ANNOUNCEMENT In Memoriam - Dana Gardner Bob Dutton, San Bernardino County Assessor/Recorder/Clerk appeared to speak on behalf of Dana Gardner, a Grand Terrace resident who tragically perished in the attack on a concert venue in Las Vegas, Nevada on October 1, 2017. Mr. Dutton met Dana when he began working for the San Bernardino County Assessor/Recorder/Clerk office and commented on her dedication to public service over the last 26 years, as well as her tremendous wealth of knowledge about .the inner workings of the agency. He stated she earned the respect from many of her co-workers, as well as many from other government agencies throughout the State of California. City of Grand Terrace Page 1 Minutes Grand Terrace City Council October 10, 2017 He was pleased to see the turnout at the candlelight vigil that was held in her honor as being a testament to how much she was loved by many, believes he is a better person for knowing her and he thanked the City Council for honoring her at the October 10, 2017 Council meeting. Joani Finwall, Assistant County Recorder, also- from the San Bernardino County Assessor/Recorder/Clerk, thanked the City Council for honoring Dana Gardner. Ms. Finwall knew Dana for the -last three (3) years and described what a valued and dedicated employee she was. She stated that what made. Dana such a dedicated public servant was, first and foremost, the .dedication to her family. Dana was passionate about spending time with her family and that passion transferred over to serving San Bernardino County. Ms. Finwall believed that with the talents Dana possessed, she could have taken offers to go to other agencies, but because she loved the area so much, her home meant the world to her. She described conversations held with Dana about living in Grand Terrace and explained that Dana loved the City and was proud to call it her home. Mayor Darcy McNaboe described the honor she had presenting Dana Gardner's family with an In Memoriam plaque which was delivered to her home. Mayor McNaboe then proceeded to read the certificate into the record. Council Member Wilson expressed his appreciation to those attending the meeting saying a few words on behalf. of Dana Gardner and her family. He also appreciates the help her family has received and is very sorry for her loss. Mayor Pro Tern Sylvia Robles extended her deepest condolences. That same weekend she was visiting a classmate whose son-in-law lost his life in the San Bernardino County massacre from 2016 and stated it really hits home with these types of tragedies. She will also be attending a memorial next week for another victim of the San Bernardino County massacre and just commented on how horrendous these events are, as well as overwhelming. She sends her thoughts and prayers to everyone affected by these events. Americans used to be so pragmatic and could set aside differences and figure out how to be unified. Mayor Pro Tern Robles believes that is being lost and in closing she stated, "May God Bless Us All". Council Member Bill Hussey attended the beautiful memorial service that was held to honor Dana Gardner by her friends, family and strangers. He met her once at a council meeting where she voiced her concerns about a development project. He also commented that she lived right around the corner from his in-laws and when he happened to see her, she always had a smile on her face. He stated that It is sad there is evil in the world, however there are a lot of good people in the world too. He recommended everyone make the best out of every day and he City of Grand Terrace page 2 Minutes Grand Terrace City Council October 10, 2017 believes she is in heaven wondering what all the fuss is about. He explained that Grand Terrace lost an angel, however heaven.gained an angel and extended his thoughts and prayers to her family and friends and stated Grand Terrace will truly miss her. Mayor Darcy McNaboe again wanted to thank Bob Dutton and Joani Finwall for taking the time to come to the meeting and attending Dana Gardners memorial over the weekend as the community really wanted to do something for her. Mayor McNaboe stated there is no making sense of why Dana was taken from the community and from those that loved her and depended on her. Maybe the focus should be on not trying to make sense of her being taken but making sense of the life she led, the wisdom she imparted to others, to the lessons that she taught, and to the support, loving and caring person that she was. Part of the pain is she is not here for those things anymore, but the community'that knew her and coworkers that knew her were touched by her and will continue to be touched by those things that she left behind. Council Member Doug Wilson. requested information on Check #74532 payable to CHJ Consultants in the amount of$24,067.41. Alan French, Public Works Director stated the payment was for geotechnical testing on the materials used for the recent slurry seal project. Council Member Doug Wilson asked if the City has seen any benefit realized regarding liability insurance premiums due to the active lease as it relates to child care. Cynthia Fortune, Assistant City Manager stated that a letter was sent to JPIA informing them of reduced staffing levels and they made an adjustment which resulted in a lowered premium of approximately $50,000.00 from the previous year. Mayor Darcy McNaboe questioned Invoice No. 82538 referencing