Approval of Minutes - Special Meeting - 09/29/2016
Commissioner Allen inquired about correcting the minutes due to an error in recording
Allen had cast a vote when he was actually absent at the time the vote was taken.
Commissioner Allen inquired about the reason that the minutes were being voted on.
Chairman Comstock asked the City Attorney to address the question.
The City Attorney stated that minutes are a matter of public record keeping with records
going back at least 20 years.
Commissioner Allen restated his question, asking about these specific minutes.
Commissioner Goatcher entered the room.
Director Molina clarified that this set of minutes was prepared by an outside consulting
firm, and that they had not been previously voted on.
Chairman Comstock asked Commissioner Goatcher if he had any comments or
questions regarding these minutes.
Commissioner Goatcher replied, saying he does not have any comments.
Director Molina confirmed that the error in the voting record for these minutes would be
corrected.

Director Molina gave the PowerPoint presentation for this item.
Commissioner Goatcher asked whether there were any communications from the public
regarding this project.
Director Molina said that there were not any.
Chairman Comstock asked if there were any commissioners who had questions for
staff.
Commissioner Giroux asked about RV parking in the CC&Rs.
Director Molina replied that one of the conditions restricted RV parking in driveways.
Commissioner Giroux asked the applicant, Darryl Moore, to speak at the podium.
Commissioner Giroux asked the applicant whether residents would be allowed to load
their RVs at their houses.
Darryl Moore replied that he did not know the answer to that question.
Darryl Moore stated that they had not yet written the CC&Rs.
Commissioner Giroux commented that residents should be allowed to park their RVs
temporarily to load them.
Commissioner Allen asked the applicant about vehicle size limits for residents who may
have larger vehicles for work.

Darryl Moore said that he was open to working with the City to write the HOA rules.
The City Attorney stated that there was a common requirement in CC&Rs to allow
loading and unloading of vehicles.
Commissioner Cesena thanked the applicant for moving the fences and adding a
playground area.
Commissioner Cesena stated her concern about parking.

Darryl Moore commented that they were building less square footage and less rooms so
there would be no issues with parking.
Commissioner Giroux commented about standard road width at 36 feet being able to
accommodate parking at the curb.
Darryl Moore confirmed that fact.
Commissioner Allen asked staff about a new development on Mount Vernon Avenue
called Greenbrier and what their setbacks were.
Director Molina replied that the rear yard was 10 feet and the side yard was 4 feet, but
reminded Commissioner Allen that the setbacks were smaller because that was a
condominium project.
Director Molina explained that this current project is not a condominium project.
Chairman Comstock opened the item to comments from the public.

Director Molina replied that they would look closely at the CC&Rs for this development,
and that RVs could park for no more than 72 hours on public streets.
Commissioner Allen commented that people would be able to park their RVs on the
street indefinitely if they periodically moved them to different locations.
Chairman Comstock replied that code enforcement would deal with that issue.
Commissioner Allen stated that he disagreed and that code enforcement does not do
anything.
Commissioner Giroux asked Director Molina about the vehicle code and city ordinance
on the 72-hour parking restriction and whether the city ordinance was more restrictive
than the vehicle code.

Director Molina replied that she would have to do more research on that matter.
Angela Wagman, 22322 Van Buren Street, expressed her concern about the lack of
parking on her street and the number of vehicles being parked there for extended
periods of time.
Chairman Comstock commented about the original intentions of the 72-hour parking
ordinance being so that people could not park their RVs on the street indefinitely.

ChairmanComstock asked Director Molina if she could do some research into the topic.
Chairman Comstock commented that the City might want to consider making the street
parking ordinance more restrictive regarding RV parking.
Director Molina commented that the reason for the condition for this project to not allow
on-site RV parking was due to the smaller size of these lots, and to reduce the feel of
congestion with RVs parked in the driveway.
Director Molina stated that CC&Rs commonly restrict RV parking.
Chairman Comstock commented on the difference between a work vehicle and an RV,
and having a closer look at this difference when writing the CC&Rs.
Chairman Comstock asked if anyone else in the audience had any additional comments
or questions regarding this project.
Chairman Comstock invited the applicant back to the podium.
Darryl Moore stated that this project would create more housing and would be
welcoming to millennials, as well as being a benefit to the city.
Chairman Comstock closed the public hearing.
Commissioner Giroux commented that anyone who owns a car in the state has a right
to use a public road. It would be difficult to restrict street parking outside of a CC&R
area. The city should consider developing street parking restrictions specific to RVs and
larger commercial vehicles.
Chairman Comstock stated that this project would increase quality of life for this
neighborhood due to the smaller sizes of the houses.
Chairman Comstock expressed his concern about building large single-family homes
within multifamily zones where apartments could be built instead, and expressed his
satisfaction with this project due to the smaller footprints

