Grand Terrace Municipal Code to Amend an Existing Municipal Code Section
Specifying the Design Standards for New and Existing Trash Enclosures. This
Ordinance Will Not be Enforced Retroactively and Apply Only to New Buildings and
Existing Buildings Undergoing Alterations Where a Building Permit is Required Per CA
Building Code [A] 105.1 with Alterations Encompassing 50% or More of the Existing
Total Building Area.
RECOMMENDATION:
Direct the City Attorney to read the ordinance by title only, waive reading of, and adopt,

House.

Effective March 6, 2024, Council Member Sylvia Rodriguez-Robles submitted her
resignation from the City Council. The City Council presented Council Member Rodriguez-
Robles with a plaque and gifts commemorating her years of service.

Council Member Henderson stated for the record and for future reference that the City
Council approach the Boards, Commissions and Committee appointments with more equity
in mind.
Mayor Hussey moved with a second from Council Member Henderson to appoint Mayor Pro
Tem Wilson as the alternate board member to the San Bernardino County Transportation
Authority/San Bernardino Council of Governments and appoint Council Member Henderson
as the alternate committee member to the Colton Joint Unified School District Community
Cabinet.

K. CITY MANAGER COMMUNICATIONS
City Manager Bolowich announced the following:
· Thanked everyone for their assistance and participation in the Annual Walk on Blue
Mountain event.
· Barton Road will have road work begin next week and there will be some traffic
impacts.
· Southern California Edison is working on a project adjacent to the Barton Road
location stated above.
· SoCal Gas is working on a large pipeline project off Preston Street.
SHERIFF’S REPORT
Lieutenant Bryan Lane reported on the following:
· The department goals on helping the homeless
· Please call dispatch at (909) 387-8313 if you encounter a problem with the homeless
· The H.O.P.E. team will be addressing the homeless encampment in the area very
soon.
· OTS Grant DUI Checkpoint held on Friday, March 8, 2024, resulting in:
o 27 stops
o Issued 20 citations.
o No DUIs
The Sheriff’s Department noticed a large number of vehicles funnel into the Stater Bros.
parking lot which appeared to be a potential street takeover. Patrol deputies surrounded the
group, issued a number of citations and shortly after, they were on the road out of the city.
FIRE DEPARTMENT REPORT
Assistant Fire Chief Gary Jager reported on the following:
· Announced that Measure W, the repeal of FP-5 appears defeated, and he wanted to
thank everyone for supporting the San Bernardino County Fire Protection District.

2030 VISION STATEMENT:
This staff report supports Goal #1, “Ensuring Our Fiscal Viability”, through the
continuous monitoring of expenditure budgets, allocations, and operational costs.
BACKGROUND:
The check register for the month of February-2024 has been prepared in accordance
with Government Code §37202 and is hereby submitted for City Council’s approval.
The check register lists all vendor payments for the respective month, along with a brief
description of the type of goods or services purchased and the account code(s)
associated with each payment. The check registers list all payments made to vendors
and employee reimbursements during the month of February-2024.
The attached index to the Check Register is a guideline account list only and is not
intended to replace the comprehensive chart of accounts used by the City and Grand
Terrace Successor Agency. Expenditure account number formats are XX-XXX-XXX
[Fund-Department-Account]. Expenditures may be made from trust/agency accounts
(Fund 23-XXX-) or temporary clearing accounts that do not have a budgetary impact.

RECOMMENDATION: Direct the City Attorney to read the ordinance by title only,
waive reading of, and adopt, "AN ORDINANCE OF THE
CITY COUNCIL OF THE CITY OF GRAND TERRACE,

18.33.050, 18.36.060, 18.39.060, 18.40.060, AND 18.56.080
OF TITLE 18 (ZONING) OF THE GRAND TERRACE
MUNICIPAL CODE, TO ESTABLISH DESIGN
STANDARDS FOR TRASH ENCLOSURES"
2030 VISION STATEMENT:
This item supports Goal #3 to develop proactive economic development plan to attract
new businesses and to prepare for development by updating zoning and development
codes.
BACKGROUND:
The City of Grand Terrace Zoning Code does not currently state any specific design
requirements for trash enclosures in multi-family and non-residential properties. As a
result, there are multiple unsecured multi-family and non-residential trash enclosures
that are overwhelmed with illegal dumping and unpermitted occupancy by homeless
individuals.
Unsecured trash enclosures pose a threat to the health and safety of the public, as
illegal dumping can have significant negative economic and environmental impacts on
the City, new businesses, and local residents. In addition to significant clean-up costs,
illegal dumping can have negative polluting effects upon the environment, contribute to
blight, attract vermin, and create a public nuisance. Additionally, trash enclosures are
unfit for human habitation.

The City Council conducted the first reading of Ordinance No. 352 on March 12, 2024.
The ordinance is now ready for second reading and adoption.
The design standards shall follow the City’s objective design standards (ODS) and
include the following requirements:
• Lockable front facing decorative metal doors and side door
• A decorative metal cover with screening to prevent illegal dumping
• Built of decorative material as permitted by the City’s ODS
• The enclosure shall follow current California Building Code accessibility
requirements as stated in Chapter 11B.
• A drain shall be installed and connected directly into the City’s wastewater
system.
This ordinance shall not apply retroactively but would apply to existing multi-family and
non-residential properties where alterations are performed to a building that
encompasses at least fifty percent or more of the total existing building area.
The City Council conducted the first reading of the ordinance on March 12, 2024. The
ordinance is now ready for second reading and adoption.
SAFETY IMPACT:
The proposed ordinance will significantly decrease the likelihood of illegal entry within
trash enclosures and prevent the likelihood of any trash fires caused by the illegal
occupancy of enclosures. Additionally, it will prevent any child related injuries or deaths
by making the enclosures difficult for climbing and falling.
ENVIRONMENTAL REVIEW:
No environmental impact
ECONOMIC IMPACT:
The proposed ordinance will significantly reduce the overall illegal dumping costs to
businesses and multi-family complexes.
RECOMMENDATION:
Based upon the foregoing, Staff recommends that the City Council to direct the City
Attorney to read the title of the ordinance, waiver further reading, and adopt the
proposed ordinance.

