Contract for Laser Light Productions with Volt Live for 2018 Veteran's Day Celebration at Veteran's Freedom Park Council Member Kenneth J. Henderson expressed his concern regarding Section 5 of the Volt Live Contract where it states, "during the event period the Equipment will be deemed to be in the care, custody and control of the Client", which is the City and Section 7, "The Volt Live personnel shall perform the Technical Services in commercially reasonable and timely manner" which would appear to remove the statement in Section 5. He is also concerned with Section 8 where it states, "Client shall furnish Volt Live with insurance certificates which name Volt Live as an additional insured. The City's standard agreements require the contractor to name the City as additional insured. II, City Attorney commented that those sections quoted by Council Member Henderson regarding the Volt Live contract are a little unusual. Council Member Henderson is uncomfortable with the terms of the agreement. G. Harold Duffey, City Manager stated Staff can bring the agreement back to Council after receiving clarification from Volt Live_ APPROVE CONTRACT WITH VOLT LIVE IN THE AMOUNT NOT TO EXCEED $15,400 FOR LASER LIGHT SHOW AT VETERAN'S FREEDOM PARK RESULT: NO ACTION TAKEN C. PUBLIC COMMENT Jeffrey McConnell, Grand Terrace expressed his concerns with the unfair treatment he has received from the City regarding his political campaign. He also is upset with the City's restrictive political sign ordinance. Martin Gregoire, Head Coach for the Piranha Swim Team, provided the Council with information about his organization's mission. He asked for the Council's assistance to help his organization and the school district negotiate the temperature of the pool the organization uses at Grand Terrace High School. D. CITY COUNCIL COMMUNICATIONS Council Member Kenneth J. Henderson Council Member Kenneth J. Henderson attended the Grand Terrace Titans Youth Football League kick off. He also attended the League of California Cities Annual Conference in Long Beach which is a wonderful event. He commented on one of the breakout sessions which showcased how one City turned around its financial condition. Council Member Bill Hussey Council Member Bill Hussey attended the League of California Cities Conference. He attended several breakout sessions which included homelessness and Renovate America representing the HERO Program_ He would like to invite the speaker to attend a future Council meeting to present information to the City's residents. Council Member Doug Wilson Council Member Doug Wilson commented on his travels along the West Coast. He was impressed with the environmental beauty from Washington through Oregon. However, when he arrived in California, the environmental picture emphasized the need regarding City of Grand Terrace Page 3 Minutes Grand Terrace City Council and Successor Agency September 25, 2018 water use. Realizing California is a desert, he encouraged residents to enhance their landscaping where practical. Mayor Pro Tem Sylvia Robles Mayor Pro Tem Sylvia Robles attended one day at the League of California Cities and attended a breakout session on pensions which was comprehensive. Discussion was held on how cities can negotiate employee contributions to the unfunded liability and medical retiree health benefits. The City of Fullerton was highlighted which she compared to the City of Grand Terrace. The City is very conservative, hired a new City Manager however the City simply does not have revenues and is unwilling to implement taxes. Therefore, the City is implementing demotions and conducting layoffs, including police and fire to meet its budget targets. Mayor Pro Tem Robles shared that the Grand Terrace Women's Club is celebrating its 110th year. Mayor Darcy McNaboe Mayor Darcy McNaboe attended the General Policy Committee Meeting with SBCTA on September 12, 2018 and discussed the following: Approve a lease agreement with Mostafa Khaled, DBA Steve's Snack Shack • Authorize the Executive Director to execute an amendment with Royal Coaches Towing Release of Request for Proposal for the procurement of tow operator services for Freeway Service Patrol Beats 10 and 23 Received information on a draft forecast that is being prepared by the Southern California Association of Governments and SBCTA in conjunction with local jurisdictions for the 2020 Regional Transportation Plan Sustainable Community Strategy Approve a contract with David Evans and Associates, Inc. to develop a San Bernardino County Comprehensive Pedestrian Sidewalk Inventory Approve the FY 2018/2019 Council of Governments Work Plan and Budget Authorize staff to seek fund sources for projects lacking funding Received a Transportation Development Act Triennial Performance Audit Report for FY 2014/2015 and 2016/2017 On September 19-21, 