Commissioner Allen asked Director Molina about the status of the Habitat for Humanity
homes project on Michigan Street.
Director Molina replied that the housing plans were approved and the applicant had
recently submitted the final map, the grading plan, and the public improvement plan.
Chairman Comstock inquired about the status of the Caltrans roundabout project.
Director Molina replied that the City had asked Caltrans for an updated construction
schedule and as soon as she got it the information would be shared with the
Commission.
Commissioner Allen asked about Commerce Way and when that street extension would
be completed to alleviate the traffic on Michigan Street.
Director Molina replied that the City Manager was spearheading that project in
conjunction with Lewis Homes.
Commissioner Allen commented that completing that street would help the residents on
Michigan Street.

Director Molina replied that there were not any communications except from Tony
Tejeda, vice president of CB Tyres, indicating that he would be present at this meeting.
Chairman Comstock asked if there were any commissioners who had questions for
staff.
Commissioner Giroux asked if the Fire Department had any estimates of fire danger
due to the number of tires on the lot.
Director Molina replied that the findings of a recent Fire Department were not yet
finalized.
Director Molina stated that she could request a County Fire representative to be present
at the next hearing.
Chairman Comstock agreed with Director Molina.
Chairman Comstock asked Director Molina about the conditions of approval. Details are
illegible from the video.
Chairman Comstock asked if there were any abandoned vehicles on the property.
Director Molina replied that there were none.
Chairman Comstock asked if the unpaved portions of the site were taken care of.
Director Molina replied that they had been, and that Code Enforcement had not seen
any issues with the rest of the conditions of approval.

Commissioner Allen mentioned that one of the conditions stated that
and asked if the applicant could store more than 499 tires if they kept them off the
ground.
Director Molina clarified that the intention of the condition was to limit the number of
tires on site to 499.
Commissioner Allen asked how many employees CB Tyres has.
Director Molina replied that she did not know.
Commissioner Allen asked if any neighbors have communicated with the City regarding
this business.
Director Molina replied that she was not aware of any complaints.
Chairman Comstock asked if there were any issues with the Fire Department and
expressed his concerns about air quality should a fire ever break out on the property.
Director Molina replied that the Fire Department had contacted the City regarding this
issue because CalRecycle had contacted the Fire Department.
Director Molina stated that the Fire Department had done their inspections and that the
City would know the details of the inspection soon.
Chairman Comstock asked if the information would be available at the next hearing.
Director Molina replied in the affirmative.
Commissioner Allen asked if the previous Code Enforcement violations had been paid.
Director Molina replied that she did not think that the violations were all paid.
Commissioner Giroux asked if CalRecycle was the same as California Integrated Waste
Management or if they were different entities.

Chairman Comstock called the applicant, Tony Tejeda, to the podium.
Tony Tejeda requested an extension to clean up the tires he has on site.
Tony Tejeda explained that he was in the process of improving conditions on the site
and speeding up the process, and that he is not currently accepting any tires and that
his only priority is cleaning up the property.

Chairman Comstock asked Mr. Tejeda if the date March 16 gave him enough time to
do what he needed to do.
Tony Tejeda replied that it was too soon.
Chairman Comstock asked if staff had a reason for setting up the meeting quickly.
Director Molina replied that the case had been on-going since June 2016.

Chairman Comstock asked if the March 16 date was reasonable.
Director Molina replied in the affirmative.
Chairman Comstock asked Mr. Tejeda if he had anything to add.
Tony Tejeda expressed his intent to remedy the situation and that it would require 3
months to do so.
Chairman Comstock asked if a date in May was what Mr. Tejeda was looking for.
Tony Tejeda replied in the affirmative.
Chairman Comstock asked if there was anything Mr. Tejeda wanted to add.
Tony Tejeda stated that he brought his accountant to the hearing.
Commissioner Giroux asked about how many trucks per day were going to the
Mitsubishi cement plant.

Tony Tejeda replied that there were 2 tractor trailers going per day and 2 bobtail trucks
going twice a day, getting rid of 50 tons of tires a day.

directly to the Mitsubishi plant.

