However, it is estimated that the Agency will receive tax increment up to the year 2026. Every October, the Agency must file a Statement of Indebtedness(SOI)to inform the State and County of the Agency's available tax increment and current outstanding indebtedness. In accordance with redevelopment law, if the Agency receives more tax increment than it owes in debt, than the agency would lose that tax increment above the amount needed to pay for its' debt. While we currently have sufficient debt, potentially there can be problems in the future. Therefore, Staff believes there is a need for a detail analysis of our current and future CRA debt position to be done to insure there is no loss of tax increment and to provide any analysis to see if more bonded indebtedness is worthwhile in view of the debt limitation in 2003. The firm of CM de Crinis& Co. has proposed an amount not to exceed $5,000 for an AB 1290 debt limitation study. Emphasis will be given to encumber Low Mod Housing Funds due to our continuous surplus situation in housing funds. STAFF RECOMMENDS THATAGENCYBOARD• 1) Approve a study of the CRA revenue and indebtedness in relation to the 2003 debt limitation and an appropriation of$5,000 for FY 1999-2000 from CRA Low Mod Income Housing Funds, available fund balance. We suggested that an analysis be done to ascertain the impact of the automatic changes imposed by AB 1290. As you are now aware, the deadline to finance new projects is December 31, 2003. We would propose reviewing the Agency's audit report, historical and current assessed valuation, debt between the Agency and the City and the status of pass through agreements. i i Upon completion of the analysis, we will provide the Agency with an analysis of bonding capacity. In addition, we would be able to assist the Agency with a strategy to fund projects within the time constraints imposed by AB 1290. We will perform this engagement at the hourly rate of$185.00. We do not j anticipate this project costing more than $5,000 and will cap our total fee at i that level unless there are additional requirements not anticipated at this time. Discussion Regarding a Ballot Measure on the November Election Regarding a Transient Occupancy Tax City Manager Schwab, indicated that a Councilmember requested that this item be placed on the agenda for discussion. Mayor Pro Tern Buchanan, indicated that he has some concerns with the tax,however he is willing to let the residents decide. Councilmember Garcia, feels that the Council needs more information on the tax. Councilmember Larkin,expressed his concerns with the fact that at the current time there is only one business that will be affected. Mayor Matteson, stated that the proposed tax does not affect the residents of Grand Terrace and he doesn't understand why there are questions as to whether or not to place the tax on the ballot. In FY 1999-2000 Vavrinek, Trine, Day& Co. compiled and submitted SB 90 claims of approximately$25,000 ('including prior year claims)on behalf of the City. The City has received $16,000, net of 10% commission, up to the date of this report. Staff anticipates that the eligible claims cost will be approximately$12,000 for FY 2000-2001. Proposal The Mandated Cost Services department in the Carmichael regional office of the accounting firm of Vavrinek, Trine, Day and Co., CPA's,LLP has proposed to prepare and submit an SB 90 reimbursement claim on behalf of the City of Grand Terrace at a cost of 15% of the claim amounts to be paid by the State Controller not to exceed $5.500 for claims submitted July 1, 2000 through June 30, 2001. RECITALSA. Municipality has the authority to seek reimbursement for certain costs from the State of California pursuant to California Government Code Section 17550 et seq. B. Municipality has the authority to contract for the preparation of said claims through a designated individual or entity. C. Consultant is duly qualified to provide the service of preparing said Claims in consideration for the fees,expenses, and costs stipulated in this Contract. Consultant will make good faith effort to file Claims in accordance with existing laws, regulations and applicable written guidelines but does not warrant the reimbursable nature of any particular Claim. Municipality will provide Consultant with all the documents, records and information, if not otherwise prohibited by law, necessary to prepare Claims in a timely manner. 2. In no case shall Consultant's fee exceed the not to exceed the amount specified in Appendix A to this Contract. a. Payments are due and payable within 30 days after the submission of each Claim to the Controller. b. Payments owed 45 days after the date of invoice are subject to interest at the rate of 18%per annum, compounded daily until full payment has been received. 