PUBLIC COMMENT Mark Cloud, Southern California Edison, Government Affairs Representative introduced himself to the City Council and its residents. When asked by Mayor McNaboe about the instability in various areas of the City, Mr. Cloud indicated he would be addressing that issue with the City Council soon. Frank Audi, Grand Terrace expressed his concern regarding the City's red tape and the success of his business. Janese Makshanoff, Grand Terrace asked the City Council if members of staff can enter her property without her permission. Mayor McNaboe asked the City Attorney to call Ms. Makshanoff to discuss. D. CITY COUNCIL COMMUNICATIONS Council Member Kenneth J. Henderson Council Member Kenneth J. Henderson presented a report on his attendance at the League of California Cities New Mayors/Council Members Academy. Council Member Wilson asked about that portion of his report that talks about the switching from Level of Service (LOS) to Vehicle Miles Traveled (VMT) and how the VMT works versus the LOS. Council Member Henderson responded that most communities don LOS for their roads and thoroughfares. Under VMT that is a methodology that will go into effect January 2020. It is important because the City has taken receipt of 31 acres from the Lewis Group and it would be important for Staff to analyze which approach would be most advantageous to the City. if that project goes as contemplated and the City attracts customers to the City, the need for our citizens to travel elsewhere to purchase goods and services would be somewhat eliminated and VMT may be advantageous. 5. League of California Cities New Mayors/Council Members Academy Report Council Member Bill Hussey Council Member Bill Hussey thanked everyone for coming to the meeting. Council Member Doug Wilson Council Member Doug Wilson was happy with the harassment prevention seminar he attended. He kept a narrative of the training and plans on using it in classes he teaches. City of Grand Terrace Page 3 Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 Mayor Pro Tem Sylvia Robles Mayor Pro Tem Sylvia Robles attended the Omnitrans Board of Directors meeting and discussion was held on a USC Study regarding transportation planning under the premise that millennials do not like to drive. Under the study, it was found that millennials are moving inland for affordable housing and commuting to the LA Basin, therefore that planning will need to be re-evaluated. Mayor Pro Tem Robles recently spoke with a member of the City of Chino Hills City Council and held discussion about that City's battle to underground Edison's towers. She commented about the appearance of the towers on Mt. Vernon and it was suggested the City speak with an Edison representative. The City Manager set up a meeting with Mark Cloud from Southern California Edison and discussion was held about the potential use of that land where those towers sit. Mayor Pro Tem Robles suggested that the Parks & Recreation Advisory Committee address the City's Master Plan for that area and bring forward some options for Council to consider. Mayor Darcy McNaboe Mayor Darcy McNaboe attended the SBCTA Board Meeting: Staff was given direction by the Board regarding Closed Session with Legal Counsel - Anticipated Litigation. Under Consent: Adopted a Resolution to become part of the SBCTA California Vanpool Authority Received first half of Fiscal Year Railroad Right of Way Grant Grant of Use Report Received a report on the SBCTA Rights of Way Interest in overview of Metro Link Stations Approved an agreement with the E Street Plaza providing a Reciprocal Easement for Pedestrian Access at the San Bernardino Transit Center Approved issuance of Request for Qualification to pre-qualify general contractors for the Redlands Passenger Rail Project Approved the reallocation of FY 2015-2016 Low Carbon Transit Operations Program • Approved a Memorandum of Understanding between Southern California Association of Governments, Omnitrans and Victor Valley Transit Authority for carrying out the Metropolitan Transportation Planning process Under Discussion Items: Hearings to consider adoption of Resolutions of Necessity for parcels needed for the Redlands Passenger Rail Project Received SBCTA Comprehensive Annual Financial Report and the audit of the State Transit Assistant Fund, audit of the Local Transportation Fund and the Single Audit Compliance Report for the FY 16-17 Approved contract with Center for Sustainable Energy to develop a San City of Grand Terrace Page 4 Minutes Grand Terrace City Council and Mousing Successor Agency February 13, 2018 Bernardino Countywide Zero Emission Vehicle Readiness Implementation Plan Council of Governments This City Council discussed the idea that the Council of Governments wanted to fund a fulltime staff person, that funding sources