Department STAFF.REPORT CRA ITEM (X ) COUNCIL ITEM (X ) MEETING DATE: FEBRUARY 10, 2000 FUNDING REQUIRED NO FUNDING REQUIRED X SUBJECT: NEW ERN FOR TOWN SQUARE PROJECT RECOMMENDATION: APPROVAL This report brings to the City Council a request for approval of a new exclusive right to negotiate (ERN) for the Town Square Project. While Lisa Hjulberg will remain as a project manager/partner, the ERN is being requested by Inland Pacific Advisors Inc. (IPA). IPA is a full service real estate advisory and management firm with significant experience in brokerage and tenant representation services, asset management, property management and leasing, financial investment services, and planning development and construction management. - The proposed ERN is for 90 days rather than 180 as the previous one, with a similar clause for automatic renewal per certain circumstances for an additional 90 days. IPA believes they will be able to ascertain project feasibility within the 90 day period and will be submitting a cost estimate for this effort. They plan to ask for the Agency's financial assistance in this first phase of determining the project viability. Please refer to the letter and draft ERN in Attachment A. Staff is in support of this request and we are looking forward to working with IPA and Ms. Hjulberg to develop a good site plan and elevations. A schedule of performance and project pro formas that will meet the General Plan Task Force recommendations and be feasible to attract a movie theater tenant. Stoutenborough Architects and Planners are being considered however no firms have beer' named in the ERN as a team. INLA ACIFIC AD RS, INC B ce omas Vice President Attachment "A" AGREEMENT CONCERNING EXCLUSIVE RIGHT TO NEGOTIATE COMMUNITY REDEVELOPMENT AGENCY OF THE CITY OF GRAND TERRACE TOWN SQUARE PROJECT 1.0 PARTIES AND DATE This Agreement is made on this 27th day of January, 2000 (the "Effective Date"), by and between the Community Redevelopment Agency of the City of Grand Terrace, a public agency, created and authorized to transact business pursuant to the California Health and Safety Code ("Agency'), and Inland Pacific Advisors, Inc., a California corporation, or permitted assignee ("Developer'). 2.0 RECITALS 2.1 The Project. In furtherance of the objectives of the Community Redevelopment Law, Agency has formed a redevelopment'project area in order to undertake the clearance, reconstruction, development and rehabilitation of blighted areas in the City of Grand Terrace (the "Project Area"). Pursuant to the Redevelopment Plan for the Project Area, Agency desires to carry out a mixed-use redevelopment project known as the "Town Square Project." 2.2 Developer's Proposal. Developer desires to purchase and develop and/or redevelop certain real property located within the Project Area in accordance with the Redevelopment Plan for the Project Area. The subject property is depicted on the map attached hereto as Exhibit A (the "Property"). Developer desires to negotiate a contract with Agency (either a "Disposition and Development Agreement" or an Owner Participation Agreement," hereinafter collectively referred to as "DDA") concerning Agency's possible provision of assistance to the Developer. This assistance may include, without limitation or guarantee, a land write-down, marketing assistance, down payment assistance, rent guarantees, off-site improvements, and/or fast-tracking of plans and permits. 3.0 TERMS 3.1 Negotiation 3.1.1 Good Faith Negotiations. Agency and Developer agree, for the period set forth below, to negotiate in good faith the terms and conditions of a DDA for consideration by Agency and Developer concerning the Property. The term "negotiate" as used herein shall preclude Agency from seeking, considering or accepting development proposals from persons or entities other than Developer, or discussing with other developers or investors plans for the Project (defined below) which might be acceptable to Agency. However, Agency shall not be precluded from furnishing to other persons or entities unrelated to Developer information in the possession of Agency relating to the Redevelopment Plan for the Project Area, the implementation of which will be within Agency's purview to administer. Agency may also furnish any other information which (IPA.ERN) Page 1 of 5 EXCLUSIVE RIGHT TO NEGOTIATE TOWN SQUARE PROJECT Initials frL it would normally furnish to persons requesting information from Agency concerning its activities,-goals and matters of a similar nature. 3.1.2 Negotiation Period. Agency and Developer hereby establish a negotiating. period ("Negotiation Period") beginning on the Effective Date of this Agreement, and continuing to and including ninety (90) days from that date. If, .at the expiration of the Negotiation Period, Developer has not signed and submitted to Agency a DDA which is acceptable to Agency staff and ready for submission to Agency's governing board for final approval, then this Agreement will terminate unless the Negotiation Period is further extended by mutual agreement of the parties. If the DDA is submitted less than thirty (30) days prior to the end of the Negotiation Period, the Negotiation Period will automatically be extended for ninety (90) days from the date of submittal to enable Agency to take actions necessary to review and consider the DDA and, if approved, to, execute same. If, following Developer's submittal of the DDA, Agency decides not to approve the agreement or Agency makes a good faith determination that further negotiations will not lead to a DDA which Agency will approve, this Agreement will automatically terminate without penalty to either party. 