVATION AND TRECHINGTRENCHING
STANDARDS
WHEREAS, in 1982 the City of Grand Terrace (“City”) adopted Ordinance No. 64,
adding Chapter 12.08 relating to Excavations in City Streets and Public Places (“Chapter
12.08”) to the Grand Terrace Municipal Code (“GTMC”), in order to establish rules and
regulations to govern openings excavations and trenching within the public right of way
by project applicants, residents, and utility companies; and
WHEREAS, in 1990 the City of Grand Terrace (“City”) adopted Ordinance No. 125
amending Chapter 12.08 of the GTMC by repealing section 12.08.360, and adding a new
sections 12.08.080 entitled Cash Deposits and section 12.08.360 entitled Public Service
Companies; and
WHEREAS, in 2005 the City of Grand Terrace (“City”) adopted Ordinance No. 218
amending adding sSection 12.08.410 to s in Chapter 12.08 establishing fines of
$1,000.00 for failure to obtain a street cut permit and failure to comply with specifications
established in the chapter; and
WHEREAS, in 2020 the City of Grand Terrace (“City”) adopted Ordinance No. 330
amending sSections 12.08.080 and 12.08.260 in Chapter 12.08 to authorize the City
Council to adopt certain fees and deposits by resolution; and
WHEREAS, the City desires to amend Chapter 12.08 (Street Excavations) of its
municipal codethe GTMC to ordinance is undergoing revisions with the overarching
objective of streamlineing its content, updateing the language to align with prevailing
standards, implement a new, street pavement moratorium, and effectuating the removal
ofremove “"Attachment A: Specifications for Construction Within the Right of Way.”" The
intent is that, Hhenceforth, all pertinent construction specifications shall be diligently
adhered to as promulgated and directed by the City Engineer., This thereby
obviatingobviates the necessity for redundant documentation and ensuring ensures
conformity with the most up-to-date engineering standards and guidelines.; and
WHEREAS, under circumstances where permission to excavate is granted
notwithstanding the moratorium, excavations shall be permanently patched, all permitted
work, and material shall meet current City Standards and Greenbook Standard
Specifications for Public Works as further provided in this ordinance; and

SECTION 1. Recitals. The above recitals are true and correct and incorporated
herein by reference.
SECTION 2. CEQA. The City Council finds that the actions contemplated by this
Ordinance are exempt from the California Environmental Quality Act ("CEQA") pursuant
to Section 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a project
as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations,
Title 14, Chapter 3, because it has no potential for resulting in physical change to the
environment, directly or indirectly.
SECTION 3. Chapter 12.08 (“Street Excavations”) of Title 12 (“Streets, Sidewalks
and Public Places”) of the Grand Terrace Municipal Code is hereby attached as Exhibit
Aamended as follows:
a. Section 12.08.020 (“Definitions”) of Chapter 12.08 (“Street Excavations”) of
Title 12 (“Streets, Sidewalks and Public Places”) of the Grand Terrace Municipal Code is
hereby amended and shall now read as follows (deleted text, if any, is shown in
strikethrough; new text, if any, is shown in bold & italics):
“12.08.020 Definitions.
For the purposes of this Chapter, the following terms shall have the meaning
designated unless it is clear from the context that a different meaning is intended:
A. “Applicant” means any person making written application to the City
Engineer for an excavation permit encroachment permit under this
Chapter.
B. "Excavation" means any opening in the surface of a public place
made in any manner whatsoever except an opening into a lawful
structure below the surface of a public place, the top of which is flush
with the adjoining surface and so constructed as to permit frequent
openings without injury or damage to the public place.
C. “Encroachment” means constructing or placing temporary or
permanent structures, improvements, facilities or materials in, on,
over, or under any public right-of-way or using any right-of-way so as
to prevent, obstruct, or interfere with the normal use of that way,
including but not limited to the performance of any of the following
acts:
1. Excavating or disturbing the public right-of-way;
2. Erecting or maintaining any post, sign, pole, fence, guard rail,
wall, pipe, conduit, cable, wire, communication service
equipment, or other facility or structure on, over, or under a
public right-of-way;