had changed and at this time they have funding for about half a staff person. The staff person is also allocated to transportation. Through discussion no additional money will be assessed to the member agencies. Mayor McNaboe enjoyed the January 31 st Sexual Harassment Prevention Training. On February 2nd, she represented the City at the Rosa Parks Statue Unveiling ceremony at the Caltrans building. It was a wonderfully attended event with Assemblymember Reyes as the keynote speaker. On February 10, Mayor McNaboe was honored to represent the City at the Unforgettables Foundation annual luncheon. The Foundation recognized so many different volunteers that give so much of their time and energy. Two volunteers from the City of Grand Terrace were honored. Mayor McNaboe commented on the 1-215 Barton Road Interchange Project moving forward in full swing, asked for resident input if they see a problem and requested everyone's patience during this time. E. PUBLIC HEARINGS 6. Prioritization of Community Development Block Grant (CDBG) Funds for Program Year 2018-2019 Mayor McNaboe opened the public hearing at 6:30 p.m. Sandra Molina, Planning and Development Services Director gave the PowerPoint presentation for this item. Jennifer, Founder of the REC Center provided some background information about the non-profit organization. She explained that the funding requested is for the annual lease payments and without the City's assistance, they would not have any other means to make their lease payments except for fundraising. Michelle Granger, Food Services Director for Family Service Senior Nutrition Program provided some statistics on its food service. She expressed her appreciation for the City's past support for the program. Mari Montes, Grand Terrace supports the REC Center and stated it has great after school and summer programs which offers working parents options for summer and after school. City of Grand Terrace Page 5 Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 Mayor McNaboe closed the public hearing at 6:40 p.m. Council Member Hussey suggested that the REC Center apply for the Community Benefit Fund to help offset their costs. Council Member Henderson asked the applicant for the REC Center if the amount recommended will cover the lease payments. The Applicant stated the amount recommended will not cover the lease payments for the year. 1. CONDUCT A PUBLIC HEARING FOR THE PRIORITIZATION OF ELIGIBLE APPLICATIONS FOR 2018-2019 COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDING; AND, 2. PRIORITIZE FUNDING ALLOCATIONS AND AUTHORIZE STAFF TO SUBMIT THE CITY'S CDBG FUNDING RECOMMENDATION TO THE COUNTY OF SAN BERNARDINO ECONOMIC DEVELOPMENT AGENCY. NEW BUSINESS 7. A Request by a Member of the City Council to Revisit the Rezoning of 45 Acres Sandra Molina, Planning and Development Services Director gave the PowerPoint presentation for this item. Council Member Hussey asked if there would be additional costs for another study to rezone the project area as Residential Agricultural with an M2 Overlay District. Director Molina indicated there would be additional costs. Council Member Hussey asked if the owners of the majority portion of the area were opposed to any rezoning. Director Molina indicated that the new owners do not support the residential agricultural zoning however do support the previous AG-2 Overlay District which maintains the M2 primary zoning. City of Grand Terrace Page 6 Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 Council Member Hussey asked if Council approved the AG-2 Overlay District would the two residents who are grandfathered no longer need a Conditional Use Permit. Director Molina stated the existing residential uses can remain, be expanded and reconstructed. They are legal non-conforming therefore they need to remain continuously occupied. Council Member Hussey has concerns about the requirement of continuous occupancy of 180 days. He asked if the 180-day restriction be removed. G. Harold Duffey, City Manager stated if the water and electricity is connected, and someone comes by on a regular basis, the house is not vacant. If no one is taking care of the property and no utilities are connected, then it is considered vacant. Council Member Hussey asked what it would take for Mr. McConnell to reside in the home on his property and have his agriculture. City Manager Duffey explained under the existing conditions, the house cannot be occupied. If Council were to pass the AG-2 Overlay, he would be able to occupy the house by establishing an AG related business with a Conditional Use Permit. Mayor Pro Tern Robles shared her review of the project since 1984. One of her concerns is protecting the existing property owners who have rural type residential uses. Why didn't the City perform Spot Zoning; M2 on one side