Conduct a Public Hearing b. Adopt an Ordinance of the City Council approving ZCA 24-04 Background •Earlier this year City processed Zoning Code Amendment that updated standard hours of operation of businesses •7am to 11pm are “standard” if within 500 feet of residential •11pm to 7am are “after hours” if within 500 feet of residential (CUP) •Council asked directed Staff to go through the Municipal Code to make sure hours for noise activities were consistent with the business hours •ZCA 24-04 addresses noise activities and includes additional clean-up changes to streamline the Municipal Code Chapter 5.06 HOME OCCUPATION PERMITS (HOP) Goal: Streamline the HOP application timeline. Currently 2 mailers for a compliant HOP Application takes over a month to process. Revised so mailer only when not compliant (14 day turn around). Revised so compliant applications are approved (10 day turn around). 5 Chapter 5.40 GARAGE SALES Goal: Look at the hours when garage sales occur to ensure minimal impact. Current hours are 8am to 8pm. Revised hours from 8am to dusk. No garage sales in the dark. 6 Chapter 5.42 INTEGRATED WASTE MANAGEMENT Goal: Look at the hours when trash collection occurs to ensure minimal impact. Current hours are 6am to 5pm for residential and 5am to 5pm commercial. Revised hours are from 7am start time to 5pm. No trucks picking up before then. 7 Chapter 5.48 MASSAGE PARLORS AND MASSAGE TECHNICIANS Goal: Look at the hours when massage occurs to ensure consistent with standard business hours. Current hours are 7am to 10pm. Revised hours are from 7am to 11pm. That matches standard business hours. 8 Chapter 8.108 NOISE Goal: Look at the hours when noise activity occurs to ensure minimal impacts. Current constructions hours are 7am to 8pm weekdays/Saturday No Sunday or Federal Holidays. Revised hours are from 7am to 5pm weekdays / Saturday No Sunday or Federal Holidays. 9 Chapter 8.108 NOISE Goal: Look at the hours when noise activity occurs to ensure minimal impacts. Current agricultural equipment hours are 7am to 8pm. Revised hours are from 7am to 5pm. 10 Chapter 8.108 NOISE Goal: Look at the hours when noise activity occurs to ensure minimal impacts. Current property maintenance hours are 8am to 8pm weekdays/Saturday 9am to 8pm Sunday. Revised hours are from 7am to 5pm weekdays and 9am to 5pm weekends. 11 Chapter 8.108 NOISE Goal: Look at the hours when noise occurs to ensure minimal impacts. Current electronics, whistles, bells, equipment and auto repair hours are 7am to 10pm. Revised hours are from 7am to 5pm. Clarified what loading / unloading activities are. 12 Chapter 8.112 FIREWORKS 13 Goal: Look at the hours when fireworks occur to ensure minimal impacts. Current hours are 12pm to 11am on July 4th. Revised hours are from 12pm to 10pm on July 4th. Chapter 9.05 VENDING ON CITY SIDEWALKS 14 Goal: Look at the hours when street vending occurs to ensure minimal impacts. Current hours are 8am to 9pm. Revised hours are from 9am to 6pm or sunset, which ever is earlier, weekdays/Saturday. No Sunday or Fed. Holidays Chapter 10.16 - STORAGE OF VEHICLES—INTERSECTION OBSTRUCTION 15 Goal: Fix conflicting code sections for internal consistency. Sec. 18.60.030 (Parking Regulations of Chapter 18.60 (Off-Street Parking) regulates recreational vehicles. Revised to nix recreational vehicles from Sec. 10.16.021 graphic so only commercial vehicles remain. Chapter 12.32 CONDUCT ON PUBLIC PROPERTY—PARKS 16 Goal: Fix conflicting code sections for internal consistency with current Public Works application. Current park hours are 6am to 10pm. Revised hours reflect current operations of 7am to dusk. Chapter 12.56 WIRELESS TELECOMMUNICATIONS FACILITIES IN THE PUBLIC RIGHT-OF-WAY 17 Goal: Look at hours when cell site backup generators run to ensure minimal impact. Current backup generator test hours are 7am to 7pm. Revised hours are from 8:30am to 4:30pm. Chapter 15.56 WATER EFFICIENT LANDSCAPE 18 Goal: Look at hours when overhead irrigation occurs to ensure minimal impact. Current overhead irrigation hours are 8pm to 10am. Revised hours are from 7:00am to 11:00pm. Chapter 18.10 - RESIDENTIAL DISTRICTS 19 Goal: Look at bedrooms totals and ensure they reflect built environment. Current code limits multifamily to two bedrooms. Minimum 800sq ft for one room and 1,000sq ft for two rooms. Revise development standard allows more than two rooms and updated minimum sq ft for rooms. Chapter 18.64 - OBJECTIVE DESIGN STANDARDS 20 Goal: Look at Objective Design Standards (ODS) for areas of refinement. Current ODS requires LEED and that it be Platinum (highest level only). Revised ODS to require LEED a certification level of Applicants choice. Chapter 18.80 SIGNS 21 Goal: Look at sign standards to ensure minimal impact. Current temporary sign display hours in the public right-of-way are 8am to 5pm. Revised hours to match standard business hours of 7am to 11pm. 22 Chapter 18.80 SIGNS Goal: Look at sign standards to ensure minimal impact. Current code prohibits signs within 100ft of residential from being illuminated. Revise sign standard so only a sign facing a residential use can’t be illuminated. 23 Chapter 18.82 - STANDARDS FOR SPECIFIED LAND USES AND ACTIVITIES Goal: Look at hours when care facilities activity occurs to ensure minimal impact. Current hours for outdoor care facility activities are from 7am to 9pm. Revised hours to 7am to dusk for outdoor activities at a care facility. Conclusions CEQA Exempt – Common Sense Exemption Notification – Expanded Public Hearing Notice & Outreach Policy Findings – Can be made in compliance with Zoning Code (EXHIBIT A to Attachment 1) Staff recommends Approval of Resolution (Attachment 1) and incorporate any modifications the the Planning Commission determines are necessary Thank you for your consideration.