3. Planting any tree, shrub, grass, or other growing thing within
the public right-of-way;
4. Placing or leaving on the public right-of-way any rubbish,
brush, earth, or material;
5. Constructing, placing, or maintaining on, over, under, or within
a public right-of-way any pathway, sidewalk, driveway, or
other surfacing; any culvert or other surface drainage or
subsurface drainage facility; or any pipe, conduit, wire,
communication service equipment or facility, or cable; and
6. Constructing, placing, planting, or maintaining any structure,
embankment, excavation, tree, or other object adjacent to the
public right-of-way which causes or may cause an
encroachment.
C.D. “Facility” means pipe, pipeline, tube, main, service, trap, vent, vault,
manhole, meter, gauge, regulator, valve, conduit, wire, tower, pole,
catch basin, pole line, anchor, cable, junction box, transformer or any
other material, structure or object of any kind or character, whether
enumerated in this Chapter or not, which is or may be lawfully
constructed, left, placed or maintained in, upon, along, across, under
or over a public place.
D.E. "Permit holder” “Permitee” means any person who has been granted
and has in full force and effect an excavation permit encroachment
permit issued under this Chapter.
E.F. “Person” means any person, firm, partnership, association,
corporation, company, political body or organization of any kind.
F.G. “Public place” means any public street, way, place, alley, sidewalk,
park, square, or any other public property owned or controlled by any
governmental agency in a governmental capacity.
H. "Public utility" means any electrical corporation, gas
corporation, heat corporation, water corporation, telephone
corporation, pipeline corporation, sewer corporation, telegraph
corporation, where the service is performed for, or the
commodity delivered to, the public or any portion thereof.
I. "Slurry seal" means a mixture of polymer modified asphalt
emulsion, mineral aggregate, mineral filler, water, and other
additives, properly proportioned, mixed, and spread in
accordance with the City of Grand Terrace and Caltrans
standard plans specifications, and details, whichever is more
stringent, or as directed by the City Engineer and usually less
than one-half inch in thickness.

H.J. “Street” means any street, highway, sidewalk, alley, avenue or other
public way or public ground in the City.
K. “Street overlay” means one or more courses of asphalt
construction on an existing pavement; usually greater than one-
half inch in thickness; generally includes an asphalt leveling
course to correct the contour of the old pavement.
I.L. “Substructure” means any pipe, conduit, duct, tunnel, manhole, vault,
buried cable or wire or any other facility located below the surface of
any public place.”

“12.08.070 Signs.
All places of business and residences abutting the public place or streetright of
way that are is within the limits of any workconstruction zone shall be notified, by
the permit holder, by mail or door hangers at least five (5) days prior to
commencement of work. This written notification shall be approved in advance
by the City Engineer and explain the sequence of work and indicate any
restrictions of access. Verbal notification shall be given to all places of business
and residences at least 24 hours in advance of commencing work that will affect
access to and from their properties.”

A. Each permittee, prior to receiving a permit pursuant to this Chapter,
shall deposit an amount set by resolution of the City Council with the
City Finance Department. This amount is to secure emergency street
repairs required as a result of the permittee's street cuts. This amount
shall be placed by the Finance Director into a special account. The
deposit shall be utilized by the City to make any emergency street
repairs required, which repairs cannot be done by the permittee. The
amount of deposit above the $500.00 minimum shall be computed in
accordance with the fees schedule set by resolution. Such deposit
shall be refunded to the permittee upon request 24 months after
completion and acceptance of the project.
B. Return of the deposit shall be conditioned upon the permittee's
compliance with this Chapter, and further conditioned that the
permittee must fill up, restore and place in good and safe condition
as near as may be to its original condition, and to the satisfaction of
the City Engineer, all openings and excavations made in streets, and
must maintain any street where excavation is made in as good
condition for the period of 24 months after the work has been done.
Any settlement of the surface within that two-year period shall be
deemed conclusive evidence of defective backfilling by the
permittee. Nothing contained in this Subsection shall be construed
to require the permittee to maintain any repairs to pavement made
by the City if such repairs should prove defective. Any owner of real
estate repairing or engaging another to repair his own sidewalk shall
not be required to give such deposit. An acceptable bond or letter of
credit may be given under this provision, which shall remain in force
for two years, conditioned as above in the amount specified, and in
other respects as specified but applicable as to all excavation work
in streets by the principal making such deposit during the term of two
years from such date.
C.A. An application for an excavation encroachment permit to perform
excavation work under this Chapter shall be accompanied by a cash
deposit, payable to the City, in accordance with a schedule of fees
set by resolution. No deposit shall be less than the amount as set by
resolution of the City Council. Any person intending to make
openings, cuts or excavations in streets or public places may make
and maintain with the City Finance Director a general annual deposit
in the sum of not less than an amount set by resolution of the City
Council. , and the person so depositing shall not be required to make
the special deposits provided in this Section, but shall, however, be
required to comply with all other applicable provisions of this
Chapter. Any special or general deposit made under this Section
shall serve as security for the repair and performance of work
necessary to put the street in as good a condition as it was prior to
the excavation if the permittee fails to make the necessary repairs or

