needs of persons of low and moderate income, and CDBGfunds are used by thousands
ofneighborhood based non profit organizations throughout the nation to address pressing
neighborhood and human service needs; and
RHERE4S, the Community Development Block Grant Program has had a
significant impact on our local economies through job creation and retention,physical
redevelopment and improved local tax bases; and
HWEREAS, City, USA and local governments have clearly demonstrated the
capacity to administer and cwlomize the CDBG program to identify and resolve pressing
local problems,such as affordable housing neighborhood and human services needs,job
creation and retention and physical redevelopment;

Mayor Matteson presented Lt. Ortiz and Captain Bottrell with plaques for appreciation of
outstanding service to the City of Grand Terrace.
Greg Bottrell thanked Council and Staff for their support and indicated that he enjoyed
working with the City.
Pete Ortiz indicated that he is grateful for the time that he was able to serve the City of
Grand Terrace and that he is thankful that he was able to work with a _great staff and will
take with him good memories and great friendships.

Mike O'Connell, 22596 Thrush Street, reported that Little League will have their Opening
Ceremonies on Saturday at 9.45 a.m. He thanked the Council for their sponsorship of
Little League teams. He presented a plaque to John Harper for his sponsorship of a Bocce:
team. He presented a check to the City in the amount of$3065.00 for the$5.00 surcharge
and asked Council to reconsider this fee in the next budget. He requested that the city pL
doors on the stalls in the women's restroom at Pico Park.
Greg Bottrell, introduced Rick Carr, the new Lieutenant for Grand Terrace and indicated
that Oscar Gomez will be the new Captain.
Rick Carr, indicated that he is happy to be at Central Station and is looking forward to
serving the community.

Mayor Matteson, indicated that he received a letter from a resident with regards to the
North-South Corridor and that she would like to see it go through San Timoteo Canyon.
He indicated that he received a letter from Sarah Green resigning from the Park and
Recreation Committee. He reported that opening ceremonies for Little League wii:be held
on Saturday at Pico Park.
Mayor Pro Tem Buchanan, indicated that he will be out of town and will be table to
attend the opening ceremonies for little league. He recently attended the closing
ceremonies for basketball which has a great program.
Councilmember Larkin, reported that the Riverside Highland Water Company held its
annual meeting today in the City of Grand Terrace Council Chambers. He indicated that
all property owners are stock holders in Riverside Highland Water Company and that the
Water Company is financially strong for the eighth year straight and that there won't be
a rate increase this year. He congratulated the members of the Board of Dire=rs that
were re-elected. Terrace View Elementary School gave a presentation at the meeting and
for the ninth year Riverside Highland Water Company is sponsoring them in the -dopt-a-
school program.
CoundltttembgrGMia, gave an update on the fiscal reform task force. She reported that
at the Inland Empire Division Meeting of the League of California Cities the guest speaker
Bob Pinzler introduced his company, ecitydeals, which allows cities to sell surplus
property on the internet through his web site. She indicated that she has two ideas for the
Town Square Project: 1. Bristol Farms and 2. Receive input from Seniors on what they
would like included in the Town Square Project for enjoyment.
Counciimember Hilkey, encouraged staff to utilize ecitydeals for some of our surplus
property. Omnitrans is holding a meeting on Public Transportation on Wednesday.March
29 at City Hall which includes issues on the smart shuttle residents are encouraged to
participate. He indicated that he received a FPPC Bulletin and found it very interesting.
He and City Manager Schwab attended a North-South Corridor Study that was pint on by
SANBAG, RCTC and San Bernardino transportation groups. He feels that this corridor
will have a great impact on the City and has asked that a similar presentation be made to

BACKGROUND:
On Januan 22,1998. the City of Grand Terrace entered into a Waste Disposal with the
County of San Bernardino for a 15 year term. This agreement provided for a
stabilization of tonnage rates, as well as, guaranteed capacity in the County Landfill
System.
As an addendum to the original agreement, the City and the County agreed on language
designating the preferred landfills for the disposal of our waste. The site listed on the
0 signed agreement provides only for the Colton Landfill and no others.
In our discussions leading toward the adoption of the WDA, it was clearly the intent of
the staffs from both parties that the San Timoteo landfill and an alternate site be
included in this designation to allow the City and our hauler the greatest flexibility in
dumping locations and guaranteed capacity throughout the term of the agreement.
Unfortunately as it exists now. the agreement does not provide for such.
The attached amendment adds both San Timoteo and the Mid-Valley Landfill to our
contract. as available and designated disposal facilities. No other provisions of our
WDA change as a result of this amendment. It is recommended that the City Council
adopt Amendment `O. 1.

