Zoning Code Amendment 17-04 Chairman Comstock opened the continued Public Hearing at 6:40 p.m. Sandra Molina, Planning and Development Director gave the PowerPoint presentation for this item. Jessica Lambarena, Planning Secretary read into the record a letter received by Staff from Ms. Becky Giroux, Grand Terrace. Ms. Giroux's health is compromised and Minutes Acceptance: Minutes of Mar 22, 2018 6:30 PM (CONSENT CALENDAR) requested that the Planning Commission consider only allowing non-toxic organic based material in the outdoor storage area being discussed. She has also requested that eighteen-wheeled trucks, tractors and trailers be disallowed. Ms. Giroux also expressed her opposition to the recommendation which would allow the City Manager to determine interim use standards. Chairman Comstock supports wood chips and other organic materials for agricultural uses however is opposed to materials with a large amount of airborne particulate matter. City of Grand Terrace Page 2 Packet Pg. 4 A.1 Minutes Grand Terrace Planning Commission/Site and Architectural Review Board March 22, 2018 Commissioner Jeffrey Allen is concerned about the many different types of organic materials and how the Staff will be able to define all materials to be able to decide what is and is not allowed. Director Molina suggested Staff could bring back more specifically and, on a case-by- case basis, which material is being proposed for outdoor storage which will allow the Planning Commission to make the determination. Vice-Chair Ceseña shared her concern with the possibility of fire when a composting pile is too large. Commissioner Edward Giroux expressed his concern with internal combustion that can be caused by storing a large amount of material and suggested that a good water system be placed in the area to assist with possible fires. Brief discussion ensued regarding additional ways to prevent trucks from using Grand Terrace Road. Commissioner Giroux expressed concern allowing medium manufacturing in the M-2 Zone and the inability of commercial trucks to get in and out of the area, whether the City is following guidelines liken to EPA standards regarding obnoxious smells and requested clarification on property illumination levels for the area. PUBLIC COMMENT Tony Harris, Grand Terrace is opposed to the screening issue and is an unfair burden to new tenants. Janese Makshanoff, Grand Terrace stated if any changes are made to the area allowing medium manufacturing, she is opposed to allowing large trucks in that area. She shared her concerns with the frequency of fires and wind in the area. Jeffrey McConnell, Grand Terrace clarified that mulch piles smolder, not burn and described what is needed to care for mulch piles. Mr. McConnell suggested a vegetation wall could be another alternative for property screening. Commissioner Allen believes any outdoor storage leakage that could happen in the area is covered within the code amendment. Director Molina explained the General Plan talks about the types of uses that would be consistent with the designation. Any type of outdoor activity is processed with a Conditional Use Permit and part of that process is looking at potential issues and ultimately goes before the Planning Commission who is the approving authority. City of Grand Terrace Page 3 Packet Pg. 5 A.1 Minutes Grand Terrace Planning Commission/Site and Architectural Review Board March 22, 2018 Chairman Comstock recessed the Planning Commission meeting at 8:00 p.m. Chairman Comstock reconvened the Planning Commission meeting at 8:05 p.m. At 8:06 p.m., Commissioner Giroux recused himself from the dais regarding that portion of discussion related to the M-2 and AG overlay within 500 feet of his property. He does not recuse himself from any other discussion as it relates to the areas concerning industrial use. Assistant City Attorney Baron Bettenhausen clarified that any discussion regarding the zoning code for the City is acceptable. He explained that Commissioner Giroux is only recusing himself from a specific parcel. Commissioner Giroux returned to the dais at 8:09 p.m. G. Harold Duffey, City Manager acknowledged expressed his appreciation with the Planning Commission that they are taking the time to look at the issue. There have been cases in the past where business located with outdoors storages which created significant issues. Their discussions will help the City deal with the highest and best use for the outdoor facilities. Commissioner Giroux requested Staff address the level of light, so it will not to interfere with moving traffic. The three-foot candle power was good but not sufficient for security cameras he asked to consider when upgrading using the recommended IES (Illumination Engineering Society) standard illumination levels. Vice Chair Ceseña asked if the flexibility provided with interim use standard could be applied to all outdoor uses. Director Molina explained the reason for significantly more flexibility under Interim Uses is because it is only interim and not intended to be permanent and did not recommend applying interim standard uses intended to be permanent. D.INFORMATION FROM COMMISSIONERS Tom Comstock, Chairman asked Staff how the westbound offramp at the I-215/Barton Road Interchange would be designed. Alan French, Public Works Director explained there is a retaining structure being installed and the footing is being excavated at this time. Chairman Comstock indicated Riverside Highland Water Company is performing work in front of his home and he had several neighbors approach him asking when the work would be completed. Director French stated the Riverside Highland Water Company pulled the permit and the timeline given was through the end of May 2018. B.1 AGENDA REPORT MEETING DATE:July 5, 2018 TITLE:Findings of Conformance with the General Plan Pursuant to Government Code Section 65402 For the Disposition of City Property Located at 22400 Barton Road, #200 PRESENTED BY:Sandra Molina, Planning & Development Services Director RECOMMENDATION:1)Adopt A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, FINDING THE DETERMINATION OF GENERAL PLAN CONSISTENCY EXEMPT FROM CEQA PURSUANT TO SECTION 15061(b)(3) AND DETERMINING GENERAL PLANCONFORMITY PURSUANT TO GOVERNMENT CODE SECTION 65402 FOR THE PROPOSED DISPOSITION OF CITY-OWNED PROPERTY LOCATED AT 22400 BARTON ROAD, #200 (APN 0275-301-04) 2030 VISION STATEMENT: This staff reports supports Goal #3 to Promote Economic Development by determining the sale of properties for ultimate commercial development is consistent with the Grand Terrace General Plan. BACKGROUND: California Government Code Section 