to complete the proper refilling of the opening and the excavation
work under the excavation permit. Such cash deposit, except in the
case of an annual deposit, shall be refunded by the City to the
permittee permit holder upon the expiration of such 24-month
period and upon request of the permittee permit holder; provided,
that the City may use any or all of any such deposit to pay the cost
of any work the City performs to restore or maintain the street or
public place as provided in this Chapter in the event the permittee
fails to perform such work, in which event the amount refunded to the
permittee permit holder shall be reduced by the amount thus
expended by the City. The decisions of the City Engineer as to the
cost of the work done or repairs made by him under the provisions
of this Chapter shall be final and conclusive as to cost. An applicant
may submit a bond or letter of credit in a form and amount
acceptable to the City Engineer, which shall remain in effect for
not less than 24 months, in lieu of a deposit under this
provision.
B. Return of the deposit shall be conditioned upon the permit
holder's compliance with this Chapter, and further conditioned
that the permit holder must fill, restore, place in good and safe
condition, and as near to its original condition the public place
or street, and to the satisfaction of the City Engineer for the
period of 24 months after the work has been accepted. Any
settlement of the surface of the public place or street within that
24 month period shall be deemed conclusive evidence of
defective backfilling by the permit holder. Nothing contained in
this Subsection shall be construed to require the permit holder
to maintain any repairs to pavement made by the City if such
repairs should prove defective.
C. Any owner of real property repairing or engaging another to
repair privately owned property that is not a part of the public
place or street shall not be required to give such deposit, but
shall comply with all other provisions of this Chapter”

The permit holder shall submit a traffic control plan subject to approval by the City
Engineer and take appropriate measures assure that, during the performance of
the excavation work, traffic conditions as nearly normal as practicable are
maintained at all times, so as to cause as little inconvenience as possible to the
occupants of the abutting property and to the general public. The traffic control
plan shall ensure that the schedule and conduct of work avoids unnecessary
inconvenience to the public and abutting property owners, avoids undue delay in
construction activities to reduce the public's exposure to construction dust and
debris. All street closures shall be approved in advance by the City Engineer. The
traffic control plan shall include a detour plan, as applicable. The City Engineer
may in his discretion permit the closing of streets to all traffic for a period
recommended by him in order for the permit holder to complete the excavation
work. The permit holder shall comply with standards set forth by the latest edition
of the State of California’s Manual on Uniform Traffic Controls Devices for route
and traffic control, including its own vehicles, as directed by the City Engineer.”

substructures and facilities located adjacent to the public place or
street who might be affected approximately six months prior to the
probable date of City initiated construction of any new paving or
repaving of any public place or street in the City. The failure to give
such notice shall not affect any provisions of this Chapter.
B. No excavation, trenching, or street overlay shall be permitted on any
public place or street that has been constructed, or reconstructed,
within the previous five (5) years from the date of the Application.
The pavement surface shall not be excavated for a period of five (5)
years after completion of, or from recordation of a notice of
completion. On a slurry sealed street, the pavement surface shall not
be excavated for a period of (3) years from completion unless the
applicant proposing to make such excavation shall agree to pay for
resurfacing the street with an asphaltic concrete cap of a minimum
thickness of one inch for a distance of 50 feet on either side of the
proposed excavation on a longitudinal basis from centerline of the
street.”

“12.08.140 Exceptions to new pavement moratorium
The City Engineer/Public Works Director may, in his sole discretion, grant an
exception to the moratorium for:
A. Emergencies which endanger life, or public health and safety.
B. Work that is mandated by city, state or federal legislation.
C. Service to buildings or properties where no other reasonable means
of providing service exist.”