ORDINANCE NO. 352
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, CALIFORNIA, AMENDING SECTIONS 18.10.090, 18.33.050,
18.36.060, 18.39.060, 18.40.060, AND 18.56.080 OF TITLE 18 (ZONING)
OF THE GRAND TERRACE MUNICIPAL CODE, TO ESTABLISH
DESIGN STANDARDS FOR TRASH ENCLOSURES
WHEREAS, the City of Grand Terrace has adopted regulations throughout Title
18 of the Grand Terrace Municipal Code, which do not set forth any specific requirements
for trash enclosures within multi-family and non-residential properties; and
WHEREAS, because there are not uniform design requirements, many trash
enclosures within multi-family and non-residential properties throughout the City are
unsecured, overwhelmed with illegal dumping, and facilitate unpermitted occupancy by
homeless individuals; and
WHEREAS, unsecured trash enclosures pose a threat to the health and safety of
the public, as illegal dumping can have significant negative economic and environmental
impacts on the City, new businesses, and local residents. In addition to significant clean-
up costs, illegal dumping can have negative polluting effects upon the environment,
contribute to blight, attract vermin, and create a public nuisance. Additionally, trash
enclosures are unfit for human habitation; and
WHEREAS, establishing design standards for trash enclosures would significantly
decrease the likelihood of illegal entry within trash enclosures and prevent the likelihood
of any trash fires caused by the illegal occupancy of enclosures. Additionally, it will
prevent any child related injuries or deaths by making the enclosures difficult for climbing
and falling; and
WHEREAS, the City Council now desires to update city-wide trash enclosure
requirements to include specific design standards for newly built and existing trash
enclosures.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE
DOES ORDAIN AS FOLLOWS:
SECTION 1. The Recitals set forth above are incorporated herein by this
reference.
SECTION 2. Section 18.10.090(C)(12) (Storage and Trash Areas) of Chapter
18.10 (Residential Districts) of Title 18 (Zoning) is hereby amended and shall now read

“12. Storage and Trash Areas. All storage and trash areas shall be located within
enclosed areas completely screened from public view. The enclosure shall
follow current California Building Code accessibility requirements, as
amended from time to time. A drain shall be installed and connected
directly into the City’s wastewater system, with approval from the City’s
Engineer. The storage and trash enclosure shall contain lockable front
facing decorative metal doors and a side door, and a decorative metal roof
or cover with screening to prevent illegal dumping. All decorative material
shall be compliant with the City’s objective design standards. Common
storage and trash areas shall be within 200 feet of the dwelling served.”
Except as expressly modified herein, the remainder of Section 18.10.090 shall
remain unchanged and in full force and effect.
SECTION 3. Section 18.33.050 (Storage and trash facilities) of Chapter 18.33 (C2
General Business District) of Title 18 (Zoning) is hereby amended and shall now read in
its entirety as follows (added language is shown in bold italics; deleted language is
shown in strikethrough):
“18.33.050 Storage and trash facilities.
All storage of cartons, containers and trash in the C2 district shall be shielded
from view within a building or within an area enclosed by a wall not less than six feet in
height, and shall not be located within 40 feet of any district zoned for residential
use. The enclosure shall follow current California Building Code accessibility
requirements, as amended from time to time. A drain shall be installed and
connected directly into the City’s wastewater system, with approval from the
City’s Engineer. The storage and trash enclosure shall contain lockable front
facing decorative metal doors and a side door, and a decorative metal roof or
cover with screening to prevent illegal dumping. All decorative material shall be
compliant with the City’s objective design standards. If unroofed, no such area shall
be located within 40 feet of any district zoned for residential use.”
SECTION 4. Section 18.36.060 (Storage and trash facilities) of Chapter 18.36 (CM
Commercial Manufacturing District) of Title 18 (Zoning) is hereby amended and shall now
read in its entirety as follows (added language is shown in bold italics; deleted language
is shown in strikethrough):
“18.36.060 Storage and trash facilities.
A. Permitted outdoor storage shall be set back 25 feet when adjacent to
residential properties.
B. When permissible outdoor storage is utilized, such storage shall be visually

wastewater system, with approval from the City’s Engineer. The
storage and trash enclosure shall contain lockable front facing
decorative metal doors and a side door, and a decorative metal roof
or cover with screening to prevent illegal dumping. All decorative

“18.56.080 Screening and trash enclosures.
A. Trash storage areas shall be enclosed by a wall not less than six feet in
height, and shall not be located within 40 feet of any district zoned
for residential use. If unroofed, no such area shall be located within 40
feet of any district zoned for residential use. The enclosure shall follow
current California Building Code accessibility requirements, as
amended from time to time. A drain shall be installed and
connected directly into the City’s wastewater system, with approval
from the City’s Engineer. The storage and trash enclosure shall
contain lockable front facing decorative metal doors and a side
door, and a decorative metal roof or cover with screening to prevent
illegal dumping. All decorative material shall be compliant with the
City’s objective design standards
B. All outdoor animal uses and/or animal enclosures shall be screened in a
manner determined by the City Council in consideration of the type of
animals being kept.”
SECTION 8. APPLICABILITY. This Ordinance shall not apply retroactively. It shall
apply only to all applications for new buildings, and existing buildings undergoing
alterations where a building permit is required pursuant to California Building Code [A]
105.1, with alterations encompassing 50% or more of the existing total building area.
SECTION 9. SEVERABILITY. If any section, subsection, subdivision, sentence,
clause, phrase, or portion of this ordinance or the application thereof to any person or
place, is for any reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remainder of this
ordinance. The City Council hereby declares that it would have adopted this ordinance,
and each and every section, subsection, subdivision, sentence, clause, phrase, or portion
thereof, irrespective of the fact that any one or more sections, subsections, subdivisions,
sentences, clauses, phrases, or portions thereof be declared invalid or unconstitutional.
SECTION 10. EFFECTIVE DATE. This ordinance shall be effective on the thirtieth
(30th) day after the day of its adoption.