2018, Mayor McNaboe attended the California Joint Powers Insurance Authority Risk Management Conference where the keynote speaker was an artist. The title of his speech was, "Embrace the Shake" which had to do with reframing perception on limitations to encourage creativity. City of Grand Terrace page 4 Minutes Grand Terrace City Council and Successor Agency September 25, 2018 One of the breakout sessions she attended was an update on marijuana activities and the problems those businesses can cause local jurisdictions as it relates to taxation. Another breakout session was a Cal/OSHA Update which provided an up close and detailed look at its consultative division. Mayor McNaboe also attended breakout sessions on Protecting Pedestrians through the use of Safety Barriers, Decision Making for Elected Officials and Retaining and Motivating Employees. On September 24, 2018 she attended, with City Manager Duffey, an initial meeting with the regional Mayors, City Managers, Police and Fire agencies at the invitation of San Bernardino Mayor Carey Davis to discuss plans for the upcoming 2019 Point in Time Homeless Count. On September 27, 2018 is the SBCTA's 6th Annual Business to Business Expo from 9:00 a.m. to 12:00 p.m. and admission is free. E. PUBLIC HEARINGS - NONE F, UNFINISHED BUSINESS - NONE G. NEW BUSINESS Agenda Item No. 8 is a Successor Agency Item 8. Update on the Successor Agency's 2011 Tax Allocation Bonds (TABS) Cynthia Fortune, Assistant City Manager gave the Power Point presentation for this item. Jim Fabian, Fieldman, Rolapp & Associates, City of Grand Terrace's Financial Advisor explained that the original bonds were issued in 2011 on a tax exempt basis. The Successor Agency had three (3) years from 2011 to spend the bonds and due to the disagreement and the process with the DOF, the Successor Agency was unable to spend the bonds. The IRS does not concern itself with the reasons why an agency does not spend bonds within the required three year period. If an agency goes beyond the three period, the agency is subject to audit and penalty. Mr. Fabian recommends a conservative approach and refund the bonds on a taxable basis to provide some added protection in case the City is audited. In providing direction, Vice Chair Robles moved and seconded by Board Member Henderson, that Staff to take the conservative approach and bring back a resolution City of Grand Terrace Page 5 Minutes Grand Terrace City Council and Successor Agency September 25, 2018 selecting Alternative #1, Approve Refunding Immediately. For clarification, Assistant City Manager Fortune stated that Staff will bring back an amendment to the Last and Final Recognized Obligation Payment Schedule. PROVIDE STAFF WITH DIRECTION IN RELATION TO THE POSSIBLE REFUNDING OF THE SUCCESSOR AGENCY'S 2011 TAX ALLOCATION BONDS. Update on San Bernardino County Fire Protection District's Annexation of Parcels Within the City of Grand Terrace into Fire and Paramedic Zone 5 (FP-5) and Review Staffs Initial Findings Regarding Alternative Service Providers for Fire Protection Services Within the City of Grand Terrace G. Harold Duffey, City Manager gave the Power Point presentation for this item. Council Member Wilson suggested that the City sell its fire station to County Fire. City Manager Duffey explained that he had a conversation with Chief Hartwig who offered to have an honest appraisal of the fire station conducted and City Manager Duffey stated he would be happy to bring that appraisal back to the Council for discussion. Jeremy Rivera, Grand Terrace suggested that the City lease the fire department building to County Fire in the amount of roughly $50,000 per month. If County Fire does not want to lease the building, he suggested the City partner with Colton and Loma Linda for fire protection services. Jeff Allen, Grand Terrace, approached the Board of Supervisors to speak with them about the FP-5 Service Zone parcel tax and the three percent annual increases to be imposed on the residents year after year. After some research, Mr. Allen suggested the City research contracting with a private company for fire protection services. Mayor Pro Tern Robles recommends that the Council approve the resolution opposing San Bernardino County Fire Protection District's Annexation of Parcels and directed staff to look at all fire protection service options available to the City to bring back for discussion after the Board of Supervisors public hearing scheduled October 16, 2018. Council Member Henderson stated the LAFCO Plan for Service process that the City would be required to develop as part of the detachment process should be equal to or greater than the service the City currently receives from County Fire. City of Grand Terrace Page 6 Minutes Grand Terrace City Council and Successor Agency September 25, 2018 Mayor McNaboe would