Tesoro Court. Sandra Molina, Planning and Development Services Director explained the invoice was for review of the CC&Rs on the Van Buren Project that Aegis Developers is constructing. PUBLIC COMMENT Don Larkin, Veterans Walls of Freedom, on behalf of the Veterans Wall of freedom and the Foundation of Grand Terrace extended an invitation to the City Council and members of the public to the Veteran's Day celebration that will be held at Veterans Freedom Park on Saturday, November 11, 2017 at 11:00 am. with United States Air Force Veteran Jacqueline Morenberg-Rodriguez scheduled to be the keynote speaker. Mr. Larkin went on to explain the events that will be provided throughout the day. Janese Makshanoff, Grand Terrace stated she did not receive a notice for the upcoming Planning Commission meeting to be held on October 19. It is an important meeting as it directly affects, her property on Vivienda. She and a .few other property owners requested a reversal of the zoning for the area that was made in the 1980s. She thought Staff.was directed to research the possibility of reversing the zone change. She now understands the meeting is going to address a new add to overlay. She stated that City of Grand Terrace Page 4 Minutes Grand Terrace City Council October 10, 2017 everyone she spoke to and would be directly affected by the decision, want nothing for this area other than residential agricultural. Ms. Makshanoff stated there have been three (3) fires located in the area where she lives. She believes access to the riverbed and weed field is difficult and has asked the City if an access road can be created to allow first respond ers.faster access to the area. G. Harold Duffey, City Manager stated the City will contact the fire department and request if anything is prohibiting them from accessing the property. Staff will research why Ms. Makshanoff did not receive her notice for the upcoming Planning Commission meeting scheduled for October 19. Staff is trying to come up with a mechanism to provide vehicles for one-acre ranchettes and farming. The add to overlay being proposed will be placed over the area for those residents who want to farm and over the area where those property owners have indicated they don't want farming. By placing the add to overlay over the whole area, at any point in time one decides to farm, they can by submitting a Conditional Use Permit. It was Staff's intent to be able to provide farm-agricultural based properties to exist at Council's direction and Staff believes this mechanism will allow the City to get there. Janet Rich, Grand Terrace stated she did not receive a notice for the upcoming Planning Commission meeting and the agenda topic also affects her property. She explained how long this fight has gone on to keep the area agricultural and opposes any light industry or anything else that would jeopardize that zoning designation. She also shared with City Council that there is an area around 'her property consisting of 20-28 acres that has extremely high weeds that is a fire hazard and she filed a report with Weed Abatement. Mayor McNaboe asked Ms. Makshanoff and Ms. Rich to provide the City Clerk with their home address so that the City can ensure they receive notices in the future. Becky Giroux, Grand Terrace did receive a notice for the upcoming Planning Commission meeting. She shared her concerns about her neighborhood on Vivienda and explained several neighbors desire to designate the area agricultural uses with ancillary residential. She stated City Council previously approved the addendum agreeing to bear the costs for the lower level analysis on zoning code and map changes. The upcoming Planning Commission is going to address adding the agricultural overlay allowing limited commercial agricultural and single-family residence as accessory use, not the underlying zoning. She does not believe this will resolve the concerns she and her neighbors have. It will still allow for light industry and the residents want agricultural. Ms. Giroux announced that the Grand Terrace Lions Club will hold their Pancake 'Breakfast on October 15, 2017.next to Bank of America and invited everyone to attend. Jeffrey McConnell, Grand Terrace stated that he and other residents do not want the add to overlay in the area of Vivienda; they want agricultural, one (1) house per acre City of Grand Terrace Page 5 Minutes Grand Terrace City Council October 10, 2017 and to create a green zone. He reminded the City Council that he previously provided ' them with a petition containing approximately 200 signatures and those individuals want to see .a 40-acre green zone. He also wanted to share with the City Council that there are 19 acres in the area that have weeds approximately five (5) feet tall and the property owner is not trimming. There have .been three (3) fires in the last three (3) months and if the winds were blowing in the residents' direction, they would have been burned out. Bobbie Forbes, Grand Terrace stated .she received her notice for the upcoming Planning Commission meeting. . With respect to weed abatement, San Bernardino County came out and cited some properties which she believed were in error as she personally has knowledge of homes which need to be cited and were not. She stated that the area where Mr. McConnell bought his property is a flood zone. She indicated he wants to build multiple homes and she believes the parcels