BACKGROUND:
The City Manager for the City of Grand Terrace serves as the City representative at the
Riverside Highland Water Company’s Annual Shareholders Meetings. The City
Manager is unable to attend the current meeting scheduled for Thursday, March 28,
2024, at 9:00 a.m. and is requesting that the City Council appoint a Council Member to
attend this meeting on behalf of the City.
DISCUSSION:
On Thursday, March 28, 2024, at 9:00 a.m. the Riverside Highland Water Company
(RHWC) will be holding its 2024 Annual Meeting of Shareholders at 12374 Michigan
Street, Grand Terrace, CA 92313-5602 or via ZOOM by computer or phone. The City’s
shareholder representative, Konrad Bolowich, City Manager, is unable to attend and is
requesting the Mayor appoint, with the approval of the City Council, a member of
Council to attend the meeting.
The purpose of the meeting is to review the activities of 2023, elect three Board of
Directors members for the ensuing year, and to transact such other business as may
properly come before the meeting. RHWC will describe to shareholders the continuing
upgrade of the distribution system, new developments for RHWC and the 2024
operating plan.
State law provides under Government Code Section 40605 states:
In general law cities where the office of mayor is an elective office
pursuant to Article 5 (commencing with Section 34900) of Chapter 7 of
Part 1 of Division 2 of Title 4, the mayor, with the approval of the city

council, shall make all appointments to boards, commissions, and
committees unless otherwise specifically provided by statute.
At this time, Staff recommends that, subject to the advice and consent of the City
Council, the Mayor appoint a member of Council to attend the Riverside Highland Water
Company’s 2024 Annual Meeting of Shareholders on Thursday, March 28, 2024, at
9:00 a.m.

by allowing community input on potential procedures on filling City Council vacancies.
BACKGROUND:
On March 12, 2024, the staff brought to the City Council Guidelines for Filling City
Council Vacancies by Appointment and the procedures for calling a Special Election
due to the official resignation of former City Council Member Sylvia A. Rodriguez-
Robles effective March 6, 2024.
Due to the timeline to hold a Special Election, City Council requested that the City Clerk
verify with the San Bernardino County Registrar of Voters on whether the City Council
can leave the vacancy open until the next General Election scheduled for November 5,
2024.
DISCUSSION:
Based on discussions with the San Bernardino County Registrar of Voters office, the
City has been directed to follow Government Code section 36512, whereby the City
Council is required to either fill the vacancy by appointment or call a special election to
fill the vacancy within 60 days from the commencement of the vacancy.
If the City Council opts to fill the vacancy by appointment, the deadline to appoint is no
later than Sunday, May 5, 2024, and the person appointed to fill the vacancy will hold
office for the unexpired term of the former incumbent.
If the council fills the vacancy by appointment, the resident appointed will fill the
unexpired term through November 2024 when the next general election takes place. If

the appointee wishes to run for the open seat for the next four (4) year election cycle
through 2028, that appointee may pull papers during the official candidate filing period.
Based on the current timeline to appoint, staff recommends the following schedule to
accept applications, interview potential candidates and appointment:
March 27, 2024: Begin advertising and accept applications from eligible residents.
Residents must be registered voters in the City of Grand Terrace.
April 9, 2024: Interview potential candidates to fill the City Council vacancy.
April 23, 2024: Swear in the appointee.
If the City Council opts to hold a special election, Elections Code Section 4004 provides
that due to the size of the population of the City of Grand Terrace, the City is eligible to
conduct a wholly all-mail ballot election to fill a vacancy in the legislative body. Pursuant
to Elections Code 1500 the established mailed ballot election date is the last Tuesday in
August of each year, whereby the official Special Election all-mail ballot election would
be conducted on Tuesday, August 27, 2024. Additionally, Government Code section
36512 requires any election called to be not less than 114 days after the call of the
election. With a mail-in ballot election date on August 27, 2024, the City Council would
need to call the special election sooner than the expiration of the 60-day vacancy period
in order for the election to occur.
If the City Council elects to call a special election, staff will immediately begin steps to
consolidate the election with the San Bernardino County Registrar of Voters office
pursuant to its direction.
FISCAL IMPACT:
There would be no fiscal impact associated with an appointment action. The monthly
stipend for the City Council is indicated in the budget. If the City Council were to call for
a special election, staff can only guestimate at this stage the cost at approximately
$30,000 - $40,000, as the San Bernardino County Registrar of Voters cannot provide a
cost until after the election is conducted.

