1986-41 RESOLUTION NO. 86-41
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND
TERRACE, CALIFORNIA, APPROVING AN AGREEMENT BETWEEN THE
CITY AND MCMILLIN DEVELOPMENT; ACCEPTING $30,000 FROM
MCMILLIN DEVELOPMENT AND INCREASING THE CITY'S
APPROPRIATIONS IN THAT AMOUNT; AUTHORIZING THE CITY
ATTORNEY TO EXECUTE ALL DOCUMENTS TO ENTER INTO AN ESCROW
FOR THE PURCHASE OF CERTAIN PROPERTY OWNED BY THE GAGE
CANAL COMPANY; APPROVING AN AGREEMENT WITH THE CITY OF
RIVERSIDE FOR THREE PUBLIC CROSSINGS OF THE GAGE CANAL;
AUTHORIZING THE MAYOR TO EXECUTE THE AGREEMENTS WITH THE
CITY OF RIVERSIDE AND MCMILLIN DEVELOPMENT; ACCEPTING AND
AUTHORIZING RECORDATION OF A GRANT DEED RELATIVE TO THE
GAGE CANAL COMPANY PROPERTY; AND DECLARING THAT COMPLETION
OF THE ESCROW AND THE AGREEMENT WITH THE CITY OF RIVERSIDE
SATISFIES THE CONDITION NUMBER FOUR OF PHASE I OF FOREST
CITY DILLON MOUNT VERNON VILLAS DEVELOPMENT.
WHEREAS, the City of Grand Terrace has approved the Mount Vernon
Villas Development, including Condition of Approval Four, that satisfactory
access across the Gage Canal be obtained prior to development; and
WHEREAS, this access will have been obtained by terms of an agreement
between the City of Grand Terrace and the City of Riverside; and
WHEREAS, the owners of the property upon which the Mount Vernon Villas
Development is to be located, McMillin Development, have agreed to pay the
costs of obtaining certain property from the Gage Canal Company as a condition
of receipt of the crossings over the Gage Canal , including the costs of
escrow, appraisal, and the purchase price of $30,000; and
WHEREAS, it is necessary to accept the $30,000 from the McMillin
Development and authorize and increase of the City's appropriations; and
WHEREAS, it is also necessary to appoint the City Attorney to act in
behalf of the City in regards to the esrow for the purchase of property and to
authorize the City Attorney to execute the escrow documents in behalf of the
City:
NOW, THEREFORE., the City Council of the City of Grand Terrace does' _
hereby resolve as follows:
SECTION 1. APPROVAL OF MCMILLIN DEVELOPMENT AGREEMENT - That certain- -
agreement between the City of Grand Terrace and McMillin Development-relative-
to the purchase of property from the Gage Canal Company is hereby approved_-and;
the Mayor is hereby authorized to execute said agreements in behalf,of.t_he-
Ci ty. - .
SECTION 2. ACCEPTANCE OF $30,000 AND INCREASING APPROPRIATIONS - the
City does hereby accept the $30,000 tendered to it by McMillin Development
relative to the agreement approved hereinabove, and the City's appropriations
are hereby increased by. $30,000 in connection therewith.
SECTION 3. AUTHORIZING THE CITY ATTORNEY TO EXECUTE ALL ESCROW
DOCUMENTS RELATIVE TO THE PURCHASE OF THAT CERTAIN PROPERTY FROM THE GAGE
CANAL COMPANY - The City Attorney is hereby authorized to execute all escrow
documents relative to the purchase of property from the Gage Canal Company.
Said property is generally that fee title property owned by the Gage Canal
Company underlying Canal Street within the City of Grand Terrace, generally
from Victoria to Mt. Vernon Avenue.
SECTION 4. APPROVAL OF AGREEMENT WITH CITY OF RIVERSIDE - That
certain agreement with the City of Riverside relative to the acquisition of
three public crossings over the Gage Canal by the City of Grand Terrace is
hereby approved and the Mayor is hereby authorized to execute said agreement.
SECTION 5. ACCEPTING AND AUTHORIZING RECORDATION OF THE PROPERTY
OBTAINED FROM THE GAGE CANAL COMPANY - The property generally described
hereinabove and obtained from the Gage Canal Company is hereby accepted and
staff is authorized and directed to have all property conveyance obtained
therefor duly recorded.
SECTION 6. CONDITION NUMBER FOUR OF THE CONDITIONS OF APPROVAL OF THE
MOUNT VERNON VILLAS DEVELOPMENT, PHASE I, IS HEREBY DECLARED TO BE FULLY
SATISFIED - It is hereby declared that all conditions of approval of the Mount
Vernon Villas Development, Phase I, requiring crossing of the Gage Canal ,
. specifically Condition Number Four, are hereby satisfied with the close of
escrow for the purchase of property from the Gage Canal Company and the
completion of the agreement with the City of Riverside described hereinabove
in Section 4.
SECTION 7. STAFF AUTHORIZED AND DIRECTED TO TAKE THOSE ACTIONS
NECESSARY TO IMPLEMENT THE PURPOSES OF THIS RESOLUTION - Staff is hereby
authorized and directed to take those actions necessary to implement the
purposes of this resolution.
