2011-09 RESOLUTION NO. 11- 09 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE FINDING THAT THE CONVEYANCE OF APPROXIMATELY 4,000 SQUARE FEET OF LAND IS IN CONFORMANCE WITH THE GENERAL PLAN WHEREAS, on December 18, 2008, the Planning Commission adopted Resolution No. 2008-03 finding that the vacation of a portion of Britton Way, measuring 14,386 square feet, associated with the Barton Plaza commercial project, is consistent with the General Plan; and WHEREAS, on January 13, 2009, the City Council adopted a Resolution of Intent, Resolution No. 2009-01, declaring its intention to vacate that portion of Britton Way, associated with the Barton Plaza commercial project; and WHEREAS, on February 10, 2009, the City Council adopted Resolution No. 2009-03, vacating said portion of Britton Way; and WHEREAS, the Barton Plaza commercial project entails the development of a 39,500 square foot commercial center on 3.6 acres and encompasses the 14,386 square feet of vacated Britton Way ; and - WHEREAS, upon vacation of said portion of Britton Way, the underlying land reverted to the ownership of the developer of the Barton Plaza project, except for approximately 4,000 square feet, depicted on Exhibit A, of the underlying land which reverted to the ownership of the City of Grand Terrace; and WHEREAS, said 4,000 square feet was granted to the City of Grand Terrace on January 15, 2003, via recordation of a grant deed, in conformance with conditions of approval associated with Site and Architectural Review 02-02; and WHEREAS, said 4,000 square feet of land is zoned BRSP-VC, within the Barton Road Specific Plan and General Commercial on the General Plan Land Use Map; and is part of the approved Barton Plaza commercial project; and WHEREAS, the 4,000 square feet is proposed to be granted back to the current land owner; and WHEREAS, pursuant to Government Code Section 65402, prior to the disposition of real property, the purpose and extent of such disposition must be found to be in conformance with the General Plan; and WHEREAS, on November 17, 2011, the Planning Commission conducted a public meeting on said General Plan conformance on the disposition of said real property. Page 1 of 2 NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE DOES HEREBY RESOLVE AS FOLLOWS 1. The Planning Commission hereby finds that the 4,000 square feet of real property, depicted on Exhibit A, is designated General Commercial on the General Plan Land Use Map, and is located within the limits of and is a component of the 3.6-acre Barton Plaza commercial center; and that the conveyance of said real property will facilitate the build-out of the Barton Plaza commercial project as approved by the Planning Commission on July 14, 2011, and the City Council on July 28, 2011. 2. The Planning Commission further finds that pursuant to Government Code Section 65402, said conveyance of real property is in conformance with the General Plan because, as identified in the General Plan Land Use Element, the General Commercial designation is intended for general commercial uses to serve the retail and service needs of the community, and the 39,700 square foot Barton Plaza project, including the 4,000 square feet of real property, will provide a neighborhood commercial center consisting of a drug store, market, food and retail uses serving the community of Grand Terrace consistent with the General Plan.
