sponsored relocation of unhoused persons into the City’s
jurisdiction.

Incident at City of Santa Cruz
›Two law enforcement officers
transported an unhoused
individual (“Person Doe”) to City of
Santa Cruz.
›Person Doe had never been to
Santa Cruz, had no friends or
family in the area, and never
requested to be transported to the
shelter.

Ordinance Introduced by City of Santa Cruz
›Prohibits any unsanctioned government-sponsored
transportation of unhoused persons into its jurisdiction.
›Likelihood jurisdictions may engage in this type of
conduct again
–City of Grants Pass v. Johnson
–Governor Gavin Newsom Executive Order N-1-24

›Prohibits government-sponsored relocation
of unhoused persons into the City’s
jurisdiction, subject to limited exceptions.
–Hospital or medical facility
–Shelter, temporary housing, or permanent
housing
–Appointment with social service provider
–City/San Bernardino County Sheriff’s Department
–Public transportation
›A violation of shall be a misdemeanor.
Positive Impacts
›Preserves City’s limited homelessness-related resources.
›Encourages appropriate government agencies to provide shelter, care, outreach, and other homelessness-related resources to persons experiencing homelessness within their jurisdiction.
›Prevents government agencies from engaging in cruel and inhumane treatment of unhoused persons.