3. Municipality agrees to take that official action which is necessary under applicable federal and state constitutional provisions, state statutes and regulations, and any other applicable provisions, to perform its obligations under this Contract in a timely manner. III. MODIFICATIONS This Contract may be modified only by a written amendment to this contract, executed by both parties. IV. TER_MIINATION OF CONTRACT This contract may be terminated by mutual written consent or by either party, provided that the terminating party gives thirty (30) days written notice to the other party. In the event of termination Municipality shall pay for satisfactory ser%zces rendered prior to the effective dates set forth in the Notice of Termination provided to Consultant, and for such other services, which Municipality may agree to in writing as necessary for contract resolution. Upon receipt of a Notification of Termination, Consultant shall promptly discontinue all services affected. In no event shall Municipality be obligated to pay more than the total amount of the contract. Consultant shall provide the Municipality with all work products completed up to the date of termination. In the event of termination, Municipality shall reimburse Consultant for all direct service hours on claims in process at $90.00 per hour. MEMBERS PRESENT: Chairperson Philomena Spisak,JoAnn Johnson, Dottie Raborn, Lewis Neeb and Dick Rollins. MEMBERS ABSENT: Bitsy Bernor, Vice Chairperson, and Claire McElwee. CITY STAFF/SHERIFF'S DEPT Tanya Cahill, Community Services Officer and Lieutenant Rick Carr GUEST PRESENT: Bob Stewart, Citizen Patrol Member. AGENDA: The Agenda was read by the members present with Lewis Neeb making the motion to accept and Dottie Raborn making the second. The motion was carried. MINUTES: The minutes of the meeting of April 10, 2000 were distributed to the members present for their approval. Motion was made to accept the minutes as written,with a minor change, by JoAnn Johnson with the second made by Lewis Neeb. The motion carried. CORRESPONDENCE: There was no correspondence sent to the Committee for this meeting. BUDGET: The budget sheet was updated for this month indicating the purchase of the Plotter supplies for the use of Bitsy Bernor for the Auto-Cad program. There has been no other changes. UNFINISHED BUSINESS: Telephone scams seemed to be increasing as reported by Tanya Cahill. Considerable discussion describing some of the methods being used. It was suggested that informative advertising be • placed on the City's Channel# 3. Tanya stated that she would be in contact with the City Clerk's office to develop something to be displayed. NEW BUSINESS: 1. Tanya Cahill announced that there had been some new participants registered for the Grand Terrace Days events. COUNCIL AGENDA ITEM NO.jn 2. The application for membership of Mr Hugh Forbes to fill the vacancy for one of the alternate memberships available was reviewed by the members present with JoAnn Johnson making the motion to accept and Dottie Raborn making the second. The motion was carried. 3. Tanya reported that vehicle thefts and burglaries were still a problem throughout the City with most of them to vehicles parked both in driveways and in the street at night. Increased patrolling at the apartment projects seemed to be helping. With only one unit patrolling late at night coverage is not as well as it had been in the past. 4. Lewis Neeb reported that the Citizen Patrol had logged 309 hours for the month of April and 1,404 hours since the beginning of the year. The meeting was called to order at 7:06 p.m. by Chairperson, Sonia Aiken. MEMBERS PRESENT were Sonia Aiken, Vic Pfennighausen, Robert Souter, Richard Haubert, JoAnn Johnson and Hugh Forbes. MEMBERS ABSENT- Alternate, Gary Eldridge. CITY STAFF - Assistant City Manager and liaison, John Donlevy. GUESTS PRESENT-None. APPROVAL OF MINUTES of meeting of April 3rd will be postponed until next meeting. LIAISON REPORT,-John gave a brief overview of the Emergency Response Plan. 1. NO FUNDING REQUIRED BACKGROUND: In May, 2000, the City of Grand Terrace received a request from Wilden Pump requesting a red curb along the area on Van Buren St. to help alleviate concerns and problems for employees exiting their parking lot. Specific concerns include site obstructions from parked cars and some poorly located and maintained palm trees in the public right of way. - Staff has investigated this request and is presenting a recommendation for the consideration of the City Council. DISCUSSION: A field investigation was conducted by the City's Traffic Engineer and a determination has been made and a concurrence to the sight obstructions has been made. Attached is a report from TEP, outlining their findings. The Staff recommendation is that the City Council adopt a Ordinance establishing a No Parking Zone for the segment of Van Buren St. on the North side of the street for a distance of approximately 600 West. The area would be posted with No Parking signs in this area. In order to enact a No Parking Zone, the City Council must conduct a public hearing and approve an Ordinance establishing such. This lot is located on the North side of Van Buren across the street from the facility. This parking lot was enlarged in order to help eliminate any potential of personal injuries and/or property damage from occurring. There is a substantial amount of commercial and non-commercial traffic that travels Van Buren, which is adjacent to the front entrance of Wilden Pump. We have made it clear to all our employees there will be no more parking, of employee vehicles. anywhere on Van Buren and this was made effective as of 12/20/99. There is, however, a problem that exists that I am greatly concerned about. On the East side of this new parking lot the view from the exit is blocked. There are two contributing factors to the reason that any one exiting from this parking lot can not see any westbound traffic. 