2012-02 RESOLUTION NO. 12-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE APPROVING AN ADDENDUM TO THE BARTON PLAZA INITIAL STUDY AND MITIGATED NEGATIVE DECLARATION WHEREAS, on July 14, 2011, the Planning Commission adopted Resolution No. 11-05 approving Site and Architectural Review 11-02, a 39,500 square foot commercial center on 3.6 acres, and adopted the Initial Study/ Mitigated Negative Declaration prepared for the Project, concluding that although the Project may have significant environmental effects, these effects can be avoided or reduced to less than significant levels through design, construction or operational features that mitigate the potential effects. WHEREAS, since adopting Resolution No. 11-05, it has been determined that a portion of the Project must be changed, more specifically that Mitigation Measure NOS-05 pertaining to the height and construction materials of the six foot-high shielding wall at the west property line along the existing residences must be changed. Specifically, that the shielding wall be reduced to a height of 5 feet and transition into a four foot shielding wall with 12 inches of metal fencing adjacent to the existing residences. WHEREAS, pursuant to Section 15164 of the California Environmental Quality Act (CEQA) Guidelines, an Addendum to the Initial Study/Mitigated Negative Declaration ("Addendum") previously adopted for the Project has been prepared that analyzes the effects of the proposed change to the Project. WHEREAS, on March 1, 2012, the Planning Commission conducted a public hearing at the Council Chambers located at 22795 Barton Road, Grand Terrace, California. NOW THEREFORE, THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE DOES HEREBY RESOLVE AS FOLLOWS . 1. The Planning Commission hereby approves the attached Addendum. 2. The Planning Commission hereby finds that based on the analysis in the Addendum that the revision to Mitigation Measure NOS-05 creates no new issues regarding significant effects upon the environment and therefore finds that this change to the Project does not require the preparation of either a new or supplemental Mitigated Negative Declaration or an Environmental Impact Report. AYES: Chaftman Wilson, Vice Chairman Addington, Commissioner Bailes NOES: Commissioner Comstock ABSENT: Commissioner Kongtang ABSTAIN: 0 ATTEST: 1 br Tracey Motihbz Doug Wilson City Clerk Chairman Page 2 of 2 ADDENDUM TO BARTON PLAZA MITIGATED NEGATIVE DECLARATION Background On July 14, 2011 and July 28, 2011, the Planning Commission and City Council (City), respectively, took separate actions approving the Barton Plaza Commercial Project (Project), including adoption of a Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Plan (MMRP), which included Mitigation Measure NOS-05 requiring "A six-foot high shielding wall shall be constructed along the northwest corner property line (adjacent to residential units) and along the Market (Phase II) loading dock." Status In response to project changes, City has prepared this California Environmental Quality Act (CEQA) Addendum to the MND, to revise Mitigation Measure NOS-05 relating to height, materials and design for a portion of the west boundary wall, and to provide a development incentive as permitted within the Barton Road Specific Plan. Description NOS-05 is proposed to be revised to read as follows: A sWive-foot high shielding wall shall be constructed from the northwest corner of the orooertv along the west orooertv line. and shall transition to a four-foot hiah shieldina wall with one-foot hiah tubular fencina on too along the northwest seFReFproperty line (adjacent to residential units) and a six-foot high shieldina wall shall be constructed along the Market (Phase II) loading dock Environmental Evaluation As discussed in Section Xll.a of the Barton Plaza Initial Study, an Acoustical Study was prepared for the Project, which analyzed the Project's potential long-term noise impacts that are typically associated._ with operation of onsite uses, such as parking lot noise, loading/unloading dock activities, truck deliveries, and speakerphone usage, and which are intermittent and vary by use. The Acoustical Study prepared for the Project anticipates that the worst case unmitigated noise level from the Project site would range from 58.7 (residential to the west) to 59.0 (commercial uses to the west) dBA Leq during daytime hours (7:00 am to 10:00 pm). The anticipated increase in noise levels do not exceed the City's noise level thresholds of 65 dBA (exterior) for residential land uses, or the Noise/Land Use Compatibility Index which finds that noise levels less than 60 dBA are generally acceptable. Although the stationary noise impacts would be within the City's noise level thresholds, Mitigation Measure NOS-05 was incorporated into the Project to further reduce potential noise levels.' In addition, the Barton Road Specific Plan (BRSP) requires the installation of a six foot opaque wall where commercial uses are adjacent to residential uses. The reduction in height and use of open fencing would qualify for an incentive. Given that noise levels are not expected to exceed City thresholds, that the intent of the six foot high shielding wall was to help reduce potential noise levels even further, and that a shielding wall will be constructed adjacent to the loading well, the modification to the wall design will not result in substantial long-term adverse noise impacts. FINDINGS The Planning Commission finds that pursuant to Section 15162 of the California Environmental Quality Act (CEQA) Guidelines, a subsequent Negative Declaration is not required. Substantial changes are not proposed, nor do substantial changes occur with respect to the circumstances under which the project is undertaken, that would require major revisions to the previous negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; the Project will not have significant effects not discussed in the previous negative declaration; effects will not be substantially more severe than shown in the previous negative- declaration; and the applicant is in agreement with the revised mitigation measure.
