City of Grand Terrace Page 2 Minutes Grand Terrace City Council and Successor Agency August 8, 2017 - C. PUBLIC COMMENT Dustin Reilich, Senior Director of Market Development for the HERO program. Mr. Reilich stated that his agency has joined with the CSCDA Joint Power Authority through the League of California Cities and wanted to provide an update for the City on the HERO Program. Mayor McNaboe stated she had a meeting with Mr. Reilich and suggested to Council if they are 'interested, in the HERO Program being agendized, please inform the City Manager after the meeting today. Jeff Allen, Grand Terrace provided information on some legislation that is before the State Assembly and State Senate. Senate Bill 35 is the planning and zoning affordable housing act which would remove and restrict the control of the local community over multi-family housing development. Senate Bill 649 requires local government to lease public land to telecommunication companies that takes away the fair use fees and does not give the local municipality the opportunity to negotiate for public benefits .and caps the fair use fees at an unreasonable rate. Mayor McNaboe welcomed the arrival of Mayor Pro Tern Robles at 6:12 p.m. D. CITY COUNCIL COMMUNICATIONS Council Member Brian Reinarz Council Member Brian Reinarz commented on a deputy involved shooting in the City where a young man lost his life. The men and women of the San Bernardino County Sheriffs department are to be commended for their professionalism and devotion to the safety of the residents of the City of Grand Terrace which was on clear display during the incident. Council Member Reinarz wanted to extend his heartfelt best wishes and prayers to this young man's family and friends. Council Member Bill Hussey" Council Member Bill Hussey thanked everyone for coming to the meeting. He.wanted to thank the Sheriffs and first responders for everything they did on the evening of the shooting incident that took place in the City of Grand Terrace, by protecting its citizens and residents. He also wanted to thank City Staff for opening up City Hall for those residents who wanted-a safe place to go. Council Member Hussey extended his prayers to the family and commented on the serious_ nature of PTSD and stated there are resources out there for those to get help: Council Member Doug Wilson Council Member Doug Wilson stated PTSD affects many people, not just war veterans. He was saddened by the event. He wanted to thank the Sheriffs for their activity, how they handled the incident and were very professional. City of Grand Terrace Page 3 Minutes Grand Terrace City Council and Successor Agency August 8, 2017 Council Member.Wilson commented Governor Brown's recent signature on a water bill that would result in a water basin plan. All of the water basins up and down California are obligated to prepare a plan. The responsibility for managing the water supply has fallen upon the district themselves. Our water district is adjudicated and equipped the plan obligation; however communities still need to be aware of the existing drought conditions. Mayor Pro Tern Sylvia Robles Mayor Pro Tem Sylvia Robles asked Mayor McNaboe to adjourn the City Council meeting in memory of,Eulalio Aldaco, father of residents Alfonso Aldaco and his wife Beverly who is a member of the Grand Terrace Women's Club. He was 99 years old and before his wife died 3 years ago, they had celebrated 74 years of marriage. Mayor Pro Tern Robles shared a story from her childhood about growing up with the Aldaco family. Mayor Darcy McNaboe Mayor Darcy McNaboe wished Mayor Pro Tern Robles a happy belated birthday. Mayor McNaboe expressed her thanks to the Sheriff's Department and the fine job that they did during a very tough situation. Mayor McNaboe stated that Sergeant Silva helped her fully understand the resources that are provided to the City of Grand Terrace when it's really needed, no matter what the situation. She extended her prayers to the family and friends of the young man who lost his life that day and wanted to also thank the community for providing support to the family. E. PUBLIC HEARINGS -NONE F. UNFINISHED BUSINESS PROJECT UPDATE CHP DevCo Property Location: 22273, 22293 & 22317 Barton Road Brian Tracy, CHP DevCo provided a progress report regarding the properties listed above. Mr. Tracy stated there are over a dozen interested retailers in the property. He provided a description of the preliminary site plan for the property. Mr. Tracy indicated some of the interested retailers expressed their desire to have access to the signal light located at Canal Street. Discussions need to be held with Brookdale to resolve the right of way .access to the signal light which will also address safety entering and exiting the property. Harold Duffey, City Manager reiterated that Council entered into an Exclusive Negotiation Agreement with CHP DevCo, which is a ninety (90) day process and after ninety (90) days, an agreement will need to be reached for disposition and development of the property which will come back to the Council for discussion. G. NEW BUSINESS 10.Review and Recommend Projects for Further Assessment and Funding with Excess Redevelopment Bond Proceeds G. Harold Duffey, City Manager gave the PowerPoint presentation and a brief history for this item. He also explained that for each project listed that Council would be interested in, would come back individually at a future date for approval. City Council took this opportunity to weigh in on the project list proposed. Mayor Pro Tern Robles believed the project list was substantially amended and wanted to make sure that the public had