Disposal Agreement executed between Grand Terrace and the Count-in 1998 listed only
the Colton Landfill as the designated waste facility. We agreed that it was clearly the
intent of both parties to have San Timoteo Landfill also listed so that Grand Terrace's
disposal needs would be met for the full 15 year term of the agreement. I suggest that
Mid Valley Landfill also be included so that vour cit%- has the Greatest flexibility possible_
I have attached to this letter an amendment to the Waste Disposal Agreement to add NIid
Valle' and San Timoteo Landfills to Appendix 1. «hieh lists the designated disposal
facilities. If the text of this amendment is acceptable. I would ask that you forward it to
your Council for approval. 1 have also included, for %our information,a draft of the staff
report that I will use to present this item to the Board of Supen-isors for approval. Since
you indicated that you could present this to the Council on April 13'h, I am planning on
requesting the Board's approval on April 25 h. I will need five (5)copies of the

WASTE DISPOSAL AGREEMENT
This Amendment No. 1 to the Waste Disposal Agreement entered into on
February 24, 1998 (County Contract No. 98-107) by and between the County of
San Bernardino ("County') and the City of Grand Terrace ('City') is entered into
on April 25, 2000, with the parties agreeing as follows:
1. Appendix 1 to the Waste Disposal Agreement is hereby amended to
designate, as the Designated Disposal Facility, the following County solid waste
facilities: the Colton Landfill, the Mid Valley Landfill and the San Timoteo
Landfill.
2. Except as amended in the preceding paragraph, each and every other
provision of the Waste Disposal Agreement shall remain in full force and effect.

THE LEAGUE OF CALIFORNIA CITIES AND THE
CALIFORNIA LEGISLATURE CONSIDER AND ADOPT
CERTAIN FISCAL REFORM MEASURES
WHEREAS, recent declines in federal, state and county aid to cities and major
reductions in property tax revenues have substantially undermined the stability of local
revenues; and
WHEREAS, such declines have led to service and program reductions in cities
across the State of California; and
WHEREAS, in light of uncertain funding from intergovernmental sources, as well
as uncertain property tax revenues, cities have become increasingly reliant on local sales
tax revenues, fees, and charges to fund essential services; and
WHEREAS, reliance on sales tax revenues by cities and counties may place an
undue emphasis on the sales tax potential of retail land development proposals in
comparison with other competing and desirable uses such as industrial and residential
development; and
0 WHEREAS, the League of California Cities has appointed a special task force and
charged it with formulating recommendations for addressing the major problems in the
stateflocal fiscal relationship in California, and the means to achieve greater balance and
predictability in local revenue systems and land use decision-making; and
WHEREAS, the City of Grand Terrace recognizes and supports state/local fiscal
reform efforts that are necessary to provide a stable and reliable source revenue to fund
essential services;
NOW, THEREFORE, the City Council of the City of Grand Terrace, does hereby
resolve as follows:
SECTION 1. The City of Grand Terrace hereby recommends the following
state/local fiscal reform principles be adopted by the League of California Cities and the
Califomia State Legislature:
1. Any proposed state/local fiscal reform efforts shall be undertaken gradually
so as not to upset the delicate balance of current fiscal realities.

2. Any proposed state/local fiscal reform efforts shall recognize that differences
betNeen and among cities necessarily require distinct solutions and varying
degrees of fiscal reform.
3. Any proposed state/local fiscal reform efforts shall retain existing
Constitutional protections for traditional local revenue sources including, but
not limited to, the property tax, the Bradley-Burns sales tax, the vehicle
license fee (VLF) and the VLF backfill, the existing additional .5% county-
wide sales tax authority and all other locally levied taxes.
4. Any proposed state/local fiscal reform efforts shall be prospective in nature
and only affect subsequent land use approvals. To protect cities and
projects currently being negotiated under current rules, projects receiving
building permits in the next 4 years should be counted as existing uses.