1. Vehicles parked on the North side of Van Buren(Non Wilden) 2. Overgrown and poorly located palm trees. In an effort to continue to provide a safe working environment for our employees, Wilden is requesting that the curb, on the north side of Van Buren and East of the parking lot, be painted red for approximately 50' from the parking lots exit. The Walden management is concerned about obstructions that interrupt the line of sight for vehicles exiting from the east driveway of their parking lot located on the north side of Van Buren. Field Review: TEP staff completed the field review of this area on May 24, 2000. The following are the findings of this review: The street width of Van Buren fronting the project driveway is 44 feet. The street transitions to a width of 40 feet, approximately 41 feet east of the driveway. For the segment of the street with a width of 40 feet, the north side of Van Buren lacks curb and gutter. Van Buren terminates approximately 500 feet west of the Wilden site, and to the east Van Buren terminates at Michigan. This intersection is four way stop sign controlled. Adjacent land uses are primarily industrial. The segment of Van Buren lacks a posted speed limit. Due to its characteristics, this segment of Van Buren has a prima facie speed limit of 55 mph. However, because the segment is relatively short, it is impossible for vehicles in the eastbound direction to achieve this speed prior to reaching the east driveway of the Wilden parking lot. However, it is reasonable to assume that speeds are no greater than 35 mph for the street segment. Red curb is painted for twenty feet immediately to the west and east of the parking lot east driveway. Transportation Engineering and Planning, Inc. Stopping Sight Distance Evaluation: The stopping sight distance requirements for the east driveway were evaluated using procedures conforming to Caltrans Design Manual, Chapter 200, assuming an operating speed for Van Buren of 35 mph. Based on the assumed operating speed, stopping sight distance at the driveway is 250 feet. Within the sight distance triangle (see attached) the following obstructions are noted: A utility pole 2 palm trees, approximately three feet diameter In addition, any vehicle parked on the north side of Van Buren between the driveway and the intersection at Michigan would obstruct the line of sight of vehicles exiting the east driveway of the Wilden parking lot. Recommendations: The City should enact an ordinance to establish a no parking zone on the north side of Van Buren from the east driveway of the Wilden parking lot to the intersection of Michigan in accordance with section 22500 of the California Vehicle Code. In addition, the north side of Van Buren west of the east driveway was not evaluated in detail. However, the segment between the east and west driveway of the Wilden parking lot would also be within the line of sight for vehicles exiting both driveways. Therefore, it is recommended that the no parking zone be extended to include the curb area between the two driveways. The two palm trees on the north side of Van Buren should be removed. Although the utility pole is also on obstruction, it appears that it is not feasible to remove the pole at this time. No parking signs (R28 or R28a) should be installed on the north side of Van Buren where the no parking zone will be enacted. Notwithstanding any other provision of this Code, each violation of the provisions of this Code may be enforced alternatively as follows: A. Infraction. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of this Code may be prosecuted for an infraction. Written citations for infractions may be issued by police officers or non-safety employees designated by Grand Terrace Municipal Code Section 1.06.020. Any person convicted of an infraction under the provisions of this Code shall be punishable either by fines as is specified in the currently adopted Uniform Infraction Bail Schedule used by the San Bernardino Consolidated Municipal/Superior Courts, or where no fine is specified therein by: 1. A fine not exceeding one hundred dollars ($100.00) for a first violation; 2. A fine not exceeding two hundred dollars ($200.00) for a second violation of the same ordinance within one year; 3. The City Council further finds that an appropriate method of enforcement for minor violations is an Administrative Citation Program as authorized by Government Code Section 53069.4. B. The procedures established in this Chapter shall be in addition to criminal, civil or any other legal remedy established by law which may be pursued to address violations of the Municipal Code or applicable State Codes. C. ' The City Council hereby finds and determines that enforcement of the Grand Terrace Municipal Code, other ordinances adopted by the City, conditions on entitlements and terms and conditions of City Agreements are matters of local concern and serve important public purposes. Consistent with its powers as a General Law City, the City of Grand Terrace adopts this Administrative Citation Program provision in order to achieve the following goals: (1) To protect the public health, safety and welfare of the citizens of the City of Grand Terrace; (2) To gain compliance with the Municipal Code and State Codes, Ordinances and regulations in a timely and efficient manner; (3) To provide for an administrative process to appeal the imposition of