SECTION 4. City of Grand Terrace seeks to ameliorate pavement degradation,
maintain structural integrity of thoroughfares, maintain and preserve a smooth surface for
all modes of transportation, and reduce negative visual impacts. By revising Chapter
12.08 (Street Excavations), property owners, contractors or utilities companies with
proposed projects that require excavation of roadways can more effectively plan for
excavation activities while preserving the integrity of public right of ways.
SECTION 5. The inclusion of a comprehensive street pavement moratorium for
those public right of ways that have recently been constructed or rehabilitated serves as
an instrumental mechanism in preserving and fortifying the structural integrity of the City's
thoroughfares. This measure ensures that the newly rehabilitated streets remain
undisturbed during a critical period, thereby optimizing the efficacy of the rehabilitation
and safeguarding the municipality's infrastructure investments.
SECTION 6. Severability. If any provision(s) of this Ordinance or the application
thereof to any person or circumstances is held invalid or unconstitutional by any court of
competent jurisdiction, such invalidity or unconstitutionality shall not affect any other
provision or application, and to this end the provisions of this ordinance are declared to
be severable. The City Council hereby declares that they would have adopted this
ordinance and each section, subsection, sentence, clause, phrase, part or portion thereof,
irrespective of the fact that any one or more sections, subsections, clauses, phrases,
parts or portions thereof be declared invalid or unconstitutional.
SECTION 7. Posting. The City Clerk shall certify to the passage and adoption of
this Ordinance by the City Council and shall cause this ordinance to be published or
posted in accordance with Government Code Section 36933 as required by law.
SECTION 8. This Ordinance shall take effect and be in full force and effect from
and after thirty (30) calendar days after its final passage and adoption.

On June 13, 2023, Council Member Jeff Allen requested that the City Council consider
a future agenda item requesting renaming the City of Grand Terrace Dog Park after
Anne Wade-Hornsby. On October 24, 2023, staff brough back a staff report for the City
Council to consider re-naming the City of Grand Terrace Dog Park to “Anne Wade-
Hornsby Dog Park”. After questions and deliberations, it was the recommendation of the
City Council to forward the item to the Grand Terrace Parks & Recreation Advisory
Committee for discussion and consideration.
DISCUSSION:
On November 9, 2023, the Grand Terrace Parks & Recreation Advisory Committee
(Committee) held its regular meeting. One of the items up for discussion was the
possible re-naming of the Grand Terrace Dog Park (Dog Park) after Grand Terrace
resident, Anne Wade-Hornsby.
Several suggestions were made for consideration by the entirety of the Committee
which were:
• Renaming the dog park after another member of the community.
• Leave the park name unchanged.
• Seek input from the Grand Terrace Foundation on other name suggestions.
• Request more input from city residents.
• Naming specific items within the park, such as a water fountain or fire hydrant
after individuals who have made significant contributions and using placards to
identify those contributions made.
• Consideration be given to those individuals who initiated the development of the
dog park and avoid naming the park after a single individual.

was to narrow down the list of suggestions that the Committee made at its November 9,

appropriations; and

collaboration with community groups, youth programs and senior organizations.
BACKGROUND:
In past fiscal years, the City Council has approved the use of funds for the
establishment of the Community Benefits Fund Grant Program. The purpose of the
Community Benefits Fund Grant Program is to provide funding for local youth programs,
community events, community fee waivers, and be used as an economic development
tool for small business development in the City. Each year, part of these funds has been
designated for the City’s annual Light Up Grand Terrace event.
For Fiscal Year 2023-24, the City Council has approved the use of $20,000 toward
community benefit funded programs and activities.
Various youth and senior program activities have benefited from the Community
Benefits Fund including the Foundation of Grand Terrace, the REC Center, several
youth sports leagues, and the Friends of the Grand Terrace Library.

