Staff Recommendation
Conduct a Public Hearing and Adopt a Resolution
(Attachment 1) recommending the following actions
to the City Council:
a. Conduct a Public Hearing
b. Adopt an Ordinance of the City Council approving
Zone Change Amendment 24-03
Background Nonresidential Land Uses
•Title 18 of the Municipal Code regulates what land uses can occur in the City’s residential and nonresidential zoning districts.
•For the residential zoning districts and special districts there are tables that make this exercise quick and efficient.
•However, for the City’s nonresidential zoning districts there is not such a table.
•Instead, each individual nonresidential zone has a chapter with lists of land uses.
Background Hours of Operation
•There is no clear section in the Municipal Code that established
standard hours of operation (6am to 11pm).
• “After-hours operation” (11pm to 6am) is defined in Title 18 and is
sporadically applied to nonresidential land uses across multiple Zones
•Footnotes speak to two approval processes for “after-hours
operation”
•Administrative CUP – Planning Director (less than 2,000 sq. ft. business)
•CUP – Planning Commission (greater than 2,000 sq. ft. business)

•Several land uses currently not listed in the Municipal Code that have
been the point of inquiries with Planning Staff recently

All nonresidential land uses from previously listed under each individual nonresidential zone has been consolidated into a new table.
All nonresidential land uses now refer to Chapter 18.27

6am-11pm is standard hours (within 300 feet of residential property)
-any request “after hours” 11pm-6am is a CUP before the Commission
24/7 standard hours for any business 301 feet plus from a residential property unless limited by a CUP
New Chapter 18.27 – On-site alcohol consumption and no meals
Establishments with on-site alcohol beverage sales and consumption that
are not bona fide eating establishments
(bars/taverns/cocktail lounges/breweries/distilleries/wine making
facilities)
Are listed as “C” in the AP/C2/CM/MR zones

sales and services”, (indoor) as “P” and (outdoor) as “C” in the
CM/MR/M2 zones