BACKGROUND:
The process for approval, modification, and revocation of a Conditional Use Permit. A
Conditional Use Permit also known as a “CUP”, is defined in exhibit 1 as a permit that
allows cities and counties to regulate certain land uses by adding conditions to ensure
that the proposed land use will be compatible with the surrounding businesses,
residential homes, or other developments.
An example are bars, bars are on-site drinking establishments that serve all types of
beer, liquor, and wines to their customers. Such a land use can have negative impacts
on the surrounding neighbors such as loitering, excess noise, public intoxication,
aggressive behaviors and littering. Therefore, the city may require the bar to apply for a
Conditional Use Permit, in which the city would impose conditions that limit hours of
operations, sound proofing the building so no excess noise is heard from the exterior,
security guards, age verification devices, and parking requirements. Again, these
conditions are being imposed on the bar, so there are no negative impacts occurring to
surrounding businesses, residential homes, and other developments.
Title 18 of the Grand Terrace Municipal establishes the zoning plan and code for the
purpose of promoting growth of the City in an orderly manner and to promote and
protect the public health, safety and comfort and general welfare for the City. The
zoning code establishes different zones in which different uses are either Permitted (P)
by right or (C) as a Conditionally Permitted Use which requires a Conditional Use
Permit. Attached as exhibit 2 you may reference staff’s land use matrix based off Title
18 Grand Terrace’s Zoning code, which lists the different zones within the city as well as
the uses and their status as either (P) permitted or (C) conditionally permitted.

Attached in exhibit 3 is Grand Terrace Municipal Code Chapter 18.83 Conditional Use
Permits, which establishes the Planning Commission’s authority to issue and revoke
conditional use permits to ensure the community’s health, safety, and welfare by
reviewing uses which may create objectionable or undesirable effects upon nearby uses
but may still be compatible with the property’s zoning City of Grand Terrace process for
a Conditional Use Permit. Conditional use permits under this chapter shall be revocable,
may be subject to conditions of approval, and may be valid for a certain period of time if
the Planning Commission desires to set an expiration date of the Conditional Use
Permit.
Conditional Use Permits are processed through the Planning and Development
Services Department. Applications for the CUP shall be reviewed by the Planning
Director and upon determining that the conditional use permit is complete, the
application shall be scheduled for a duly noticed public hearing consideration by the
Planning Commission.
During the hearing the Planning Commission has the authority to impose conditions on
the application which may include but are not limited to
• Setbacks, yard areas,
• Fences, Walls and Screening,
• Security
• Landscaping and maintenance of landscaping
• Regulations on signs
• Control of noise, vibration, odors, and other potentially dangerous or
objectionable elements, activities, or uses,
• Limits on hours of operation may be determined to assure that development
will not have any adverse impacts.
After the Public hearing and consideration of the proposed use, the Planning
Commission shall approve the CUP only if it meets the following findings.
A. The proposed use will not be:
1. Detrimental to the Health, Safety Morals, comfort or general welfare of the
persons residing or working within the neighborhood of the proposed
amendment or within the City
2. Injurious to property or improvements in the neighborhood or within the
City
B. The proposed use will be consistent with the latest adopted general plan.
C. Conditions necessary to secure the purposes of this Chapter are made a part of
the Conditional Use Permit.
Once the Planning Commission approves the Conditional Use Permit, the decision shall
be final unless appealed to the City Council within 10 calendar days, such appeal may
be made by the applicant, any member of the City Council or any interested person

through the appeal process. Once issued Conditional Use Permits are permanently tied
to the land unless there is a set expiration for the Conditional Use Permit or if the
Conditional Use Permit is revoked.
Revisions and Modifications
Revisions and modifications to the Conditional Use Permit may be requested by the
applicant; further, the Planning Commission may periodically review, modify, or revoke
a Conditional Use Permit.
1. Revision or modifications can be requested by the applicant to an approved
Conditional Use Permit, such as, but not limited to, change in conditions,
expansions, intensity or hours or operation may be requested by the applicant.
The requested revision or modifications shall be processed in the same manner
as the original conditional use permit.
2. Additionally, the Planning Commission has the authority to periodically review
any Conditional Use Permit to ensure that it is being operated in a manner which
is not detrimental to the public health, safety or welfare, or materially injurious to
properties in the vicinity. If, after review, the Commission deems that there is
sufficient evidence to warrant a full examination, then a public hearing date shall
be set. At the public hearing the Planning Commission may modify or revoke the
permit.
On occasion, portions of a CUP may be superseded by State or Federal Laws. An
example of such would be an existing condition that all signage at a location be in
English. This condition is in direct contradiction to limitations on content at the federal
level, and as such would be moot and result in a modification to the CUP by statute.
Issues relating to free speech and protected categories are typically associated with
this.
Revocation of a Conditional Use Permit
Lastly, Chapter 18.30 of the Grand Terrace Municipal code states that Conditional Use
Permits granted in accordance with Title 18 may be revoked if any of the following
Actions occur:
a. Any violation of a Conditional Use Permit’s required condition of approval
b. Any Federal, State or local law or ordinance is violated in connection with
conditionally permitted use.
The process for revocation of a Conditional Use Permit shall include a hearing by the
Planning Commission for the proposed revocation. The hearing shall be notified in
accordance with Section 65091 of the California Government Code and with Section
18.03.070 public hearing. After conducting the public hearing, the Planning Commission
shall make a recommendation to the City Council regarding the revocation of the
conditionally permitted use. After receiving the Planning Commission, s
recommendation, the City Council shall conduct its own public hearing and make a final
determination to revoke, amend, or leave unchanged the Conditional Use Permit.

FISCAL IMPACT:
Conditional Use Permits are tools for economic development as it allows businesses,
like bars, auto dealers, day care centers or recreational facilities that could have
adverse effects on the neighborhood, be able to be regulated to allow the business to
function harmoniously with the surrounding neighborhood. As of October 1st, 2023, the
Planning and Development Services Department is able to process Conditional Use
Permits through a $5,000 application fee and a deposit with charges at the fully
allocated hourly rates for all personnel involved plus any outside costs.

