A. SPECIAL PRESENTATIONS
Thomas Rice, President of the Foundation of Grand Terrace thanked the City Council
for all of their efforts on the dog park groundbreaking and for establishing the Dog Park
Endowment Fund. Mr. Rice explained that another member of the Foundation of Grand
Terrace, Mike Auld, has spent the last six (6) years raising money for an endowment
fund for the dog park.

Mr. Rice provided a donation to the City of Grand Terrace Dog Park Endowment Fund
on behalf of the Foundation of Grand Terrace in the amount of$3.000.00.
Mike Auld, Member of the Foundation of Grand Terrace also wanted to thank the City's
residents, particularly those that initially got the ball rolling to bring a dog park to Grand
Terrace, as well as Thomas Rice, City Council and City Staff who have worked so hard
on the dog park. He explained that through the endowment, the Foundation is able to
maintain and repair the dog park without tapping into the wallets of the residents. Mr.
Auld also announced donations made to the Grand Terrace Dog Park Endowment Fund
will receive recognition for their. donation with a plaque placed on' one of the dog park
benches.
Mayor McNaboe announced for the public that the Council Chamber is experiencing
technical difficulties and wanted to express her apologies.
G. Harold Duffey, City Manager introduced Megan McKibben.as the new Grand Terrace
Senior Center Coordinator.
Megan McKibben expressed her gratitude and was looking forward to working with the
seniors. She also announced that on September 28, 2017 the Senior Center will host a
Movie Night with the feature film Pillow Talk with Doris Day being shown and invited
everyone who was interested to attend.

C. PUBLIC COMMENT
Jeff McConnell, Grand Terrace expressed his concern that nothing has been done since
May 22, 2017 as it relates to the.rezoning of the 40 acres down along the river. He
wants to know what is taking so long and has many questions.
Mr. McConnell stated that his situation has not been resolved regarding his nine (9)
page email he sent to Council and has less than two (2) weeks to go until he goes to the
next level.

G. Harold Duffey, City Manager stated he met with Mr. McConnell and attempted to
address the issues presented and outlined some of the processes. The mechanisms in
place to rezone the 40 acres should be completed by December.
D. CITY COUNCIL COMMUNICATIONS
Council Member Brian Reinarz
Council Member Brian Reinarz thanked everyone for attending this evening's meeting.
He attended the recent public workshop held for public safety and sheriff staffing: He
was pleased to see how many residents turned out for the event and knows where the
community's concerns are and the issues they care about.
Council Member Reinarz also attended the Grand Terrace Dog Park Groundbreaking
which was a source of community pride. A lot of dedicated volunteers worked on that for
a long time and he was happy to see that come to fruition. He also conveyed his
thoughts and prayers. to the residents of Houston, Texas; Miami and Tampa Bay,
Florida with the flooding, rains and hurricanes they are experiencing.
Council Member Bill Hussey
Council Member Bill Hussey thanked everyone for coming tonight. He attended a
leadership summit for CJUSD kids' Went to SB College and where he. spoke and
presented 10 points that he used to become a leader. He stated. the children were
excited to be there and they expressed their appreciation for the gifts that he took with.
him provided by Mr. Duffey. A couple of the students asked if the City offered_
internships.
Council Member Hussey also attended the Dog Park Groundbreaking Ceremony and
thanked staff for putting everything together and the Foundation of Grand Terrace for
being in attendance. He stated it was a proud moment for him.
He stated that his son graduated from the County.of San Bernardino Sheriff Academy
and finished number one in his class and wished him all the best.
Council Member Hussey commented on the escaped turtle running around the area and
thanked staff for their assistance.
He conveyed his thoughts and prayers to everyone in Texas and Florida, wished them
,the best and thanked first responders for putting their life on the line to save innocent
people.