Commissioner Giroux asked if there were any additional recycling plants that could be
used.
Tony Tejeda replied that there are other locations in Long Beach and Azusa but they
were not accepting tires currently.
Tony Tejeda stated that he is investing a lot into the shredder solution and expressed
his wish to see the CUP broadened.
Commissioner Giroux asked Mr. Tejeda if he knew of a company in Arizona that
recycles tires.
Tony Tejeda said he does, and that the company owns a location in Compton. He also
stated t
Commissioner Giroux asked Mr. Tejeda if he could dispose of his tires at the Compton
location.
Tony Tejeda said he could not because that facility was too busy.
Commissioner Giroux asked if it was possible to send the tires to Arizona.
Tony Tejeda replied that it was complicated due to regulations.
Chairman Comstock asked Mr. Tejeda how many employees he had.
Tony Tejeda replied that he had 17 employees.
Commissioner Allen asked if shredded tires were easier to dispose of than whole tires.
Tony Tejeda replied in the affirmative.
Chairman Comstock asked if a change in business operations would require a CUP.
Director Molina replied in the affirmative.
Chairman Comstock asked about the noise level of a tire shredder.

Commissioner Allen asked if the shredder would require an environmental review.
Director Molina said that the question can be looked at.
Director Molina stated that the discussion on the shredder was that it was only going to
be temporary to reach compliance.

Tony Tejeda stated that he would like to keep a shredder for situations when the
recycling plants were not accepting tires as landfills only accept shredded tires.
Chairman Comstock recommended that Mr. Tejeda work closely with staff regarding
this matter.
Chairman Comstock expressed his concern about this business becoming a tire
shredding business bringing in even more tires.
Director Molina asked how long it would take to reduce the number of tires and become
compliant.
Chairman Comstock also asked how many tires were being delivered to the recycling
plant per load.
Tony Tejeda replied that there were around 2,400 tires per day.
Chairman Comstock replied that it would take around a month to remove the tires.
Director Molina asked that if it would take a month to remove the tires then was the
shredder necessary?
Director Molina stated that this question could be asked by the commission during the
next hearing.

Director Molina stated that the March 16 date was reasonable.
Commissioner Giroux asked if the tractor loads were being used to reduce the pile on
the property or for current tires.
Tony Tejeda replied that the tractors were for the pile and the bobtail trucks were for
newly accepted tires.
Commissioner Giroux stated that the 6-week period should be enough.
Tony Tejeda replied that he would be in great shape.

Commissioner Allen asked how the shredded tires would be measured when looking at
e limit and expressed his concern about the environmental impact of
shredding the tires.
Chairman Comstock said that those issues should be addressed during the next public

Director Molina stated that the shredder should not be utilized on the property until after
a CUP has been granted to allow for the shredder on the site.

Director Molina stated that the shredder is not necessary to reach compliance for the
site.
Chairman Comstock expressed his concern about the increase in business due to the
shredder and the environmental impact of the shredder.
Chairman Comstock relayed a story of a previous applicant who was denied due to
environmental issues.
Chairman Comstock recommended that Mr. Tejeda communicate with staff closely to
reach a reasonable conclusion.
Tony Tejeda agreed and explained how his shredder will operate to reduce the number
of tires potentially on site.
Chairman Comstock recommended that Mr. Tejeda reduce the number of tires to the

and causing accidents.
Chairman Comstock requested that the City traffic engineer add stop signs to the
intersection of Canal Street and Newport Avenue.
Commissioner Giroux asked if the accidents along Canal Street are being documented
Chairman Comstock expressed that all the incidents along Canal Street need to be
reported.
Commissioner Giroux expressed his concern about the danger of speeders on Canal
Street.
Director Molina said that she would forward the concerns to the City Manager.

Staff presented the project and summarized the staff report.
Commissioner Allen requ
tenants. Director Molina confirmed low-intensity uses such as medical, florists, and
insurance agencies are the intent.
Commissioner Ceseña said she was concerned about the required parking being
reduced by two spaces. Staff explained it was due to the size and shape of the lot.
Commissioner Ceseña asked if overflow parking would be placed on Preston Street.
Staff indicated they were not anticipating any negative impacts. Commissioner Ceseña
expressed her concern about the railing and the drop-off.
Commissioner Allen requested making the exit out of the parking lot at Barton Road a
right-turn only lane. Commissioner Goatcher concurred with Commissioner Allen along
with the location of the two handicap designated parking spaces.
Chairman Comstock asked if there had been any written communications on this
project, and staff said none had been received. However, one resident had come to the
Planning Department counter to voice her concerns about the project.
Chairman Comstock opened the public hearing and asked the applicant to come
forward.
Jonathan Zane, architect and representative for the applicant, confirmed the challenges
of the site and stated the proposed site plan was the best solution. He spoke of the
placement of the handicap spaces and the terracing of the drop-off. He said he did not
believe making the exit lane right-turn only was necessary.
Commissioner Goatcher asked if the exit on Barton Road would be a right-turn only
lane. Mr. Zane said as there is an existing island so the right-turn only restriction would
not be necessary.
Commissioner Ceseña asked about the level of the parking spaces, and Mr. Zane