ABOUT CONDITIONAL USE PERMITS
This explains 1) what a "conditional use permit" is, 2) how such permits fit into our efforts to shape our surroundings, and 3) how
you can participate in the decision-making process.
What is a Conditional Use Permit?
A key goal of land use rules is for nearby land uses to be compatible with one another. One way cities and
counties do this is to say that certain kinds of uses are allowed only under certain conditions.
If someone wants to make such a use of property, he or she must get a conditional use permit. Sometimes
planners call this a "CUP." Other names include "special use permit" or just "use permit." Zoning rules usually
explain when someone needs a conditional use permit.
The permit process allows decision-makers to create requirements to avoid problems. These requirements
must relate to the expected problems a use will create. The relationship must be backed up with facts
presented to decision-makers.
Decision-makers must explain their decision with findings. Such findings explain why the decision-maker
decided that the permit is or is not justified under the circumstances.
Example
An example is a bar. Such a use can have negative
impacts on neighbors. Common restrictions include
limited hours of operation, soundproofing and noise
limits, security guards and parking requirements.
Decision-Making Process
Decision-makers want to hear from those who
have opinions or information about whether to
approve a conditional use permit. If you want
to share your thoughts, see "Preparing for Public
Hearings" on the back of this sheet for some tips.

Staff may be able to tell you at what point public input will be sought at
the meeting and what you need to do to be recognized to speak. Be
prepared to wait until the item you are interested in is called.
• Indicate You Want to Speak
The presiding official will generally ask for people who want to speak to
come forward. Some agencies use a speakers list to help the presiding
official manage the meeting better (for example, if lots of people want to
speak, there may be time limits for each speaker).
• Make Smart Use of Your Time
Listen carefully to what others say. Try to find common interests and
values. Try to not repeat their comments (although you may want say if
you agree what someone else said). If you are part of a group, coordinate
your remarks to avoid repeating each other.
• Be Prepared for Questions
Answer as best as you can. It's okay to say that you don't know or that a
given question would be a good one to research.
Opportunities for Input: Meetings and Letters
There are a number of ways to share your views with decision-
makers. One is to participate in public hearings or other kinds of
gatherings during which public input is sought. Another is to send
letters and other written materials in advance of a meeting.
General Communications Tips
• Focus Your Message
You may have lots of concerns. See if they can be grouped into
categories or themes. Choose two or three of your most important
themes or concerns to emphasize. Otherwise, you risk overloading
your listeners and possibly diminishing your effectiveness. It's not
how much you say, it's how well you say it.
Start with your basic position (for example, "I support the proposed
specific plan"). Then explain your connection to the issue (for
example, "I live in the neighborhood covered by the plan"). Then
explain the reasons for your position. It can be persuasive to think
about the values underlying these reasons. ("I believe the plan fairly
balances the need for affordable housing with the need for urban
open space.") Tie your position to larger community interests.
("For our businesses to thrive, we need workforce housing.")
• Organize Supporting Materials
A Note about Civility
Your goal is to persuade decision-
makers to see the issue your way.
Focus on the merits of your
position. Even if you disagree about
what's best for the community in
this situation, it doesn't mean
someone is a bad person.
Questioning others' motives or
intelligence, being hostile, engaging
in name-calling or making threats
will not reflect well on you or the
position you are urging.
No matter how passionate you are
about an issue, conduct yourself in a
way that will add to your credibility
and standing as a thoughtful
member of your community.
About Public Hearings
A public hearing is a relatively formal
proceeding. A typical one involves:
• A report to decision-makers, given by a
asstaff member or consultant who has
asbeen working on the item;
• A statement by the project applicant or
asproponent (the person asking for the
asdecision); and
• Statements from members of the public
aswho may 1) support the proposed action,
as2) have concerns that they would like
asdecision-makers to address, and 3)
asoppose the action under any
ascircumstances.
The decision-making body will then decide
what to do by voting. If it needs more time
to get more information or think about the
issues raised at the hearing, the body may
postpone a decision until another meeting.You may have written materials you want to share with decision-
makers. Make sure that you have at least enough copies for each
member of the decision-making body plus one for staff. If you have a lot of documentation, think about submitting it in
advance. A page explaining what a larger packet contains can be helpful.
To Participate in a Meeting
• Get the Agenda and Other Information
The meeting agenda explains what issues are up for discussion and provides other useful information. Agendas usually are

post agendas on their websites. Another option is to ask that an agenda

the Planning and Development Services Director in the form provided by the Planning and Development Services Director and shall include a detailed description of the proposed use and such other
information as may be required by the Planning and Development Services Director to facilitate the determination. Such application shall also include payment for such application fees as may be
adopted by resolution of the City Council. The determination of the Planning and Development Services Director shall be appealable to the Planning Commission and the determination of the Planning
Commission shall be appealable to the City Council. The determination by the City Council shall be final.

Chapter 18.83 - CONDITIONAL USE PERMITS
Sections:
18.83.010 - Purpose.
The purpose of this Chapter is to establish the Planning Commission's authority to issue and revoke
conditional use permits in order to ensure the community's health, safety and welfare by reviewing uses
which may create objectionable or undesirable effects upon nearby uses, but may still be compatible with
the property's zoning.

18.83.020 - Application.
Conditional use permits may be issued by the Planning Commission for any of the uses or purposes for
which such permits are required by the terms of this Title. Such conditional use permits shall be revocable,
may be subject to conditions of approval and may be valid only for a specific period of time, in case the
Planning Commission desires to set an expiration date.

