2003-06 RESOLUTION NO. 03-06 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE,CALIFORNIA APPROVING FILE NO. CUP-03-03/E-03-03 APPLICATIONS FOR A CUNDITIONAL USE PERMIT AND ENVIRONMENTAL REVIEW TO OPERATE A SALES OFFICE AND OUTDOOR DISPLAY OF MANUFACTURED HOMES IN THE CM ZONING DISTRICT. WHEREAS, the applicant, Van Taylor, applied for a Conditional Use Permit and Environmental Review to operate a sales office and outdoor display of manufactured homes in the C2 Zone District; and WHEREAS, a properly noticed public hearing was held by the Planning Commission on May 15,2003; WHEREAS, under the California Environmental Quality Act(CEQA) Article 19, Section 15303, Class 3, this project qualifies for a Categorical Exemption, Class 3, which is a class of projects that have been determined by the State's Secretary for Resources not to have a significant effect on the environment and which shall,therefore,be exempt from the provisions of CEQA;and NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, STATE OF CALIFORNIA,AS FOLLOWS: The Planning Commission, after holding a public hearing and considering the proposed Conditional Use Permit and Environmental Review, makes the following findings: 1. That The proposed use will not be detrimental to the general health, safety, morals comfort or general welfare of the persons residing or working in the neighborhood of the proposed use or within the City.As conditioned the project will not have any significant negative impact on the environment, nor on the health, welfare, and safety of the surrounding commercial area or within the City. 2. The proposed use will not be injurious to any physical property or improvement in the neighborhood or within the City. As conditioned below the project should not have a detrimental or injurious effect on any physical property or improvements in the surrounding neighborhood or within the City.All hazardous materials will be regulated and monitored so as not to create or expose people to potential health hazards. A Trust Fund account has been established to ensure the construction of street improvements. This project is a pleasing and appealing addition to the surrounding properties. 3. The proposed use is consistent with the latest adopted General Plan.The current General Plan designates the land use as General Commercial.This proposed use is permitted with a Conditional Use Permit in the General Commercial(C2)District per the Grand Terrace Zoning Ordinance which is consistent with the General Plan Land Use. Planning Commission Resolution File No.CUP-03-03/E-03-03 Page 2 of 3 BE IT FURTHER RESOLVED,that the proposed project is hereby approved subject to the following conditions of approval: CONDITIONS OF APPROVAL: The Planning Commission's approval of the above referenced project is subject to the following conditions of approval: CUP-03-03 and E-03-03 provide for the commercial operation of a business involved in the sale of manufactured homes. The sales office will be located in an existing building.To the east and south of the property is the 215 freeway. To the west and north are properties that are Zoned C2(General Commercial)and the property to the northwest is a Mobile Home Park Zoned M3 (Medium Density Residential). This use located in the General Commercial (C2) District at 12142 La Crosse Ave., Grand Terrace, CA 92313 must conform to the following: 1. This Expiration CUP expires five (5) years from the date of Planning Commission approval (Expires on May 15. 2008). If the applicant desires to continue operation of the project after expiration, the applicant shall be required to file a new application for a CUP. 2. Any significant expansion or chances of use shall be reviewed by the appropriate City agencies. Additional permits or amendments to the Conditional Use Permit may be necessary. 3. All building,whether permanent or movable shall meet all set back requirements. 4. All new improvements must be approved by the Community Development Department and Building and Safety Department. 5. All signs shall comply with the C2 Zoning Sign Ordinance. 6. Hours of operation shall not exceed 7:00 a.m. to 8:00 p.m. Monday thru Sunday 7. All aspects of the proposed project including the building and landscaping/irrigation shall be maintained in a clean and functional manner in accordance with this approval and the overall goals and objectives of the City of Grand Terrace. 8. Upon approval of these conditions and prior to becoming final and binding, the applicant must sign an, "Acceptance of Conditions" letter prepared by Community Development Department. 9. Comply with the conditions set by the County of San Bernardino, Fire Department, Community Safety Division, dated May 8, 2003. 11. Comply with the conditions set by the City Engineer, dated May 1, 2003. 12. Comply with the conditions set by the Riverside Highland Water Company, dated May 6, 2003. ' NOW,THEREFORE,THE PLANNING COMMISSION OF THE CITY OF GRAND TERRACE, HEREBY APPROVES CUP-03-03/E-03-03- BASED ON THE ABOVE FINDINGS.