3.1.3 Termination Prior tc Expiration of Negotiation Period. Upon completion and review of the development plan and project proformas required under Section 3.4.2 of this Agreement, Agency and Developer shall have the right to terminate this Agreement if, based upon the information set forth in those plans and documents, the parties believe in good faith' that further negotiation will not lead to a DDA which either of the parties will approve. 3.2 Consideration. Any proposed assistance or consideration to be rendered by Agency and Developer under the DDA will be established by Agency and Developer as a result of negotiations during the Negotiation Period. Such consideration will be based upon, but not necessarily limited to, such factors as market conditions, density of development,-costs"bf` development, risks of development, estimated or actual profits, and the fair market value of the uses permitted to be developed. 3.3 Method of Financing. Upon request, Developer will make available and provide full disclosure to Agency of the methods of financing to be used in the development of the Project (defined below). Any such requests for information shall be in writing, must be reasonable, and shall take into consideration the progress made to date in the negotiations. Developer shall answer all such requests for financing information to the full extent said information is available. a Agency acknowledges that Developer is a private entity, and agrees to keep confidential any and all financial information submitted by Developer pursuant to this Agreement, subject to Agency's need to disclose such information under applicable public disclosure laws. Agency further agrees to refrain from releasing information provided by Developer pursuant to this Agreement unless Agency's legal counsel determines, after consultation with Developer's legal counsel, that the release of the information is required by: the Califomia Public Records Act or other applicable statutes or laws, or a court orders such release. In the event Agency determines hereunder it is required to disclose or release any (tPA.Ewr) Page 2 of 5 EXCLUSIVE RIGHT TO NEGOTIATE TOWN SQUARE PROJECT Initials `b such information during the term of this Agreement, Agency shall notify Developer of its decision to release such information. 3.4. Proposed Development 3.4.1 Scope of Development. The proposed development (the "Project") will provide housing for senior citizens, including subsidized units to meet State housing requirements for the provision of very low-, low- and moderate-income housing, and a mixed- use retail/commercial center, including the provision of a central public space. r� 3.4.2 Concept of Development. A comprehensive development plan for the - Project, including basic concept drawings and financial proformas, will be prepared by Developer during the Negotiation Period and submitted to Agency within sixty (60) days from the Effective Date of this Agreement. Any and all such plans, drawings and proforma documents shall be owned and controlled by, and proprietary to, Developer and shall be returned to Developer, together with all copies thereof, upon request. Such development plan will contain or address the residential, retail/commercial, public use, and parking aspects of the Project, conceptual renderings, and number of units and approximate square footage in each use category. The development plan, concept drawings, and proformas shall be subject to preliminary review and comment by Agency staff, which may require that additional information be provided or that adjustments to the plan, drawings and/or proformas be made. Developer shall promptly respond to all such requests for additional information. 3.4.3 Preparation of DDA. Developer shall be responsible for preparation of all draft and final Disposition and Development Agreements DDAs, which are subject to the review and approval of Agency. 3.4.4 Studies and Reports. Developer agrees to report on the status of the performance of its obligations hereunder and to provide copies of all studies being made hereunder by or for Developer. 3.4.5 Cooperation and Additional Information. Developer shall generally cooperate with Agency and supply all other documents and information as may be reasonably requested by Agency. 3.5 Agency Responsibilities 3.5.1 Assistance and Cooperation. Agency shall cooperate to the extent legally permissible in providing Developer with appropriate information and assistance on all relevant matters. 3.5.2 Public Hearing. If negotiations culminate in a DDA signed by Developer, such DDA will become effective only if and after it has been considered and approved by Agency's governing board at a public meeting in accordance with California law. 3.5.3 Supplemental Information. Agency reserves the right at any time to make reasonable requests for additional information and data from Developer, and Agency (WkERN) Page 3 of 5 EXCLUSIVE RIGHT TO NEGOTIATE TOWN SQUARE PROJECT Initials specifically reserves the right to obtain further information, data and commitments to ascertain the ability and capacity of Developer to develop the Property expeditiously. 