18.83.030 - Submittal process.
Applications for a conditional use permit shall be submitted to the planning department. The planning
director shall review each application and determine its completeness. Upon determination that an
application is complete, the application shall be scheduled for a public hearing consideration by the
planning commission. An application for a conditional use permit shall consist of the following.
Completed application form;
Site plan, 25 blueline copies plus one blueline copy colored for presentation purposes. The
site plan shall be a fully dimensioned drawing clearly showing:
All buildings, property lines and easements;
All parking spaces, driveways and drive aisles;
All landscaped areas;
All walls and fences;
Location of all signs;
Public improvements to the street centerline;
Site address and assessor's parcel number;

18.83.031 - Conditions of approval.
In granting a conditional use permit, the Planning Commission shall require that the use and
development of the property conform with a site plan, architectural drawings, or statements submitted in
support of the application, or such modifications thereof as may be deemed necessary. Conditions imposed
may include, but are not limited to, the following:
Setbacks, yard areas and open spaces;
Fences, walls and screening;
Parking, parking areas and vehicular ingress and egress;
Landscaping and maintenance of landscaping and grounds;
Regulation of signs;
Control of noise, vibration, odors and other potentially dangerous or objectionable elements,
activities or uses;
Limits on hours of operation or duration of approval; and
Such other conditions as may be determined to assure that development will be in
accordance with the intent and purposes of this title.

18.83.032 - Revisions or modi cations.
Revisions or modifications of conditional use permits may be requested by the applicant. Further, the
Planning Commission may periodically review, modify or revoke a conditional use permit.

Revisions or Modifications Requested by Applicant. A revision or modification to an approved
conditional use permit such as, but not limited to, change in conditions, expansions, intensity
or hours or operation may be requested by an applicant. The requested revision or
modification shall be processed in the same manner as the original conditional use permit.
Review by Planning Commission. The Planning Commission may periodically review any
conditional use permit to ensure that it is being operated in a manner consistent with
conditions of approval or in a manner which is not detrimental to the public health, safety or
welfare, or materially injurious to properties in the vicinity. If, after review, the Commission
deems that there is sufficient evidence to warrant a full examination, then a public hearing
date shall be set. At such public hearing, the Planning Commission may modify or revoke the
permit pursuant to Section 18.83.080.

18.83.040 - Public hearing.
The Planning Commission shall hold a public hearing on any proposed conditional use permit and shall
notice said hearing in accordance with Section 65091 of the California Government Code and with Section
18.03.070 (Public hearing notice) of Chapter 18.03 (General provisions).

18.83.050 - Approval process.
The Planning Commission, after holding a public hearing and considering the proposed use, shall make
its determination. The Planning Commission shall approve the application only if it finds:
The proposed use will not be:
Detrimental to the health, safety, morals, comfort or general welfare of the persons
residing or working within the neighborhood of the proposed amendment or within the
City;
Injurious to property or improvements in the neighborhood or within the City;
The proposed use will be consistent with the latest adopted general plan.
Conditions necessary to secure the purposes of this Chapter are made a part of the
conditional use permit.

The decision of the Planning Commission shall be final unless appealed to the City Council within ten
calendar days. Such an appeal may be made by the applicant, any member of the City Council or any other
interested person.
An appeal of a Planning Commission decision shall be made in the following manner:
Filing with the City Clerk's office a completed application for appeal.
Payment of the appropriate appeal fee.
After accepting an application for appeal, the City Clerk shall set a date for the City Council to
hear the appeal. Notices of the appeal shall be given to the applicant, the Planning
Commission and the appellant. The notice shall also be provided in accordance with Section
18.83.040 (Public hearing) of Chapter 18.83 (Conditional use permit).
The Planning Commission shall submit a report to the City Council containing the reasons for
the Commission's decision and the minutes of its meeting regarding the appealed decision.
The City Council shall hear the appeal and make its own determination regarding the
application and its consistency with this Title and the general plan. Upon such determination,
the City Council shall uphold, modify or reverse the Planning Commission's decision. If during
the City Council's hearing of the appeal, new information is provided that was not considered
by the Planning Commission, the City Council may refer the application back to the Planning
Commission for reconsideration of the application with the new information.

18.83.070 - Building permit and business license process.
After the appropriate appeal period has ended or after a final determination is made by the City Council,
the applicant may submit for a business license and/or a building permit.
An application for a building permit shall include three sets of the approved site plan and
floor plans, each set shall be approved and signed by the Planning Director and shall have
attached to it a copy of any conditions of approval required by the Planning Commission or
the City Council. Two of the required sets of plans shall be submitted to the Department of
Building and Safety along with the appropriate construction specification plans for the
approved project. The third set shall be kept on file in the Planning Department. The
Department of Building and Safety shall then prepare the appropriate permits in accordance
with all applicable State and local codes.
An application for a business license shall be processed through the Finance Department. An
application for a business license shall be signed by the Planning Director indicating the
proposed use's compliance with this Title. A copy of any conditions of approval required by

18.83.080 - Revocation.
Any conditional use permit granted in accordance with this Title may be revoked if any of the following
actions occur:
Any violation of a conditional use permit's required condition of approval;
Any Federal, State or local law or ordinance is violated in connection with a conditionally
permitted use.
The Planning Commission shall hold a public hearing to consider the proposed revocation. Said
hearing shall be noticed in accordance with Section 65091 of the California Government Code and with
Section 18.03.070 (Public hearing notice) of Chapter 18.03 (General provisions). After conducting the
public hearing the Planning Commission shall make a recommendation to the City Council regarding
revocation of the conditionally permitted use. After receiving the Planning Commission's
recommendation, the City Council shall conduct its own public hearing and make a final determination to
revoke, amend or leave unchanged the subject conditional use permit.

