A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY ,OF
GRAND TERRACE APPROVING MINOR DEVIATION 13-02 AND SITE
AND ARCHITECTURAL REVIEW 13-02 TO ESTABLISH A HEALTH
CARE CLINIC AT 11980 MOUNT VERNON AVENUE (APN 0275-251-37
AND -38)
WHEREAS, Riverside-San Bernardino County Indian Health, Inc., represented by
Mark Jensen, ("Applicant"), submitted Site and Architectural Review 13-02 to operate .a
health care clinic at an existing.6-acre site, and Minor. Deviation 13-02 to reduce the
parking requirement by 12% ("Project"). The site .is zoned AP-Administrative
Professional.and has a General Plan land use designation of Office Commercial.
WHEREAS, the Applicant, would occupy two buildings totaling 36,783 square feet
and provide non-ambulatory health care including, out=patient medical, nursing, dental,
optical, lab,.pharmacy, behavioral and public health nursing services.
WHEREAS, the Project is categorically exempt from the California. Environmental
Quality Act (CEQA) Guidelines, pursuant to Section 15332, which exempts infill projects.
1, WHEREAS, on March 21, 2013, the Planning Commission conducted a duly
1 noticed.public hearing on Project at the Grand Terrace City Council Chambers located at
22795 Barton Road, Grand Terrace, California 92313 and concluded the.hearing on said
date.
WHEREAS, all legal .prerequisites to the adoption of this Resolution .have
occurred.
NOW THEREFORE,BE IT RESOLVED by the Planning Commission of the City
of Grand Terrace:
1. The Planning Commission hereby finds that the Project is categorically exempt
pursuant to Section 15332 from the provisions- of the California Environmental
Quality Act (CEQA). The Notice of Exemption.-prepared in connection-with the
Project has been reviewed and considered and reflects the independent judgment
of the Planning Commission, and is hereby adopted:
2. The Planning Commission finds as follows with respect to Minor Deviation 13-02:
a. In accordance with Section 18.89.050 of the Zoning Code, the minor
deviation is in accordance with the general .plan and zoning ordinance of
the city because the health care center use can be supported with 162
parking spaces in lieu:of the 184 required by the Zoning Code.-

i- The minor relaxation of the off-street parking regulations, as permitted by
Section 18.60.050 of Chapter 18.60 Off Street Parking is minor in nature
(12% of the overall parking requirements), will be of benefit to the project
and will not create a negative impact on existing or potential uses adjacent
to or in the vicinity of the project because based on the Applicant's
operation of an existing Native American health care clinic, only 51% of the
existing parking spaces will be necessary to serve employees and patients.
3. The Planning Commission finds as follows with respect to Site and Architectural
Review 13-02:
a. The Project is consistent with the intent of the Grand Terrace Municipal
Code and the General Plan. The proposed health care clinic is consistent
with the AP-Administrative Professional zone classification which principally
permits medical, dental offices and related health clinics. With the granting
of Minor Deviation 13-02 the new use will be consistent with off-street
parking requirements.
The Project is consistent with the Office Commercial General Plan land use
designation, which is intended for office/administrative uses and support
retail and service commercial uses.
b. The location and configuration of all structures associated with this Project
l are visually harmonious with this site and surrounding sites and structures,
that they do not interfere with the neighbors' privacy, that they do not
unnecessarily block scenic views from other structures and/or public areas
and are in scale with the townscape and natural landscape of the area. All
structures are existing and will remain in place.
C. The architectural design of structures, their materials and colors are visually
harmonious with the surrounding development, natural landforms, are
functional for the Project and are consistent with the Grand Terrace
Municipal Code. Exterior repairs and patch work will match existing colors
and materials.
d. The plan for landscaping and open spaces provide a functional and visually
pleasing setting for the structures on this site and is harmonious with the
natural landscape of the area and nearby developments. The Project site is
already developed and on-site landscaping will remain in place, with plant
material replaced, on an as needed basis.
e. There is no indiscriminate clearing of property, destruction of trees or
natural vegetation or the excessive and unsightly grading of hillsides, thus
the natural beauty of the City, its setting and natural landforms are
preserved. The Project site is already developed and on-site landscaping
will remain in place, and only replaced as needed.

f. The design and location of all signs associated with this Project are
consistent with the scale and character of the building to which they are
attached or otherwise associated with and are consistent with the Grand
Terrace Municipal Code. A monument sign exist on the property, and only
a change of copy will be necessary.
g. Conditions of approval for this Project necessary to secure the purposes of
the Grand Terrace Municipal Code and General Plan have been applied to
the Project.
BE IT FURTHER RESOLVED that Minor Deviation and Site and Architectural Review
area hereby approved subject to the following conditions:
1. Site and Architectural Review 13-02 and Minor Deviation 13-02 are approved to
operate a health care clinic within two existing buildings totaling 36,783 square
feet on an improved 5-acre site with a 162 space parking lot. Building #1
measures 22,250 square feet and will house out-patient medical, nursing, dental,
optical, lab, pharmacy, behavioral and public health nursing services; and
Building #2 is 14,533 square feet in area and will house administrative functions.
,— 2. This approval shall expire twelve (12) months from the date of adoption of this
resolution unless the use has been inaugurated or a time extension has been
granted by the City, in accordance with Chapter 18.63 of the Zoning Code. Time
extensions shall be filed at least sixty (60) days prior to the expiration date.
3. The applicant shall defend, indemnify, and hold harmless the City of Grand
Terrace and its officers, employees, and agents. from and against any claim,
action, or proceeding against the City of Grand Terrace, its officers, employees,
or agents to attack, set aside, void, or annul any approval or condition of approval
of the City of Grand Terrace concerning this project, including but not limited to
any approval or condition of approval of the Planning Commission, or Community
and Economic Development Director. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and the City
shall cooperate fully in the defense of the matter. The City reserves the right, at
its own option, to choose its own attorney to represent the City, its officers,
employees, and agents in the defense of the matter.
4. Upon approval of these conditions and prior to becoming final and binding, the
applicant 'must sign and return an "Acceptance of Conditions" form., The form
and content shall be prepared by the Community Development Department.
5. Prior to issuance of a building permit, the applicant shall submit tenant
improvement plans to the Grand Terrace Community Development Department,
Riverside Highland Water Company, and San Bernardino County Fire

Department for review and approval, and obtain all requisite clearances from
each agency prior to any alterations to and occupancy of any structure.
6. The applicant shall file a Lot Merger with the Community Development
Department, which shall be approved and recorded with the San Bernardino
Recorder's Office prior to issuance of a certificate of occupancy for any structure
on the property.
7. The applicant shall obtain a sign permit prior to changing the sign on the existing
freestanding monument sign.
8. Exterior repairs and patch work shall match the existing color and materials.
9. The applicant shall comply with all applicable provisions of the City's Municipal
Code, including, but not limited to, the Noise Ordinance.
10. If at any time the City determines that additional parking spaces are needed to
support on site uses, the applicant shall submit the necessary plans and permits
for the construction of 22 additional parking spaces, and construct the parking
spaces within 90 days of approval of the construction plans.