4.0 GENERAL PROVISIONS 4.1 Hold Harmless. Each party hereto ("Indemnifying Party") shall indemnify, defend, protect and hold the other party ("Indemnified Party") harmless from and against any loss, liability, claim, damage or expense (including reasonable attorney fees and costs) suffered or incurred by.the Indemnified Party to the extent arising out of any loss, damage, injury or death resulting from or in connection with the Indemnifying Party's activities upon the Property and/or performance under this Agreement. 4.2 Attorney Fees. In the event either party shall bring legal action to enforce or interpret the terms of this Agreement, the prevailing party shall be entitled to receive reasonable attorney fees and costs. 4.3 California Law. This Agreement.shall be interpreted pursuant to the laws of the State of California. 4.4 Severability. In the event that any of the provisions of this Agreement shall be held by a court or other tribunal of competent jurisdiction to be illegal, invalid or unenforceable, such provisions shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect. 4.5 Integration. This Agreement supersedes all prior discussions and writings and l J, constitutes the entire agreement between the parties regarding the subject matter hereof. 4.6 Waiver and Modification. No waiver or modification of this Agreement will be binding upon either party unless made in writing and signed by a duly authorized representative of each party. 4.7 Authority of Signatories. Each person signing this Agreement on behalf of a party hereby represents and warrants that he or she has full authority on behalf of such party to do so, and that this Agreement is binding upon said party. 4.8 Interpretation. The captions or paragraph headings of this Agreement are for the convenience of the parties. To the extent the captions or paragraph headings are in conflict with the terms of this Agreement, the terms of this Agreement shall control. 4.9 Not to be Construed Against Drafter. The parties hereby agree that the terms of this Agreement are the product of their mutual negotiations, and any ambiguity in the terms of this Agreement is not to be construed against the party deemed to be the drafter of the Agreement. 4.10 Assignment. Neither party may assign, encumber or otherwise transfer any right or interest under this Agreement without the written consent of the other party, which consent shall not be unreasonably withheld. GTB: 99-07- CIVIC CENTER RESTORATION AND WEATHERPROOFING PROJECT. FUNDING REQUIRED DISCUSSION: In October 1999, the Redevelopment Agency authorized the bid of the Civic Center Restoration and Weatherproofing Project. In total, the project includes the removal and replacement of masonry wall areas in the North-Westerly portion of the Civic Center structure. Throughout the course of the bidding of the project, the Project Manager's WLC Architects extended the bid of the project via addenda to address various questions and issues which arose during the bidding period. Additionally, the City also proceeded with the purchase of masonry brick blocks to allow the process to be expedited once a contract is awarded. On February 1, 2000, bids were opened in the City Clerk's Office as follows: 1. ASR Constructors, Inc. $147,167.00 2. Krest Group Inc. $228,740.00 Attached to this report is an evaluation and recommendation from WLC recommending that the Redevelopment Agency award GTB: 99-07 to ASR Constructors Inc. in the amount of $147,167.00. WLC has qualified the bid and ASR has indicated they are ready to proceed with the project. Staff is recommending a budget and appropriation in the amount of$201,994.00. Council Reports Mayor Pro Tem Buchanan, stated that the Library gave each Council Member a calendar. He reported that at the Plans and Programs Committee meeting for SANBAG he was selected to Chair the committee. Councilmember Garcia, reported that she and City Manager Schwab attended the East Valley Coalition meeting which was very informative. The Inland Empire Division of the League held their meeting where it was stated that Cities need to be better about letting the League know about legislative actions. She expressed her desire to keep the quality of Grand Terrace good and to raise the spirit of.volunteerism throughout the community. Councihnember Hilkey, thanked everyone for the cards and well wishes with the passing of his father. Councilmember Larkin, believes that there is a strong volunteer effort within the community. He indicated that more and more, people are turning to government for the answers and that they should be turning to each other to make things happen. He reported that he attended the League of California Cities Inland Empire Division meeting and commended Councilmember Garcia on the meeting. He stated that he is a member of the Board of Directors for Riverside Highland Water Company and feels that the joint billing- is going well and has been beneficial. Community Development Block Grant Program: Public Hearing Assistant Citv Manager Donlevy, indicated that representatives from the County of San Bernardino are at the meeting to receive input on the prioritization of needs for Community Development Block Grant Funds. Norm Buckner,County of San Bernardino Development Department, indicated the County Board of Supervisors holds an annual public hearing to determine the communities that*are participating in the Community