confirmed the parking spaces to the right were on the same level, including the
handicap spaces. She expressed her concern about the size of the building, and Mr.
Zane confirmed the building size was only 5,000 square feet divided into three small
suites.
Bobbie Forbes, realtor and resident at 11850 Burns Avenue, told the Commission she
had two clients on Barton Road who were concerned about the project. She read one
note from one of her clients (Ann Petta) into the record and verbally informed the

and it was confirmed the developer would be responsible. She also mentioned she had
thought this site was zoned professional business, not commercial, and that the
proposed florist is a commercial business.
Bob Henry, 22614 Miriam Road, said he was concerned about vehicle movement for
larger vehicles in the parking lot and that the adjacent vacant lot, whenever it becomes
developed, is going to cause additional traffic problems.
Mr. Zane said he understood change was difficult but this project would be beneficial to
the City and bring in tax revenue. He said he did not believe this project would add an
additional burden to the parking and mail delivery issues that already exist. He also
explained the turning radius was large enough for a fire truck.
Chairman Comstock closed the public hearing and turned the item back to the
Commission.
Chairman Comstock asked staff if the traffic engineer had reviewed the project, and
Director Molina said it had been reviewed by the previous Public Works Director, who
location of the driveway on Preston Street nor provided recommendations regarding the
Barton Road entrance.
Chairman Comstock asked if the Fire Department had approved the turning radius in
the parking lot, and Director Molina said the Fire Department had informed staff they
would not need to enter onto the site but would stage on Barton Road and Preston
Street.
Commissioner Allen asked if there was a fire hydrant near the site, and staff confirmed
there was one at the Barton Road entrance. He asked what the difference was
between commercial and professional businesses and what the property was zoned for.
Director Molina said it is designated Office Commercial on the General Plan Land Use
Map and zoned Administrative Professional under the Barton Road Specific Plan, which
does permit a florist, medical, and office uses. He said he thought that Preston Street
was similar to an alleyway and that staff should go there in the morning and afternoon
when school is in and out of session.
Chairman Comstock said this was the best plan he had yet seen proposed for the site.

He said his concern about the project was the left-turn onto Barton Road from the lower
driveway and asked if staff could condition the project to make this a right-hand turn
lane only as vehicles exit the project, and City Attorney Bettenhausen said the
Commission has the discretion to do so.
Alan French, Public Works Director, said the striping from Barton Road onto Preston
Street was a normal left-hand lane, and the driveway is going to be located to the left of
the property to be developed. He said there was some stacking availability there.
Commissioner Goatcher asked how that would affect the driveway on the downhill side

Director Molina presented the project and summarized the staff report.
Chairman Comstock referenced emails and letters he had received regards the
amendment. He spoke about agricultural land designations being dropped in 1984 and
asked why. Director Molina said she was not aware of the reason.
Director Molina read into the record an email from Mann, expressing support of the
amendment and wish to see a community garden in the city.
Commissioner Ceseña asked how the yellow highlighted area shown on the 1978 map

could be accessed. Director Molina said there was access through Terrace Avenue.
Commissioner Allen asked why there needed to be a new Agricultural-2 Overlay instead
of the existing overlay being modified. He also asked if there could be an M2 Overlay to
avoid existing homeowner issues. Director Molina said the existing Agricultural Overlay
district is located on various properties throughout the city, and staff did not want to
make changes to that existing overlay district that would affect other properties. The
change was proposed to reintroduce residential uses to this area. Commissioner Allen
asked for the difference between changing zoning versus keeping zoning and adding an
overlay. Director Molina said there was a different CEQA analysis. Commissioner Allen