RECOMMENDATION: Unanimous Approval
In 1999 the State of California enacted AB 1475 to help fund street mprovement
projects to make routes to school safe for pedestrian and bicyclers.
Our recently awarded grant from SANBAG Article 3 for the bicycle staging areas is not
sufficient to complete the full realignment of the road and construct:cn of the sidewalk.
(Please see letter from SANBAG confirming Article 3 grant in attac-ment A:.
Staff would like the City Council to join in with Terrace View Eleme-:ary School, the
Colton Joint Unified School District, and the County Sheriff's Deparment in support of
this application. All items required are being prepared by April 17, so that Craig
Newsteadter can assemble the information and mail the grant appl:;ation prior to
deadline of April 26, 2000. The selection process will be extremely competitive, since it
is at the state level, however, we must try.

5 WHEREAS,in 1999 the state of California enacted into law Assembly Bill (AB) 1475 that
calls for Caltrans to establish and administer a"Safe Routes to School" construction program and
to use federal transportation funds for construction of bicycle,pedestrian safety,and traffic calming
projects, and
WHEREAS, AB 1475 mandates that Caltrans shall make grants available to Iocal
governmental agencies under the program based on the results of a statewide competition, and
WHEREAS,the finds available under this program are federal transportation safety funds,
the use of which trust abide by Federal Highway Administration policies,and Title 23,United States
code, and
WHEREAS,Caltrans expects to fiord S20 million worth of projects under this program per
Oyear for at least the next two years, and
WHEREAS,the funds are available to local governments which provide a requisite local
funding share for specific eligible activities as defined by the AB 1475 legislation and Caltrans,and
WHEREAS, projects eligible for funding include construction projects that improve the
safety of pedestrian and or bicycle routes to and from schools.and
WHEREAS,the City Council of the City of Grand Terrace possesses the legal authority to
nominate, finance, acquire and construct projects that are eligible for funding under the AB 1475
program-
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF GRAND TERRACE

SUBJECT: SENIOR CENTER EXPANSION PROJECT- CHANGES
APPROPRIATION REQUIRED
BACKGROUND:
As the Ciry Council is aware. the City has funded. through Community De,.elopment Block Gras.:
Funds. a S7.000 Senior Center Expansion Project. The project was awarded in December, 1999 :o
Paul W. Crabtree Construction Award in the amount of S76.134.00.
DISCUSSON:
During the course of the project. Staff and Crabtree ha%a found a number of irregularities and L«es
which are in need of address. These have resulted in a need to issue chances to the scope of the r--)ject
which include:
1. Replace a rotted sill and flocs joist between the expansion area and the existing building. The _ost
of this was S719.43.
2. Change the exterior window :rom a 4X4 wide to a 4X6 storefront window. The cost of this a_s
S701.45.
3. Install a 60 amp 240 volt sus panel to enable adequate electrical power to the expansion area.

The meeting was called to order at 7 p.m. by Chairman Pauline Grant Those present were Pauline,
Ann Petta,Hannah Laister,Judy McBride,Brenda Stanfill,Shelly Rosenkild and Colleen Edmundson_
The Minutes for February were read and approved on motion by Judy, seconded by Colleen.
The Treasurer's Report showed no change, balance same as February.
Historical Report Ann had no new report. Colleen suggested talking to Jim Harber,Kim Hathaway
and Tun Oberschmidt. Judy suggested a bit on cable for people to write an article,be interviewed,
or present pictures.
Art Show: Shelly had posters prepared for our review. Brenda will make up 50 posters to be put
around town two weeks prior to show. Ann reported that she has 23 people lined up so far.
Workshop to work on signs will be March 13'at noon.
Status of Vi Gratson: Judy reported that Vi told her she did not want to be a member. Judy made
a motion to declare position open,seconded by Hannah,all in favor. There is also a City policy that
a member may not miss 3 meetings in a row unless approved by the Committee, or they are out

the City-of Grand Terrace needs to take a new direction. One of building a tat base
for this city. This can only serve to brim back this department and committee as well as

help in whatever political way to bring thu city a Town Center. Do you realize that the nearest