Council Member Doug Wilson
Council Member Doug Wilson is happy that the City has such great traction in relation to
the -City's emergency planning. With the television coverage of emergency
management, brings home some of the policies that FEMA has instituted over the last
10-15 years and now brought to an enforcement situation.
He commented that during the Dog Park Groundbreaking, his dog was not doing well
and unfortunately she did not make it. He will observe the construction of the park in her
memory and looks forward to its completion.
Mayor Pro Tern Sylvia Robles
Mayor Pro Tern Sylvia Robles stated on the anniversary of September 11th she takes a
moment to remember Cora Hidalgo Holland from San .Bernardino who perished in the
first plane strike. She shared Ms. Holland's story that placed her on the plane that day.
She unfortunately missed the last Omnitrans meeting as there has been an issue with
her email. At the previous meeting she attended, Omnitrans is the lead agency for the
Federal Transit Act and there was some cleanup on the Redlands Rail Project and they
are in the process of hiring a rail coordinator. The report she received on the Digital
Pass for Omnitrans passes has been a phenomenal success. Omnitrans has
implemented service to Ontario Airport and that has been a success as well.
Mayor Pro Tern Robles also attended the Dog Park Groundbreaking and she wanted to
thank CityStaff for preparing the ceremony.

She attended the Public Safety Workshop and asked if there is any recent legislation on
what the threshold is for ballot measures if it is citizen initiated.
City Attorney Richard L. Adams, II - indicated that if citizens obtain the number of
signatures that would require the city to put it on for a special election, which it should
be a special election even if it doesn't follow the constitutional provisions that taxes
need to be added to a General Election.
Mayor Pro Tem Robles extended her condolences to longtime Grand Terrace Rudy
Gutierrez and also extended her condolences to the Grand Terrace family of Richard
Ponce who she and her husband grew up with.
Mayor Darcy McNaboe
Mayor. Darcy McNaboe attended the Public Safety Workshop held by the Sheriffs
Department and was overwhelmed by the amount of residents in attendance. She
shared that Lt. Wolfe and Captain Gomez did an excellent job with their presentations
and thanked them for putting the event together. She also wanted to thank the residents
for inviting other members of the community to attend. Sheriff Service Specialist Sylvia
,Beasley was here personally inviting people and handing out flyers and that really
showed in attendance.

She attended the Dog Park Groundbreaking and went exceptionally well despite the
heat; there was a wonderful turnout and staff did a great job putting it together.
On September 6, 2017, Mayor McNaboe attended the San Bernardino County
Transportation Authority's Board of Director's Meeting. There were a number of items
she reported on from General Policy and Metro Valley Study Session. All of those items
did pass; however, there were a few items she did not report on. One was a Closed
Session the Board had with legal counsel on .existing and anticipated litigation. Under
Discussion for Administrative Matters, the appointment of Valley Transportation
Services Member, John Roberts was extended to December 31, 2017. There is a
change in representation for that particular service that they are providing and
Omnitrans will be the selected service provider.
Project Coordinator, Lou Monville from the Inland Economic Growth Opportunity Project
presented an opportunity that they have with the Brookings Institute to prepare a report
on the Inland Empire and needs assessment for growing the economy. He will come
back and let the Board know as they get closer to a report that they can share.
Under Project Delivery hearings to consider, resolutions of necessity for parcels for the
US 395 Phase One widening in the cities of Adelanto and Victorville.
Under Transit the Board had Southern California Regional Rail Authority budget
amendment allocation for FY 2017-2018. This is the same type of budget allocation that
they asked for last year and. it adds an extra Metrolink.train out to the stadium area for
-� the LA Rams football. Last year when they added this extra train. service in their
schedule it was well taken advantage of. The budget amount they are asking for is only
for running the train.
Mayor McNaboe announced that the City also lost a couple of other longtime residents,
one of which was Terence "Terry" McGuire, Jr. He is the husband of Sally McGuire who
is active in the community and both lived in the area before the City was founded. Also,
Gary L. Robinson, who is a co-owner of Stonewood Construction. He and his wife,
Corinne have been developers of homes in this area for quite a number of years.

Mayor McNaboe asked when repealing the chapter, are we repealing our ordinance on
sex offenders; we are making them more align with the State?
City Attorney Adams stated that the ordinance would be repealed. He stated that State
law is very similar to what the City has so if the City repeals, Grand Terrace is not
vulnerable, it has the protection of state law.
Council Member Reinarz clarified that the City's law and State law were redundant; the
only difference was 600 feet.

After the agenda was posted, Terrace View Elementary PTA notified City Staff that their
organization. had received funding from another source in the amount of $200.00;
therefore, all they are asking for at this time is $1,430.00.
Council Member Reinarz asked for clarification on the exact dollar amounts requested.

