1983-23 RESOLUTION NO. 83- 23
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
GRAND TERRACE, CALIFORNIA, STRONGLY OPPOSING
ASSEMBLY BILL 1958 (WATERS) AND URGING LEGISLATION
TO HALT IMPROPER CAMPAIGN TACTICS.
WHEREAS, absentee voting is increasing significantly and is becoming a
determining factor in election results; and
WHEREAS, soliciting absentee ballots has become an effective tool for
candidates in search of votes, since present law permits campaign workers to
obtain and mail completed absentee ballots to election officials; and
WHEREAS, Assembly Bill 1958 (Waters) would remove the chief remaining
legal restriction on the handling of absentee ballots by allowing third
parties to hand-deliver ballots to election officials, thereby allowing even
more latitude in soliciting absentee votes; and
WHEREAS, AB 1958 would allow absentee ballots received in the mail
postmarked no later than Monday preceding the election to be counted up to two
days after the election; and
WHEREAS, AB 1958 would make it only a misdemeanor offense for a person
to collect absentee ballot applications and fail to return them within three
days, a provision intended to correct an abuse in which a candidate could
collect applications from supporters of his opponent and then "forget" to turn
them in; and
WHEREAS, passage of AB 1958 could lead to increased election fraud and
could destroy the very basis of our democractic system;
NOW, THEREFORE, the City Council of the City of Grand Terrace does
hereby strongly oppose Assembly Bill 1958 (Waters) and urges reconsideration
of AB 768 (Goggin), or similar restrictive legislation, to eliminate the
loopholes in the current California law allowing improper campaign tactics.
