1996-02 RESOLUTION NO. 96-02 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, CALIFORNIA APPROVING CUP- 95-05-RI and SA-96-02, CONDITIONAL USE PERMIT REVISION AND SITE AND architectural REVIEW WITH ADDENDUM TO PREVIOUSLY ADOPTED NEGATIVE DECLARATION FOR CHURCH OFFICES, CLASSROOMS/MEETING ROOMS, AND ACTIVITY CENTER IN THE R1-7.2 ZONE DISTRICT WHEREAS, the applicants, CHRIST THE REDEEMER CATHOLIC CHURCH, applied for a Conditional Use Permit, Site and Architectural Review, and Environmental Evaluation to construct church offices, classrooms\meeting rooms, and activity center in the R1-7.2 Zone District; and WHEREAS, the City of Grand Terrace Zoning Code, Chapter 18.10.030 - Use Regulation, establishes that churches and schools are a permitted use in any R1 District subject to the approval of a Conditional Use Permit; and WHEREAS, the City of Grand Terrace Zoning Code, Chapter 18.63.010 - Site and Architectural Review III, establishes that all major projects to receive full review from the r Site and Architectural Review Board through a public hearing of design criteria standards; and WHEREAS, this project requires a Negative Declaration under the California Environmental Quality Act and is attached as Exhibit 1; and WHEREAS, a properly noticed negative declaration has been prepared for this project; and WHEREAS, the Planning Commission approved a Negative Declaration during the first approval of the project at their December 7, 1995 meeting; and WHEREAS, the California Environmental Quality Act Section 15164 (1995 CEQA Amendment) permits an addendum to an adopted Negative Declaration if only minor technical changes or additions are necessary; and WHEREAS, an Addendum to the adopted Negative Declaration is attached to the initial study and attached to Exhibit 1; and WHEREAS, a properly noticed public hearing was held by the Planning Commission on April 4, 1996, to hear this application; and WHEREAS, the Planning Commission approved CUP-95-05-R1 and SA-96-02; and - NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Grand Terrace that the following findings have been made in accordance with the approval of CUP-95-05-RI (and related cases SA-96-02): 1. The proposed use will not be detrimental to the general health, safety, morals comfort or general welfare of the persons residing or working in the neighborhood of the proposed use or within the City. As conditioned the project will not have any significant negative impact on the environment, nor on the health, welfare, and safety of the surrounding single family residential area or within the City. 2. The proposed use will not be injurious to any physical property or improvement in the neighborhood or within the City. As conditioned below the project should not have a detrimental or injurious effect on any physical property or improvements in the surrounding neighborhood or within the City. It does not involve hazardous materials nor will it create or expose people to potential health hazards. This project is a pleasing and appealing addition to the surrounding properties. 3. The proposed use is consistent with the latest adopted General Plan. The current General Plan designates the land use as Low-Density Residential. _ This proposed`project meets the R1-7.2 Zone District minimum development standards per the Grand Terrace Zoning Ordinance and is consistent with the General Plan Land Use. BE IT FURTHER RESOLVED, that the proposed project is subject to the following conditions of approval: 1. The project shall be constructed in accordance with Site and Architecture design as approved by the Site and Architectural Review Board on April 4, 1996. All plans shall be consistent in terms of property lines, easements locations and dimensions, and other measurements. Minor changes or clarifications may be approved by the Community Development Department. All building materials to match submitted materials board, and as approved by the Site and Architectural Review Board. 2. Compliance with all recommendations listed in the Building and Safety/Public Works memorandum to the City dated March 13, 1996 (Attachment-A). 3. Compliance with all recommendations listed in the California Department of Forestry and Fire Protection memorandum to the City dated October 19, 1995 (Attachment-B). �- 4. Compliance with all recommendations listed in the Riverside Highland Water Company Letter dated October 24, 1995 (Attachment Q. 5. Compliance with all special conditions associated with Use Permit 82-1 approved on September 13, 1982 (Attachment D). 6. Any significant expansion or changes of use shall be reviewed by the appropriate City agencies. Additional permits or amendments to the Site and Architectural Review/Conditional Use Permit may be necessary. 7. Applicant shall provide a landscape and irrigation plan for Community Development Department and Building and Safety approval prior to issuance of any building permits. 8. A revised grading and drainage plan shall be submitted to the Community Development Department along with hydrology report and any other information required by the City Engineer and Building Official. Grading shall fully address Planning Commission concerns regarding drainage,protection of buildings,and elimination of future building pad from southwest corner. Revised grading plan shall be approved by City Engineer, Building and Safety and Community Development prior to issuance of any building permits. 9. Per Trip Reduction Ordinance Number 147-Code Section 16.04.040(B)(1),the applicant shall install four(4)bike racks near the classroom/meeting room and Activity Center building. 10. Applicant shall provide a lighting plan for Community Development Department and Building and Safety approval prior to issuance of any building permits(around proposed building and parking lot). 11. In the event adopted narking agreement approved by the Community Development Department and Planning Commission is not maintained,or off-site parking takes place as overflow,the applicant shall install additional off-street parking spaces per City standards. 12. All aspects of the proposed project including the building and landscaping/irrigation shall be maintained in a clean and functional manner in accordance with this approval and the overall goals and objectives of the City of Grand Terrace. 13. Upon project approval and prior to any issuance of building permits,these conditions shall be recognized and approved by the Roman Catholic Bishop of San Bernardino Diocese. 14. Upon approval of these conditions and prior to becoming final and binding the applicant must sign an"Acceptance of Conditions"letter. Letter form and content -- to be prepared by Community Development Department. 15. Remove building pad from the grading plan located on the south west portion of the subject property. No other building pads not associated with the Classroom/Meeting room and Activity Center building shall be graded on the subject property. All other structures require separate approval. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, HEREBY APPROVES SA-96-02 and CUP-95-05-R1, BASED ON THE ABOVE FINDINGS. PASSED AND ADOPTED by the Planning Commission of the City of Grand Terrace California at a regular meeting held on the 4th day of April, 1996 by the following vote: AYES: Chairperson Sims, Vice-Chair Wilson, Commissioners Munson, NOES: Van Gelder, Huss, Addington and Garcia.