Development Block Grant Program and to find out what the needs of the communities are. Typically the public hearings are held twice a year and the second part of the process is where the Board of Supervisors entertains any modifications to any proceeding, programs or adds on any programs that the different metropolitan areas would like to entertain. He stated that he is primarily here to find out what the needs of Grand Terrace are. The Senior Center has been the primary target area in the community with the exception of a few minor upgrades at the parks. Councilmember Hilkev, indicated that he understands the limitations on the CDBG funds. He stated that the Junior High is located in Grand Terrace, however, student that attend not only come from Grand Terrace but they come from South Colton, Reche Canyon and, Cooley Ranch. Their economic base is much different than the neighborhoods around the school and same thing happens to Little League by designation from the National Little League Association and questioned if this can be taken into consideration when we would like to make improvement to the joint use facilities with CDBG funds. Mr. Buckner, indicated that the low to moderate income target areas are composed by' census tracks and the last census track showed that the area that the Junior High is in is not a low to moderate income area. He stated that HUD does not take into consideration that individuals outside of the area utilize the facility. Their consideration is the area in which the school was built to serve. He indicated that he would be glad to take any proposal to HUD for consideration. Community and Economic Development Director Materassi, stated that the City has two problem areas on an economic development perspective, we are poor in businesses in the down town area and poor in jobs in the industrial area and questioned if there is a way we can get some economic development use of the funds. Mr. Buckner, responded that their office offers a multitude of different programs, however, the common ground for all of their programs is low to moderate income. Community and Economic Development Director Materassi,indicated that the commercial area has no businesses and she believes that it would be considered.a blighted area. Mr. Buckner, responded that it is not considered blight and it would not be an eligible Council Minutes January 27, 2000 Page 4 project. Mayor Pro Tem Buchanan, stated that a way the money could be spent in a qualified manner would be to have a business start up assistance program or a business incubation program where the person applying meets the HUD requirements. Assistant City Manager Donleyy, stated that the City receives approximately $37,000 of which 15% of that can be used for service type programs. The balance has to be used for Capital Improvements. - Mayor Matteson opened discussion to the public. There being none he returned discussion to Council. Assistant Ci1y Manager Donlevy, indicated that Mr.Buckner has given him questionnaires for residents to give their input and they will be available in the Community Services Department. Councilmember Hilkey, questioned if the census tracks are going to change. Mr. Buckner, stated that if there have been changes since the last census the tracks will reflect that change. UNFINISHED BUSINESS 7A. Park and Recreation Committee CC-2000-15 MOTION BY MAYOR PRO TEM BUCHANAN, to disband the Park and Recreation Committee and send out appropriate letters to the committee members. Motion dies due to the lack of a second. CC-2000-16 MOTION BY COUNCILMEMBER HILKEY, SECOND BY COUNCH MEMBER GARCIA, CARRIED 3-2 (MAYOR MATTESON AND MAYOR PRO TEM BUCHANAN VOTED NO),to leave the Park and Recreation Committee as it is currently and direct staff to revise the description of the Park and Recreation Committee's direction and goals. 7B. Signalization of the Intersection of Barton Road at Grand Terrace Road/Honey Hill Drive. CC-2000-17 MOTION BY MAYOR PRO TEM BUCHANAN, SECOND BY COUNCILMEMBER LARKIN, CARRIED 5-0,to direct staff to proceed with the implementation of the bicycle lane grant including the realignment of the intersection of Barton Road at Honey Hill Drive and Grand Terrace Road and pending the realignment that crosswalk warning signs be posted and that when the ` I Council Minutes January 27,2000 Page 5 realignment is designed and developed that staff take into consideration the future signalization of the intersection and plan for and include all the efficiencies in that process and once the realignment is being completed the issue be brought back to Council with staff recommendations for the future of that crosswalk. 