asked if there was an overlay for industrial uselike there was for agricultural. City
Attorney Bettenhausen said Director Molina was correct, that it would be uncommon to
do it in that order, and what was being proposed was the simplest process. He said
adding steps of rezoning and adding overlays adds additional costs to the city for
additional studies.
Director Molina added if a property owner wanted to enact the Agricultural-2 provisions
they would establish a commercial/agricultural-related use, and the number of allowed
animals would be based on the project area.
Chairman Comstock asked if there are restricted differences between the original
agricultural zoning and the Agricultural-2 zoning now proposed if a property owner did
not want to use their animals for commercial purposes. Director Molina said this overlay
was in effect in other parts of the city and only in residential areas where there are
existing homes.
Chairman Comstock opened the public hearing.
Stephanie Jones, 12857 Reed Avenue, said her family enjoyed being on Mr.
organic farm. She showed the Commission photos of her family picking on
the farm.
Anne Wade Hornsby, 22594 Eton Drive, said she kept her horses on the ranch shown
on the map. She said she had lived in Grand Terrace before incorporation and never
understood the rezoning as no industrial had ever taken place.
Jennifer Katuls, 21815 Vivienda Avenue, said she enjoyed the area of Grand Terrace
she lived in because of its rural nature.
Don Smith, 12029 Mount Vernon Avenue. He expressed his support for a farm in the
city.
Bobbie Forbes, 11850 Burns Avenue, said no one in her neighborhood wants
machinery, odors, and dust in the area. She said she was concerned that the intent
was to build ranchettes which will limit the agricultural use and the existing farm would
be reduced to 1-acre. She expressed her support for bigger lots on the parcel.

Matthew McConnell, 21758 Walnut Avenue, brought the Commission a petition that had
been submitted to City Council in July 2017 that now had over 300 signatures in support
of the amendment. He read the title page of the petition into the record.
William Mahaney, 21769 Vivienda Avenue, said the parcel with its existing zoning is not
developable due to easements and utilities and that he wants to do away with the M2
Overlay. He also mentioned in a culvert by the project, which drains into the property
below, was leftover slurry seal from a recent road repair that was never cleaned out.

Katie Guthrie, 21769 Vivienda Avenue, said she enjoys the green space of the project
but is concerned if industrial is built, her property value would decrease.
Janet Rich, 11701 Terrace Avenue, said she has owned property in the city since 1967
and lived in the city since 1972. She said she and her neighbors had always objected
to the property being zoned as industrial back in 1984. She said when it was rezoned to
industrial the City placed an agricultural overlay to appease the landowners, but at
some point it was removed and staff could not tell her when that occurred. She said in
2010 she attended several meetings and the agricultural overlay was reinstated. She
said she wants the zoning to just revert to agricultural.
Janese Makshanoff, 21816 Vivienda Avenue, reviewed the history of the property with
the Commission. Referencing Page 34 of the agenda packet, she asked if the City was
looking to remove the grandfather clause. She spoke about the possible trucking uses
of the property should it stay industrial, and how the shipping industry has already
negatively affected Agua Mansa, Rialto, and Bloomington.
Michael Simon, 21797 Vivienda Avenue, requested that the 45 acres below his property
have the zoning revert to the pre-1984 agricultural. He expressed his support for 2.5- to
5-acre lots. He said the property was inferior for commercial development due to its
lack of infrastructure. He said there should not be anything parked under the power
lines. He mentioned previous litigation and possible future litigation.
Scott Berndt, resident of Riverside, said he works for Riverside Unified School District
as a food-hub coordinator and buys from local farmers to sell to one vendor. He said he
is funded through a grant to purchase California-grown produce and purchases $4
million in produce per year. He said there is not a lot of local farm land in Southern
California so he purchases approximately 90% of his produce in the Central Valley. He
supports growing food locally to support small farms and create economic activity.
Jennifer Reich, at Michigan Street and De Berry Street, said she grew up in Grand
Terrace and it was difficult seeing the changes. She said there were few places to see
wildlife and enjoy the open space by riding horses or cycling. She said if any part of the
area went commercial it would destroy many peop
Brenda Anders, 12072 Preston Street, said her family had lived in Grand Terrace since
the 1970s and recently she had witnessed the growth with signs on every lot for sale
and industrial buildings going up, although she said that was not necessarily a bad

diversity. She said as more buildings go in, they are losing more green land. She
expressed her support for the McConnell farm.
Grand Terrace Renee Ravolos, read 2016 statistics into the record about parolees, sex
offenders, and the homeless in the San Bernardino County area. She said more
commercial and industrial uses would bring more crime into the area. She expressed
her support for leaving the area agricultural.