and Agricultural on the. other. Why didn't the City consider flipping the burden where both property rights were protected but the overlay was reversed. Mayor Pro Tem Robles recapped a previous appeal on a sizeable two-story home that was built in the community; however, with not a lot of support. She needs to have an honest effort from both sides; from myself, from the residents and staff to craft the best compromise without prejudice. It is very difficult when there is some strongly expressed dislikes for some of the people in this process. I hope the endeavors of the study were fair and not calibrated to induce any hardships on anybody. City Manager Duffey explained when this item initially came forward to the Council there was that discussion when property owners came forward and said that they wanted to retain their M2 zoning. The direction from the City Council was to have residential agricultural uses which would create these ranchettes for agricultural uses. As Staff looked at the issue in terms of multiple property owners wanting to retain their rights; one being M2 zoning and one being the AG uses, Staff weighed Council direction received to create residential agricultural uses; these one-acre area ranchettes. The AG-2 zoning does exactly that, but it requires a commercial component which is an AG use to be able to have residential uses. Two-thirds of the property owners were not in favor of the all AG zoning. Staff tried to ensure that the City meet the Council goals allowing the ranchettes yet still preserving the ability of the M2 property owners to move City of Grand Terrace Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 forward with any potential projects. Mayor Pro Tern Robles believed there were other options to be able to achieve that goal; an M2 zoning or RA1 zoning. City Manager Duffey indicated that the zoning could have been split. When the item was presented to Council there was this desire to create a green belt overlay for the entire area and that is what the City is trying to achieve. There was some discussion regarding the split zoning however the AG-2 overlay accomplishes the ability to have AG and M2. Council Member Henderson complimented the Planning Commission for the excellent job they did on this item. He supports the City's proper implementation of the General Plan and Zoning Ordinance. Knowing what he knows now about the project, he does not believe it should have qualified for a Council-initiated zone change. He believes the reason for the request was to avoid paying application fees associated with the General Plan Amendment Zone Change. Any property owner or developer in this community that submits a General Plan Amendment Zone Change, must pay for that process and staff time associated with it. If the Council initiates it, there is no payment. The proposal before the Council is going to require at least an additional $20,000 on something that is opposed by the majority property owners in the area. This project protects two of the property owners and their legal non-conforming uses. He has never seen before an all- encompassing protection of legal non-conforming uses. Council Member Henderson described the steps for a General Plan Amendment Zone Change. He is generally opposed to what is being proposed, however if the Council wants to have the matter remanded back to the Planning Commission for further consideration, he might be able to support that. Council Member Wilson would like to point out that there was no current member at the dais involved in the 1984 hijack of the zoning to begin with. He calls it a hijack because at the time there were agricultural uses and because of the so-called flood control situation that was a justification to change the zoning from a residential type zoning to an AG-2. The Council really needs to look at what is for the good of the community. The body has the opportunity and the obligation to look after the good of the community and he would support further action on the item. Mayor Pro Tem Robles stated the two continuous residents from 1984 were affected by the zoning change. She would like to remand the item back to the Planning Commission to decide whether this is the only option or Council make the decision here today that one property owner was not affected by any zoning changes. Council Member Henderson states the City has expended a significant amount of money that it cannot recover and there is one beneficiary in this whole discussion since two of the property owners have been protected since 2010. The would-be beneficiary City of Grand Terrace Page 8 Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 purchased a dwelling that was legal non-conforming. That person should have known it was legal non-conforming, and the action being proposed is for the City to