7C. Craig Neustaedter, TEP, gave an overview of the technical report that was done for a Barton Road Median Improvement project from Canal Street to Mt. Vernon. Councilmember Garcia, indicated that she would like to see staff receive input from property owners that would be affected by the installation of a raised median on Barton Road from Canal Street to Mt. Vernon Avenue. Councilmember Larkin, indicated that he agrees with the concept of a median on Barton Road, however, he feels it would be pre-mature for staff to move forward with receiving input by affected property owners. He feels that it would be more appropriate to wait until a town center project is developed. Councilmember Hilkey, concurred with Councilmember Larkin and feels that it may be too restrictive. The SANBAG TIP is incorporated by SCAG into the RTIP and finally approved by the Federal Highway Administration (FHWA) and Environmental Protection Agency (EPA). In the past, SANBAG has accepted RTIP programs without a resolution of City Council responsibility. This year a standard resolution is required and is very strict in that the cities shall either have funds to cover their projects or shall not include them in the list. In previous years, SANBAG encouraged the cities to treat the RTIP process as a "wish list" of projects cities plan to ask for funds. This year the process has evolved to a list of"financially constrained" projects which shall have sure funding at the time of listing. This strict clause is the reason we have deleted all but one of our projects - the remaining project is the bicycle lane/street improvements along Main Street. This project was maintained on the RTIP list because we received a grant to implement it. Please refer to RTIP submittal to SANBAG from Craig Neustaedter dated October 29, 1999, Attachment B. Two other projects not listed in the RTIP memo and deleted during the last RTIP cycle included a potential Multi modal Transfer Station at the northeast corner of Mt. Vernon and Barton Road, and the reconstruction of the overpass on Barton Road over the I- 215 freeway. Recently, we heard that SANBAG's staff has not been able to delete those two projects due to requirements of air quality conformity findings. Those projects are no longer feasible and are not covered in our resolution. Projects listed as TCM, or Transportation Control Measures, are no longer allowed to be deleted. However, we had already requested deletion of those two projects in 22795 Barton Road • Grand Terrace, California 92313-529tftF4LSf-1--ftP-NDA ITEM NO. previous cycles. Please refer to Attachment C for Grand Terrace projects originally listed as TCMs and previously deleted from the RTIP for lack of funding source and other reasons. While SANBAG provides good technical support to cities in terms of filling out forms, providing sample ordinances and reminding us of SCAG's RTIP deadlines, there is little or no help provided to cities in terms of specific content with the exception of the °RTIP Guidelines" from SCAG. SANBAG staff is not oriented to help city staff in selecting applicable projects from their"wish list", nor orienting cities on what type projects are more likely to be funded by certain sources. Federal funds will be disbursed only if a priority project is in the RTIP. At the same time a priority project cannot be listed in the RTIP until funding has been arranged. Staff, therefore, will work closely with SANBAG to include any appropriate priority projects in future RTIP cycles. This process involves the preparation of a draft capital improvement plan (CIP) to the City Council. Should the Council be interested in previous RTIP submissions, such as 1993, 1995 and 1997 please call Pat Lunsford at the Community and Economic Development Department at 430-2247. The file is available for review. Recommendation At this time, staff recommends the City Council move to confirm the RTIP submittal done by staff last October, 1999 with amendments faxed to SANBAG on January 5, 2000, and approve the attached standard resolution, Attachment A. Secretary's Minutes: The Minutes were read and approved on motion by Ann,seconded by Judy. — Treasurer's Report:There is a balance of$122.02 in Petty Cash and$921.92 in the Budget. Colleen reported that the Birthday Party cost $165.10, which will be corrected as Judy and Ann turned in more bills. A motion was made by Ann, seconded by Pauline, to pay Judy's bill of$67.30 for balloons and helium. Historical Report:Ann reported she is investigating the Thomas house on Grand Terrace Road and Barton. She will try to find pictures and he will write an article. Dr.Bill Darwin will be interviewed and we are waiting for Mayor Matteson to write his article on early history. Birthday Party: Tony Petta gave a short history on the G.T. Market and the Weirs were presented with a plaque. Mayor Matteson spoke about Vi Gratson, our former Chairman,and a plaque was presented for her to her son-in-law and granddaughter. Judy reported that Vi was very appreciative and has the plaque on her wall at the Terrace where she now lives. Ann reported that she was very dissatisfied with the lasagna but that the ham was good except should be sliced thinner. Judy reported that she did not allow enough time for decorating. Next year,we will have much simpler decorations. A thank you will be sent to the men of the G.T.Fire Department for all their help. On the whole, everything went well. We will inform the Tiny Tots of our date next year so there will be no conflict. Art Show:Flyers:No more sewer bills so Ann will start by phone. Applications were prepared and these will be mailed out with the Chamber Newsletter. We will be sure it is on cable also. It was discussed that a separate ad-hoc committee be formed to decide how the balance could be best utilized for the balance of the year.. UNFINISHED BUSINESS: The case regarding Senior Swindles that the Committee has been addressing was further updated by Tanya CahM regarding calls being made to persons regarding insurance against problems arising from the so-called Y2K"meltdown"predicted by some unscrupulous individuals,basically requesting credit card