Cheryl Lago, resident of Riverside and former agricultural instructor at Moreno Valley
Unified School District, spoke about trail closures and loss of wildlife due to
development. She said if the property is industrial the nearby housing values would
decline. She spoke about the possibility of school children taking field trips to the farm.
She expressed her support for reverting to the original agricultural zoning.
Colleen Longo, 22429 Terrace Pines Drive in Unit G, said having the farm within
walking distance was very important to her and the potential of any industrial taking over
like in Redlands would be devastating.
Jeffrey McConnell of McConnell Farm said he was the instigator for this zone
amendment. He has lived in the area for 17 years. He said he was challenged to find a
use for the property, and he believes he has found it. He said he purchased the
property to grow food, not develop. He said he is asking for the one residential
structure per acre so that adjoining property owners could develop their own properties.
He said when he overgrows food he invites people to come and pick what they need.
He asked why the opposition was not at the meeting. He said he turned in paperwork
date-stamped May 31, 2017 that should have been a
agenda packet. He said he had a copy of the minutes from the 1984 meeting where the
residents in the area originally objected to the industrial zoning. He asked the
Commission to put the zoning back to the way it was and to asked staff why the
amendment was being done with another overlay instead of reverting back to the
original zoning and why submitted paperwork was not in the agenda packet. He asked
the Commission to either reject the amendment or make a different recommendation.
He said staff wanted him to pay a $2,300 application fee and a public works review for
permission to grow food. He spoke about the growing movement for locally grown
produce. He said he was tired of staff members and property owners who do not live in
town trying to dictate how citizens should live.
Chairman Comstock closed the public hearing.
Chairman Comstock asked staff about the existing grandfather clause. Director Molina
said it was not the intent of the proposal to negate the non-conforming status of the
existing occupied residential uses in that area. She discussed a conversation she had
with Janese Makshanoff the previous day regarding the code amendment done back in
2010. She said in 2010, when the City replaced the agricultural overlay district on the

southern half, the City Council also adopted an ordinance that recognized the three
occupied homes and put protections in place so that the provisions of the R-zone would
apply to those properties. Chairman Comstock said it was his belief if a property was
owned prior to the city incorporating then the owner should be able to continue the use
of his/her property. He asked if it was the City Cou
intent to keep those safeguards in place. Director Molina clarified the protections
placed back in 2010 only apply to the two properties.

Chairmain Comstock said he had been down the road and had seen a large sinkhole,
and that he reported it to the city and it was filled in. He said with the road being non-
certified and unable to carry truck traffic, and lack of infrastructure, it needs to be
addressed. He also mentioned the traffic issues at the train bridge and a light would
need to be installed. He felt the property has not yet been developed due to the costs
of mitigation. He asked if the access at La Cadena Drive under the railroad bridge was
still in talks to being closed, and Director Molina said it was still open. Director Molina
said there needs to be specific findings per state law to close the street, and staff had
not yet made those findings.
Chairman Comstock said in reviewing the archived City Council meeting minutes there
was discussion about the economic viability of changing zoning. He asked if, regarding
the 40 acres in blue on the map being discussed, it was viable to go back to the original
agricultural zoning. Director Molina said it would trigger a modification to what was
currently before the Planning Commission, with need to modify the CEQA addendum
and create a zoning code chapter. He asked if it would be expensive to do, and she
what the City Council had agreed to.
Commissioner Allen asked if staff had considered reverting the property back to its
original zoning. Director Molina said not particularly, that they did look at an agricultural
designation but believed the overlay would provide the most flexibility. He asked if there
had been any correspondence from any of the property owners in the yellow area on
the map, and she said no, but she did receive a phone call from a representative of the
property owners to ask about the proposal. She said she had explained the overlay
concept to that representative. He asked if the land was still in escrow, and Director
Molina said she did not know if it had been transferred yet. He asked if she knew what
the people who were in escrow planned to do with the property, and she said no. He
asked what level of development would be required to rebuild the non-certified road,
and she said it would be based on the intensity of the use and the potential increase in
traffic volume. He asked about the abandoned water wells and whether they would
affect the the property, and Chairman Comstock said no. He wondered if the intended
use of a property after being rezoned did not come to fruition if there was a timeframe
the property would revert to its original zoning.
Commissioner Goatcher said he was confused why the property was ever rezoned to
industrial and believes it should revert to agricultural. Chairman Comstock said when

the rezoning was being discussing there was concern if there would be contamination if
there was a flood.
Commissioner Ceseña asked the City Attorney if the reason they could not revert to the
original agricultural zoning was because the property would no longer be in compliance
with the General Plan. City Attorney Bettenhausen said the Commission has the
discretion to make any recommendation to the City Council on how to amend it, but
what was being presented was staff trying to navigate the most efficient way. She
asked how the floodplain would be mitigated for the proposed ranchettes, and also