enough notice to review the changes on the project list. She does.not want to invest anymore money into the Palm/Barton Digital Billboard. She would like to look into the Library Expansion. With regard to the Veterans Freedom Park, she recalled some interpretative and oral projects discussed in the past. She would Like to have some discussion on Michigan Street as there are no sidewalks or lighting and add some trees. She stated Omnitrans comes in and speaks with City representatives and they have quoted bus shelters at $50,000 .and the difficulty of serving high school students because of Michigan Street and also the bus route. That is a major interchange between people ferrying from Riverside and she would like it looked into further. Council Member Hussey and does not want to pursue investing any money into the Palm/Barton Digital Billboard. He is concerned about Richard Rollins Park and the Child Care Playground and the possibility of injury to a child. He asked if the City is going to replace the playground equipment at Richard Rollins Park with equipment that will last. City Manager Duffey described alternative options for playground equipment. Jeff Allen, Grand Terrace-stated he has taken his grandchildren to Richard Rollins Park on a regular basis and has found broken glass on more than.one occasion in the wood chips. He recommended that Council research the rubber mat surface in place of wood chips as you will be able to see anything dangerous lying on the mat versus hiding in between wood chips. Mr. Allen also asked that discussions begin on trying to recover and restore Cage Park. Jeff McConnell, Grand Terrace suggested more ALPR cameras be placed throughout the community for resident safety. City of Grand Terrace Page 5 Minutes . Grand Terrace City Council and Successor Agency August 8, 2017 Karina Roach, No Fault Sport Group wanted to provide examples of the rubber surfacing for Richard Rollins Park and provided some suggestions on lowering the cost. City Manager Duffey provided a cost comparison between wood chips and rubber mat surfacing for Richard Rollins Park playground. Mayor McNaboe expressed her desire to use rubber mat surfacing for the Richard .Rollins Park playground versus wood chips. . Council Member Hussey recommended eliminating funding for the Palm/Barton Digital Billboard and that would allow complete resurfacing of the playground area at Richard Rollins Park. Mayor McNaboe suggested shade for the fitness park. With respect to the Palm/Barton Digital Billboard, she would place that at the bottom of her wish list and she has heard from many residents stating that the sign is a distraction and unnecessary. Mayor Pro Tern Robles requested a consensus from Council that wood chips will not be used in the rehabilitation of Richard Rollins Park playground. She also asked for clarification on whether or not Cage Park is located within the city limits of Grand Terrace. Planning and Development Services Director Sandra Molina stated that Cage Park is located within the city limits of Grand Terrace and that it is privately owned. City Manager Duffey informed Council that the owners of Cage Park are trying to develop the property. It was the consensus of the City Council to: REVIEW AND RECOMMEND PROJECTS FOR FURTHER ASSESSMENT AND FUNDING WITH EXCESS REDEVELOPMENT BOND PROCEEDS . 11.Establishment of Endowment for Annual Maintenance and Equipment for Grand Terrace Dog Park G. Harold Duffey, City Manager gave the PowerPoint presentation for this item. Richard L. Adams, II, City Attorney explained to Council that the City Attorney's office prepared .an updated version of the Endowment Fund Resolution. Mr. Adams explained how a traditional endowment fund is established and the use of those funds. However, the updated version is set up to allow the use of principal funds and interest earned. Mayor McNaboe asked why the City should establish an endowment fund versus,of a savings account. City Manager Duffey stated if someone were to donate a large sum or a fixed asset, they would be more likely to donate into an endowment instead of a savings account. City of Grand Terrace Page 6 Minutes Grand Terrace City Council and Successor Agency August 8, 2017 ( Mayor Pro Tern Robles is not comfortable allowing naming rights of the dog park after the community has spent a substantial sum of money. Council Member Reinarz echoes Mayor Pro Tern Robles' concerns regarding the naming of the dog park. 'He is not a fan of someone writing a check and getting their name placed on a building or a park. He believes community members who have spent hundreds of hours on this park are actually more deserving of having their name placed on the park versus someone writing a large check. He would support the endowment without naming rights. City Attorney Adams clarified that the resolution is to set up the fund. It is the consensus of the City Council that fundraising for the dog park will exclude the naming of the park. Mike Auld, Board Member of the Foundation of Grand Terrace supports the idea of a fund to maintain the dog park. The Foundation of Grand Terrace has fundraised for the dog park and has earmarked $3,000 to donate to the endowment. Council Member Reinarz moved to support the quasi Endowment Fund allowing access to the principal. APPROVE RESOLUTION ESTABLISHING AN ENDOWMENT FUND FOR GRAND TERRACE DOG PARK FOR ANNUAL MAINTENANCE AND EQUIPMENT RESULT: APPROVED [UNANIMOUS] MOVER:. Mayor McNaboe directed the City Attorney to clarify that the City can use redevelopment bond proceeds for this item. Richard L. Adams, II; City Attorney stated that the item is not maintenance, it is