The Organization’s mission is that they are dedicated to ensuring that the graduating
seniors of GTHS experience an unforgettable and fulfilling year. We are a team of
passionate and driven volunteers committed to making a meaningful impact on the lives
of the graduating class. Through the support of our community, businesses,
fundraisers, grants, and other contributions, we strive to provide direct and discreet
assistance to students who may face financial constraints. Our aim is to enable every
student to participate in significant senior events including Grad Night, Prom, Senior
Inspiration, and access to yearbooks, formal wear for dances, scholarships and more.
Below summarizes the current application submitted by the Organization:
Project Title: GTHS Senior Legacy for the Class of 2024
Project Activity: Funding for qualified GTHS seniors to potentially
include Prom, Grad Nite, Senior Inspiration
dinner, Scholarship opportunities, college

other direction.

identifying additional revenue sources.
BACKGROUND:
On December 12, 2023, an Ad Hoc Citizens Committee made a presentation to the City
Council regarding potential funding sources for additional law enforcement services in
Grand Terrace. As part of the presentation, this Committee recommended that the City
Council consider adoption of 1.00% transactions and use tax to generate the necessary
revenue for these added services. The City Council, thereafter, directed staff to return
with a follow-up presentation on the options and corresponding procedures to establish
a Transactions and Use Tax at a Rate of 1.00%. This staff report now serves as a
general overview of transactions and use taxes and the procedural aspects of adopting
such a tax.
DISCUSSION:
I. Transactions and Use Tax Generally
The current city-wide tax rate is 7.75%, which is composed of State, County and City
sales tax rates. The City’s component is only 1.00% as shown below.

State law “caps” the total cumulative sales tax rate at a maximum rate of 10.25% for the
jurisdiction of Grand Terrace. Because 7.25% has already been accounted for of this
maximum, 2.50% remains available to be allocated.
If there is a desire to capture a portion of this remaining 2.50%, which is what the Ad
Hoc Citizens Committee has recommended, an ordinance will need to be adopted, as
described in this report, to establish a Transactions and Use Tax with a specified tax
rate for implementation. Per section 7285.92 of the Revenue and Tax Code, a
maximum of 2.00% of the remaining 2.50% may be captured by the City via a
Transactions and Use Tax. The Ad Hoc Citizens Committee has recommended 1.00%.
It is important to note that transactions and use taxes under the Transactions and Use
Tax Law (TUTL)1 are distinct from sales and use taxes (otherwise known as the
Bradley-Burns sales tax).2 A sales and use tax is generally allocated to the jurisdiction
where the sale is made, while a transactions and use tax is allocated to the jurisdiction
where the goods are delivered or placed into use.3 For example, sales of motor vehicles
are taxable if registered in the city that imposes the transactions and use tax, regardless
of the point of sale.
II. The City Council May Levy a Transactions and Use Tax
The City may implement the transactions and use tax itself pursuant to the TUTL,
subject to approval by the City Council and electorate.4 The proposed tax may be for a
general purpose (i.e., a “general tax”) or specific purpose (i.e., a “special tax”).
A. General Purpose (i.e., a “general tax”)
A city may levy, increase, or extend a transactions and use tax “for general purposes at
a rate of 0.125% or a multiple thereof, if the ordinance proposing that tax is approved by
a two-thirds vote of all members of that governing body and the tax is approved by a
majority vote of the qualified voters of the city.”5 The authority of a city to impose
transactions and use taxes under any provision of law is subject to the rate limitation
specified in the California Revenue and Tax Code section 7251.1 (currently 2%).6
Due to Proposition 218, a general tax measure must be consolidated with a general
municipal election where the city council seats are up for election.7 Since the next
general election will take place on November 5, 2024, the City may present the
proposed transactions and use tax as a general tax in the upcoming general election.

