2003-03 RESOLUTION NO. 03- 03 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, CALIFORNIA APPROVING FILE NO. SA-02-12/E-02-16 APPLICATIONS FOR A SITE AND ARCHITECTURE AND ENVIRONMENTAL REVIEW TO CONSTRUCT A SINGLE FAMILY RESIDENCE AT 12030 LA CADENA DR. IN THE R1-20 ZONING DISTRICT WITH AN AGRICULTURAL OVERLY. WHEREAS,the applicant,Al Aguirre and Associates on behalf of Mr.B. J. Ghuman,applied for a Site and Architectural and Environmental Review to construct a single family residence in the R1-20 Zone District with an Agricultural Overlay; and WHEREAS, a properly noticed public hearing was held by the Planning Commission on February 20, 2003; WHEREAS, under the California Environmental Quality Act(CEQA)Article 19, Section 15303, Class 3, this project qualifies for a Categorical Exemption, Class 3, which is a class of projects that have been determined by the State's Secretary for Resources not to have a significant effect on the environment and which shall,therefore,be exempt from the provisions of CEQA;and NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, STATE OF CALIFORNIA,AS FOLLOWS: The Planning Commission, after holding a public hearing and considering the proposed Site and Architectural and Environmental Review,makes the following findings: 1. The proposed project to construct one, single story single family residence is consistent with the intent of the Grand Terrace Municipal Code and the General Plan in that It meets the standards of the Zoning Code R1-20 zoning and provisions of the City's General Plan,LDR(Low-Density Residential) category. 2. The locations and configuration of all structures associated with this project are visually harmonious with this site and surrounding sites and structures,that they do not interfere with the neighbors' privacy, that they do not unnecessarily block scenic views from other structures and/or public areas, and are in scale with the townscape and natural landscape of the area. The design and appearance of the proposed single family residences will be consistent with existing residential development in the area and the City. In addition,the site will be appropriately landscaped to blend in with existing development along La Cadena. 3. The architectural design of structures,their materials, and colors are visually harmonious with surrounding development and natural landforms; are functional for the proposed project; and are consistent with the LDR category and R1-20 zoning of the Grand Terrace Municipal Code. Said materials will match existing materials and colors of the existing residences in the area along La Cadena. Planning Commission Resolution File No.SA-02-10/13-02-14 Page 2 of 4 -- 4. The plan for landscaping and open spaces provides a functional and visually pleasing setting for the structures on this site and is harmonious with the natural landscape of the area and hereby developments. The proposed landscaping of the site for the two houses will minimize any visual impacts to the surrounding area. 5. There is no indiscriminate clearing of property, destruction of trees or natural vegetation or the excessive and unsightly grading of hillsides,thus the natural beauty of the city, it's setting and natural landforms are preserved. The subject site is a residential parcel that has no natural resources. 6. The design and locations of all signs associated with this project are consistent with the scale and character of the building to which they are attached or otherwise associated with and are consistent with the Grand Terrace Municipal Code. All signs will be subject to a separate review through a required and separate sign permit. This is a single family residential project which will not require any special sign permits. 7. Conditions of approval for this project necessary to secure the purposes of the Grand Terrace Municipal Code and General Plan are made a part of this approval as set forth in the accompanying Resolution of Approval. BE IT FURTHER RESOLVED, SA-02-12 and E-02-16 hereby approved subject to the following conditions of approval: General Conditions: 1. The proposed project shall be constructed in accordance with the Site and Architectural Review design as approved by the Site and Architectural Review Board/Planning Commission on February 20, 2003. All plans will be consistent in terms of property lines, easement.location and dimensions,and other measurements. Minor changes can be reviewed and approved by the Planning Director. 2. Street address shall be posted during construction and appropriate lighted address numbers shall be installed prior to final construction. 3. Pay all applicable development fees,park fees, and school impart fees. 4. Payment of the Traffic Signal and Circulation Improvement fees as established by Ordinance No. 190 of the City of Grand Terrace prior to the issuance of building permits. 5. Appropriate dust control measures shall be integrated into grading plans. 6. Hours of construction shall be limited to 7:30am to 6:30 pm. 7. All construction debris shall be collected and placed in appropriate containers on a daily basis, and the construction site shall be maintained in a neat and orderly manner. 8. The proposed landscaping shall be shown on a landscaping/irrigation plan to be approved by the Community Development Director. Said landscaping/irrigation plan shall show plant types, numbers of plants, sizes and irrigation facilities. Three copies of the Planning Commission Resolution File No.SA-02-10/E-02-14 Page 3 of 4 landscaping/irrigation plan shall be submitted for review and approval prior to the issuance of building permits. Said plan shall include at least two street tree(24"box)taken from the approved list in Section 12.28.010 of the Municipal Code for each residence.Installation and maintenance of front yard landscaping shall occur prior to issuance of occupancy permit. 9. Garage shall only be used for non-business purpose. All business home occupancies require City approval. All parking areas and driveways on the subject site shall be surfaced and maintained with asphaltic concrete,or other permanent,impervious surfacing material so as to prevent mud, dust, loose material and other nuisances. 10. Any proposed fencing for the site shall comply with all applicable requirements and regulations of the City including the filing of a land use application and building permit, if needed. 11. All mechanical equipment shall be ground mounted and shall be screened from public view. All HVAC units shall be located in the side yard behind solid side yard fencing or in the rear yard.No roof mounted HVAC units shall be allowed. 12. Compliance with all recommendations listed in the Building and Safety/Public Works Department memorandum, dated January 6, 2003. 13. Compliance with all recommendations listed in the Engineering Department memorandum, dated December 30, 2002. 14. Compliance with all the conditions of approval listed in the letter from the County Fire Department, Office of the Fire Marshal, dated December 30, 2002. 15. The applicant will apply and submit three complete sets of plans for appropriate building permits for the residence. 16. All contractors shall acquire a valid City business license and be in compliance with all City codes. 17. Any construction activity occurring under this permit approval shall comply with the City of Grand Terrace Stormwater System Ordinance(Ordinance No. 142,Subsection 1.010, 1993) and the Santa Ana Regional Water Quality Control Board's NPDES Permit for San Bernardino County, as required under the Clean Water Act. 18. This grant shall not be deemed effective until the "Acceptance of Conditions" for Site and Architectural Review Case No. 02-10 has been signed by the applicant and returned to the City. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE,HEREBY APPROVES SA-02-10/E-02-14 BASED ON THE ABOVE FINDINGS.