solve that problem on behalf of that beneficiary and that he opposes. City Manager Duffey explained that Staff was given clear direction to create an area for one-acre area ranchettes. The feeling he received from Council was that was the very best use for the area and would allow the City to market the area based on AG related ranchettes. Mayor McNaboe stated based on the discussions council has had she thought the AG-2 zoning accomplished everyone's goals. To her dismay, there was nobody in support of it therefore she did not second the motion that was made at the previous Council meeting. It is unfortunate that the City spent the money to address everybody's needs and keep the majority land owners whole with the zoning that they preferred. Yet when it came time to vote, it seemed the applicant ended up being the City and no one wanted it so why do it. Council Member Hussey does not want to take away any property owner rights. He wants to confirm that the two original owners are grandfathered in and they can live their life, raise their chickens, cows, grow vegetables and if they want to sell their property there will be no problems. Another property owner can have a chance to develop a portion of his property by paying a fee. The City has taken care of everybody's property rights with the AG-2 overlay. The following members of the public are proponents to the proposed Rezone the Project Area as Residential Agricultural with an M2 Overlay District: Janese Makshanoff, Grand Terrace is concerned about losing her grandfathered legal non-conforming status. Janet Rich, Grand Terrace wants to keep her grandfathered clause. Katie Guthrie - Mahaney Anne Wade - Hornsby Jennifer Rebs Jeffrey McConnell Scott Heil, Davis Family Trust does not oppose nor take a position regarding the M2 Zoning with the AG-2 Overlay. The property owners do not support rezoning the project area to Residential Agricultural with an M2 Overlay District. David Mlynarski, San Bernardino supports AG-2 Overlay or no action. Patrick O'Brien, Majority Property Owner provided a little background on the various businesses he owns and supports AG-2 Overlay while keeping the M2 zoning as is. City of Grand Terrace Page 9 Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 Bobbie Forbes, Grand Terrace asked Council to be sure the lot sizes are one-acre or more if they are going to allow ranchettes and large animals. Council Member Wilson made a motion to direct Staff to rezone the project area as Residential Agricultural with an M2 Overlay District. The motion by Council Member Wilson died for lack of a second. Mayor Pro Tern Robles asked what impacts to the property owners located in the M2 area were if the City did a split zoning or go residential. Director Molina stated that one of the southern portion property owners is not in support of the residential zoning. Therefore, it would only be a small pocket of residential zoning surrounded by M2 zoning. The impact would be the burden of the M2 zoning property owners to make sure they properly design their property to not impact adjacent residential uses. The alternative to rezone entirely residential is opposed by the majority property owners. Mayor McNaboe asked if an AG related business can be established within the existing zoning. Director Molina explained that the AG Overlay allows agricultural/nursery supported uses. There is still the Floodplain Overlay District on the property that plays into future uses. Mayor Pro Tern Robles asked if the City was to proceed with the residential RA1 how that would adversely affect those property owners with the M2 Overlay. Mayor McNaboe clarified if the change is made so M2 is the overlay and the underlying is residential agricultural, how does that change the property value. Mr. Mlynarski doesn't believe it is the proper technique dealing with land use issues. The property is currently zoned in the General Plan for industrial use. To make a change you would have to go through a process and address many different issues. The property was purchased for the M2 zoning and those owners would not like to see it changed. It presents a series of obstacles when you deal with primary use versus overlays or ancillary uses. The property owner likes the M2 Overlay which has a whole host of primary uses and that should be the driving force. Ancillary uses are supposed to be secondary or minor to the primary use. It is a convoluted way of dealing with a land use issue. Richard Adams, II, City Attorney suggested if Council wants to move forward with the original recommendation of the Planning Commission, they will need to ask staff to re- notice the item as a public hearing. General Municipal Election Consolidated November 6, 2018 Timetable Debra Thomas, City Clerk gave the presentation for this receive and file