Administrative Citations and fines; (4) To provide a method to hold parties responsible when they fail or refuse to comply with the provisions of the Municipal Code, Ordinances, Agreements or terms and conditions on entitlements in the City of Grand Terrace; (5) To minimise the expense and delay where the sole remedy is to pursue responsible. parties in the civil or criminal justice system. D. Use of this Chapter shall be at the sole discretion of the City. 1.05.020 Definitions A. Responsible Person shall mean any individual who is the owner or occupant of real property, owner or authorized agent of any business, company, or entity, or the parent or the legal guardian of any person under the age of eighteen(18) years, who causes or maintains a violation of the Grand Terrace Municipal Code or applicable State Code. 3 B. Enforcement Officer shall mean any officer or employee with the authority to enforce the Grand Terrace Municipal Code, whether employed by the City or by contractual agreement, or applicable State Codes, as provided in Section 1.06.020. 1.05.030 Authority A. Any person violating any provision of the Grand Terrace Municipal Code or applicable State Code may be issued an Administrative Citation by an Enforcement Officer as provided in this Chapter. A violation of this Code includes, but is not limited to, all violations l of the Municipal Code, the Uniform Codes adopted by the City Council, failing to comply with any condition imposed by any entitlement, permit, agreement or environmental document issued or approved under the provisions of this Code. B. Each and every day a violation of the Municipal Code or applicable State Code exists constitutes a separate and distinct offense. C. A civil fine shall be assessed by means of an Administrative Citation issued by the Enforcement Officer and shall be payable directly to the City of Grand Terrace. D. Fines shall be assessed in the amounts specified in this Chapter, as adopted by the City Council, as: A fine not exceeding one hundred dollars ($100.00) for a first violation; A fine not exceeding two hundred dollars ($200.00) for a second,violation of the same ordinance or permit within one year from the date of the first violation; A fine not exceeding five hundred dollars ($500.00) for each additional violation of the same ordinance or permit within one year from the date of the first violation. E. Fines collected resulting from enforcement of Grand Terrace Municipal Code Administrative Citation violations will be placed in the General Fund and used solely for the purpose of the code enforcement program in order to insure and maintain the character and well being of the City of Grand Terrace. 1.05.040 Service Procedures A. An Administrative Citation on a form approved by the City Manager or Police Chief may be issued to the responsible person by an Enforcement Officer for violations of the Municipal Code or applicable State Code in the following manner: (1) Personal Service. In any case where an Administrative Citation is issued: i. The Enforcement Officer shall attempt to locate and personally serve the responsible person and obtain the signature of the responsible person on the Administrative Citation. 4 ii. If the responsible person served refuses or fails to sign the Administrative Citation, the failure or refusal to sign shall not affect the validity of the Administrative Citation or of subsequent proceedings. B. Service of Citation by Mail. If the Enforcement Officer is unable to locate the responsible person, the Administrative Citation shall be mailed to the responsible person by certified mail, postage prepaid with a requested return receipt. Simultaneously, the citation may be sent by first class mail. If the citation is sent by certified mail and returned unsigned, then service shall be deemed effective pursuant to first class mail, provided the citation sent by first class mail is not returned; or, C. Service by Citation by Posting Notice. If the Enforcement Officer does not succeed in personally serving the responsible person, or by certified mail or regular mail, the Enforcement Officer shall post the Administrative Citation on any real property within the City in which the City has knowledge that the responsible person has a legal interest, and such posting shall be deemed effective service. 1.05.050 Contents of Notice A. Each Administrative Citation shall contain the following information: (1) Date, approximate time, and address or definite description of the location where the violation(s) was observed; (2) The Code sections or conditions violated and a description of the violation(s); (3) An order to the responsible person to correct the violations within the time specified, and an explanation of the consequences of failure to correct the violation(s); (4) The amount of the fine for the violation(s); (5) An explanation of how the fine shall be paid and the time period by which it shall be paid; (6) Identification of rights of appeal, including the time within which the Citation may be contested and the place to send a written request for a hearing, to contest the Administrative Citation; and (7) The name and signature of the Enforcement Officer and if possible the signature of the responsible person. 