Ordinance Updates for Requirement of a Permit for Parkway Tree Pruning G. Harold Duffey, City Manager stated that this ordinance was to be re-written to ensure property owners understand that they were going to need to obtain a permit to trim the trees. The way the Ordinance is written it limits their ability to address hazards and obstructions of streets and sidewalks. The change to the Ordinance will allow the residents to be able to prune the tree and'bushes to address any hazards or blocking the public right of ways. Alan French, Public Works Direction gave the PowerPoint presentation for this item. The amended language to Section 12.28.140 (Maintenance and Pruning) of Title 12 (Streets Sidewalks and Public Places) is hereby amended and outlined in italics and bold to read as follows: B. The trees and ground cover shall be maintained so as not to constitute a hazard and in addition, to avoid interference with vehicular or pedestrian use of streets and sidewalks, the property owner shall be required to maintain trees and shrubbery in such a manner.so as not to encroach into or over any adjacent sidewalk or street. C. .' Absent special circumstances and approved by the City, encroachment is defined as a minimum of eight feet of clearance above any sidewalk and 15 feet above any street.. No permit is required to remove the hazard or correct the encroachment. 1. PUBLIC COMMENT David Laskowski, Grand Terrace expressed his concern regarding the need for maintenance on the `speed bumps, school crossing and street signs located on Brentwood Street near Terrace View Elementary School. G.. Harold Duffey, City Manager requested clarification on which signs needed replacement. Reece Purdie, Grand Terrace provided a letter to the City Council highlighting her concerns about a steep hill located on S. Mount Vernon Avenue between E. Washington Street in Colton and E. Canal Street/Grand Terrace Road in Grand Terrace which she believes is a dangerous condition, especially at night. She is requesting installation of a walkway on the exterior portion of the guardrail and more lighting for pedestrian protection. City Manager Duffey explained that the City of Colton is responsible for the majority of that portion of the road, however he stated the City will work with them to coordinate possible funding through the local regional group that can obtain funds for these types of roadway projects and bring it back to Council. Jeff McConnell, Grand Terrace is concerned about the dumping taking place at the north end of Terrace Avenue on private property. He has seen Burrtec and the City of Grand Terrace maintenance crews at that location clearing trash and asked why taxpayers are paying for private property trash removal. City Manager Duffey stated that the City's maintenance crews will assist with trash removal when it is close to the street and is causing a hazard. CITY COUNCIL COMMUNICATIONS Council Member Brian Reinarz Council Member Brian Reinarz would like to have a discussion on a future agenda addressing sign ordinance fees. Council Member Bill Hussey Council Member Bill Hussey thanked everyone for coming out to the meeting. He announced that Citizens on Patrol is looking for volunteers and stated joining is a great way to serve the community and help prevent crime. Go to the City's website, contact any member or staff or contact Council Member Hussey directly and the information on how to volunteer will be provided. He attended the Grand Terrace High .School Community Event and thanked the volunteers for helping to put the event together and thanked Assembly Member Reyes for attending. Council Member Hussey announced that Friday Night Lights will. return along with other high school activities such as volleyball and tennis just to name a-few. He also wanted to give a shout out to the band that was instrumental in rallying everybody together. Council Member Hussey reminded residents to attend Dinner & the Community Workshop hosted by the San Bernardino County Sheriffs Department on Thursday, August 24, 2017 beginning at 6:30 p.m. at Azure Hills Church in the small Fellowship Hall. He stated Lieutenant Wolfe will be providing residents with information on how they can assist the Sheriffs Department to help prevent crime in the City. Council Member Hussey would like to have discussion on commercial parking in the City..He witnessed a vehicle parked by the fire department and had concerns that it was causing a safety hazard. He would like to discuss limited commercial parking or eliminating it altogether. Council Member Doug Wilson Council Member Wilson had nothing to report. Mayor Pro Tern Sylvia Robles Mayor Pro Tem Robles attended an Omnitrans Administrative Committee Meeting, however she will report out on the particulars after the full Board acts on those items. She attended the local opening soccer tournament, although it was extremely hot, and wanted to praise those parents who are committed to their children's sporting activities. Mayor Darcy McNaboe Mayor Darcy McNaboe attended the San Bernardino County Transportation Authority General Policy Committee Meeting and discussed the following: City of Grand Terrace Page 4 Minutes Grand Terrace City Council August 22, 2017 • Received the June and July 2017 Procurement Report • Received a report on Measure I revenue receipts for Measure 1 2010-2040 • Received and reviewed Measure I Local Pass-Through Compliance Audit for the City of.Adelanto • Recommended that the Board change the Flexible Benefits Plan and that will. reflect the organization's name change • Approved a FY 2017/2018 budget amendment to increase structural engineering services needed for the San Bernardino Santa Fe Depot basement repair • Received information on Electric Vehicle Charging Infrastructure Projects SBCTA's for the parking.lot at the Metrolink Station and Transit Center • Approved a pilot program that will extend the Freeway Service Program to weekends along the areas where it is most needed for a five (5) year trial period • Received the August 2017 State and Federal Legislative Update ..On August 10, 2017, Mayor McNaboe attended the Metro Valley.Study Session which was combined with the Transit and Rail Committee and discussed the following: • Recommended to the Board that they receive and file a change order report for both the Project Delivery for transit and large projects • Received the Fourth Quarter Right-of-Way Grants Use Reports • Reviewed and recommended, for final approval by the Board of Directors, an Amendment to the Cooperative Agreement with the City of Ontario. This is an i agreement for acquisition of a property necessary for. the Archibald Avenue Improvement Project at State Route 60. • Received information and recommended that the Board approve a Rideshare Pilot Project opportunity with Loma Linda University Medical Center • Reviewed and recommended to the Board a number of items which included Enterprise Rideshare Vanpool Leasing Services and a Marketing and Branding Campaign for that vanpool program • Reviewed an update to the Measure 1 2010-2040 Strategic Plan • Approved a contract with Southern California Regional Rail Authority for the design and construction support of the Eastern Maintenance in Facility for the Downtown San Bernardino Passenger Rail Project • Recommended the Advanced Conceptual Engineering for the Montclair Segment of the Metro Gold Line Foothill Extension Project • Recommended approval of Addendum Nos. 1, 2 and 3 to the Redlands Passenger Rail Project, the WSP USA Agreement amending the Construction Management for the Downtown San Bernardino Passenger Rail Project and Eastern Maintenance Facility Project • Awarded a contract to AMMA Transit Planning for the Development of Low Carbon Transit Operations, Program Transit Marketing and Fare Subsidy Services • Received information on the Long Range Transit Plan City of Grand Terrace Page 5 Minutes Grand Terrace City Council August 22, 2017 Mayor McNaboe enjoyed the soccer-opening ceremonies and the Grand Terrace Titans Community Kickoff. She stated these are wonderful examples of the Grand Terrace Community coming together to put together programs for the children and witness the involvement of parents in activities for our youth. She was honored to attend the Eagle Court of Honor for Ash Randhawa of Troop 40. Council signed the Commendation for him; however she attended the ceremony and presented the Commendation on behalf of the Council and the City. Mayor McNaboe attended the 1st Annual San Bernardino County Economic Forecast with Dr. Christopher Thornberg. He is with the UCR Center for Economic Forecasting and has been preparing.an economic forecast for Riverside County. It is now looking to conduct an Economic Forecast for San Bernardino County. The three (3) takeaways from his presentation are that the Inland Empire job growth is outpacing the state by a 2.7% increase compared.to 1.7%. The demand for housing in the Inland Empire has felt the strongest construction activity in nearly ..a decade and business activity has grown for twenty-one (21) straight quarters. E. PUBLIC HEARINGS 5. Public Hearing Relating to the Adoption of Residential and Commercial Solid Waste and Recycling Rate Increases- Mayor McNaboe opened the public hearing'at 6:30 p.m.. City Clerk Debra Thomas read a protest letter into the record that was received from resident Zeke in opposition to the proposed increase for solid waste and recycling rates. Alan French, Director of Public Works gave the presentation for this item. Council Member Hussey asked if Burrtec offers senior assistance programs and if so, can the City assist those seniors with completing the appropriate paperwork to qualify. G. Harold Duffey, City Manager explained that the needs of a resident could be assessed and based on those needs; the resident could receive a smaller container which would be more cost effective. Mike Aragon, Vice President, Burrtec Waste stated that Burrtec has a variable can rate which is for a 96 gallon and a 65 gallon. The difference in savings is based on disposal. He explained that issues in many cities were raised that senior rates were preferential. To combat that perception, Burrtec created adjustable rates based on size of container which are.available for everyone. Mr. Aragon stated that Burrtec has smaller containers that could be placed.in the City's inventory if it so chooses. T. Leon Berry, Grand Terrace is opposed to raising rates for solid waste and recycling. City of Grand Terrace Page 6 Minutes Grand Terrace City Council August 22, 2017 Jeff McConnell, Grand Terrace asked if Burrtec provides smaller containers for recyclables. Mr. Aragon explained that the smaller container they have in stock is 35 gallons. Generally there is some savings, however a lot.of times the amount of savings versus the volume or capacity that you have in a 65 to 95 gallon, most people feel that is not enough of a break. The break is based on the capacity or volume of trash out there. If there are seniors or disabled individuals who need assistance, Burrtec offers free pull out and setback for those containers by its drivers. If those containers are something the council would like Burrtec to look into and develop a rate for the City, Burrtec can bring that back to Council. Mayor McNaboe closed the public hearing at 6.45 p.m. Mayor Pro Tern Robles asked if an individual moved to a smaller container and had, on occasion, a larger volume of waste, how would that affect the ratepayer's contract. Mr. Aragon explained that if Burrtec is notified in advance that a resident is going to have excess trash due to a party or event, Burrtec will document the ratepayers file and pick up those extra bags that do not fit in the smaller container. 