Code) of the City of Grand Terrace to allow an administrati,%c
conditional use permit process to expedite design review (Z-99-02 and
E-99-11)
RECOINIEN END ATION: Adopt First Reading of the Proposed Ordinance Adding Administrath e
Conditional Use Permits to the Zoning Code and Approve the Negate e
Declaration as recommended by the Planning Commission.
Background:
There are many uvzs in the City's De%elopment Code which require the filing of a conditional use perr,-
(Cup). Cup's require an application. submittal of extensive plans and drawings, a filing fee as much
$2,000,and a public hearing before the Planning Commission with a total processing time of 2 to 3 month`
Many times the nature of the particular request would suggest that such an extensive review is not warrante=.
The proposed Ordinance will allow the Director to approve smaller. Iess potentially impacting reque_
through an administrative review which would eliminate the public hearing. Such a review would be cal'e_
an "administrative conditional use permit."
There are several sites in the City where there are existing buildings %%ith various suites and or offices
lease. Man% times we have had potential applicants who come to the front counter and are told that the-,
need a"conditional use permit'* for«hat the% want to do and that this requires a public hearing. etc. Nlar._
of these inquires inN olve the kind of uses w hich will occupy onh a very small or limited area(1,000 to 10C.-
square feet)and will not involve an% kind of activities which might ad%ersel% impact the environment. F.
example,there have been several inquires made regarding the"Park Center" buildings at 12210 Michig_~
Street. This property is zoned CNl(Commercial Manufacturing). These inquires were about locating offices
or other light impact uses in this center which presently has various uses including offices, auto accesson
stores,cabinet shop and an Italian deli.The CI NI Zone indicates that a conditional use permit is required fc-
an office use. These requests would only occupy a very limited suite or area and would not adverseh impw-.
the en%ironment or the surrounding rroperties. A"full"conditional use permit in such a situation would td
unwarranted. while an administrative review would be more appropriate.
Not all conditional use permits would be handled through an administrative review. There art
circumstances where a "full" conditional use permit should be required. As an example, a new office
building in the CN1 Zone would require a full conditional use permit review. The administrative review w;
be reserved for small, non-impacting types of conditional uses.

The proposed crdinance setting forth the regulations and procedures for an administrative conditional use
permit is very s=milar to the requirements and procedures for the"regular"of"full" conditional use permit
;Please see the attached proposed Ordinance.) The main difference is that it authorizes the Community and
Economic Development Director to approve, disapprove or modif} conditional use permit applications
administrativel%,that is,«ithout setting the matter for a public hearing if the particular application meets the
stated criteria listed below which is also included in the proposed ordinance. The criteria is as follows:
1. The use%ould ha%a to be located in an existing building,old and new.
2. The use could not exceed 2,000 square feet in size.
3. All applicable zoning regulations and standards wou;d have to be met including off-street
parking and signage,
4. All potential adverse impacts must be fully mitigated with revie%vs by appropriate agencies
such as Fire, Health, Air Quality and Sheriff to insure that this requirement can be met.
5. The proposed use must qualify for a "categorical exemption" under the California
Environmental Quality Act,orotherwise becleared bythe responsible environmental agency,
i.e., San Bernardino County Health and/or Hazardous Division.
The Planning Commission, in its discussion of the Proposed Ordinance, noted that it will provide many
benefits not on1%-to prospective applicants «ith a greatly expedited process but also to the City in general.
These benefits will include the folio%%ing:
1. Allow the Planning Commission to focus on issues that have a greater long-term impact on
the community such as General Plan issues,zoning amendment issues, and larger project
reviews; and
2. Create department efficiency by reducing the number of reports. packets, minutes, public
notices and follo%%-up procedures; and
3. Be consistent with the City's development friendI� policy; and
4. Significantly expedite development processing by streamlining the approval process for minor
projects while allowing limited staff time to concentrate on larger,more significant projects;
and
5. Aid small businesses and in the overall economic de%elopment of the City.
F:r the reasors and analysis discussed above, the PIanning Commission, follo%%ing its public hearing on
Februar% 17a`,r.commended that your bode adopt the Proposed Ordinance adding administrative conditional
use permits to he City's Zoning Code. Also included in that recommendation is the proposed Negative
Declaration«<h the en%ironmental checklist. The environmental documentation stipulates that the approval
of the Proposed Ordinance w ill not ha%e an adverse impact on the environment.
Recommendation:
The staff recommends that the City Council open the public hearing on the Proposed Ordinance, receive any
testimony and close the public hearing. Following the hearing,adopt the first reading of the ordinance adding
Administrative Conditional Use Permits to the Zoning Code and appro%a theNegativ;Declaration in that there
is no substantial evidence that the ordinance will have a significant impact on the environment.