stated that she had traveled down to the project through Vivienda Avenue and did not
understand how that road could be used for access. Director Molina said the City has a
Floodplain Ordinance that regulates development and requires structures to be built to a
certain grade elevation above the floodplain.
Commissioner Allen said he would like to see the item go back to staff to study the
feasibility of reverting to the original agricultural zoning so there would be a comparison
of the AG-2 Overlay versus agricultural zoning.
Chairman Comstock said he would like to talk to the property owner whose property is
in escrow and asked if there was a possibility of being sued by the property owner if the
property reverted to agricultural zoning. City Attorney Bettenhausen said the property
owner has no vested rights until he breaks ground. He asked the City Attorney if an
official motion needs to be made, and City Attorney Bettenhausen said yes, with specific
direction provided to staff. He said it appeared most, if not all of the audience who
spoke were in favor of reverting the property back to agricultural, and that as a
contractor he did not see it every being feasible to develop the property with industrial.
Chairman Comstock requested one option to return the item back to staff for further
information on reverting the property back to the original agricultural zoning and the
costs associated with that. Commissioner Ceseña requested a second option of
straight agricultural in the blue on the map and a version of what is being proposed in
the yellow on the map. She said they need to take advantage of an opportunity to
preserve a piece of Grand Terrace that is really valued.
Director Molina requested more clarification. Chairman Comstock said he knew the City
Council was concerned about economics and liability. He also asked for more
advertising or to create a survey to obtain more citizen input. Commissioner Allen said
he would like to see more research done to give the residents an honest answer on
their desires and why they can or cannot have the property revert to agricultural. He
clarified that staff should research either returning both the blue and yellow properties
on the map back to agricultural with no M2 designation, or straight agricultural in the
blue on the map and a version of what is being proposed in the yellow on the map.
Commissioner Goatcher made a motion to return the entire property to agricultural, and
City Attorney Bettenhausen said CEQA findings need to be made to do that first.
Chairman Comstock said he wanted this all done legally with CEQA so there was no

possibility of having anything reversed. Commissioner Goatcher withdrew his motion.
A motion was made to continue the item to the November 16, 2017, Planning
Commission/Site and Architectural Review Board meeting and return the item back to

2030 VISION STATEMENT:
This item supports Goal 3 to Promote Economic Development.
PROPOSAL/DISCUSSION:
A Land Use application has been submitted by the Crest Timbers LLC, represented by
Regional Manager Szandra Bedo, proposing site improvements to the apartment
complex located at 22491 De Berry Street. The proposed improvements include a new
color scheme for the entire apartment complex, car garages and leasing office.
The Subject Property is located at the corner of Mt. Vernon Avenue and De Berry Street
on a 8.43 acre lot and it is zoned R3 -Medium Residential.
Due to the prominent location of the apartment complex along Mount Vernon Avenue
and De Berry Street and the size of the 228 unit apartment complex, staff is seeking
approval of Land Use Application 17-91 to ensure the proposed overall color scheme is
compatible and harmonious with the surrounding area.
The Crest Village Apartments are under new management and the new owners are
investing in the property by proposing site improvements. The Applicant has formally
submitted an application seeking approval of the proposed color scheme.

The proposed dominant color for the apartments is a neutral light brown "Riverbed. The
front window of the 228 units projects from the building wall approximately 8 to 12
inches and it will be accented with a gray "Metal Fringe," paint color, and the window
of accent colors. Although the gray and the red accent colors are used only on the
projections, their use is repetitive and will be prominent along the Mount Vernon Avenue
color but it is located in the interior of the site and will not be visible. Attached is a
photograph showing the color scheme painted on a portion of one of the apartment
units.
Future improvements include updating the sign copy on the existing monument signs
and remodeling the club house; however, no formal applications have been submitted
for these items.
CONCLUSION:
Staff recommends that the Planning Commission approve the Project finding that the
proposed color palette is appropriate and consistent with the surrounded neighborhood.