Debra Thomas, City Clerk gave the presentation for this item.
Mayor McNaboe asked if.the City would need to purchase a separate server for the
electronic document management software.
City Clerk Thomas explained that the City would not need an additional server at this
time. When the City addresses historical and archived records, the City can assess the
need for an additional server at that time.
Mayor McNaboe noted that the proposal outlined a computer could have its own user
license for anyone to utilize at a designated station.
City Clerk Thomas stated that it is the preference to have each member of Staff
licensed as a user but it can be considered using one station as a kiosk to allow anyone
access.
G. Harold Duffey, City Manager added that the City's new IT consultants have given the
City two (2) terabytes of memory so the City should not need to purchase an additional
server at this time. .

10.Amend Contractor Agreement with West Coast Arborists, Inc. to Include Tree Planting
Services
Alan French, Public Works Director gave'the PowerPoint presentation. for this item.
Council Member Hussey asked how many trees would be provided for$15,000.00.
Director French stated 61 trees, varying in size.
Council Member Hussey asked if there was a guarantee on the trees after planting.
Director French stated there was not. The City would be required to maintain the trees
as soon as they are planted for the first year.
�— Council Member Hussey stated if you purchased a tree from Home Depot, it would be
guaranteed for up to a year. If it dies, you can return it.
Martin Cortez, West Coast.Arborist stated that this particular quote did not include any
warranty for the trees.
Council Member Hussey asked what species of trees will be planted.
Director French stated the City has a record of the' ones removed and those trees will
be replaced with the same trees that were originally planted.
Mr. Cortez indicated the contractor can make recommendations for different tree
species at different locations to help ensure the tree's survival.
Council. Member Wilson asked if the trees would be planted pursuant to the City's
established ordinance. .
Director French stated the ordinance requires a certain type of tree.in the parkway and
the City ensure compliance.
Council Member Wilson asked who would pick the trees that are going to be planted.

C. Harold Duffey, City Manager explained that the City hired an arborist to review all of
the trees throughout the City. When the City hired West Coast Arborist, they are
- certified arborists that will be planting the trees on the second year of a five year. Some
locations where trees were .planted led to concrete lifting which had the potential of
liability exposure. Through the GPS scoping of every tree in the City, the City has
identified the proper trees to be planted at each location. The City previously hired a
.consultant to develop a list and they made recommendations for planting trees, the
location and their proximity to the parkway. The City will follow that mechanism as it
implements. the program. The City has that arborist on contract and we can have the
arborist validate the location of the type of trees that are going to be placed.
Council Member Wilson stated someone needs to be chosen Who is qualified to choose
select trees at a nursery. If you.the right stock is chosen in the beginning, the chance of
survival is a whole lot better.
City Manager Duffey stated that the separate arborist on contract will be part of the tree
selection process.
Council Member Reinarz asked for clarification that the money being used to replace
the trees is the same funding that was identified in the priority list for the bond proceeds.
City Manager Duffey confirmed that is correct.
Jeff McConnell, Grand Terrace shared with the City Council that whenever he has a
�1 question about trees on his property, he takes a twig over to West Coast Arborist and
asks their staff for advice. He stated his experience with them is that they are very
knowledgeable.

11.Ratification of the San Bernardino County Fire District Board's Adoption of the 2016
California Fire Code with Local Amendments
Sandra Molina, Planning and Development Services Director gave the presentation for
this item.
Council Member Wilson is concerned that the County Code does not necessarily fit the
situation of Grand Terrace. For example, it allows fireworks, the County does not.