provisions to insure that all potential adverse impacts must be fully mitigated follow :g review by

The purpose of this Chapter is to establish the Community a: Economic
Development Director's authority to issue administrative cocditional use
pe mits without setting the matter for a public hearing in order to expedite
certain minor conditional uses to both further the economic go-':of the City
a=d protect the community's health, safetyy and welfare.
Section 18.8.4.020 Definition:
A_ Administrative Conditional Use Pe.mit is the administrive review,
arroval or denial by the Community and Economic Development Director
without setting a public hearing for those uses requiring a conditional use
permit and meeting the criteria as specified by this Chapter.
Section 18.8.1.030 Application:
The Community and Economic Development Director is zuzhorized to
consider and to appro%e. disapprove or modify applications fc.any or the
uses or purposes for w-Ech such permits are required by the terms of this title
a_d meet the criteria as established by this Chapter. Such administrative
conditional use permits shall be revocable,may be subject to conditions of
approval and may be valid only for a specific period of time in case the
D:.-ector desires to set an expiration date.
Section 18.84.040 Submittal Process:
Applications for an admL—:s=tive conditional use permit shall be submitted
to the Community azi Economic Development Department. The
Community and Economic Development Director shall rep iew each
application and determi=its completeness in accordance with Strut law. In
addition. an application for a conditicrsl use permit shall corsist of the
fouo«-ing:
A. Completed application form.
B. Letter of Intent :o describe the type of business and to establish
current level of inumsity of actitii=es, i.e., traffic, hours of operation,
number of employees, noise levers, etc.
C. Site plan, ten ('•7) copies. Tl:: site plan shall be dravm at an
appropriate scale and shall be a :ally dimensioned dra«ing clearly
sho,Aing:

2. All parkL.-,spaces, driveways and drive aisles.

In granting an administrative conditional use permit, the Comm::ity and
Economic Development Director shall require that the use and development

Revisions or modifications of alministrative conditional use permits may be
reque~ed by the applicant. Further, the Community and Economic
Devekpment Director ma,- periodically review or modify an admir-:,-trative
condi-onai use permit. Such revisions or modifications shall be s_bject to

1. Revisions or hiodificatons Requested by the Applicant:
A revision or modification to an approved administrative cor_:itional
use permit such as, but no limited to, change in conditions,
expansions, intensity or hours of operation may be requeste�by the
applicant_ The requested revision or mcdi.tication shall be processed
in the same manner as the original administrative conditic,al use
-ermit as long as the rersest meets the c feria of Section 18..-4.50 of
:his Chapter.
2. Review by the Community and Economic Development Director:
The Community and Economic De,.elopment Directc. may
periodically review any adn inistrative conditional use pe:nit to
ensure that it is being crerated in a manner consistent with the
conditions of approval or in a manner which is not detrimenta] to the
public health, safety or welfare, or materially injurious to properties
in the %icinity. If after the Director's review, if warranted, the matter
may be referred to the Planning Commission for additional review.
If after the Planning Coa-mission's review, the Commission deems
that there is sufficient evidence to warrant a full examina:ion, then a
public hearing date shall be set. At such public hearing, the Planning
Commission may modify or revoke the permit pursuant to Section
18.83.080 of this Title.

proposal to the adjacent propem- owners requesting that any comments be
submitted to the City within two weeks.
Section 18.8.4.090 Approval Process:
Following the submittal of an a_7iication for an administrative conditional
use permit and once an application is deemed complete. it shall be approved,
Odenied or modified by the Community and Economic Development Director.
The Director shall approve the application only if he.'she finds:
A. The proposed use will not be:
1. Detriment_" to the health. ssferv. morals. comfort or
general we:.--are of the persons residing c: working
within the reighborhood of the proposed amendment
or within&.e city.
?. Injurious to property or improvements in the
neighborhood or within the city.
B. The proposed use will be consistent with the City's General Plan.
C. The proposed use meets the criteria for an ac,ni:--istrative u-se as listed
in Section 18.8.1.50 of this Chapter.
D. Conditions necessary to secure the purposes of this chapter are made
a part of the administrative conditional use permit.