1. An Ordinance to Repeal Chapter 9.32 (Regulation of Registered Sex Offenders) of Title 9 (Public Peace, Morals and Welfare), Relating to Sex Offenders and a Finding that the Ordinance is Exempt from CEQA Review Richard L. Adams, 11, City Attorney gave the PowerPoint presentation for this item. Council Member Hussey commented that he is disappointed that the Council is being forced to repeal its Ordinance because it is being threatened with a lawsuit if it does not. . �l City of Grand Terrace Page 7 Minutes Grand Terrace City Council August 22, 2017 Mayor Pro Tern Robles asked the City Attorney to explain how the City's Ordinance �i violates a registered sex offender's constitutional rights. Keith Collins, Deputy City Attorney explained that a case coming from San Diego was brought by parolees which were subject to San Diego County's local restrictions which further restricted where they could live. The court analyzed the effect of those restrictions on their constitutional rights to live and work and participate in society. The .court found that the restrictions imposed by the County of San Diego prevented them from functionally living in that jurisdiction and that it actually frustrated the purpose of the regulations regarding residencies and monitoring of registered sex offenders. For that reason the court struck down those local ordinances as unconstitutional violations of the registered sex offender's civil rights. City Attorney Adams asked Deputy City Attorney Collins to explain what would happen if someone challenged the Ordinance and was successful in court; what would be the consequences to the City. Deputy City Attorney Collins explained when someone brings a lawsuit for violation of their civil rights they bring it under U.S. Code § 1983 which gives the person who prevails in the action, the right to collect attorney's fees from the opposing party. In the event a .lawsuit is brought agai.nst the City; alleging that its local ordinance is unconstitutional and it prevails, the City will be required to pay for those legal costs in addition to their own legal fees. U Council Member Hussey commented on the fact that taxpayers would be responsible for the cost of a lawsuit if the City does not repeal its. Ordinance, however he doesn't want to waste their money on a frivolous lawsuit either. He asked what it would cost to fight a lawsuit if one is brought forward. Deputy City Attorney Collins explained it could cost upwards of $100,000 and dragged on for years. Mayor Pro Tern Robles asked what is the substantial difference between State law and the City's local enhancement of the law. Deputy City Attorney Collins stated State law does not regulate personal conduct which means the registered sex offender is not prohibited from entering a location where children are present. That is where the City's local ordinance kicks in-'to provide additional restrictions on registered sex offenders. Mayor Pro Tern Robles asked how a sex-offender is designated a non-parolee. Deputy City Attorney Collins stated the sex offender would have been released from prison, discharged from parole but the requirement that they register as a sex offender could last longer. City of Grand Terrace Page 8 Minutes Grand Terrace City Council August 22, 2017 Mayor Pro Tern Robles asked if a registered sex offender could go into a school as long as they have a reason to be there. Deputy City Attorney Collins stated that a legal guardian or parent who is a registered sex offender can enter a school. There are some exceptions in State law that does allow them to conduct lawful business at a place where children regularly gather. Council Member Reinarz stated that the local schools are closed campuses and even he cannot go into the school without going through the office. His concern is the parks which are open. Deputy City Attorney Collins stated that the Court of Appeal found local ordinances to be unconstitutional. City Manager Duffey stated that the Resolution allows each Council Member to appoint a member to the Parks & Recreation Committee and he will be in touch with the Council Members to get those recommendations and come back with a report that identifies the ' membership body for the Parks& Recreation Committee. Harold Duffey, City Manager gave the PowerPoint presentation for this item. i Council Member Hussey asked if any of the bond proceeds can be used for lighting at the location that public speaker Reece Purdie spoke about; the steep hill located on S. Mount Vernon Avenue between E. Washington Street in Colton and E. Canal Street/Grand Terrace Road in Grand Terrace. City Manager Duffey explained that the City will need to get together with the City of Colton and perform an assessment of the area and come up with a joint project and possibly receive funding through SBCTA or the City's bond proceeds. He believes the lighting is an issue; however the slope of the hill is a significant issue