item. Mayor Pro Tern Robles asked that the timetable and deadlines for the November 6, 2018 General Municipal Election be placed on the City's website. RECEIVE AND FILE. RESULT: CONSENSUS 9. Approval of the Housing Successor Agency Subordination Policy Cynthia Fortune, Assistant City Manager gave the presentation for this item. Discussion ensued regarding the current outstanding loans, promissory notes and the former Redevelopment Agency covenants. Bobbie Forbes, Grand Terrace stated, for the record, that a lot of the outstanding loans went to former City employees and that those individuals knew the note must be paid once they sold or refinanced their home. There is plenty of equity in the home to pay back the loan. ADOPT A RESOLUTION APPROVING A SUBORDINATION POLICY FOR CURRENT OUTSTANDING LOANS ADMINISTERED BY THE HOUSING SUCCESSOR AGENCY. RESULT: NO ACTION TAKEN 10.Award of Professional Services Contract for Final Design of Commerce Way Alan French, Public Works Director gave the PowerPoint presentation for this item. Council Member Wilson asked if it is standard for the City to peace meal a design. Director French stated it has happened in the past. For this project the City started out with the 35% to work with Webb, they are the designer for the southern section of the Lewis project. The City is using CPNA money, which is a 60140 match and of the 40%, City of Grand Terrace Page 11 Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 the City is planning on using the DIF. Council Member Wilson asked what kind of discount the City is receiving since Albert A. Webb is contracting with the Lewis Group. Lin McCaffrey, Albert A. Webb Associates stated combining the project with both agencies allows Webb Associates to provide the City with a lower rate rather than an individual client. The City is receiving the discounted rate at prices from four years ago. The proposal includes the field survey, the traffic signals for the new intersection and the realignment. Council Member Wilson asked if this includes any survey other than what is needed to establish the design points. Ms. McCaffrey stated the pricing includes the survey and title reports for the additional properties. It needs to prepare the legal paperwork and temporary construction easement documents. The package also includes the bid document, specifications, and cost estimates, it's the whole package. Council Member Henderson asked if the area was a divided four-lane thoroughfare and if the City has some responsibility for the Lewis Group's portion. Director French confirmed that the area is divided in the southern section. The existing segment is not divided. There will be some improvements in the area that the City will be responsible for however it will transition into the divided four lane route where the Lewis Group takes over. 1. Bobbie Forbes, Grand Terrace commented that most of those loans were given to former employees and she knows they understand the terms of the loans. She does not want the City Council to make any changes. If a borrower sells their home or refinances, they need to pay the loan in full. ADOPT RESOLUTION NO. 2018-XX - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE AMENDING SECTION 24: ELECTRONIC EQUIPMENT USE POLICY OF THE CITY'S PERSONNEL RULES AND REGULATIONS. Henderson, Council Member SECONDER: Sylvia Robles, Mayor Pro Tern AYES: McNaboe, Robles,Wilson, Hussey, Henderson 12.Proposal to Re-Organize Code Enforcement to Include Animal Control Services Sandra Molina, Planning and Development Services Director gave the PowerPoint presentation for this item. Mayor McNaboe asked if the proposed part time field officer would reduce the current configured costs the City pays in its current contract. Director Molina indicated the City has not renegotiated its current contract to include that position. Mayor McNaboe asked what difficulties, if any, the City of Loma Linda has had changing over to this type of configuration; from code enforcement to code enforcement/animal control. Director Molina explained that the animal control/code compliance officer was a new hire therefore Loma Linda started from scratch with an employee that came into the position knowing it was dual skill requirements. They indicated there is a training period to become familiar with the laws of animal control but have been very positive with providing the dual service The City of Loma Linda seems to have a proactive position when it comes to animal control and is very happy with its program. G. Harold Duffey, City Manager stated that with the size of the City of Loma Linda and having a local officer, it was able to mitigate some measures. The officer knows the city based on its dual relationship with code and animal service and knows where the animals belong. Mayor McNaboe pointed out