65402(a) states that "If a General Plan has been adopted, no real property shall be disposed or acquired, until the location, purpose and extent of such disposition or acquisition, \[has\] been submitted to and reported upon by the planning agency as to conformity with said adopted general plan within forty (40) days after the matter was submitted to it." Therefore, for the disposition of property to occur, the Planning Commission must first make a report on the conformity of the proposed acquisition with the General Plan. velopment opportunities,the City is in negotiation to sell the property at 22400 Barton Road, #200, which houses the former Grand Terrace Child Care Center. The City no longer operates or owns the child care business and the property is leased to Family Services Association (FSA), and as of June 29, 2018, FSA will terminate the operations of the child care center. The City Manager received an offer to purchase the property and building from 22400 Packet Pg. 11 B.1 Barton, LLC (Buyer). On July 10, 2018, the City Council will consider the proposal to purchase the Property. In accordance with the Government Code, Staff is recommending that the Commission find the disposition in conformance with the General Plan, as follows: GENERAL PLAN CONSISTENCY: The Property is measures approximately 0.91-acres and contains an approximately 6,500 square foot commercial building that has been historically occupied by a child care center. It is located at 22400 Barton Road, #200 (Attachment 1), in the Town and Country Commercial Center. The property is designated General Commercial (GC) on the General Plan Land Use Map, and designated Barton Road Specific Plan-Village Commercial (BRSP-VC) on the Zoning Map. It is anticipated that the Buyer will operate a similar type of child care use; however, the BRSP-VC also allows a variety of commercial uses similar to the uses that are located within the existing commercial center. The Village Commercial designation is designed to accommodate specialty uses such as cafes, bakeries, gift shops, florist shops, bookstores, and other similar commercial retail uses. According to the General Plan, the GC land use designation is primarily located along Barton Road and near the I-215 Freeway; and provides for general commercial uses to serve the retail and service needs of the community. The General Plan further states that the BRSP serves as the zoning code for most properties fronting along or directly related to Barton Road, and is intended to provide guidance for the development of predominantly commercial property along the primary transportation corridor through the City. The sale of the Property for operation of uses consistent with the Village Commercial designation of the BRSP, including a child care center, is consistent with the Grand Terrace General Plan. It provides for general commercial uses to serve the retail and service needs of the community; WHEREAS, as stated in the Grand Terrace General Plan, the BRSP serves as the zoning code for most properties fronting along or directly related to Barton Road, and is intended to provide guidance for the development of predominantly commercial property along the primary transportation corridor through the City; WHEREAS, State Government Code Section 65402 stipulates that prior to the disposition of real property by a government agency, the planning agency of the jurisdiction in which said property is located must first make the finding that the disposition of said real property is in conformance with the adopted General Plan of the local jurisdiction; WHEREAS, this action is exempt from the provisions of the California Environmental Quality Act (CEQA), pursuant to Section 15060(c)(3) of the CEQA Guidelines; WHEREAS, on July 5, 2018, the Planning Commission conducted a duly noticed public meeting on this matter at the Grand Terrace Council Chambers located at 22795 Barton Road, Grand Terrace, California 92313 and concluded the meeting on said date. WHEREAS, all legal prerequisites to the adoption of this Resolution have Attachment: Attachment 2 - PC Resolution \[Revision 2\] (2481 : GP Conformance Finding Child Care Property) occurred. Packet Pg. 14 B.1.b Page 2of 3 NOW THEREFORE, it is hereby found, determined, and resolved by the Planning Commission of the City of Grand Terrace, as follows 1.The Planning Commission hereby specifically finds that all of the facts set forth in the above Recitals, are true and correct. 2. The Planning Commission hereby finds that the Project is not subject to environmental review pursuant to Section 15060(c)(3) of CEQA because this action merely determines that the sale of the property is consistent with the General Plan. No development or alteration of the property will occur and therefore this action is not a Project as defined by CEQA. 3. Based on substantial evidence presented to the Planning Commission during the July 5, 2018, public meeting, including public testimony, and written and oral staff reports, the Planning Commission specifically finds: a. The property is designated General Commercial on the Grand Terrace General Plan Land Use Map. The General Commercial land use designation is primarily located along Barton Road and near the I-215 Freeway; and provides for general commercial uses to serve the retail and service needs of the community. b. The purpose of the BRSP and associated zoning districts is to assure the systematic implementation of the City of Grand Terrace's General Plan within the Specific Plan area. The BRSP identifies that the Village Commercial area is Grand Terrace's existing commercia containing primarily commercial uses with some office type uses. It states that the main focus for will be the creation of a downtown "village" atmosphere with an upgrading of retail commercial uses to take advantage of identified opportunities in the community retail market; and that the overall community design concept will emphasize the Barton Road/Mt. Vernon intersection as the "heart" of downtown with strong urban c. The proposed disposition of the subject property would be accomplished for the intended purpose of implementing the Barton Road Specific Plan, in accordance with the General Plan land use designation, goals, and policies. 4. Based on the findings and conclusions set forth in paragraphs 1, 2, and 3 above, this Commission hereby determines that the proposed disposition of the subject Property would be in conformity with the Grand Terrace General Plan in accordance with State Government Code Section No. 65402. 5. The City Clerk of the City of Grand Terrace shall certify to the adoption of this Resolution.
