RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND
TERRACE, STATE OF CALIFORNIA,APPROVING CONDITIONAL USE PERMIT CASE
NO. 98-04 AND ENVIRONMENTAL REVIEW CASE NO. 98-10
WHEREAS, the applicant, American Modular, has applied for the approval of
Conditional Use Permit Case No. 98-04 and Environmental Review Case No. 98-10 to
expand an existing manufauturing use to increase the production of manufactured mobile
modular structures including portable classrooms and office trailers and to have new hours
of operation from 6:00 a.m. to 7:00 p.m.; and
WHEREAS, a properly noticed public hearing was held by the Planning Commission
on July 15, 1999 and September 16, 1999; and
WHEREAS, under the California Environmental Quality Act (CEQA) Article 19,
Section 15002 this project qualifies for a Negative Declaration in that there is no substantial
evidence that the project will have a significant impact on the environment; and
NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF
THE CITY OF GRAND TERRACE, STATE OF CALIFORNIA, AS FOLLOWS:
1. That the proposed project is consistent with the intent of the Grand Terrace
Municipal Code and the General Plan.
2. That the proposed use as a manufacturing facility of manufactured mobile
modular structures including portable classrooms and office trailers will not
be:
` 1) Detrimental to.the health, safety, morals, comfort or general
welfare of the persons residing or working within the
neighborhood of the proposed amendment or within the city.
2) . Injurious to property or improvements in the neighborhood or
within the city.
3. That the conditions of approval for this project necessary to secure the
purposes of the Grand Terrace Municipal Code and General Plan are made
a part of this approval.
4. That if this project is not conditioned, it will have a major negative impact on
the development standards of this community.
BE IT FURTHER RESOLVED that CUP-98-04 is hereby approved subject to the
following conditions:

1. The proposed project shall be maintained in conformance with the plans and
drawings submitted to the Community and Economic Development
Department and approved by the Planning Commission as Exhibit 1. All
plans shall be consistent in terms of property lines and other measurements.
Minor changes or clarifications may be made by the Community and
Economic Development Director.
2. All storage of cartons, containers and trash shall be shielded from view within
a building or within an area enclosed by a wall not less than six feet in height.
3. One (1) parking space for every five hundred (500) square feet of gross floor
area devoted to manufacturing use; and one (1) parking space for every two
hundred (200) square feet of gross floor area devoted to office use shall be
provided on the site. For the proposed use a total of 55 parking spaces are
required.
4. All other provisions of Chapter 18.60 of the City's Zoning Code relative to off-
street parking shall apply including the requirement that all parking areas
shall be appropriately surfaced and maintained and that a minimum of 5%
of the parking area shall be landscaped.
5. No employee parking shall be permitted along the private street known as
Hunt Road.
6. Any new signs proposed on the subject site shall comply with the provisions
of Chapter 18.80 of the Zoning Code for signs including the requirement for
�— a sign permit.
7. In the event roof top mechanical equipment is necessary, it shall be located
at a distance from the edge of the building or shielded by means of a lattice
or similar material or parapet so as not to be visible from the pedestrian level
and adjacent road ways.
8. The parking areas on site shall be lighted in accordance with Section
18.60.040 of the Zoning Code. These provisions require the following:
1) Lighting shall be designed to reflect away from residential
districts and public roadways.
2) Light standards shall not exceed eighteen feet in height
measured from the finished grade of the parking surface.
3) No lighting shall create illumination on an adjacent property
which exceeds five (5) foot candles (measured at ground
level).
9. All night lighting on the site shall be shielded away from the residential uses
which are on the south side of Main Street.