18.83.090 - Expiration and extensions.
The Planning Commission may allow a use to operate in a location for the duration of the continued use
or may allow it with a specified expiration date. The following regulations are for both types of conditional
use permits:
Permanent Conditional Use Permit. The Planning Commission allows a particular use to be on
a particular location subject to conditions of approval. No expiration time is set.
Compliance Period. The approval of a permanent conditional use permit application shall
automatically expire one year from the date of its approval unless:
All conditions of approval are met; or
Sufficient investment has been completed and building permits are issued; or
Business license is issued in accordance with the Grand Terrace Municipal Code.
In case the applicant is not able to comply with subsections a, b or c, then the applicant shall apply
for an extension of the one-year compliance period prior to the end of that year period. The Planning
Director may, upon application by the applicant, extend the compliance period for a specific length of
time up to one year. Two extensions are the maximum allowed.

Barton Road

RECOMMENDATION: It is recommended that the City Council: 1) receive the staff
report; and 2) refer the review the nonconforming land use.
2030 VISION STATEMENT:
This staff report supports Goal #1, Ensuring Fiscal Viability and Goal #3, Promote
Economic Development by having an internally consistent General Plan.
BACKGROUND:
The property located at 22325 Barton Road, Grand Terrace, CA 92313, was entitled by
the City in 1985. The entitlements are Conditional Use Permit (CUP) 85-09 and Site and
Architectural Review (SA) 85-09. In 1985 the zoning designation for the property was
noted as being C-2 “General Commercial Zoning District”. The entitlements established
a senior independent living project also known as a “senior rest home” that was called
the “Terrace Plaza Retirement Hotel.” The development has 88 rooms with a communal
kitchen, office space and a T.V. room. The independent living nature of the Terrace
Plaza Retirement Hotel meant there was no medical care being provided onsite. In the
1985 zoning code, the C-2 land use category classified the Terrace Plaza Retirement
Hotel classified as a “rest home,” which was permitted only in residential and
commercial districts with a CUP.
CUP 85-09 and SA 85-09 had twelve (12) conditions of approval from Public Works and
ten (10) conditions from Planning. All twenty-two (22) conditions of approval are
included in the copy of the August 5, 1985, staff report for CUP 85-09 and SA 85-09 is
provided as Attachment 1 to this staff report.
CUP 85-09 and its conditions of approval, like all CUPs, run with the land. Since its
adoption in 1985 there have been businesses that have operated at 22325 Barton Road
under CUP 85-09. Following the chain of custody of CUP 85-09 from 1985 to 2024
reveals changes have occurred in the type of land uses operating at the site. The most
notable change occurred in 1996 when the City approved an addendum to CUP 85-09.

In 1990, the Barton Road Specific Plan was adopted and established new zoning and
land uses applicable to the property at 22325 Barton Road.
In 1996, a new owner of the property changed the business name to “The Terrace” and
obtained approval of the CUP addendum identified as CUP 85-09-A1. The addendum
allowed business owners of The Terrace to provided daily assistance services to the
senior residents under a Residential Care Facility for the Elderly License from the State
of California Department of Social Services. It would seem the original nonconforming
“rest home” land use approved in 1985 ceased with the ownership and land use change
in 1996 when the business operations started providing assistance services to the
senior residents. It stands to reason that all subsequent land uses since then have not
been in compliance with the Barton Road Specific Plan’s land use matrix. A question to
put forth to the Planning Commission is how to address the post “rest home” land use
changes at 22325 Barton Road that occurred under CUP 85-09-A1 in 1996 to the
present.
The spirit and intent of the City’s nonconforming provisions is to allow nonconforming
use to continue; provided, that no such use shall be enlarged or increased, nor be
extended to occupy a greater area than that occupied by such use at the time of the
adoption of the ordinance codified to continue to exist, provided, that no such use shall
be enlarged or increased, nor be extended to occupy a greater area than that occupied
by such use at the time of the adoption of the ordinance codified in this title, and when
any such use ceases, the subsequent use of such land shall be in conformity to the
regulations specified by this title for the district in which such land is located.
Records show that in 2005 the site became The Brookdale Grand Terrace Assisted
Living and Memory Care Community. The spirit and intent of the original CUP 85-09
was for a senior rest home with no medical care. What started in the 1996 addendum to
allow daily assistance services for senior residents again grew in intensity and scope to
where Brookdale Grand Terrace Assisted Living and Memory Care Community was
providing assisted living with medical care for seniors with memory health issues.
The Brookdale Grand Terrace Assisted Living and Memory Care Community closed and
sold in December 2019. In January 2020 the property became Vista Blue Mountain RBP
Grand Terrace LLC assisted living community, which then closed and sold in 2023. The
new ownership became MHRE Grand Terrace, LLC. MHRE and the business operating
from that location is the JC Wallace House AHS Grand Terrace Operating LLC. The JC
Wallace House provides mental health services and programming to help people 18
years old and older learn independent living skills. This operation change is again
another intensification and change in land use that is bringing new programs and care