A general tax measure may be presented to the electorate at a special election “in
cases of emergency declared by a unanimous vote of the governing body.”8 The
emergency would be a “fiscal” emergency and the city council would need to adopt facts
and findings in a resolution supporting the declaration of a fiscal emergency. Although
no published decisions address what constitutes an “emergency” under Article XIII C
Section 2 of the California Constitution, cases reviewing urgency ordinances have
stated that, provided an ordinance recites facts that could reasonably be held to
constitute an emergency, “the courts will not interfere, and they will not undertake to
determine the truth of the recited facts.”9
The City will not hold any special elections in 2024. Thus, if the City Council chooses to
proceed with a general tax measure in 2024, it must be presented in the next general
election in November 2024.
B. Specific Purpose (i.e., a “special tax”)
A city may also levy, increase, or extend a transactions and use tax for specific
purposes. The tax may be levied, increased, or extended at a rate of 0.125% or a
multiple of that rate if:
1. The ordinance proposing that tax is approved by a two-thirds vote of all members
of the city council and is subsequently approved by a two-thirds vote of the
qualified voters of the city voting in an election on the issue;10
2. The transactions and use tax conforms to the Transactions and Use Tax Law;11
and
3. The ordinance includes an expenditure plan describing the specific projects for
which the revenues from the tax may be expended.12
Again, the authority of a city to impose transactions and use taxes under any provision
of law is subject to the rate limitation specified in the California Revenue and Tax Code
section 7251.1.13
Under the California Government Code section 50077, a city may place a special tax on
the ballot by ordinance or resolution, adopted after notice and a public hearing.
Proposition 62 requires that the ordinance or resolution proposing the tax include the
type of tax, its rate, the method of collection, the date on which the election on the tax

will be held, and the purpose for which the special tax will be used.14 Accordingly, the
measure may be introduce as a special tax in the next general election on November 5,
2024.
As discussed above, the City will not hold any special elections in 2024. Thus, if the City
Council chooses to proceed with a special tax measure, it must be presented in the
upcoming November 2024 general election.
C. Adoption of Three Elections Resolutions and Reading of an Ordinance
Upon determining a general or specific purpose, the following items concerning the
proposed transactions and use tax must be completed by the City Council:
1. Adoption of a resolution ordering submission to the qualified electors of the City
of a certain measure relating to a transactions and use tax at the general election
to be held on November 5, 2024.
2. Adoption of a resolution setting priorities for filing written argument(s) and
directing the City Attorney to prepare an impartial analysis regarding the
transactions and use tax measure.
3. Resolution providing for the filing of rebuttal arguments for a transactions and
use tax measure submitted at the general election on November 5, 2024.
4. If the resolutions above are adopted, a first reading, by title only, of an ordinance
relating to the proposed general transactions and use tax measure. (Note, the
second reading of the ordinance would be conducted after the election is certified
presuming the ballot measure is approved by the voters.)
Per the City Clerk and relevant county requirements, the last day to submit these
adopted resolutions to the San Bernardino County Elections office is August 9, 2024. As
such, all four listed items must be completed before this deadline. Accordingly, if the
City Council directs staff to move forward with a ballot measure, our office recommends
adoption of the necessary resolutions by the second meeting in June 2024, or at worst,
the first meeting in July 2024, to provide sufficient time for the City Clerk to work with
the County to satisfy this deadline.
III. The Initiative Process May Be Used to Impose a Transactions and Use Tax
If the City Council elects not to move forward with establishing a transactions and use
tax, the residents may still pursue the tax by initiative measure. Since courts liberally
construe the initiative process and resolve all doubts in favor of its use, a tax by initiative
measure will be upheld unless its unconstitutionality is clearly, positively, and

unmistakably evident.15 The only express limitations on the initiative power are the
prohibition against measures that embrace more than one subject16 and any
constitutional amendments and statutes which name any individual to hold office or
name/identify any private corporation to perform any function or have any power or
duty.17 As such, the California Supreme Court has established that “there is no
restriction on the use of the initiative in the area of taxation.”18
A. Procedures for an Initiative Measure
The statutory procedures for city initiative processes may be found in the California
Elections Code sections 9200-9226. The following summary provides an overview of
the relevant requirements.
1. Notice of Intention. Before circulating an initiative petition, the proponents shall
file with the City Clerk a notice of intention. The notice shall be accompanied by
the written text of the initiative and may be accompanied by a written statement
not in excess of 500 words, setting forth the reasons for the proposed petition.
The notice shall be signed by at least one, but not more than three, proponents.19
2. Title and Summary. The city attorney shall prepare a ballot title and summary
within fifteen (15) days from filing of the notice of intention. The ballot title may
differ from any other title of the proposed measure and shall express in 500
words or less the purpose of the proposed measure. In providing the ballot title,
the city attorney shall give a true and impartial statement of the purpose of the
proposed measure in such language that the ballot title shall neither be an
argument, nor be likely to create prejudice, for or against the proposed measure.
The elections official shall furnish a copy of the ballot title and summary to the
person filing the proposed measure.20
3. Publication. The proponent must publish (in a qualifying newspaper) and/or post
the notice of intention and the title and summary of the proposed measure. The
Election Codes do not require the publication or posting of the text of the
proposed measure. Within ten (10) days after publication and/or posting the
proponent must file with the elections official an affidavit made by a
representative of the newspaper with respect to publication and/or a voter of the
city with respect to posting.21

