This staff reports supports Goal #3 to Promote Economic Development.
BACKGROUND
California Government Code Section 65402(a) states that "If a General Plan has been
adopted, no real property shall be disposed or acquired, until the location, purpose and
extent of such disposition or acquisition, \[has\] been submitted to and reported upon by
the planning agency as to conformity with said adopted general plan within forty (40)
days after the matter was submitted to it." Therefore, in order for the acquisition and
disposition of property to occur, the Planning Commission must first make a report on
the conformity of the proposed acquisition with the General Plan.

sell a number of properties consisting of approximately 53 acres within the City. In
accordance with the Government Code, Staff is recommending that the Commission
find the disposition in conformance with the General Plan, as follows:
GENERAL PLAN CONSISTENCY
The Subject Property is made up of six separate parcels totaling approximately 53 acres
generally located between Michigan Street and theI-215 Freeway. This area is referred
to as the Southwest Area, within the former Redevelopment Plan.

The City has been working with Lewis Land Development, LLC for a number of months
on the proposed sale, master planning and development of the 53 acres. The Subject
Property is designated Mixed Use (commercial and residential mix) on the General Plan
Land Use Map, and zoned a combination of Commercial Manufacturing (CM),
Restricted Manufacturing (MR), and Industrial (M2) on the Zoning Map. The Subject
Property is only 53 acres of approximately 90 acres of land designated Mixed Use on
the General Plan.
Properties designated as Mixed Use are intended to be developed with multiple uses,
that may include residential, commercial, business park, open space, and recreational
uses.
This sale of this property for future development is consistent with the intent of
developing land in the City. Development of the Property will be subject to a Master
Plan which will identify uses that conform to the Mixed Use designation of the General
Plan. In addition, in conformance with General Plan goals and policies, needed
infrastructure will also be master planned and developed. Therefore, the disposition of
the Subject Property is consistent with the General Plan.

WHEREAS, the City of Grand Terrace is proposing to dispose of a
approximately 53 acres of land generally located between the I-215 Freeway
and Michigan Street; identis 1167-151-22, 74, 68,
71, 1167-161-03, and 04;
WHEREAS, the City of Grand Terrace and Lewis Land Development, LLC
are negotiating a Disposition and Development Agreement on the sale and
purchase of subject property;
WHEREAS, the properties are zoned Commercial Manufacturing, Restricted
Manufacturing and Industrial, and are designated Mixed Use on the General Plan
Land Use Map;
WHEREAS, the Mixed Use are intended to be developed with multiple uses,
that may include residential, commercial, business park, open space, and recreational
uses;
WHEREAS, State Government Code Section 65402 stipulates that prior to
the disposition of real property by a government agency, the planning agency of
the jurisdiction in which said property is located must first make the finding that the
acquisition of said real property is in conformance with the adopted General Plan of
the local jurisdiction;
WHEREAS, this action is exempt from the provisions of the California
Environmental Quality Act (CEQA), pursuant to Section 15060(c)(3) of the CEQA
Guidelines;
WHEREAS, on November 17, 2016, the Planning Commission conducted a duly
noticed public meeting on this matter at the Grand Terrace Council Chambers located at
22795 Barton Road, Grand Terrace, California 92313 and concluded the meeting on

said date.
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.

NOW THEREFORE, it is hereby found, determined, and resolved by the Planning
Commission of the City of Grand Terrace, as follows
1. The Planning Commission hereby specifically finds that all of the facts set forth in
the above Recitals, are true and correct.
2. The Planning Commission hereby finds that the Project is not subject to
environmental review pursuant to Section 15060(c)(3) of CEQA.
3. Based on substantial evidence presented to the Planning Commission during the
September 15, 2016, public hearing, including public testimony, and written and
oral staff reports, the Planning Commission specifically finds:
a. Mixed Use designation is intended to be developed with multiple uses,
that may include residential, commercial, business park, open space, and
recreational uses. The disposition of this property for future development
is consistent with the intent of developing land in the City. Development of
the Property will be subject to a Master Plan, as identified in the General
Plan, which will identify uses that conform to the Mixed Use designation of
the General Plan. Therefore, the disposition of the property is consistent
with the General Plan.
b. The proposed disposition of the subject property would be for the
intended purpose of developing the subject property in, accordance with
the General Plan land use designation, goals, and policies.
4. Based on the findings and conclusions set forth in paragraphs 1, 2, and 3 above,
this Commission hereby determines that proposed acquisition of the subject
property would be in conformity with the Grand Terrace General Plan in
accordance with State Government Code Section No. 65402.
5. The City Clerk of the City of Grand Terrace shall certify to the adoption of this
Resolution.

2030 VISION STATEMENT:
This staff reports supports Goal #2 Maintain Public Safety by investing in critical
infrastructure.
BACKGROUND:
Last year, the City Council contracted with Interwest Consulting to prepare a pavement
management index study. Interwest visually inspected all public streets and street
frontages. Based on the field observations, each City street was given a rating based on
the street condition.
Public Works Director Yanni Demitri took that study and prepared a 5-year Capital
Improvement Paving Plan. The Plan is attached to this report.

GENERAL PLAN CONSISTENCY:
The 5-Year CIP Program will slurry seal all streets that are eligible for slurry sealing in
the first year of the program. In the following three years several streets will be
overlayed with new asphalt pavement or completely reconstructed. The streets were
selected based on their Pavement Condition Index (PCI) numbers starting from the
bottom of the 25 -50 PCI range, which indicates a Poor/Failing condition and moving up
that range. The 5-year Plan does not identify construction of any new streets.
The 5-Year CIP Program also includes sidewalk repairs of all damaged sidewalks
Citywide, curb and gutter repair, ADA curb ramp repair and installation, tree-trimming

and removal of dead trees that were identified earlier this year in a report prepared by
Arbor Pro.
Collector, Divided Major Highway, Major Highway, Secondary Highway, or Potential
Major Highway. All other streets not classified, are considered local streets. The
maintenance of existing City streets is consistent with the General Plan Circulation
Element.

WHEREAS, the City of Grand Terrace is proposing to adopt a 5-year
Capital Improvement Paving Program for the maintenance of existing streets
throughout the City;
WHEREAS, on April 27, 2010, the City Council of the City of Grand Terrace
adopted the Grand Terrace General Plan, including a Circulation Element;
WHEREAS, State Government Code Section 65402 stipulates that a local
report as to the conformity of such programs with the adopted general plan, or part
thereof;
WHEREAS, this action qualifies for a categorical exemption
pursuant to Section 15301 of the California Environmental Quality Act
(CEQA), which exempts repair and maintenance activities to existing
facilities involving negligible or no expansion of an existing use;
WHEREAS, on November 17, 2016, the Planning Commission conducted a duly
noticed public meeting on this matter at the Grand Terrace Council Chambers located at
22795 Barton Road, Grand Terrace, California 92313 and concluded the meeting on
said date.
WHEREAS, all legal prerequisites to the adoption of this Resolution have
occurred.
NOW THEREFORE, it is hereby found, determined, and resolved by the Planning
Commission of the City of Grand Terrace, as follows
