1992-01 - RESOLUTION NO. 92-01 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, CALIFORNIA APPROVING V-92-02, USE EXISTING TEMPERATURE AND TIME POLE SIGN AS MONUMENT SIGN WITH BUSINESS IDENTIFICATION WHEREAS, the Applicant, Mr. Joe Kohorst (Mr. T.V. Video), has applied for approval of V-92-02, which is a proposed variance from the Barton Road Specific Plan Sign Guidelines in relation to monument sign requirements of 6 feet in height, sign content and allowable sign area; (see Exhibit A) allowing 16 foot height pole sign to serve as monument sign, change to sign content, and allowing use of existing sign structure; and WHEREAS, a properly noticed public hearing was held by the Planning Commission on November 5, 1992, regarding an application for a variance, V-92-02; and WHEREAS, it was determined that the time and temperature pole sign provides a community benefit and has a historical significance to the City of Grand Terrace and it is recommended to be maintained, thus creating a hardship for the applicant. WHEREAS, this project is a Class 1g of Chapter 15301 categorically exemption per the California Environmental Quality Act. NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City of Grand Terrace, California, that the following findings are hereby made: 1. Is the subject property deprived of privileges enjoyed by other properties in the vicinity and under identical zoning classification due to special circumstances applicable to the subject property, including size, shape, topography, location or surroundings? 2. Is the proposed variance consistent with the latest adopted General Plan? Yes, the property has a general plan designation of General Commercial and has sign guidelines per the Barton Road Specific Plan. The proposed variance for the sign height, type of monument sign, design and height of sign, content of sign is in conformance with the designation per the review process by the Planning Commissin for any signs that do not strictly adhere to the code. =; 3. Does the proposed variance allow any land use or activity which is not in `d 1 conformity with the regulations specified for the district in which the subject property is located? No, signage allowing business identification and monument signage is allowed and encouraged within the confines of the Barton Road Specific Plan Guidelines and Zoning Code. Any signage variations from these guidelines may be allowed or reviewed in closer scrutiny by the Planning Commission. This will not allow any land use or activity which is not in conformity with the City Code regulations. 4. Will the proposed variance constitute a grant of specific privileges inconsistent with the limitations upon their properties in the vicinity and under identical zone classification? No, the.limitations or hardship faced by this property owner are not shared by surrounding property owners. The City and community have considered this time and temperature pole sign as a historical landmark as recently considered by the Historical Committee,refer to Attachment C. Additionally, the applicant has indicated in his letter to the Planning Commission, Attachment B, that citizens have repeatedly requested from him to continue the operation of the time and temperature sign. 5. Will the proposed variance have a detrimental effect on the health,safety and welfare of the surrounding neighborhood and/or general public? No, due to the pole sign and tenant business identification being there for many years previously this variance would not alter any physical aspect of the pole sign other than the tenant identification portion to Mr. T.V. Video. Therefore, there would be no detrimental effect on the health, safety or welfare of the surrounding neighborhood and/or general public. During the last City Council meeting on current sign inventory, this pole sign was reviewed from the prospect of being a historical landmark. A determination was not made by City Council however, the option to continue checking the feasibility of such a consideration was not left out and.was left up to the Planning Director. The Historical Committee in their letter refers to it along with the barber pole sign as historical landmarks in the community. It can be established that the temperature and time sign provides a community service which will not create a precedence. It is the only sign of its type in our city and is at the focal point of our city which is easily identifiable at the four comers of two main streets in our city. 6. Will conditions necessary to secure the purposes of the Grand Terrace Municipal Code, including guarantees and evidence of compliance with conditions be made a part of the variance approval? The only allowable portion to be used for signage will be within the 3.5' x 9' four sections facing north, south, east and west, above the time and temperature section. Sign letters shall not cover more than 75% of sign panel area, or 24 square feet. 2. The signage background shall not be less than 85% opaque. Dark red background shall be used for signage background. Business Identification Sign shall be constructed and maintained in accordance with this variance approval. 3. Appropriate building and electrical permits shall be pulled for the construction of the business identification sign and time/temperature sign. 4. Landscaping at the base of the pole sign shall be irrigated and maintained. 5. The time and temperature portion of the structure shall operate accurately, consistently, and regularly otherwise this variance will be null and void. This variance is recommended for approval for the sole purpose to keep a historical landmark which offers a service to the Community. In case the clock operating ceases the sign structure must be brought into conformance with the Barton Road Specific Plan sign regulations. 6. This variance is applicable to other possible tenants provided a sign permit is applied for. 7. Sign structure must be kept in a maintained fashion by regular cleaning and painting.