4. Circulation. After publication and/or posting the title and summary prepared by
the city attorney, the proponent(s) may circulate the petition among the voters of
the city for signature by any registered voter of the city. Each section of the
petition shall bear a copy of the notice of intention and the title and summary
prepared by the city attorney.22
5. Deadline. The petition must be filed in the office of the elections official no later
than 180 days following the date that the title and summary was received by the
proponent. If the petition is not filed within the time permitted, then the petition
shall be void for all purposes.23 The elections official shall accept the petition for
filing, and it shall be deemed as filed on that date, if the number of signatures,
prima facie, equals or is in excess of the minimum number required. Any petition
not accepted for filing shall be returned to the proponent.24
6. Examination. Within 30 days from the date of the petition having been filed,
excluding, Saturdays, Sundays, and holidays, the elections official shall examine
the petition for its sufficiency in accordance with Elections Code sections 9114
and 9115.25 A petition is sufficient if it is signed by not less than 10 percent of the
voters of a city, according to the last report of registration by the county elections
official to the Secretary of State pursuant to Elections Code section 2187,
effective at the time the notice of intention was published.26
7. Sufficiency/Insufficiency. The elections official shall notify the proponents as to
the sufficiency or insufficiency of the petition. If the petition is found insufficient,
no action shall be taken on the petition. If the petition is sufficient, then the
elections official shall certify the results of the examination at the next regular city
council meeting.27
8. City Council. If the petition is sufficient, then the city council shall do one of the
following pursuant to the Elections Code: (1) Adopt the ordinance at the regular
meeting at which the certification of the petition is present or within 10 days after
it is presented. No ordinance that is proposed by initiative petition and adopted
by the vote of the legislative body of the city without submission to the voters
shall be repealed or amended except by a vote of the people, unless the
provision is otherwise made in the original ordinance; (2) Submit the ordinance to
the voters at the next regular election held not fewer than 88 days after the date
of the order of the election; or (3) Order a report at a regular meeting at which the
certification of the petition is presented (see No. 9 “Report” below).28 While state
law allows for adoption through initiative measure, the California Constitution
prohibits the imposition of any tax until it is submitted to the electorate and

approved by the necessary majority of votes.29 Thus, our office recommends the
ordinance to be submitted to the voters at the next regular election, consistent
with the California Constitution.
9. Report. During circulation of the petition, or at the regular meeting at which the
certification of the petition is presented, the city council may refer the proposed
initiative to city staff for a report on the proposed measure’s potential impact on
the city and any matters the council requests to be in the report, to be presented
to the city council in the time prescribed by the council, but no later than 30 days
from the date the petition is certified. If the report is requested, then the options in
No. 8 above are delayed until the report is received.30
10. Arguments and Rebuttals. Written arguments in favor of the ordinance, and
written arguments against the ordinance, may be submitted. The city council may
adopt provisions to permit rebuttal arguments to be filed, with these provisions to
be adopted at the same meeting at which the resolution calling the election is
adopted.31
11. Impartial Analysis. Whenever a city measure qualifies for a place on the ballot,
the city council may direct the city attorney to prepare an impartial analysis of the
measure showing the effect of the measure on the existing law and the operation
of the measure.32
12. Election. If a majority of the voters voting on a proposed ordinance vote in its
favor, the ordinance shall become a valid and binding ordinance of the city. No
ordinance that is either proposed by initiative petition or adopted by the vote of
the legislative body of the city without submission to the voters, or adopted by the
voters, shall be repealed or amended except by a vote of the people, unless a
provision is otherwise made in the original ordinance.33
RECOMMENDATION:
City staff recommends that the City Council:
1. Direct staff whether or not to prepare necessary resolutions and an
ordinance to establish a Transactions and Use Tax, and if so directed,
provide direction as to rate for implementation and whether such tax shall
be a general tax or special tax; or
2. Provide other direction to staff.