services to broader range of individuals than previous business operations had provided
for at the site. As with previous businesses at the location, the JC Wallace House has
obtained a City Business License and agreed to operate under CUP 85-09-A1 that was
provided by City in addition to having obtained a State Department of Social Services
license.
It appears from the archival records that the land uses at 22325 Barton Road, for which
CUP 85-09 / 85-09-A1 is active, have changed with ownerships and business in recent
years from 1) the senior independent living project without medical care, to 2) a senior
living community with assistance services, to 3) an assisted living community for seniors
needing memory care into its current form as a 4) residential care facility for adults with
mental health issues.
DISCUSSION:
A new ownership/business can agree to operate from a location under an existing CUP
if the land use is the same as that which was authorized by the preexisting CUP, and
the conditions of approval are agreeable. If the conditions of approval are not
agreeable, then the new owners can seek an addendum or a new CUP from the
Planning Commission. The current business at 22325 Barton Road is operating under
CUP 85-09-A1 as an “Adult Residential Facility.” The location has a business license
named JC Wallace House AHS Grand Terrace Operating LLC. JC Wallace House
currently has an active Adult Residential facility type license from the California
Department of Social Services. The Barton Road Specific Plan’s land use matrix does
not identify a land use listed for “Residential Care Facility.” That would result in the
“Residential Care Facility” being an unlisted land use in the Barton Road Specific Plan’s
land use matrix. Furthermore, when looking back at the Brookdale Grand Terrace
Assisted Living and Memory Care Community which operated from 2005 through 2019
it too would be a “Residential Care Facility” land use which is unlisted in the Barton
Road Specific Plan. Typically, if a change in land use is significant enough, it warrants
amending the existing CUP or even obtaining a brand new CUP. Amending or obtaining
a CUP is not an option however when the land use is nonconforming or prohibited.
The Grand Terrace Municipal Code defines a "residential care facility" as being
Any facility place or building that is maintained and operated to provide non-
medical residential care as defined by State law, including, but not limited to, the
physically handicapped, mentally impaired, incompetent persons, abused or
neglected children and the elderly. The term "residential care facility" is limited to
those facilities, places or buildings that are both subject to regulation and

licensed by the State of California. No facility, place or building that may
otherwise be regulated by the State of California, but is not actually licensed by
the State of California, shall be deemed a "residential care facility" for the
purposes of this Title. Whether or not unrelated persons are living together, a
residential, community or group care facility licensed by the State of California
that serves six or fewer persons shall be considered a residential use of property
for the purposes of this Title. (A residential care facility that is not licensed by the
State of California shall be deemed a rooming or boarding house.)
The Grand Terrace Municipal Code contains procedures to address unlisted uses such
as “residential care facility” in the Barton Road Specific Plan land use matrix. The
Municipal Code states that in order to ensure that the zoning regulations will permit all
similar uses in each district, the Planning Commission, upon its own initiative or upon
written request, shall determine whether a use not specifically listed as a permitted use
or a conditional use in any district shall be deemed a permitted use or a conditionally
permitted use in any one or more districts on the basis of similarity to uses specifically
listed. This is an important function of the Planning Commission given that a CUP
cannot authorize any land use that the Barton Road Specific Plan does not authorize in
the land use matrix.
In 2005, 2020, and 2023 when the ownership and businesses changed at 22325 Barton
Road, there appeared to be no action taken by the Planning Commission to determine if
the unlisted “Residential Care Facility” land use should be deemed permitted or
conditionally permitted in the Barton Road Specific Plan. CUP 85-09 / CUP 85-09-A1
appears to have remained the constant during the changes in 2005, 2020, and 2023.
Being that a CUP cannot authorize any land use that the Barton Road Specific Plan
does not authorize in the land use matrix, nor any land use not expressly authorized by
the conditional use permit itself, it is important to review the CUP with the Planning
Commission to ensure the current land use at 22325 Barton Road is consistent with
what CUP 85-09 authorized. Nor can a CUP authorize a modification to a
nonconforming land use.
Within the conditions of approval of CUP 85-09, there is an age restriction. This would
likely not be enforceable in 2024 as the age of any patrons of the businesses is
potentially a protected category given current Planning and Zoning Law in the State
Government Code prohibits discrimination based upon age. The age restriction issue is
a topic to put forth to the Planning Commission to work out with a likely opinion form the
City Attorneys Office.

The Municipal Code provides a termination process to address situations whenever a
nonconforming use or structure becomes obsolete, dilapidated, substandard, unsafe, or
exists in a state of general disrepair. Municipal Code Section 18.76.034 “Termination-
Abatement as a Public Nuisance” states that whenever a nonconforming use or
structure becomes obsolete, dilapidated, substandard, unsafe, or exists in a state of
general disrepair, the Planning Commission may hold a Public Hearing to evaluate and
make declaration of nuisance.
CONCLUSION:
The Grand Terrace Municipal Code establishes that the Planning Commission may
periodically review, modify, or revoke any conditional use permit. Furthermore, it
provides a process for abatement and termination of a nonconforming land use should it
be declared a public nuisance by the Planning Commission at a Public Hearing. As
described in this report, there have been changes in businesses and their respective
land use classifications, changes in the zoning, and modification to the entitlements that
occurred from 1985 to the present at 22325 Barton Road. Most notable is the shift from
nonmedical care senior living; to assisted living senior care; to an assisted living
memory care facility; and, most recently into a mental health facility for adults.
The original “rest home” land use approved in 1985 became nonconforming in 1990 and
ceased to exist in 1996. All subsequent action and uses that have occurred from 1996
to present at this location have done so in contradiction to the Barton Road Specific
Plan, which is the governing zoning document for the property. It is within the City’s
Planning Commission authority to review the nonconforming land use at 22325 Barton
Road and to make any necessary determinations as to whether or not the JC Wallace
House is a public nuisance, detrimental to the public health, safety or welfare, or
materially injurious to properties in the vicinity and warrants termination. Pursuant to the
Municipal Code this matter should procedurally be assigned to the Planning
Commission at a duly noticed Public Hearing for further action.
FISCAL IMPACT:
No impact at this time. However, depending upon how the matter proceeds it is within
reason to see a cost associated with notification of public hearing(s), costs of staff time,
and costs associated with City Attorney review and assistance with the matter should it
proceed out of any future Planning Commission Public Hearing and future legal actions.
