CITY COUNCIL COMMUNICATIONS Council Member Brian Reinarz Council Member Reinarz commented that the Grand Terrace High School is not receiving very much funding. They need to replace the portable classrooms and change the way student drop-off and pick-up is set up. City of Grand Terrace Page 2 Minutes Grand Terrace City Council and Successor Agency April 11, 2017 - Council Member Bill Hussey Council Member Hussey commented that the portables at the High School, as Council Member Reinarz stated, need to be replaced. He went to the Asher Hills Easter Egg Hunt and the children had a good time. His heart goes out to the families at the San Bernardino School. Council Member Doug Wilson Council Member Wilson attended to family business. Mayor Pro Tern Sylvia Robles Mayor Pro Tern Robles experienced the passing of a 31 year neighbor. Mayor Darcy McNaboe No comment E. PUBLIC HEARINGS 6. Zoning Code Amendment 17-01, an Amendment Relating to Accessory Dwelling Units. Planning and Development Services Director Sandra Molina gave the PowerPoint presentation for this item. i Council Member Wilson asked if there were any written correspondence was received. Director Molina replied no. Resident Jeff inquired about Page 49, Item M. If both dwelling units are occupied by a party who is'_not'the owner for any period longer than sixty (60) days, one of the two dwelling units must be converted to accessory living quarters or a guest house, and kitchen facilities shall be removed from one of the units. Mayor McNaboe asked Director Molina if a dwelling unit had to be vacant more than sixty (60) days or is that a problem. Director Molina replied that if it is vacant more than sixty (60) days the kitchen has to be removed. Council Member Reinarz asked if that information was in the packet report. City Attorney Richard L. Adams, II replied that it only applies if it's not occupied by the owner. Council Member Reinarz asked if it could be vacant. Director Molina replied that it cannot. Mayor Pro Tem Robles questioned why the kitchen had to be removed and what it meant. City Attorney Adams replied that a policy is in place that property owners cannot convert �— the dwelling unit into two properties. Director Molina replied that a kitchen is a refrigerator, stove and cabinets that have to be removed if the unit is not occupied for.sixty (60) days. City Manager G. Harold Duffey added that if the owner occupies the land then it is ok, but if the owner leaves then it has to be converted back. Mayor McNaboe asked if she should recuse herself because she is a member of both the Foundation of Grand Terrace and the Grand Terrace Lions Club. City Attorney Richard L. Adams, 11 replied that she should recuse herself. Mayor McNaboe recused herself from this item. City Manager G. Harold Duffey commented that last year there was an issue that organizations came back for fee waivers. Planning and Services Director Molina stated that benefit funds are in the FY 16-17 Budget and no fee waiver is required. Planning and Development Services Director Sandra Molina gave the presentation for this item. Dennis Baxter commented that they envision everybody would have a home. Derrick Caddell commented that once the permit is issued the house would be built Within twelve (12) months. Ms. Woldermarian commented that her mother applied years ago to provide for her family. Two (2) years ago she got the call for a home in Grand Terrace, but there have . been delays in building the home. She is not sure why, but please find out why and move forward. GRANT A DEFERRAL OF THE PAYMENT OF THE DEVELOPMENT IMPACT FEES DUE PRIOR TO ISSUANCE OF A CERTIFICATE OF OCCUPANCY. 10.Memorandum of Understanding with Lewis Land Developers, LLC for 53.16 Acres of City Owned Property. Planning and Development Services Director Sandra. Molina and City Manager G. Harold Duffey gave the presentation for this item. Council Member Wilson commented that he was behind the idea on page 114 of the package but felt that it was a little early on Limits of the project as described on lines #2 below: "Except as expressly set forth in the preceding paragraph 1, City or others will be responsible for all costs and expenses associated with Taylor/Commerce north of the northerly property line of APN 1167-151-22, as more particularly depicted on Map #3 attached hereto, including, without limitation, costs and expenses associated with the acquisition of right of way and the planning, design, construction and.maintenance of all improvements. Development of the Project Property will not be conditioned upon nor shall Developer have responsibility for any activities, timing, costs or expenses for any portion of Taylor/Commerce north of the northerly property line APN 1167-151-22." Council Member Wilson asked what cost, is involved and the timing for that stretch of road. Can the City Council include a subject to line #2? Director Molina replied that if was meant to be a guideline. and that there would be a plan to outline future use and what is. needed such as water, gas, electric, etc. The specific plan will address those matters and the developer will only be able to maintain what they have. Council Member Wilson held that it's premature and that it was necessary to have a subject to the agreement plan. Mayor Pro Tern Robles pointed out that on .page 105, #5 Fair Share Allocation of Infrastructure Requirements and Mitigation Measures states that "After due analysis and consideration, City and Developer agree that the Mitigation Measures, the fair share allocations and the understandings set forth on Exhibit "B" attached hereto for the Project are roughly proportionate to the Project's impacts and do not exceed its fair share in relation to the Other Properties that either are benefiting from or would be expected to benefit from any such improvements." So, therefore, asked if City'Council was talking about fair share. Lewis commented to Mr. Hoover that they are working with the City Manager and that this is not binding, it is just an understanding of the elements. This is a .true private- public relationship; they will reach out to private owners to join them. Mayor McNaboe commented that it does not say conceptual. Council Member Wilson commented that it is not a binding contract and asked if there was an issue with adding a subject to line#2 City of Grand Terrace Page 6 Minutes Grand Terrace City Council and Successor Agency April 11, 2017 Lewis commented that they want their fair share and that this is part of the conditions of approval.