like the City to include the San Bernardino County Fire District when looking at pricing and alternatives for fire protection services for the City. Mayor Pro Tern Robles suggested a consultant be brought on board to assist Staff with compiling pricing and alternative options, as well as work with the City's legislative representatives at the State level. APPROVE A RESOLUTION OPPOSING SAN BERNARDINO COUNTY FIRE PROTECTION DISTRICT'S ANNEXATION OF PARCELS WITHIN THE CITY OF GRAND TERRACE INTO THE FP-5 ZONE AND REVIEW STAFF'S INITIAL FINDINGS ON ALTERNATIVE FIRE PROTECTION SERVICE OPTIONS AND DIRECT STAFF TO CONTINUE THE INVESTIGATION OF SERVICE OPTIONS RESULT: APPROVED JUNANIMOUS] MOVER: Sylvia Robles, Mayor Pro Tern SECONDER: Kenneth J. Henderson, Council Member AYES: McNaboe, Robles,Wilson, Hussey, Henderson 10.Review List of Eligible Projects that Are Consistent with the City's Redevelopment Plan and Bond Indenture G. Harold Duffey, City Manager gave the Power Point presentation for this item providing some history on SB 107, restated that no contracts would be awarded, and that Staff is seeking direction and feedback on the project list presented. The City's Executive Team provided a brief description of each project presented in the Power Point presentation. The City Council recessed its regular meeting at 7:49 p.m. The City Council reconvened its regular meeting at 7:54 p.m. The City Council provided Staff with additional items it would like added to the Bond Projects List for consideration: Flashing lights around various stop signs on Mt. Vernon Street lights and sidewalks with school access Special needs playground equipment (however the State has funding for this request) Portable speed feedback signs Flashing beacon warning lights approaching an intersection with a traffic signal Bus shelter in front of Senior Center Michigan Street upgrades Mt. Vernon slope stabilization EastNVest stormwater capture Curb and lighting City of Grand Terrace Page 7 Minutes Grand Terrace City Council and Successor Agency September 25, 2018 Jeremy Rivera, Grand Terrace personally recommended that the suggested new sign for Veteran's Freedom Park move quickly so that it is in place for the upcoming Veteran's Day ceremony, however in concrete, not marble; slurry seal the parking lot, replace some of the grassy area planters with gorilla grass mulch and update the basketball courts. He also suggested that the Fitness Park camera be installed as soon as possible, as well as replacement of various plants and installation of gorilla grass mulch. Council Member Wilson is opposed to spending any of the bond proceeds on anything other than storm drain infrastructure, roadway infrastructure and incentives for businesses to locate in the City. He wants the use of bond proceeds to be spent in compliance with the intent of the RDA. Council Member Henderson mentioned there is approximately $800,000 to $900,000 that Council is not sure what to do with. The DOF has insisted that it is the City's as long as it complies with the appropriate redevelopment restrictors. Council should seek final written approval from the DOF regarding the use of those monies and he believes it would cover some of the projects being discussed. Assistant City Manager Fortune explained that Fieldman, Rolapp & Associates is seeking clarification if in fact the City is entitled to the additional funding. Council Member Henderson would like to direct Staff to determine forthwith the disposition of the approximately $900,000 and reconcile the potentially different positions of the Department of Finance and the State Controller's office. Council Member Wilson moved, with a second from Mayor Pro Tern Robles, to hold on the approval of the list of projects directing Staff to further development project concepts for Council consideration and hold on authorizing the City Manager to move forward with projects less than $10,000 until Council has a complete list and can properly analyze what the City's needs are_ RESULT: APPROVED [3 TO 2] MOVER: Doug Wilson, Council Member SECONDER: Sylvia Robles, Mayor Pro Tern AYES: Darcy McNaboe, Sylvia Robles, Doug Wilson NAYS: Bill Hussey, Kenneth I Henderson H. Harold Duffey, City Manager shared with Council and residents that the City's new webpage is up and accessible. He also suggested if Council has any information it wishes to add to the webpage to please let him know. Starting Wednesday, September 19, 2018, Southern California Edison will be replacing streetlights in Grand Terrace with energy efficient LED lamps. Besides saving energy and costs, the LED lamps also produce a white light to increase night time visibility in neighborhoods. On September 22, 2018, the City held its Bulky Item Pick Up and Community Shred Day which was well attended by the City's residents. I. CLOSED SESSION - NONE J.