need to_ be larger to not compromise the area. She wanted to thank the fire department for acting so quickly putting out the recent fires; however, she does believe they get confused how to access the area and requested better signage. . City Manager Duffey explained that one important thing to note is the direction the City is taking on.AG related businesses. You can have an AG related business.on the site but you cannot have a residential unit without an AG related business. This will all be presented at the Planning Commission meeting. He urged everyone who has a vested interest to attend the meeting and comment on the issue. r' Mayor McNaboe asked for clarification about the County of San Bernardino being responsible for weed abatement. City Manager Duffey explained that County Fire will send notices to property owners to clear their property and if they don't, County Fire hire a contractor to come in and clear the property and, bill the property owner. He will investigate why the property in question has not been cleared. D. CITY COUNCIL COMMUNICATIONS Council Member Brian Reinarz Council Member Brian Reinarz- Absent. Council Member. Bill Hussey Council Member Bill Hussey stated after 35 years he is now retired. He commented on his attendance at the League of California Cities Conference in September and the League's opposition to AB 109, Prop 47 and Prop 57. AB 109 transferred approximately 45,000 felony inmates from the state system to the local level which created a burden on the local system. Council Member Hussey provided some crime statistics with increases due to the changes from felonies to misdemeanors. City of Grand Terrace Page 6 Minutes Grand Terrace City Council- October 10, 2017 Council Member Doug Wilson Council Member Doug Wilson expressed his appreciation for the a-trash drop off held on September 30, 2017. He stated that due to our ever-changing world, the best way to move forward is being prepared. The City has adopted a stance to accelerate its CERT training to be prepared . in relation to the plan that has been advanced to the State. After the State's review, it will provide suggestions for the City to implement. After brief discussions earlier regarding hurricanes, floods, wildfires, and the Vegas massacres Council Member Wilson shared that the City just experienced a 3.2 earthquake centered in Loma Linda on the San Jacinto fault. He stated California is most likely to have a very serious event but preparation of the basic preparations personally is the only way to survive these things. Mayor Pro Tern Sylvia Robles Mayor Pro Tern Sylvia Robles attended the monthly Board Meeting for Omnitrans where routine items were presented; buying tires, reporting on the continuing progress of the aerotrain and converting the buses to a different kind of fuel. She shared that Council Member Pat Gilbreath of the City of Redlands passed away and she was the Chair of Omnitrans. She stated Council Member Gilbreath was a very kind woman who was fabulous. Mayor Pro Tern Robles also shared that a 32-year employee with Omnitrans, who oversees the maintenance division suffered a fall that ` ended up being fatal. Mayor Pro Tern Robles asked Staff to contact La Pasta Italia to recognize their retirement and see if the new change of ownership would like to be introduced. Mayor Darcy McNaboe Mayor Darcy McNaboe attended the SBCTA Board Meeting and there was a tribute to Council Member Gilbreath. The items that were not approved at the Metro Valley Study Session but were approved by the Board were: Received an update on FY 17/18 work goals and objectives Hearings.to consider Resolutions of Necessity for parcels on the US 395.Phase I project near Adelanto and Victorville o There were three (3) parcels and the Board only had to consider two (2) since one had already met the negotiations to that point Public hearing establishing a fee schedule for the use of vehicle charging electric stations. o One of the things that the State looks at is the idea of going to electric vehicles. The Governor has expressed the desire to outlaw the combustion engine. She is seeing fees being established. for a few City of Grand Terrace Page 7 Minutes Grand Terrace City Council October 10, 2017 charging stations where there really isn't the infrastructure now to support the overall use of electric vehicles. Approved the addition of a fulltime exempt.Risk Manager SBCTA employee that provides an opportunity for the actual organization to look more closely at the risks that need to be considered. SBCTA currently outsources that and does not feel it is getting enough perspective on SBCTA risks for different projects. Awarded bicycle and pedestrian facilities and transit stops access improvement projects that were funded though the 2017 Transportation Development Act Nominated the following new projects for inclusion in the 2018 State Transportation Improvement Program: o 1-10 Corridor Contract Project 1 o US 395. Phase 1 Widening o Redlands Passenger Rail Project o 1-10 Eastbound Truck Climbing Lane Project o US 395 Widening Project from approximately Desert Flower to Farmington Road Approved the nomination of the following projects for SB 1 Local Partnership Program. Formula Program Funds and Partnership Program Self-Help Competitive Program Funds: . o Redlands Passenger Rail Project o 1-10 Corridor Contract State and Federal Legislative update On .September 27, Mayor McNaboe