HomeMy WebLinkAbout2012-61A RESOLUTION NO. 2012-61 A A RESOLUTION OF THE : CITY COUNCIL OF THE CITY OF GRAND TERRACE ADOPTING REVERSION TO ACREAGEITENTATIVE TRACT MAP 12-01 (TENTATIVE 'TRACT .MAP NO. 18847)1 A REVERSION TO .ACREAGE OF 19 UNDERLYING LOTS LOCATED ON THE EAST SIDE OF GRAND TERRACE ROAD, APPROXIMATELY 160 TO 400 FEET SOUTH OF VIVIENDA AVENUE WHEREAS, the City of Grand Terrace, represented by Albert A. Webb Associates, filed an application for Tentative Tract Map 12-01/Tentative Tract Map No. 18847 ("Application") requesting approval of a reversion to acreage of 19 recorded lots. WHEREAS, the Application applies to 2.55 acres, zoned R3-Low Medium Density. Residential .and designated Medium Density Residential on the General Plan. Land Use Map. The property is located on the east side of Grand Terrace Road approximately 150 to 400. feet south of Vivienda Road, and identified as Assessor's Parcel Numbers 0275-231-48 through 66. The property is currently vacant. WHEREAS, on June 14, 1990, the City Council adopted Resolution No. 90-08 approving a 19-lot subdivision for the purposes of development a multiple family --t plann ed.unit development project,.which was.subsequently recorded in 1992. WHEREAS, on October 31, 20.11, the City of Grand Terrace acquired title to the subject site. WHEREAS, to ensure the development of the park wholly on one parcel as opposed to over multiple lots a reversion to acreage. of previously recorded Tract Map 14816, a 19dot subdivision, is proposed. WHEREAS, the on July 10, 2012, the City Council adopted a resolution initiating and consenting to reversion.to acreage proceedings. WHEREAS, the Project.is categorically exempt from the California Environmental Quality Act (CEQA) Guidelines, pursuant to Section 15305(c), which exempts a reversion to acreage from the provisions of CEQA. WHEREAS, on July 19, 2012, the Planning Commission conducted a duly noticed public hearing on Project at the Grand Terrace Council Chambers located at 22795 Barton Road, Grand Terrace, California 92313 and concluded the hearing on said-date by voting 4-0 recommending City Council approval on the Project. WHEREAS, on August 14, 2012, .the City Council conducted a duly noticed public hearing on Project at the Grand Terrace Council Chambers located at 22795 Barton Road, Grand Terrace, 'California 92313 and concluded the hearing on said date. Page 1 of 3 WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Grand Terrace: 1. The City Council hereby specifically finds that all of the facts set forth in the Recitals of this Resolution, are true and correct 2. The City Council finds the Project categorically exempt from the California Environmental Quality Act (CEQA), pursuant to Section 15305(c) of the CEQA Guidelines. 3. Pursuant to Section 66499.16 of the Subdivision Map Act, the City Council finds as follows with respect Reversion to Acreage/Tentative Tract Map 12-01 (TPM No. 19131): a. Dedications or offers of dedication to be vacated or abandoned by the reversion to acreage are unnecessary for present or prospective public purposes. f,-- b. All owners of an interest in the real property within the subdivision have consented to reversion. BE IT FURTHER RESOLVED THAT based on the findings and conclusions set forth above, this Council adopts a Notice of Exemption and approves Tentative Tract Map No. 18847/Reversion to Acreage subject to the following condition of approval. 1. A final map effecting this reversion to acreage shall be filed with the Office of the San Bernardino County Recorder.