Section 18S4.0120 Expiration and Extension
The Community and Economic Development Direc:or may allo«- 1,-.
administrative conditional use to operate in a location for the duration of--.e
continued use or may allow-it with a specific expiration date. The follo:,�-T.7
regulations are for both types of Conditional Use Permits-
A. Permanent Administrative Conditional Use Permit
The Community and Economic Development Director allows a
Particular administrative conditional use to be on a particular location
subject to conditions of approval. No expiration time is set.
I. Compliance Period: The approval of a permanent
administrative conditional use permit application shall
automatically expire one(1)year Lom the date of its approval
unless:
a. All conditions of approval have been met, or
b. Sufficient investment has been completed and
building permits are issued, or
C. A business license is isst:.d in accordance with the
Grand Terrace Municipal Code.
In case the applicant is not able to compl. with sections a, b, or c of
the aforementioned section, then the applicant shall apply for an
extension of the one year compliance period prior to the end of that
one year period. The Community and Economic Development
Director may extend the compliance pe::od for a specific length of
time up to one year. Two extensions are :he maximum allowed.
B. Administrative Conditional Use Permits with an ea-pirtion date
If the Community and Economic Development Director has set a
specific expiration date for the proposed use, no extension will be
permitted. If the applicant desires to continue operation of the use
after the expiration date, the applicant si:-:_'I be required to file a new
application for an administrative conditional use permit or other
appropriate application.
Section 2: The Negative Declaration, E-99-11. attached her.to, is hereby approved.
Section 3: Effective Date: This Ordinance shall be in frill force and effect at 12:01 a.m.
on the :1 st day of its adoption.

City staff conducts an annt,- : mid-year budget review to make any necessary adjustments that
are needed as a result ofuticipated conditions and events. Identified revenue and expense
ad:ustments along with an,. _istifications are presented on Schedule A and Schedule B of the
Kowing pages.
Council passed the FY 199=-2000 Budget in May of 1999. Prior tc the beginning of FY
1099-2000, Council reduc": budgeted expenditures a total of S393,153; S370,460 from the
General Fund and $22,693 -om CRA Funds. During FY 1999-2000, a total of S474,387
additional appropriations F re made; $47,009 from the General Fund, S111,300 from Special
Revenue and Capital Imprc-ement Funds, and $316,078 from CRA Funds. A schedule of
$474,387"Budget Adjust=ts - After Beginning Year Budget Cuts" is attached. In addition, a
Nfid Year Fund Balance Ar--'vsis is attached. All fund balances appear to be in line ,%ith what
Staff anticipated.

2) Estimated Revenues by$82,350 in the Bike Lane Fund for potential grant
project reimbursement and $126.212 in anticipated reimbursements from g ants
and other agencies as outlined in Schedule A.
3) Appropriate $141,526 in unreserved, aN-Aable General Fund balance to fund mid year
budget adjustments as outlined in Schedule B and change or re-allocate line-items

4) Appropriate $42,300 in unreserved, available Storm Drain Improvement Fund balance

