Senate Bill 684 (2023) & Senate Bill 1123
(2024)
•SB 684 establishes a ministerial approval process for qualifying
small-lot subdivisions
•Applies to subdivisions of ten or fewer lots and ten or fewer
residential units
•SB 1123 refines and expands SB 684, including eligibility for certain
vacant parcels
•Cities must adopt local standards to implement these State
requirements

Purpose
•Ensure compliance with new State housing laws
•Create clear, objective standards for ministerial review
•Implement Housing Element Program No. 16
•Improve consistency and predictability for applicants and
staff
Code Amendments
•Adds new Chapter 17.29 for Small-Lot Subdivisions
•Designates City Engineer as review and approval authority
•Updates residential zoning districts to reflect State-authorized lot
sizes and densities
•Streamlines code-compliant single-family homes into a ministerial

Action
•Duly noticed Planning Commission public hearing was held
December 18th, 2025
•Planning Commission reviewed the amendment for consistency
with State law, the General Plan, and Housing Element
•Planning Commissioners asked staff to clarify the language related
to “specific adverse impact” and enforcement language in Section
18.10.100. It appeared to be duplicated.

•Additionally, Planning Commissioners suggested adding language
to reference septic system approvals from the Regional Water
Quality Control Board
•Planning Staff revised the ordinance to clearly distinguish review
stages and removed duplicative enforcement language.

•Also, staff added language clarifying that nothing in the ordinance
waives or overrides applicable requirements of the Regional Water
Quality Control Board or any other state or federal agency with
jurisdiction over water quality or wastewater disposal
•Planning Commission recommended City Council approval of the
zoning code amendment as amended.
•Text amendment only – does not approve a specific development project
•Not a project under CEQA pursuant to Sections 15060(c)(2) and
15061(b)(3)
•City Council recommendation:
•Adopt an ordinance approving ZCA -03