1.05.060 Satisfaction of Administrative Citation A. Upon receipt of a Citation, the responsible person must do the following: 5 (1) Pay the fine to the designated collector of the fine(s)as noted on the citation, within fifteen(15) days from the date of issuance of the Administrative Citation. All fines assessed shall be payable to the City of Grand Terrace. Payment of a fine shall not excuse or discharge the failure to correct the violation(s) nor shall it bar further enforcement action by the City. (2) Remedy the violation(s), if the violation(s) is of such a nature that it can be remedied. If the responsible person fails to correct the violation(s), subsequent Administrative Citations may be issued for the same violation(s). The amount of the fine for failure to correct the violation shall increase at a rate specified in this Chapter_or by Ordinance. i 1.05.070 Appeal of Administrative Citation A. Any recipient of an Administrative Citation may contest that there was a violation of the Grand Terrace Municipal Code, or that he or she is the responsible person, by submitting a written request for a hearing, and returning it to the designated collector as noted on the citation, within fifteen(15) days from the date of the issuance of the Administration Citation,together with an advanced deposit of the fine. Any Administrative Citation fine which has been deposited shall be refunded if it is determined, after a hearing, that the person charged in the Administrative Citation was not responsible for the violation(s)or that there was no violation(s)as charged in the Administrative Citation. 1.05.080 Hearing Officer A. The Grand Terrace City Manager shall designate the baring officer for the Administrative Citation hearing. The hearing officer shall not be a City of Grand Terrace employ9g. The employment, performance evaluation, compensation and benefits of the hearing officer, if any, shall not be directly or indirectly conditioned upon the amount of Administrative Citation fines upheld by the hearing officer. 1.05.090 Hearing Procedure A. No hearing to contest an Administrative Citation before a hearing officer shall be held unless and until a written inquest for a hearing has been submitted, and, the fine has been deposited in advance. B. A hearing before the hearing officer shall be set for a date that is not less than fifteen(15) and not more than sixty (60) days from the date that the request for hearing is filed in accordance with the provisions of this Chapter. The person requesting the bearing shall be notified of the time and place set for the hearing at least ten (10) days prior to the date of the hearing- C. The Enforcement Hearing Officer shall only consider evidence that is relevant to whether the violation(s)occurred and whether the responsible person has caused or maintained the violation(s) of the Municipal Code or other applicable State Code on the date(s) specified in the Administrative Citation. 6 D. The responsible person contesting the Administrative Citation shall be given the opportunity to testify and present witnesses and evidence concerning the Administrative Citation. E. The failure of any recipient of an Administrative Citation to appear at the Administrative Citation hearing shall constitute a forfeiture of the fine and a failure to exhaust their administrative remedies. F. The Administrative Citation and any additional documents submitted by the Enforcement Officer shall constitute prima facia evidence of the respective facts contained in those documents. G. If the Enforcement Officer submits an additional written report concerning the Administrative Citation to the hearing officer for consideration at the hearing, then a copy of this report also shall be served by mail on the person requesting the hearing at least five (5) days prior to the date of the hearing. H. At least ten (10) days prior to the hearing, the recipient of an Administrative Citation shall be provided with copies of the citations, reports and other documents submitted or relied upon by the Enforcement Officer. No other discovery is permitted. Formal rules of evidence shall not apply. I. The hearing officer may continue the hearing and request additional information from the Enforcement Officer or the recipient of the Administrative Citation prior to issuing a written Decision. 1.05.100 Hearing Officer's Decision. A. After considering all of the testimony and evidence submitted at the hearing, the hearing officer shall issue a written Decision within ten(10) days of the hearing to uphold or deny the Administrative Citation and shall list in the Decision the reasons for that Decision. The Decision of the hearing officer shall be final. B. If the hearing officer determines that the Administrative Citation should be upheld, then the fine amount on deposit with the City shall be retained by the City. If the hearing officer determines that the Administrative Citation should be cancelled and the fine was deposited with the City, then the City shall refund the amount of the deposited fine. C. The recipient of the Administrative Citation shall be served with a copy of the, hearing officer's written Decision in the manner prescribed by Section 1.05.090 of the GrandE Terrace Municipal Code. 1.05.110 . Failure to Pay Fines A. The failure of any person to pay the civil fines assessed by an Administrative Citation within the time specified on the Citation may result in the matter being referred to the City of Grand Terrace to file a claim with the Small Claims