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GRAND TERRACE, STATE
OF CALIFORNIA, APPROVING TPM-97-01—TENTATIVE PARCEL MAP 15068
WHEREAS, the applicant, W. J. McKeever, Inc., has applied for approval of
Tentative Parcel Map 15068 to divide one (1) residential parcel into two (2) separate,
residential parcels; and,
WHEREAS,a properly noticed public hearing was held by the Planning Commission
on April 15, 1999; and =
WHEREAS, the California Environmental Quality Act (CEQA) Article 19, Section
15313,Class 15-Minor Land Division of four or fewer parcels is Categorically Exempt;and
WHEREAS,the Planning Commission recommended approval of TPM-97-01 to the
City Council; and
WHEREAS, a property noticed public hearing was held by the City Council on May
13, 1999, regarding approval of Tentative Parcel Map 15068.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF GRAND TERRACE DOES
HEREBY RESOLVE AS FOLLOWS:
1. That the site is physically suitable for R1-7.2 (Single Family Residential
District)development. 0
2. That the design of the subdivision and the proposed improvements are not
likely to cause substantial environmental damage.
3. That the design of the subdivision or type of improvements are not likely to
cause serious public health problems or cause a threat to life and property.
4. That street improvements along the Honey Hill Drive frontage of Parcel 2 will
heavily impact the environmental integrity and economic value of the site.
5. That a traffic study submitted to review the traffic situation on Honey Hill
Drive found that future increases in traffic volume is not a consideration in
the design and operation of Honey Hill Drive;therefore,street improvements
along the frontage of Parcel 2 are not required.
6. That the proposed subdivision,togetherwith the provisions for its design and
improvements are consistent with the General Plan.
7. That the proposed subdivision, its design, density and type of development
and improvements conform to the conditions imposed by the regulations of
the Development Code and the regulations of the City of Grand Terrace.
BE IT FURTHER RESOLVED that TPM-97-01 is hereby approved subject to the
following conditions:
Conditions Prior to Final Map Approval:
1. Upon approval of these conditions and prior to becoming final and binding
the applicant must agree to and sign the 'Acceptance of Conditions' letter.
The letter form and content to be prepared by the Community and Economic
Development Department.
2. (Condition C-3 Building and Safety/Public Works)provide a W11 serve letter
from Riverside Highland Water Company.
3. The development shall conform to all requirements of the Grand Terrace
Municipal Code and the State of California Subdivision Map Act..
4. The final map shall accept and property be prepared by a licensed land
surveyor or registered civil engineer authorized to practice land surveying
and based on a field survey.
5. TrtJe Insurance shall be issued for Parcel 1 showing Victoria Street as access
for this parcel prior to recording the map.
Conditions Prior to Grading:
6. (Condition C-2 Building and Safety/Public Works)provide grading plans and
prer'uninary soils report
7. The land subdivider shall accept and property dispose of all on and off site
drainage flowing onto or through the site.
Conditions at rime of Development of Parcels:
8. Compliance with all recommendations listed in the Riverside Highland Water
Company letter dated July 6, 1997 (Attachment'H'.
9. Driveways shall conform to San Bernardino County Standard 129.
10. (Condition A-2 Building and Safety/Public Works) install one 9500 lumin
standard marblite ornamental street light.
11. (Condition C-4 Building and Safety/Public Works) provide sewer lateral to
Parcels 1 and 2.
12 (Condition C-1 Building and Safety/Public Works) pay off sewer bond liens
from assessment district CSA 70.
13. (Condition C-5 Building and Safety/Public Works) provide all utilities
underground.
14. (Condition C-6 Building and Safety/Public Works)All improvements shall be
designed by persons registered and licensed to perform such work pursuant
to the State of Carrfomia Business and Professions Code,which shall comply
with the requirements of the Americans with Disabilities Act, the U.B.C. and
the Grand Terrace Municipal Code.
15. Compliance with all recommendations listed in the Califomia Department of
Forestry and Fire Protection memorandum to the City dated July 2, 1997
(Attachment'11
16, An encroachment permit shall be obtained before any improvements
Proposed within the Victoria Street right-of-way.
17. The three corrective measures listed in the traffic study for entitled "Access
Consideration for TPM No. 15068- for Parcel 2 shall be met. These three
measures are:
a. Remove the two existing trees located at the northwest comer of the
existing drive approach.
b. Remove the portion of the decorative brick wall on the north side of
the drive approach which extends from the back of the sidewalk out
to the asphalt berm.
C. Adjust the grade at the northwest comer of the existing drive
approach extending out to the existing rock outcroppings as required
to obtain a minimum of 150 feet of sight distance.
18. Payment of the Traffic Mitigation Fee whenever the fee is installed in
proportion to the amount of trips generated by the development in an amount
not to exceed $2,856.00.

California, at a regular meeting held the 13th day of May, 1999.