was invited to Terrace View for Red Ribbon Week -' to read a book called "One and Only You." It was a great book about wisdom being passed from Mom and Dad to a child about all the different ways to go out and make friends but remember you are special, you are unique and don't have to follow the crowd. Report on the Status of the Interim Moratorium on the Expansion or Establishment of Outdoor Storage And/Or Outdoor Manufacturing Uses Sandra Molina, Planning and Development Services Director gave the PowerPoint presentation for this item. Jeff McConnell, Grand Terrace requested to know how many contractor storage yards were requested down in the 40 acres and which kinds, and what kind of trucks will be used to supply them. They are a committee of the Foundation of Grand Terrace of which she is a Board Member and left the dais at 7:08 pm. Cynthia Fortune, Assistant City Manager gave the presentation for this item. Council Member Bill Hussey asked if the refreshments budgeted were for just the sponsors of the event or for all attendees. Don Larkin, Veterans Wall of Freedom stated the refreshments are going to be supplied at the reception being held for the sponsors, however everyone in attendance is invited to the reception. Also, the organization wanted to make sure there was enough water to be provided throughout the day. Mayor Pro Tern Robles pointed out that the Foundation of Grand Terrace is asking for financial assistance for the event so that the funds needed won't be diverted from the organizations efforts to complete the monument. 1. Cooperative Agreement Between the City of Grand Terrace and City of Colton for the Eastern Barton Road Bridge Replacement Project Alan French, Public Works Director gave the PowerPoint presentation for this item. Council Member Hussey,-asked what money the City of Grand Terrace has expended on this project since 1999. Director French was not able to answer that question however he will research to see how much, if any, money has been spent on the project by the City of Grand Terrace thus far. G. Harold Duffey, City Manager stated Staff will perform a records. search on the financial side and on the Council report. side to make that determination. The total project was 3.5 million dollars at an 11% share split between the City of Grand Terrace and the City of Colton. Jeffrey McConnell, Grand Terrace asked where the public can follow the design of the bridge. City Manager Duffey explained that the City of Colton is taking the lead on the design. After the design and construction begins, the public will be able to follow along once it has been presented to Council. The bridge .was originally scheduled to be replaced, however after the railroad abandoned the line, the design changed for an elevated road. City Manager Duffey does not believe there will be any foot traffic directly underneath the bridge. Council Member.Wilson requested receipt of digital copies of the project file so that those can be. made available to the public. Once the project is complete, he wants copies of the as-builts plans. He also asks that some type of historical acknowledgment be placed at the location due to the bridge's age. 1. APPROVE A COOPERATIVE AGREEMENT BETWEEN THE CITY OF GRAND TERRACE AND THE CITY OF COLTON FOR THE BRIDGE REPLACEMENT AT THE ABANDONED UNION PACIFIC RAILROAD AND WEST BARTON ROAD; 2. Harold Duffey, City Manager gave the presentation for this item. Council Member Doug Wilson indicated he was not able to identify the loss to the City under the Fiscal Impact portion of the staff report. However, based on the agreement being presented, it appears the City is under financial stress regardless of the agreement. City Manager Duffey stated the initial agreement with the City was for rent of $120,000 a year and the City is allowing them a 50% credit toward the purchase of the building. Under the new agreement the City only expects to receive $42,000 and that money is going to be applied towards the final purchase. The City will be taking a loss but the concept is that the asset will reduce the overall impact of the loss. Harold Duffey, City Manager outlined items requested by Council for the Report Back Log as follows: Prepare an update on the Weed Abatement Process Recognition of La Pasta Italia and its owners Determine whether funds have changed hands over the years for the Eastern Barton Road Bridge Replacement Project and to determine that the City does not pay more than its portion of the 11% shared the City of Grand Terrace and City of Colton City of Grand Terrace Page 11 Minutes Grand Terrace City Council October 10, 2017 For the Barton Road Bridge Replacement Project, City to receive electronic copies of the project file, as-builts and historical marker installed at the project location. City Manager Duffey announced a Save the Date for the 3rd Annual Light Up Grand Terrace scheduled for November 30, 2017 from 4:00 pm to 9:00 pm located at 22633 Barton Rd. Mayor McNaboe announced the 1-215 Barton Road Interchange Groundbreaking Ceremony scheduled for October 13, 2017 at 10:00 am to 11:30 am. Mayor Pro Tern Robles stated all Council Members received a letter from Riverside Highland Water Company and asked if that is a Closed Session item or can City Manager Duffey report it at the next meeting. City Manager Duffey confirmed that the item is currently scheduled under Closed Session at the next City Council meeting.