Court. Alternatively, the City may pursue any other legal remedy to collect the civil fines, including the appointment of a private collection agency, acting on behalf of the City of Grand Terrace, as it's agent, to pursue and collect fines as determined by contract agreement and approved by the City Council. The City may also recover its collections costs, along with fines assessed, according to proof of attempts to collect the debt. 1.05.120 Right to Judicial Review A. Any person aggrieved by an Administrative Decision of a hearing officer on an Administrative Citation may obtain review of the Administrative Decision by filing a Petition for Review with the Court in accordance with the San Bernardino County Consolidated Municipal and Superior Courts timelines and provisions as set forth in California Government Code Section 53069.4. 1.05.130 Notices A. The Administration Citation and all notices to be given by this Chapter shall be served on the responsible person in accordance with the provisions of this Chapter. B. Failure to receive any notice specified in this Chapter does not affect the validity of proceedings conducted here under. SECTION 3: Chapter 1.06 of the Grand Terrace Municipal Code is hereby added to Title to read as follows: 1.06.010 Notice to Appear in Lieu of Arrest. i. In any case in which a person is arrested for a violation of any provision of this Code and ices not demand to be taken before a magistrate, such person may, in lieu of being niken before_a magistrate,be issued a written notice to appear in court and may then be released, all pursuant to and in accordance with the procedures prescnbed by California Penal Code Section 853.6, et. seq. 1.06.020 Issuance of Citations by Designated Officers and Employees. 1. Officers and employees of the City who have the discretionary duty to enforce a statute or ordinance may, pursuant to Section 836.5 of the Penal Code and subject to the provisions of this section, arrest a person without a warrant whenever any such officer or employee has reasonable use to believe that the person to be arrested has committed an offense in the officer's employee's presence which he or she has the discretionary duty to enforce,and to issue a notice to appear, and to release such person on his or her written promise to appear in court, pursuant to Section 853.6 of the Penal Code. No officer or employee shall be allowed by his or her superior to exercise the arrest and citation authority conferred in this section unless such officer or employee is within a classification of city officers and employees designated by the City Manager to exercise such arrest and citation authority as to specified violations. The City Manager shall establish and cause to be administered a special enforcement training program 8 designated to instruct each officer or employee who will exercise such arrest and citation authority, regarding the provisions of the statutes and ordinances to be enforced,the evidentiary prerequisites to proper procedures for making arrests or otherwise prudently exercising such arrest and citation authority, and the legal and practical ramifications and limitations attendant thereto.Any such officers or employees shall be appropriately instructed to deposit executed citations or notices with the police department for filing with the court, after review for legal sufficiency. SECTION 4: If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason held to be invalid or unconstitutional, such Decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance and each section, subsection, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional. Fax (909) 825-7506 Each year, Engineer's Report must be prepared, considered by the City Council, for the levy of annual assessment for maintenance and operation of the "District". The annual report takes into consideration the costs of operation and maintenance for the pre-vious year, amount assessed for that year and projects costs of operation and maintenance for the coming fiscal year. Based on the above costs and estimates, credits are given for any funds assessed over and above the cost of operation and maintenance for the costs incurred over and above that assessed previous year.These costs are then spread to the benefitting properties. BACKGROUND The City Council of the City of Grand Terrace adopted it's General Plan with various elements to provide guidelines for orderly development within the community. The City Council further adopted ordinances and regulations governing the development of land providing for the installation and construction of certain landscaping, lighting and appurtenant facilities to enhance the quality-of life and to benefit the value of property. The requirement for the construction and installation of landscaping, lighting and appurtenant facilities is a condition of approval for development and is a requirement of issuance of a permit for the construction of any residential, commercial, industrial and planned unit development. Landscaping and appurtenant facilities generally include trees, shrubs, plants, turf, irrigation systems, and necessary appurtenances including curbs, hardscape, monumentations, fencing located in public right-of-ways, medians, parkways, and/or ! easements adjacent to public right-of-ways_in and along public thoroughfares and certain designated primary and secondary