A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF GRAND TERRACE, CALIFORNIA,
APPROVING V-89-1
WHEREAS, the Applicant, Jimmy W. Sims, has applied for approval of V-89-1,
which is a proposed variance from Section 18.12.020 of the Grand Terrace Municipal
Code in relation to rearyard setback requirement of 20 feet in a R1-7.2 zone; (see
Exhibit A ) and,
WHEREAS, a properly noticed public hearing was held by the Planning
Commission on October 16, 1989, regarding this application; and,
WHEREAS, the proposed project is categorically exempt per Class I of the
California Environmental Quality Act; and
WHEREAS, the Planning Commission has made the following responses to
findings required by State Law and the Grand Terrace Municipal Code:
1. Is the subject property deprived of privileges enjoyed by other
property in the vicinity and under identical zoning classification due
to special circumstances applicable to the subject property, including
size, shape, topography, location or surroundings?
Yes. This property is impacted with a severe rearyard slope 15 feet
in height and 23 feet in depth located 11 feet from an existing patio
structure. This slope may be replaced with a retaining wall thus
providing the adequate rearyard setback. However, the asthetics of
such a wall would have a potentially negative impact on the subject
parcel and surrounding neighborhood.
2. Is the proposed variance consistent with the latest adopted General
Plan?
Yes. The property has a General Plan designation of Single Family
District. -The proposed project is for a room addition. The variance
requested is for a zoning code regulation regarding setbacks and does
not effect land uses permitted in the General Plan.
3. Are all land uses and activities that this variance allows in conformity
with the regulations specified for the district in which the subject
property is located?
Yes. The property is zoned R1-7.2 which permits single family
residence activity. The variance is for setbacks not for landuse.
4. Can the proposed variance be approved without constituting
a grant of special privileges inconsistent with the limitations
upon other properties in the vicinity and under identical zone
classification?
Yes, based on the findings of item #1, this property has
topography features unique to the majority of the surrounding
neighborhood.
5. Will conditions necessary to secure the purposes of the Grand
Terrace Municipal Code, including guarantees and evidence of
compliance with conditions be made a part of the variance approval?
No. Special conditions of approval are not necessary for this project.
NOW THEREFORE, BE IT RESOLVED by the Planning Commission of the
City of Grand Terrace, California, that pursuant to the findings above, V-89-1, is hereby
approved.
PASSED AND ADOPTED by the Planning Commission of the City of Grand
Terrace, California, at a regular meeting held the 16th day of October, 1989 by the
following vote:
AYES: 4, Commissioners Hawkinson, Hargrave, Hilkey, Van Gelder.
NOES: 1, Commissioner Buchanan.
ABSENT: 1, Commissioner Munson.
ABSTAIN: 1, Commissioner Sims.
