Brindi Lee, Grand Terrace opposed the project before the Planning Commission and
requested if approved, that some steps be taken to reduce the lighting and noise.
Bobbie Forbes, Grand Terrace expressed her opposition to the project.

In addition, the Commission requested staff to include the following conditions of
approval to the project:
Include a condition requiring the applicant to place signs identifying the maximum
work with the City Engineer and Applicant to identify the maximum vehicle size
supported on the site.
Add a condition to the proposed landscaping located to the north side of the
property to include mature trees tall enough to create separation between the
r similar trees and landscape material as requested by the
Planning and Development Services Director or Designee during the Landscape
and Irrigation Plan Check review.
Modify condition of approval No. 87 to include a hedge wall on the southwest
side of the drive through radius fronting Barton Road, to be kept at a height of 4-

2030 VISION STATEMENT:
This staff reports supports Goal #3 to Promote Economic Development by determining
the sale of property is consistent with Public Use Designation on the Grand Terrace
General Plan.
BACKGROUND:
On August 23, 2022, the City Council adopted a Resolution declaring the Property,
located at 22582 City Center (San Bernardino County Fire Station No.23) exempt
surplus land and approving the Sale and the Agreement of the Property to the San
Bernardino County Fire Protection District, contingent upon the Planning
Commission/Site and Architectural Review Board determination that the disposition of
the Property conforms with the General Plan.

California Government Code Section 65402(a) states that "If a General Plan has been
adopted, no real property shall be disposed or acquired, until the location, purpose and
extent of such disposition or acquisition, \[has\] been submitted to and reported upon by
the planning agency as to conformity with said adopted general plan within forty (40)
days after the matter was submitted to it." Therefore, in order for the disposition of
property to occur, the Planning Commission must first make a report on the conformity
of the proposed acquisition with the General Plan.
GENERAL PLAN CONSISTENCY
The Property is an approximately 0.84-acre lot located at the terminus of City Center
Court, occupied by San Bernardino County Fire Station No. 23, which services the City
of Grand Terrace and County (Attachment 1). The Property
the General Plan Land Use Map, and it is zoned Barton Road Specific Plan, Village
Commercial (BRSP, VC) which allows Public Uses such as Government offices and
facilities.
The sale of the Property conforms with the following findings:
a. The purpose of the Municipal Code for Public Facilities (PUB) is to provide
public service uses such as public parks, school facilities, and government

c. The property is staffed by San Bernardino County Fire Division and
provides fire protection services to the City of Grand Terrace. The city
desires to sell the property to San Bernardino County, who will continue to

WHEREAS, the City of Grand Terrace (City) owns that certain property
located at 22582 City Center Court, Grand Terrace, CA with APN 1178-011-12
(Property); and
WHEREAS, the San Bernardino Fire Protection District (District) currently
utilizes the Property as a San Bernardino County Fire Station No. 23 that provides fire
protection services to the City; and
WHEREAS, the City desires to sell the Property to the District for the
aforementioned purpose of a San Bernardino County Fire Station No. 23 that provides
fire protection services to the City; and
WHEREAS, Government Code Section 65402 stipulates that prior to the
disposition of real property by a government agency, the planning agency of the
jurisdiction in which said Property is located must first make the finding that the
acquisition of said Property is in conformance with the adopted General Plan of the
local jurisdiction; and
WHEREAS, the Property is designated Public (P) on the General Plan Land
Use Map and it is zoned Barton Road Specific Plan, Village Commercial
(BRSP,VC) on the Zoning Map; and
WHEREAS, Public uses within the Land Use Element may include schools,
parks, facilities for public service uses such as government offices and services;
and

WHEREAS, the Property is located a 22582 City Center on a 0.84-acre lot,
Assessor Parcel Number 1178-011-12; and

WHEREAS, the use of the Property is consistent with the Municipal Code and
General Plan, and it will continue to be utilized in a manner consistent with the Public
Use Designation and will support Public Services and Facilities Element Goal 7.1 to
coordinate and balance the provisions of public services with existing and planned
development to eliminate service gaps, maximize the use of existing public facilities and
services, and provide a high level of quality public services; and
WHEREAS, this action is not subject to environmental review pursuant to
CEQA Regulations Section 15060(c)(3) of the CEQA Guidelines. The activity is not a
project as defined in Section 15378 (b) (5) - Organizational or administrative activities
of governments that will not result in direct or indirect physical changes in the
environment. Further, even if it is a project, this action is exempt from CEQA pursuant
to Section 15061(b)(3) when it can be seen with certainty that there is no possibility
that an action will have a significant effect on the environment, that activity is not
subject to CEQA. The evaluation of General Plan conformity for the saleof the
Property by the City of Grand Terrace will not haveany effect on the environment.
The ownership of the Property will change; however, the use of the Property remains
the same and no physical changes are proposed or authorized with the salethereof.
Therefore, it can be seen with certainty that there is no possibility of significant
environmental effects, and this finding of General Plan conformity for the sale is not
subject to CEQA.
WHEREAS, on August 23, 2022, the City Council adopted a resolution declaring
the property exempt surplus property and approving the sale of the Property and the
Agreement contingent upon the Planning Commissions determination that the
disposition of the Property conforms with the General Plan; and
WHEREAS, on September 1, 2022, the Planning Commission conducted a duly
noticed public meeting on this matter at the Grand Terrace Council Chambers located at
22795 Barton Road, Grand Terrace, California 92313 and concluded the meeting on
said date; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.
NOW THEREFORE, it is hereby found, determined, and resolved by the
Planning Commission of the City of Grand Terrace, as follows
1. The Planning Commission hereby specifically finds that all the facts set forth in
the above Recitals, are true and correct and are incorporated herein by this
reference.
2. Based upon the forgoing and written and oral presentations made by City staff

and members of the public, including, but not limited to, written and oral staff
reports, at the September 1, 2022, public meeting, the Planning Commission
specifically finds:
a. The purpose of the Municipal Code for Public Facilities (PUB) is to provide
public service uses such as public parks,school facilities, and government
offices and services, including the citys fire station.
b. The Property is designated Public (P) on the General Plan Land Use
Map and is zoned Barton Road Specific Plan (BRSP, VC) on the zoning
map.
c. The Property is staffed by the San Bernardino County Fire Protection
District and operates as San Bernardino County Fire Station No. 23 and
provides fire protection services to the City of Grand Terrace. The City
desires to sell the Property to San Bernardino County Fire Protection
District, who will continue to operate the existing Property as the public
facility of a fire station providing fire protection services to the City.
d.Therefore, theproposedsaleof the subjectPropertywould be
accomplished for the intended purpose of implementing the Municipal
Code, in accordance with the General Plan land use designation, goals,
and policies.
4. Based upon the forgoing and written and oral presentations made by City staff

conclusions set forth in paragraphs 1, 2, and 3 above, this Planning Commission
hereby finds that proposed acquisition of the subject Property would be in
conformity with the Grand Terrace General Plan in accordance with
Government Code Section 65402.