information. How we should warn people of such scams. NEW BUSINESS: ITEM# 1 Tanya Cahill reported that the Terrace Mesa Apartments now have a new name called`Ibe Crest"apartments and that new management has been able to "clean house"evicting undesirable and problems tenants from the complex. New lighting . has been installed with new security measures. She also reported that the Highlands Apartments reported no burglaries for the month of October which has been the result of increased security. Hopefully obtaining many of the same sponsors. ITEM#3 Lewis Neeb gave an extensive report on the new class sponsored by the Sheriff s Department called the Citizen's Awareness Program. He also reported that the Citizen Patrol had completed 421 hours of volunteer time during the month of October ITEM#4 Bitsy Bernor reported that there has been nothing added to the Auto-Cad Program and requested the Committee to approve the purchase of new ink cartridges for the unit out of the Committee's budget. Bitsy Bernor made a motion that the meeting of December be canceled-as some members would be absent during the holidays.. The motion was seconded by JoAnn Johnson and it was approved The next regularly scheduled meeting would be on January 10,2000. ITEM#5 Tanya Cahill stated that nearly all law enforcement agencies were going to be on fiiIl alert during the celebration of the new millennium year. That fees for low and medium density residential be balanced and easy to adr-hinister, 2. That fees reflect the source of traffic impact of future development; and 3. That retail fees be evaluated in view of the goal to increase retail tax revenues. Proposal Staff has incorporated all City Council recommendations in the revised fee program. Three sets of fees were developed. The first set is for the commerciaUndustrial area east of 1-215, which is designated District A. These fees will cover the fair share contribution for traffic impacts throughout the City due to development of this area. Fees raised in this area would primarily cover the cost of the Commerce Way extension. The Circulation Fee Program includes five major land use categories. The second set of fees is for new development in all other parts of the City or District B. including the Barton Road Specific Plan area and residential areas. This set of fees is also based on a fair share cost allocation formula. Residential low and medium density fees are similar and easy to administer. Secondly, it is to provide for the imposition of fees for each new low density residential unit, medium density residential unit, retail commercial area, industrialfwarehouse acreage, and office professional area; said fees to be placed in a specially designated fund to be utilized for the improvements to streets as designated by the City Council in order to increase or improve the carrying capacity of such streets to solve current and proposed traffic congestion. B. Definitions. For the purpose of this chapter, the following words, terms,.; and phrases shall have the meaning given in this section: (1) 'Low Density Residential Unit' is descriptive of a dwelling unit within a residential development having a density less than 3.6 dwelling units per, acre. (2) 'Medium Density Residential Unit' is descriptive of a dwelling unit within a residential development with a density greater than or equal to 3.6 dwelling units per acre. (3) 'Retail Commercial Area' is descript8ive of a retail commercial development measured per 1,000 square feet of gross leasable area. (4) 'IndustriaUWarehouse Acreage' is descriptive of an industrial/warehouse development measured per acre. (5) 'Office Professional Area' is descriptive of an office professional development measured per 1,000 feet of gross floor area. C. Traffic Signal Improvement Fee. A traffic signal improvement fee is hereby imposed on the construction of all new low density residential units, medium density residential units, retail commercial areas, industrial/warehouse acreage, and office professional areas in accordance with the schedule of fees that may be established by the City Council by resolution. No fee shall be assessed on any City, County, State or Federal government use. F. Use of Circulation Improvement Fees. The city Council retains the right to waive or reduce fees for any new development. Fee waivers are strongly discouraged. In order to waive fees, the City Council shall make a finding that the waiver or reduction is in the short and long term economic interest of the City. I. Fee Adjustments. From time to time the City shall review the fee schedules and make adjustments, as appropriate, in consideration of changes in construction and right-of-way costs. Section 2: Adopt the respective Negative Declaration. Section 3: Effective Date - This ordinance shall be in full force and effect at 12:01 a.m. on the 315' day after its adoption. Section 4: Posting - The City Cleric shall cause this Ordinance to be posted in three (3) public places designated for such purpose by the City Council. Fees required by this chapter shall be paid upon application to the City for a building permit for any construction which adds a low density residential unit, medium density residential unit, retail commercial area, industrialfwarehouse acreage, or office professional area to any parcel of real property within the City of Grand Terrace. For the Council's.review I'm submitting the following: Table A - circulation improvements to be funded by fee program Table B - arterial intersections warranting future signalization Tables C1 through C3- signal and circulation fee analysis Table D - survey of circulation fees for selected cities in the Inland Empire Comparison of Proposed Circulation Fees with Fees from Other Ciities was able to find comparable fees for five cities in the Inland Empire, which are shown on Table D. The proposed fee for Grand Terrace shown on Table D is the combined fee for signals and circulation improvements. As indicated by the data shown on Table D, fees can vary significantly from city to city and from use to use. Factors that affect fees include the following: The cost of the improvements to be funded by the fee. The quantity and mix of new development which will be paying the fee. The quentity'of trips generated by new development versus the quantity of existing and regional trips The methodology used to calculate the fee Redlands has a broad range of fees for individuai uses. For example, the fee for retail development in Redlands varies from $ 3,406.81 to $ 11,676.04. This is because the City cf Redlands is divided into six districts: the circulation fees vary from distr'ct to district. Can the fee be based on the number of trips generated by new development? The proposed fees shown on Table C1 through L3 are based on the typical daily vehicle trip generation rates for major five !and use categories. It is recommended that new developments in the City be charged the fee on the basis of units of development such as dwelling units, Transportation Engineering and Planning, Inc. The circulation element update study indicates that improvements will be needed which cost over $ 7,675,000. This excludes the cost of certain improvements that may be required as a condition of approval on new development. According to guidelines codified in California Government Code 66000, new development can be charged for the cost of infrastructure improvements in proportion to the extent that new development causes the need for these improvements. Table A shows the fractional share of the impact for which new development can be charged for the circulation improvements that are necessary to complete the City's General Plan. A maximum of 64 % of the total cost of the circulation improvements can be charged to new development. This equals approximately $ 4,927,000. The percentage equals the portion of trips generated by new development in comparison with existing and regional trips on the City's arterial circulation system. The remaining cost of$ 2,748,000 cannot be assigned to new development. The circulation fee program is one of a limited number of options that the City can access to raise revenues to fund the completion of its circulation element. If a circu,ation fee program is not enacted, the City will need to seek out additiona' funding from Measure I, state and federal programs, or the Genera! Since that time we have utilized temporary personnel to work in this capacity. It is now time to look for someone to fill this position on a permanent basis. I This program has been in force since 1993, and duties have changed through the years. Staff has rewritten the j ob description with the inclusion that a Bachelor's Degree is required and changed the title of the position to Management Analyst. The change in title should allow us a broader range of applicants. The title of Housing Specialist might indicate to applicants that they must have experience in this program and this is not the case. We are looking for a generalist that can handle other projects assigned. We are not asking for a new salary range. We are going to use the old salary which is $2,154 to $2,918 per month. I I I I / f LIT r 'ATE Community Services Department Staff Report COUNCIL ITEM (XX) MEETING DATE: FEBRUARY 10, 2000 SUBJECT: SOLID WASTE SELF-HAUL PERMITS NO FUNDING REQUIRED DISCUSSION: The City's Franchised Solid Waste Haulter, USA Waste of California recently completed a comprehensive audit of all residential accounts within the City of Grand Terrace. As the Council is aware, solid waste service to residential units is mandatory based on the City's Integrated Waste Management Ordinance and the State Government Code which requires that residential solid waste must be hauled from residential locations a minimum of each 5 working days. The only exemptions to the mandatory service are for self haul permits which are granted by the City Council. During the USA audit, some residences were found which did not have permits to self haul and the residents have subsequently requested such. These residents were requested to contact the City to request the self haul permits. In reviewing the requests, the following criteria was used to allow the self haul permits: 4 1. Persons were unable to receive service from USA to their residence and they can demostrate that they are self hauling their waste a minimum of every 5 working days. 2. Persons owned a business where they were paying for a service. Attached as Exhibits A and B are copies of the transmittal letter and self haul agreements which outline in detail the self haul criteria. Staff has received requests from 4 residences which are qualified for the exemptions. These are attached as Exhibit C. It is the intent of Staff to annually audit these residences for compliance with the provisions of the agreements.
