Tonight I’m presenting Zoning Code Amendment 25-04, which updates the City’s Zoning Code to comply with two new State laws — Assembly Bill 98 and Senate Bill 415.These laws establish statewide standards for logistics and warehouse development. The item before you does not approve a project. It updates the City’s zoning regulations so we are consistent with State law. 1 Zone Code Amendmnet (ZCA) 26-01 Agricultural Employee Housing Establishes regulations for agricultural employee housing in AG-1 and AG-2 overlay districts Defines housing types including small-scale, large-scale, and seasonal employee housing Creates objective development standards (parcel size, setbacks, infrastructure, safety) Allows qualifying projects to be approved ministerially (by-right) Summary In 2024, the State adopted Assembly Bill 98, known as the Planning, Logistics, and Neighborhood Standards Act.AB 98 was created in response to concerns about logistics and warehouse facilities being located close to homes, schools, and other sensitive uses.The law sets uniform, statewide standards for how new logistics facilities must be designed — including building placement, truck circulation, landscaping, loading areas, and buffers.Later that year, Senate Bill 415 was adopted to clarify and refine parts of AB 98, so cities can apply the standards consistently.Together, these laws require cities to update their zoning codes to reflect the new standards. Purpose Required to comply with: California Employee Housing Act Supports the City’s Housing Element (2021–2029) Program 12 Remove constraints on housing Allow housing for agricultural workers The City is updating its Zoning Code for three main reasons.First, to comply with State law. AB 98 and SB 415 anticipate that cities will adopt local regulations implementing these standards.Second, to provide clear and objective rules for logistics facilities so applicants, staff, and the public all understand what is required.And third, to improve protections for nearby neighborhoods, especially when logistics projects are located near sensitive receptors like homes, schools, parks, childcare centers, and medical facilities.Overall, this amendment improves clarity, consistency, and predictability in how these uses are regulated. 4 Zoning Code Changes Standards include: Minimum parcel sizes Unit limits Setbacks and lot coverage Infrastructure requirements (water, wastewater) Fire and safety access Includes annual verification + occupancy requirements The ordinance makes several key updates to Title 18 of the Municipal Code. It creates a new chapter dedicated entirely to logistics uses, which consolidates all State-required standards in one place.The ordinance also adds State-aligned definitions for “Logistics Use” and “Sensitive Receptor,” and reorganizes the nonresidential use table so logistics uses are clearly separated from other industrial uses.The new standards include requirements for setbacks and buffers, truck access and circulation, building orientation, landscaping, screening, and loading bay placement.Projects located within 900 feet of a sensitive receptor are subject to enhanced standards, and large facilities must meet additional sustainability and operational requirements.All logistics projects subject to these rules will continue to require discretionary Site and Architectural Review. 5 CEQA Exemption Not a project (CEQA Guidelines §15061(b)(3)) No fiscal impact Regulatory update only Future projects subject to normal fees Staff recommends: Adopt Resolution recommending approval Environmental Review, Fiscal Impact & Recommendation CEQA Determination and RecommendationThis item is a text amendment only. It does not authorize or approve any specific development project.Because of that, the ordinance is not considered a project under CEQA, consistent with CEQA Guidelines Sections 15060 and 15061, as well as the applicable Government Code provisions.Staff is recommending that the Planning Commission open the public hearing and adopt a resolution recommending that the City Council approve Zoning Code Amendment 25-04.That concludes staff’s presentation.