Director Molina indicated that the Fire Code is updated every three (3) years and
adopted by the State and County. The City is in the service area for the County and the
� City's Code came from the Fire District.
Council Member Wilson has even greater concern because he believes by adopting the
Fire District's Code, it takes away local control. He explains the City's process different
and more fair to its citizens.
Captain Joseph Zuccaro explained that wildfire risk areas are identified from maps
received from the State. The State identifies the fire hazard severity zones and
enforcement is mandatory, including those in Grand Terrace. -
Council Member Wilson stated the City has placed that same map in its General Plan
however when it comes to the administration of fireworks, it is different.
Captain Zuccaro explained that State law requires the ratification in the areas that the
Fire District serves by the established cities. The City of Grand Terrace has the
opportunity to create its own Fire Code, using the State Fire Code as it is and the Fire
District can make those modifications as long as they are more restrictive and not less
restrictive. The Fire District_ takes into consideration other City's requirements when
reviewing plan checks.
As it relates to fireworks, The Fire District recognizes the City's approval of safe and
sane fireworks and does enforce those requirements.
Mayor McNaboe asked if the City adopts the Fire Code being presented, does it wipe
out any differences that the City has in its Fire Code.
City Attorney Richard L. Adams, II explained that the City's Fire Code is actually the
County Code.
Mayor McNaboe read, "Unless otherwise permitted the possession, storage, use sale
and handling of any fireworks is prohibited within the County of San Bernardino and the
District", and stated the City allows fireworks, will adoption of ordinance restrict the
City's from allowing fireworks?
City Attorney Adams explained that the Fire District needs to enforce the City's
additional requirements.
Jeff McConnell, Grand Terrace understands that if the Fire District believes there is a
violation on a citizen's premises, they can just enter. He believes that violates an
individual's 4th Amendment Right, illegal search and seizure.
City Attorney Adams ,explained the 4th Amendment protections apply unless there is
probable cause to go in and that is not a violation of the 4th Amendment.

Mr. McConnell stated that the County is requiring permits and regulating minor items
'� such as mulch piles; size of horse manure piles and believes it is over regulating.
Captain Zuccaro states the Fire Code requires permits for certain types of operations
and activities including the storage of mulch; more specifically commercial occupancies,
not residential. The concern regarding the size is that the amount of heat that can self-
generate can increase the chance of fire. With regard to the 4th Amendment, it applies
to occupancies that have been issued a permit.
Council Member Reinarz asked why the City has to repeal its Fire Code.
City Attorney Adams explained the City is cleaning up is Code so that there is no
conflict between the City's Code and the Fire District that serves the City.
Council Member Reinarz asked if the City could just amend its Code.
City Attorney Adams stated the City could adopt the Ordinance into the City's Code
however it will not do the job of giving the. City's Fire District enforcement. They are
actually a governmental entity in charge of fire for the City and County, as well as other
cities.
Council Member Reinarz asked what would happen if the Council does not ratify the
Code.
City Attorney Adams explained that the City's Code is no longer valid as it based on
previous California law. If the City does not ratify, the City will not have a Fire Code in
place.
Council Member Wilson wants to make sure that the ordinance is not misconstrued. He
asked Captain Zuccaro to explain fire sprinkler systems and when they are,required to
be installed.
Captain Zuccaro explained in 2011 the California Residential Code adopted by the
State requires that any new one and two family dwellings built must have sprinklers. If
an alteration is going to be made to an existing building, there is no requirement that
sprinklers be installed.
Mayor Pro Tern Robles requested clarification that as a general law city, the State
makes laws for the City.
City Attorney Adams explained even charter cities are required to enforce State laws.

AGREEMENT; WITH WEBB ASSOCIATES, IN THE AMOUNT OF $ 12,880.00,

14.Grand Terrace Draft Local Hazard Mitigation Plan
Sandra Molina, Planning and Development Services Director introduced Ethan Mobley,
Dynamic Planning and Science.
Ethan Mobley gave the PowerPoint presentation for this item.
Jeff McConnell, Grand Terrace pointed out areas in the City that he believes will benefit
from the Mitigation Plan and free dirt that can be used where the land has slumped.
1) RECEIVE THE FINAL DRAFT OF THE LOCAL HAZARD MITIGATION PLAN;
AND
2) DIRECT STAFF TO SUBMIT THE FINAL DRAFT TO THE STATE FOR
REVIEW.

H. CITY MANAGER COMMUNICATIONS
G. Harold Duffey, City Manager explained that the City has developed a standardized
yard sale sign that will have a QR code that leads directly to the City's website.. It will
also have a white board where the arrows and addresses can be placed. The City.will
issue five (5) yard sale sign per resident and will re3quire a $25.00 to $50.00 deposit.
When they return the signs, they will receive their deposit back. The signs can also be
placed in the public right of way and should resolve any issues regarding conformity.
The signs cannot be posted on stop signs or telephone poles.
Mayor McNaboe asked if the deposit replaces the original fee that was charged.
City Manager Duffey explained they would pay $5.00 for their yard sale, pay the deposit
and then receive the five (5) yard sale signs.