10. All conditions as recommended by the Forestry and Fire Warden Department
in their Memorandum dated October 21, 1998 shall be met.
11. All conditions as recommended by the City's Department of Housing and
Building in its Memorandum dated October 22, 1998 shall be met.
12. Three sets of landscaping plans for any areas to be landscaped shall be
submitted to the Community and Economic Development Department for any
new or remodeled, reconstructed areas to be landscaped. Said plans shall
the type, size and number of plants, together with irrigation facilities, and
shall be approved prior to the issuance of an occupancy permit for any
expansion area.
13. All landscaping on the site shall be maintained in a neat and healthy manner
to the satisfaction of the Community and Economic Development
Department;
14. The subject site shall be enclosed with walls and/or fencing to be approved
by the Community and Economic Development Director.
15. The entire site shall. be surfaced and striped in accordance with approved
parking locations, fire lanes and access ways as determined by the
Community and Economic Development Department, unless otherwise
approved by the Planning Commission.
16. All conditions for improvements shall be completed prior to the issuance of
occupancy of the expansion areas allowed by this approval.
17. Hours of operation shall be limited to between 6:00 a.m. to 7:00 p.m,
Monday through Saturday with no Sunday operation, provided the operation
is in compliance with the City's noise ordinance.
18. Receipt of a "will serve" letter from the City of Colton for water supply to this
property within 3 months of the effective date of this approval.
19. Submittal of plans and installation of a fire hydrant on the subject property
with the City of Colton's approval within 3 months of the effective date of this
request.
20. The proper connection of 21516 Main Street (American Modular property) to
the public waste system with submittal of plans and applicable fees to the
City of Grand Terrace within 6 months from the effective date of this
approval.
21. No storage of modular units, trailers, or vehicles shall be stored outside of
the subject site unless a separate application for a use permit is filed and
approved or the subject site is consolidated with the site in question prior to
the issuance of an occupancy permit.

22. The applicant shall provide relevant information to the San Bernardino
County Department of Environmental Health Services to determine if an
acoustical study is required. This shall be done within 60 days of the
approval of this request. If the County Health Department of Environmental
Health Services waives the requirement for an acoustical study, then no
acoustical study shall be required unless two or more complaints from
nearby residents are received by the City of Grand Terrace within a six
month period of each other regarding noise from the activities of American
Modular. In addition, the applicant shall be required to inform by letter all
trucking companies hauling modular units to or from the subject site that no
such deliveries or pick-ups shall be allowed between the hours of 6:00 p.m.
in the evening and 7:00 a.m. in the morning.
23. All requirements as recommended by the City of Grand Terrace Fire
Department in its Memorandum dated October 21, 1998 shall be met
including "adequate access be made available on the east side along the
tracks."
24. Payment of a Traffic Mitigation Fee whenever the fee is installed by the City
of Grand Terrace in proportion to the amount of trips generated by this
development, approximately but not to exceed $10,000.
25. A parcel map must be submitted to make the subject site legal and must be
filed within 6 months of the effective date of this approval.
26. Submittal of a grading and drainage plan for the parking areas prior to the
issuance of a certificate of occupancy for the easterly portion of the
manufacturing building.
27. Replanting and rehabilitation of the landscaping between the modular office
and Hunt Road. Said landscaping to be shown on the landscaping plan
required by Condition No. 12 above.
28. Eliminate existing barbed wire fencing on the perimeter of the subject site
and substitute with some other material in conformance with Condition No.
14 above.
29. Add screening to the fencing along the easterly boundary of the subject site
to the satisfaction of the Community and Economic Development
Department so as to screen the interior of the site from the public view on
Main Street.
30. Upon approval of these conditions and prior to becoming final and binding
the applicant must sign an "Acceptance of Conditions" letter. The letter form
and content to be prepared by the Community and Economic Development
Department.
31. That all improvements for fire protection purposes called for by the approved
"water plan" including an on-site fire hydrant(s) be installed within 60 days of

the approval of this request.
32. The applicant shall comply with all conditions of this approval within one year
of the date of approval excepting where an earlier compliance date is
stipulated by an individual condition of approval.
33. This grant shall not become effective until such time as the applicant
provides an "irrevocable letter of credit" to the City of Grand Terrace in the
amount of$ 84,000 to cover the costs of the installation of the improvements
for fire protection purposes called for by the "water plan" in the event that
said improvements are not installed by the applicant or as an alternative, the
applicant may provide a "certificate of deposit" (C.D.) payable to the City of
Grand Terrace in the amount of 50% of the value of the cost of the said
improvements.
