2007-02 — RESOLUTION NO. 2007-02 \ RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE APPROVING SA-06-20, CUP-06-08 AND E-06-16 TO CONSTRUCT A WIRELESS TELECOMMUNICATIONS FACILITY AT 22200 NEWPORT AVENUE IN THE M2 DISTRICT WHEREAS, the applicant, Royal Street Communications, LLC, has applied for the approval of Site and Architectural Review Case No. SA-06-20, CUP-06-08 and Environmental Review Case No. E- 06-16 to construct a wireless telecommunications facility located at 22200 Newport Avenue, Grand Terrace (SCE substation), in the M2 District; and WHEREAS, a properly noticed public hearing was held by the Planning Commission on February 22, 2007; and WHEREAS,pursuant to the California Environmental Quality Act(CEQA),this project qualifies for a Negative Declaration under E-06-16 in that said proposed project will not have a significant effect on the environment. NOW THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Grand Terrace that the following findings have been made in accordance with the approval of SA-06-20, CUP-06-08 and E-06-16: 1. The proposed wireless telecommunications facility will not be detrimental to the general health, safety,morals, comfort, or general welfare of the persons residing or working in the neighborhood of the proposed use or within the City. 2. The locations and configurations of all structures associated with this project are visually harmonious with this site and surrounding sites and structures, that they do not interfere with the neighbors' privacy, that they do not unnecessarily block scenic views from other structures and/or public areas, and are in scale with the townscape and natural landscape of the area. The design and appearance of the proposed wireless communications facility will be consistent with existing development in the area and the City. 3. The design of the facility, the materials, and colors are visually harmonious with surrounding development and natural landforms; are functional for the proposed project; and are consistent with the Grand Terrace Municipal Code. Said materials will match existing materials and colors of facilities in the area. 4. The existing landscaping and open spaces provides a functional and visually pleasing setting for the structures on this site and is harmonious with the natural landscape of the area and nearby developments. The existing landscaping of the site will minimize any visual impacts to the surrounding area. 5. There is no indiscriminate clearing of property, destruction of trees or natural vegetation or the excessive and unsightly grading of hillsides, thus the natural beauty of the city, its setting and natural landforms are preserved. The subject site is developed as an SCE substation with ornamental vegetation and no natural resources. 6. The design and locations of all signs associated with this project are consistent with the scale and character of the building to which they are attached or otherwise associated with and are consistent with the Grand Terrace Municipal Code. All signs will be subject to a separate review through a required and separate sign permit. This is a wireless communications project which will not require any special sign permits. 7. The proposed use is consistent with the latest adopted General Plan. The current General Plan designates the land use as Industrial (M2). This proposed project meets the General Standards ar Special Standards under the Wireless Telecommunication Facility Ordinance 171 (GTMC 18.71.070). BE IT FURTHER RESOLVED that SA-06-20, CUP-06-08, and E-06-16 are hereby approved subject to the following conditions: 1. The proposed project shall be constructed in accordance with the Site and Architectural Review as approved by the Planning Commission of the City of Grand Terrace on February 22, 2007. All plans shall be consistent in terms of property lines, easement location and dimensions and other measurements. Minor changes or clarifications may be made by the Director. 2. All outside lighting shall be hooded and directed so as not to shine directly upon adjoining property or the public-right-of way. 3. All mechanical equipment shall be ground mounted and shall be screened from public view. No roof mounted HVAC units shall be allowed. 4. Payment of the Traffic Signal and Circulation Improvement fees as established by Ordinance No.190 of the City of Grand Terrace prior to the issuance of building permits. 5. The applicant shall comply with all requirements of the Director of Building and Safety/Public Works in his memorandum dated December 11, 2006. 6. The applicant shall comply with all requirements of the Community Safety Division of the County Fire Department as determined by its plan check of this proposal. 7. Prior to the issuance of permits for this project by the Department of Building and Safety/Public Works, the applicant shall have obtained whatever clearances and permits are required from the appropriate State and Federal agencies, including the Public Utilities Commission of the State of California and the Federal Communications Commission. 8. Any significant expansion or change of use will be reviewed by the appropriate City, - . County, State, or Federal agencies. Additional permits and/or amendments to the Conditional Use Permit may be necessary. 9. All terms of the City's Wireless Telecommunications Ordinance No.171 shall be complied with. 10. This grant shall not be deemed effective until the "Acceptance of Conditions"for Site and Architectural Review Case No. SA-06-20 has been signed by the applicant and returned to the City.