rehabilitation. A member of the City Attorney's office staff conducted research to ensure that the City can use the funding for this project. Council Member Hussey asked how many more items are on the Child Care Center's repair list. G. Harold Duffey, City Manager explained that this is the last remaining repair that needs to take place before the State's inspection. AWARD CONTRACTOR AGREEMENT TO NO FAULT SPORT GROUP LLC, IN THE AMOUNT OF $ 22,326.00, FOR UPGRADING THE CHILD CARE PLAYGROUND SURFACES TO COMPLY WITH STATE REQUIREMENTS; AND 2. ADOPT A RESOLUTION APPROVING THE EXPENDITURE OF BOND PROCEEDS. RESULT:. APPROVED [UNANIMOUS] MOVER: Sylvia.Robles, Mayor Pro Tem SECONDER: Brian Reinarz, Council Member AYES: McNaboe, Robles, Wilson, Hussey, Reinarz 13.Ordinance Updates for Requirement of a Permit for Parkway Tree Pruning Alan French, Public Works Director gave the presentation for this item. Council Member Wilson asked if the permit is "no fee". Director French stated that it will be a no fee permit. Mayor McNaboe is concerned, that the City will not be able .to enforce permit requirements. She believes communicating to residents so that they understand what is in the public right of way and if it needs to be trimmed to contact the City. Council Member. Wilson asked if an incidents occurred throughout the State of Y g California where there isn't a permit allowing a person to trim a street tree where an injury occurred. Director French explained that the City is trying to avoid improper pruning or trimming whereby the tree dies. G. Harold Duffey, City Manager clarified that the item. before Council is a modification to the language of the ordinance that still requires a resident to obtain permission from the.. City to prune or time the tree in the public right of way. Mayor McNaboe does not believe the City has done enough to inform the residents that the City has a tree trimming schedule. Council Member Hussey informed City Staff that Southern California Edison chopped three (3) trees and did not remove the trees and they are unsightly. He asked if SCE came in and requested permission from the City to trim the trees. Jeff McConnell, Grand Terrace stated Maubry's Tree Service has a contract with SCE where they are required to trim trees for the safety of the public in case of a high wind storm or some other act of nature that would cause a tree or branch to fall which would cause a power outage. Sylvia Robles, Bill.Hussey,Brian Reinarz _NAYS: Darcy McNaboe; Doug Wilson 14.An Ordinance to Repeal Chapter 9.32 (Regulation of Registered Sex Offenders) of Title 9 (Public Peace, Morals and Welfare), Relating to Sex Offenders and a Finding that the Ordinance is Exempt from CEQA Review Richard L. Adams, II, City Attorney gave the presentation for this item. Council Member Hussey is frustrated that the City voted on an ordinance that would protect the City and its residents from sex offenders and that frivolous lawsuits dictate how we can and cannot protect the residents of the community. Johan Gallo, Grand Terrace worked with the National Center for Exploited Children for over fifteen (15) years and saw firsthand what these individuals went through. He suggests that the City of Grand Terrace take a stand against any lawsuits trying to change its ordinance. Bobbie. Forbes, Grand Terrace expressed her concerns regarding a neighbor whose son is a convicted sex offender and moved in with his parents when he was released. Those neighbors were treated' horribly however residents have .the right to be concerned if they feel their children's safety is threatened. Jeff Allen, Grand Terrace asked if we repeal our local law, will the provisions of State law be enough. Mayor McNaboe asked the City Attorney to clarify what the City is allowed to enforce. Richard L. Adams, Il, City Attorney stated that Jessica's Law is still on the books and it depends on the community. If you take a community and run a radius.and there is still adequate area for people to live who are registered, then Jessica's Law would be sufficient. City of Grand Terrace Page 9 Minutes Grand Terrace City Council and Successor Agency August 8, 2017 Council Member Reinarz asked what Jessica's Law restrictions are. City Attorney Adams apologized but does not have Jessica's Law available to reference. Mayor Pro Tern Robles stated the City added additional restrictions on sex offenders and needs confirmation that Jessica's Law is sufficient for the community. Mayor McNaboe asked if State law allows sex-offenders to reside closer to schools, parks and day cares. City Attorney Adams stated he believed that is the case. Council asked the City Attorney to bring back a staff report outlining what safe guards remain for the residents if the City repeals its current sex-offender ordinance. Harold Duffey, City Manager confirmed the following requests of Council: Council is not in favor of seeing a proposal brought back for wood chips. Council asked City Staff to contact Southern California Edison about chopping trees. City Manager Duffey announced the Grand Terrace Dog Park Ground Breaking Ceremony scheduled for August 29, 2017 at 6:00 p.m. He also announced the upcoming Public Safety Dinner and Information Session scheduled for Thursday, August 24, 2017 beginning at 6:30 p.m. located at Azure Hills Church. Southern California Associated Governments (SCAG) received a grant to promote safety and routes around intersections. The City contacted SCAG who provided us with various types of lawn signs. If a resident lives near a school or a busy intersection and is interested in obtaining one of these lawn signs, they can contact the City offices.