A RESOLUTION OF THE PLANNING COMMISSION/SITE AND ARCHITECTURAL
REVIEW BOARD OF THE CITY OF GRAND TERRACE CALIFORNIA, APPROVING
LAND USE APPLICATION 17-91 AND THE PROPOSED COLOR SCHEME THE
CREST VILLAGE APARTMENTS LOCATED AT 22491 DE BERRY STREET (APN
1167-331-07)
WHEREAS, Crest Timbers LLC, represented by Regional Manager Szandra
Bedo, has filed Land Use Application 17-91 requesting approval to paint an existing
228-unit apartment complex located on an 8.43-acre lot, at 22491 De Berry Street,
zoned R3 Medium Residential.
WHEREAS, the Project qualifies for a categorical exemption, pursuant to Section
15301 of the California Environmental Quality Act (CEQA) Guidelines, which exempts
maintenance, repair, leasing, or minor alterations of existing facilities.
WHEREAS, on December 21, 2017, the Planning Commission conducted a
meeting on the Project at the Grand Terrace Council Chambers located at 22795 Barton
Road, Grand Terrace, California 92313 and concluded the hearing on said date.
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.
NOW THEREFORE, BE IT RESOLVED by the Planning Commission of the City
of Grand Terrace:
1. The Planning Commission/Site and Architectural Review Board hereby finds that
the Project is categorically exempt pursuant to Section 15301 from the provisions
of the California Environmental Quality Act (CEQA).
3. The Planning Commission/Site and Architectural Review Board finds as follows
with respect to Land Use 17-91:
a. The proposed residential project is consistent with the intent of the Grand
Terrace Municipal Code and the General Plan. The Projects existing

structures are consistent with the R3 Medium Residential zoning and
with the Medium Density Residential designation on the General Plan
Land Use Map. The re-painting of the onsite structures is consistent with
ongoing maintenance of the site.
b. The location and configuration of all structures associated with this Project
are visually harmonious with this site and surrounding sites and structures,
that they do not interfere with the neighbors' privacy, that they do not
unnecessarily block scenic views from other structures and/or public
areas, and are in scale with the townscape and natural landscape of the

area. There Project does not trigger issues of structure configuration,
privacy issues or the blocking of scenic views because no new structures
are proposed.
c. The architectural design of structures, their materials and colors are
visually harmonious with surrounding development, natural landforms, are
functional for the proposed project and are consistent with the Grand
Terrace Municipal Code. The proposed color scheme of neutral colors
with accents of gray and red will enhance the existing building and will be
visually harmonious with the surrounding development.
d. The plan for landscaping and open spaces provides a functional and
visually pleasing setting for the structures on this site and is harmonious
with the natural landscape of the area and nearby developments. The
Project does not trigger any landscaping requirements.
e. There is no indiscriminate clearing of property, destruction of trees or
natural vegetation or the excessive and unsightly grading of hillsides, thus
the natural of tsetting, and natural landforms are preserved.
The Project does not include any clearing of property or removal of natural
vegetation.
f. Conditions of approval for this project necessary to secure the purposes of
the Grand Terrace Municipal Code and General Plan are made a part of
this approval as set forth in the accompanying Resolution of Approval.
BE IT FURTHER RESOLVED that Land Use 17-91 is hereby approved subject to the
following conditions:
1. Land Use 17-91 is approved for the re-painting of the existing apartment complex
located at 22491 De Berry Street, based on the application materials submitted
by Szandra Bedo on December 1, 2017, including the pictures and color
samples. The project site is located at the intersection of Mt Vernon Avenue and
De Berry Street, on an 8.43-acre lot, zoned R3 Medium Family Residential.
The application materials are approved as submitted and shall not be altered
unless reviewed and approved by affected departments. The following color

2. If not appealed, this approval shall become effective on the eleventh (11) day
afte

day following such eleventh (11) day when the eleventh (11) day is not a city
business day. This approval shall expire twelve (12) months from the date of
adoption of this resolution unless all conditions of approval have been met; or a
time extension has been granted by the City, in accordance with Chapter 18.63

of the Zoning Code. Time extensions shall be filed at least sixty (60) days prior
to the expiration date.
3. Minor modifications to this approval which are determined by the Planning
Director to be in substantial conformance with the approved Land Use
Application, may be approved by the Planning Director upon submittal of an
application and the required fee.
4. The applicant shall defend, indemnify, and hold harmless the City of Grand
Terrace and its officers, employees, and agents from and against any claim,
action, or proceeding against the City of Grand Terrace, its officers, employees,
or agents to attack, set aside, void, or annul any approval or condition of
approval of the City of Grand Terrace concerning this project, including but not
limited to any approval or condition of approval of the Planning Commission, or
Planning and Development Services Director. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and the City
shall cooperate fully in the defense of the matter. The City reserves the right, at
its own option, to choose its own attorney to represent the City, its officers,
employees, and agents in the defense of the matter.
5. The Applicant shall complete the re-painting of the entire site by April 30, 2018.
6. Construction and operational activities associated with the project shall comply
Terrace Municipal Code.
7. Upon approval of these conditions and prior to becoming final and binding, the
and content shall be prepared by the Community and Economic Development
Department.