CO.NDMONAL E\CROACIBiENT AGREEMENT
The City of Grand Terrace,a municipal corporation(hereir-Ifter"City"),Conrad Salinas and
Veronica Salinas,Husband and Wife,(hereinafter"Salinas")andAnthomy Petta and Ange:me Petta,
as Trustees of the Petta Trust initially created June 20, 1990(hereinafter"Petta")(jointly hereinafter
the `Parties"), do hereb-,-agee as follows:
RECITALS
A. The City is the owner of certain public road right-of-w-ay k-nown as Victoria
Avenue, fronting on property owned by Salinas, more particularl% described as Parcel 2 of Parcel
Map No. 483, as per map recorded in Boob 4 of Parcel Maps, Page 78, in the Office of the County
Recorder of the County of San Bernardino and providing access to property owned be Pena, more
particularly described as Parcel I of Tentative Parcel Map No. 1:i168.
B. The Cin-bi heretofore entered into a Conditional Encroachment Agreement with
Salinas,dated January 2' 4997 and recorded as Document No. 20- 400 930 87 0109 to t.�e Office
of the County Recorder for the County of San Bernardino.
C. Pursuant to said Conditional Encroachment Agreement,Salinas has constructed and
maintained certain impro%ements within the public right-of-.ay
D. Pursuant to said Conditional Encroachment Agreement, Salinas agreed to remove
and or relocate any and all of the improvements authorized under the permit,upon written demand
of the City of Grand Terrace within thirty(30)of notice to do so. at no cost to the City
E As a con_«:±.:ence of the subdi%i t:on of that proper:, described in Tentati, a Parcel
N'o.1Y068 by Petta, it is necessary and desirable that the existing Conditional Encroachment
Agreement be terminated and that the Parties enter into a subsequent Conditional Encroachment
Agreement.
NOW, THEREFORE, IT IS HEREBY AGREED BY AND AMONG THE PARTIES AS
FOLLOWS:
l. The foregoing recitals are true and correct and are incorporated herein.
The prior Conditional Encroachment Agreement between the City and Salinas is
hereby tenainated and Salinas hereby relinquishes any and all rights and entitlement which may have
been acquired under said prior Conditional Encroachment Agreement.
3. Upon execution of this Agreement, Salinas shall be entitled to maintain v6 thin the
public right-of-way the improvements existing as of the date of this Agreement, subjen to the
requirement for removal set forth herein. Said improvements are generally described as the planting
and cultivation of trees, plants and gardening and temporary fencing.
4. Salinas shall be allowed to maintain said improvements for a period of ni.ety (90)
days from the date of this Agreement. Based upon the mutual written agreement of the Parti es
hereto,said ninety(90)day period may be renewed without limitation. After expiration ofthe ninety
(90)day ptriod or any written extension thereof.Salinas shall have thirty(30)days within which to
remo%,e and/or relocate said improvements at no expense to the City or Petta.
i. Should Salinas fail to remove said improvements on or before the expiration of the
thirtieth dav, City may, without further notice of any kind,and without liability to either Salinas or
Petra,remove and dispose of said improvements. Salinas shall pay to the City and/or its agent,the
actual cos.of removal and disposal within fifteen(15) days of receiving an invoice then'-
:ore.
6. Salinas agrees to indemnify the Ciz•, its officers, agents and employees a£_nst and
hold ti:e= free and harmless of and from all claims and liabilities of any kind arising = of, in
connecticz with or resulting from the actions, ne�igent or intentional, on the part of Sal C their
officers,dents, contractors and employees in connection with any improvements installed or work
performer pursuant to this Agreement and defend the City, its officers, commissions, agents and
employm from any suits or actions at law or in equity for damages, and pay all court casts and
reasonable attomevs fees.
7. Should it be necessary for any part to enforce this A

QCity staff is in the process of preparing the fiscal year 2000-2001 budget for both the City and
the Community Redevelopment Agency. The preliminary budget document will be distributed to
the City Council on or about June 1, 2000. Our budget document will be done later than last
year due to the many organizational changes in the Finance Department.
Council is requested to designate one evening for a special meeting on the subject of the n'
2000-2001 City and CRA Budget, along with a second meeting date, if needed. Only one
meeting date was needed last year. Last year's meeting date was May 11.
Staff recommends that Council consider some time between June 5 through June 21, 2000 for
the budget session. Specifically, Staff would like to suggest two consecutive nights such as
June 12th& 13th (Mon-Tues), June 13th& 14th(Tries.-Wed.), or June 19th& 20th
(Mon-Tues).
A calendar has been included for your convenience.
This year Staff is focusing on having a budget resolution passed by the second meeting in June or
the first meeting in July.