on Page 3, Paragraph 2 of a four-page letter received on this item starting with "Take a look at our City. It is one of the best Cities in the Inland Empire. Why? Your Code Enforcement Officers are everywhere! My friends and I have City of Grand Terrace page 13 Minutes Grand Terrace City Council and Housing Successor Agency February 13, 2018 all had a few of their tickets, but they were just doing their job. Grand Terrace has beautiful homes, clean streets and clean businesses. We don't have hundreds of signs on the curbs or graffiti on the walls. Why would you even think to add Animal Control to their plate. What this brings to mind is will this make it more difficult for the City's code enforcement officers to do their job that they are currently doing if we add these additional services." Director Molina provided the stats for Council to show that the additional services hours are 5-6 hours per week. It is anticipated as the program is implemented, there may be a need to fine tune. For the number of hours that the City is seeing statistically, it doesn't anticipate a significant impact in code enforcement services. City Manager Duffey stated based upon the City's sheltering service numbers, a part time officer can cover the needs for the City. Council Member Henderson stated the program being proposed is common, it's been successful in communities and has happened at the firefighter level taking on code enforcement responsibilities. Mayor Pro Tern Robles does not believe there will be an average workload with this program. There was some strong discussion in the past by Council that certain positions would be evaluated in a year. If the City is going to be making a fundamental change reorganizing two positions, why can't the City have a part time person as an animal control officer. She believes it is a substantially different kind of position and is concerned with the volatility when these duties are peaking, other things will fall by the way side. The quality of life for the community is important. She would like to see the report tweaked addressing her concerns and she believes the fire agency, although independent of the City, can work with the City to come up with some ways to assist. She wants to move slowly on this item. Council Member Hussey addressed citizen concerns with the San Bernardino Animal Shelter's euthanasia rate and mismanagement of animals. He has heard nothing but good things regarding the shelter in Riverside County. He believes the City's current contract is expensive. He doesn't believe the current contract is fulfilling the needs of the City. He believes with the proper training the current code enforcement officers can be successful. Council Member Wilson wanted to remind council there is more than just dogs and cats when animal keeping. Snakes can sneak up on a person and be challenging. He believes there is a current underground in the City that tries to assist and make sure animals are returned to their owners. He also has concern regarding the liability that is attached to this new venture. Bobbie Forbes read Mari Montes' opposition to the item into the record. Harold Duffey, City Manager announced the Dog Park is in its final phase. The City Council can start planning its grand opening between Friday, February 23, 2018 and April 12, 2018. In addition, there is only one park bench left for purchase The City is holding its low-cost vaccination clinic on February 22, 2018 at City Hall from 6:00 p.m. to 7:30 p.m. City Manager Duffey shared the new LED safety lights which have been installed at City intersections. In March and April, all the City's lights will have LEDs installed by Southern California Edison. The 11th Annual Blue Mountain Hike will take place on Saturday March 3rd at 8:00 a.m. The City will be partnering with Friends of Blue Mountain, the Sierra Club and the Foundation of Grand Terrace. A new partner has been established with Niantic who provides the platform for reality-based programs called Ingress and Pokemon Go. The City has mapped out the area with Pokemon on the mountain. If hikers travel 3,000 miles on Saturday, Niantic has committed 100 trees for the future trailhead site. In addition, the City will have Tuition Bites providing breakfast burritos on site. For every burrito purchased, 100% of those profits will go to Grand Terrace High School for scholarships providing laptops for seniors going to college. Mayor Pro Tern Robles is wondering why the City does not submit press releases for the empty Stater Bros. building and promote on the City's Facebook. City Manager Duffey indicated Staff could place a 20-30 second spot on its Facebook page talking about economic development and market the City. They are conducting a live Facebook interface with the City Manager or Mayor and the City Manager.