and needs to be addressed with the City of Colton. Mayor Pro Tern Robles would like to tighten the list a little more and prioritize those projects with the most need. Jeff McConnell, Grand Terrace has suggested more ALPR cameras and believes that falls heavily under quality of life and will help solve crimes. Mayor McNaboe would like more trees around the outside of the play area at Richard Rollins Park which would provide more shade but not necessarily under the current bond proceeds list;.that can be addressed in the future. She would like to focus on the core services that the City needs to provide and then address the items that,would be nice to have. With respect to the 15% bond proceeds, she would like to see that go more towards a major infrastructure project as it was intended' when the City sold the bonds which would mean finding other matching grants and funding sources and working with other agencies. Mayor Pro Tem Robles would like to leave the list open ended and add the ALPR cameras and the infrastructure focus, then you can bring those back item by item. She asked how much the ALPR cameras cost. City Manager Duffey stated ALPR cameras are $15,000 per lane. Two (2) are on Barton Road at Honey Hill and two (2) will be placed at Main and Michigan. Approval of Information Systems Support Agreement Cynthia Fortune, Assistant City Manager gave the presentation for this item. Frank Barbarossa, President of On-Site Computing expressed his appreciation for the invitation to the Council meeting and as a past resident he was happy to be back in the City. He is looking forward to providing reliable services for the City's IT support and infrastructure. City of Grand Terrace Page 10 Minutes Grand Terrace City Council August 22, 2017 Council Member Hussey asked On-Site Computing if the City's server and phone -- system need to be upgraded. Mr. Barbarossa will be performing assessments of the equipment and infrastructure and make recommendations. Council Member Hussey asked if that would be a separate cost from the contract amount. Mr. Barbarossa stated it would depend on what those upgrades are; the proposal includes quite a bit of project work. The goal is to support the City, its members and only spend money when absolutely necessary. 1. APPROVAL OF AN INFORMATION SYSTEMS SUPPORT AGREEMENT; AND 2. NEW BUSINESS 10.Municipal Code Amendment 17-02 to Add Chapter 15.26 Electrical Vehicle Charging Station Streamlined Permitting Process to Title 15 of the Grand Terrace Municipal Code Sandra Molina, Planning and Development Services Director gave the presentation for this item. Council Member Wilson asked if there were any guidelines the State will provide for those applying for an Electric Vehicle Charging Station permit to assist with the streamlining process. Director Molina explained that the State has a plug in Electrical Vehicle Infrastructure Permitting Checklist and also a Readiness Guidebook that the City can refer to. The City will not reinvent the wheel; it will borrow what other cities have in place. Council Member Hussey wanted to make sure that the lease agreement beginning date between the City and FSA is not going to change. G. Harold Duffey, City Manager stated the original date is in place. FSA is a complete operating facility, the City is collecting the revenue and they are operating with a full staff. The City is waiting until the final letter is issued. 1. APPROVE AN AMENDMENT TO THE INTERIM CHILD CARE SERVICES AGREEMENT TO EXTEND THE AGREEMENT WITH FAMILY SERVICES ASSOCIATION FROM.AUGUST 31, 2017 TO SEPTEMBER 30,2017; 2. Harold Duffey, City Manager reminded everyone that the Public Safety Dinner & Information Session will be held on August 24, 2017 at 6:30 p.m. in Azure Hills Church. Lieutenant Wolfe will be the guest speaker. This will allow the residents to get some data on the City of Grand Terrace. The City Clerk will also provide information on how they can help increase the level of public safety service. City of Grand Terrace Page 12 Minutes Grand Terrace City Council August 22, 2017 City .Manager Duffey also announced on Tuesday, August 29, 2017 at 6:00 p.m. r everyone and their dog is invited to the Grand Terrace Dog Park Ground Breaking Ceremony. Grill-A-Dog will be there to provide dinner. City Manager Duffey also informed the Council and community that Community Clean Up Day will be held on Saturday, September 30, 2017 from 8:00 a.m. to 12 p.m. and encouraged everyone to bring their bulky items and a-waste to City Hall at 22795 Barton Road where Burrtec will be there to collect those items. City Manager Duffey commented that there has been chatter on Facebook and some similar sites about the City's Sign Ordinance. To clarify, he stated a permit can be obtained to place a sign and a realtor has the ability to place 25 signs. The pre-printed sign must identify who the broker is. He also described the difference between legal and illegal signs. . Mayor Pro Tern Robles asked for clarification on the topic of yard signs and whether or not they can place.the signs in their car. She also wanted to remind residents that they had a two (2) year opportunity to provide input on the sign program and also shared with the community that they can come to a Council meeting and provide input or write a letter to the City Clerk who will present it to Council at their meeting. Sandra Molina, Planning and Development Services clarified that yard sale signs can be placed on the car; however they cannot place the car somewhere else in the City to ' direct people to the yard sale.