arterials. Page 1 of COUNCIL AGENDA ITEM NO®' Lighting and appurtenant facilities includes poles, lighting fixtures, conduits and the necessary equipment to maintain, operate and replace a lighting system at designated intersections, in medians, parkways and adjacent to certain public facilities in and along certain streets, right-of-ways and designated lots. The installation of landscaping and lighting systems and the construction of the necessary appurtenant facilities is the responsibility of the property owner/applicant, as conditions of approval of a development application. The City may cause the installation by property owners directly, or accept financial arrangements for installation of these facilities. The cost of servicing, operation, maintenance, repair and replacement of the landscaping, lighting and appurtenant facilities in turn becomes the responsibility of the benefitting properties. The owners/applicants petitioned for formation of the Landscaping Lighting Assessment District and/or annexation. These have been completed, and will increase the City's obligation for maintenance and servicing. The City of Grand Terrace is administering a lighting system for the benefit of all parcels of land within the City. The lighting benefit is directly related to public safety and property protection. These benefits have been studied widely, locally, regionally and nationally. The City has formed Landscaping and Lighting Assessment District 89-1 and subsequently annexed other parcels as Annexation No. 1 to said District to insure a fair and equitable levying of the necessary costs of s:nicing and maintenance of the respective facilities,which in turn will enhance the value of each and even- parcel in the District directly and collectively. The 89-1 District Boundaries of the Landscaping and Lighting Assessment District are the boundaries of Tract 13364 filed in Map Book 203, Pages 89 through 92, Records of San Bernardino County. The boundaries of Annexation No. I are the boundaries of Tracts 14264 and 14471. filed in Map Book 242, Pages 17 and 18, and Map Book 237, Pages 41 and 42, respectively, of said County. Senicing and administration of the City's landscape maintenance program shall be according to the pro-isions of the Landscaping and Lighting Act of 1972, Part 2, Division 15 of the Streets and Highways Code of the State of California. Payment for the assessment for each parcel will be made in the same manner and at the same time as Payments are made for property taxes for each Property. The proceedings will be conducted under the Landscaping and Lighting Act of 1972, Part 2, Division 15. Sections 22500 through 22679, of the Streets and Highways Code of the State of California. A RESOLUTION OF THE CITY COUNCIL ORDERING THE PREPARATION OF PLANS, SPECIFICATIONS, COST ESTIMATE, DIAGRAM, ASSESSMENT AND REPORT PURSUANT TO THE PROVISIONS OF DIVISION 15, PART 2 OF THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, FOR PROCEEDINGS FOR THE ANNUAL ASSESSMENT LEVY AFTER FORMATION OF A DISTRICT WHEREAS, the CITY COUNCIL of the CITY OF GRAND TERRACE, CALIFORNIA, desires to initiate proceedings for the annual levy of assessments for a landscaping and street lighting district pursuant to the terms and provisions of the "Landscaping and Street Lighting Act of 1972," being Division 15, Part 2 of the Streets and Highways Code of the State of California, in what is known and designated as CITY OF GRAND TERRACE LANDSCAPING AND STREET LIGHTING DISTRICT NO. 89-1 (hereinafter referred to as the "District"); and, `- WHEREAS, the proceedings for the annual levy of assessments shall relate to the fiscal year commencing July 1, 2000, and ending June 30, 2001; and, WHEREAS, there has been submitted to this City Council for its consideration at this time, a map showing the boundaries of the territory affected by the levy of the assessment for the above referenced fiscal year, said map further showing and describing in general the works of improvement proposed to be maintained in said District, said description being sufficient to identify the works of improvement and the areas proposed to be assessed for said maintenance thereof; and, WHEREAS, the provisions of said Division 15, Part 2 require a written "Report," consisting of the following: 1. Plans and specifications of the area of the works of improvement to be maintained; 2. An estimate of the costs for maintaining the improvements for the above referenced fiscal year; 3. A diagram of the area proposed to be assessed; 4. An assessment of the estimated costs for maintenance work for said fiscal year. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Grand Terrace does hereby resolve, determine and order as follows: SECTION 1. That the above recitals are all true and correct. SECTION 2. That a map, entitled CITY OF GRAND TERRACE LANDSCAPING AND STREET LIGHTING DISTRICT NO. 89-1 as submitted to this City Council, showing the boundaries of the proposed area to be assessed and showing the works of improvement to be maintained, is hereby approved, and a copy thereof shall be on file in the Office of the City Clerk and open to public inspection. The proposed parcels and properties within said area are those to be assessed to pay certain of the costs and expenses for said maintenance work. SECTION 3. That the proposed maintenance work within the area proposed to be assessed shall be for certain street lighting and landscaping improvements, as said maintenance work is set forth in the "Report" to be presented to this City Council for consideration. SECTION 4. That William Addington, City Engineer is hereby ordered to prepare and file with this City Council, a "Report" relating to said annual assessment and levy in accordance with the provisions of Article IV, commencing with Section 22565 of Chapter 1 of the Streets and Highways Code of the State of California. SECTION 5. That upon completion, said "Report" shall be filed with the City Clerk, who shall then submit the same to this City Council for its consideration pursuant to Sections 22623 and 22624 of said Streets and Highways Code. I am 12 years old and I live in Grand Terrace and spend time at the parks to play ball and attend community activities. My project, "The Terrace Is Grand With Sruoke-FREE Parks", received a mini-grant to conduct tobacco-free activities from Tri-County SOUTH Regional Tobacco-FREE Project, Funded by Prop 99. 1 am respectfully requesting to be put on the agenda for the City Council meeting schedule for June 22, 2000. Our group will propose to vie council that they adopt a resolution to declare the city parks as Tobacco-FREE zones. VVe have collected over eight hundred signatures on petitions in suppor: of this !; resolution. We also surveyed one hundred (100) residents regarding their opinions of tobacco-free parks. Ninety-three (93) surveys are in support of tobacco-free parks, three (3) are against and four(4) said maybe tobacco-fret parks were a good idea. My group also collected :rash from the parks. A lot of the trash contains cigarette butts, packages, etc. We will use all the trash as a visual aid at the council meeting. Once the resolution is adopted the project will be willing to pay for the signs to post in our parks indicating that they are Tobacco-FREE Zones. Vie have aiready discussed this proposal with the City Manager, Assistant City lianzger, the Mayor and a majority of members of the City Council. We look forward to speaking to the council on June 22,2000. The parks in the City of Grand Terrace are Tobacco-Free Zones. Appropriate signage will be posted at city parks, declaring the parks a tobacco-free zone. COUNCIL AGENDA ITEM NO. �,E C%T r RnMDTER Community Services Department Staff Report CITY COUNCIL ITEM (XX) MEETING DATE: JUNE 22, 2000 r y SUBJECT: CHAMBER/CITY NEWSLETTER: PROPOSAL FUNDING REQUIRED BACKGROUND: As the City Council is aware, the Terrace View Newsletter published by the City was discontinued as part of the FY 1999-2000 budget reductions. This has left a significant void in the communications with residents regarding important City issues and the announcement of community events. In March, Councilman Herman Hilkey suggested that staff look into the development of a publication for notifying residents of community recreation opportunities with private and non-profit organizations. Examples provided came from such cities as Moreno Valley and Chino. DISCUSSION: Staff arranged a meeting with Steve Peters, President of the Grand Terrace Chamber of Commerce regarding coordinating the inclusion of City information in the Blue Mountain Outlook, the Chamber newsletter. Two meetings were held and a variety of concepts were discussed. A concept which is being recommended is the idea of incorporating a City section in -the Outlook which would contain much of the information previously contained the Terrace View Newsletter. Articles a CommunityCalendar Key Phone Numbers and � Y Recreational Opportunities would be included in the Section, which would be sent on a monthly basis to residents. Under this proposal. City Staff would develop the articles and a simplified layout. This would be transferred to the Chamber, who would coordinate the final layout, printing and distribution. June 22, 2000 Page 2 of 2 Attached is a letter from Steve Peters outlining a proposal which would charge the City $5,600 annually. This would provide for 12 publications which would be mailed to individual residences. For the City, funding for this proposal could from two sources. a Used Oil Recycling Grant $2,500.00 and $3,100 from the General Fund. Additional costs would obviously be from Staff time incurred in the development of the Articles for the publication. A report and presentation will be made at the meeting by Steve Peters regarding this proposal. RECOMMENDATION: That the City Council 1. Approve the development of an Agreement with the Grand Terrace Chamber of Commerce for a cooperative newsletter publication; and 2. Appropriate $3,100 from the Unallocated General Fund Balance toward this project. FISCAL IMPACT: $2,500 from the Used Oil Grant Program and $3,100 from the Unallocated General Fund Balance. The city's annual cost for the publication will be Commerce $5,600. This will help offset the cost of printing and composition of four extra pages and help with the mailing of 4,500 newsletters to all Grand Terrace residents and businesses. The estimated monthly costs of for publishing the newsletter are: $550.00 Printing $425.00 Composition $500.00 Mailing $200.00 Commission on Ads $1,675.00 The City's share of monthly expenses will be $467.00. For this the city will have four full pages on which they can let the city residents know what's happening with the city, and upcoming events and dates.
