Mayor McNaboe wanted to express her condolences to Council Member Doug Wilson
on the passing of his father-in-law this day, Eric Weirs and close the meeting in memory
of Mr. Weirs as well as Thelma Winkler-Beach, a residence since 1983 who was very
active in the community and she would have been 100 years old today.

CONSENT CALENDAR ITEM NO. 6 PULLED FOR DISCUSSION:
6. Approval of Amendment No 1. to the Professional Services Agreement Between the
City of Grand Terrace and Lagerlof, Senecal, Gosney & Kruse, LLP
Mayor McNaboe recused herself from this item.
William McKeever, Grand Terrace and President of the Board of Directors for Riverside
Highland Water Company conveyed to the City Council that its board opposes the
proposed agreement. Mr. McKeever also provided background information on Riverside
Highland Water Company and how moving forward with this item would affect the City's
residents adversely.
Jeff Allen, Grand Terrace praised Riverside Highland Water Company's efficiency and
stated it is the best water company in the Inland Empire.
Council Member Wilson stated the City's first priority was to formalize arrangements by
written agreement and of equal priority was a cooperative relationship to find out what
( J financial benefit each side could receive.
City Attorney Richard L. Adams, II provided the staff report for this item.
City Attorney Adams stated the purpose for hiring Lagerlof, Senecal, Gosney & Kruse
was to study the situation and provide advice to the City Council with regard to the
feasibility of a franchise fee agreement with the water company. Additionally this item
extends those services of Lagerlof, Senecal, Gosney & Kruse to continue with the
exploration of a franchise fee agreement.
Mayor Pro Tern Robles stated that .an amicable decision has not been made with
respect to a franchise fee agreement with the water company.
Council Member Hussey asked City Attorney Adams if the City Manager could explain
to the public what a franchise fee is and what it would cover.
City Manager G. Harold Duffey explained that a potential franchise fee would consist of
the same fee that you would pay for a cable company; a gas company, electric
company or a water company. The franchise fee is regulated by the state and can be no
less than one percent and no greater than two percent of water sales.
Council Member Hussey asked if it was too late to have dialogue with the water
company.
City Attorney Adams stated it is never too late for discussion.
Council Member Hussey asked Mr. McKeever it the water company would be willing to
-work together to find a solution to this issue.

Mr. McKeever stated that the water company has always been willing to find a way for
\J the City and water company to work together finding cost savings.
City Attorney Adams confirmed that the dialogue between the City and the water
company indicated it would decline participation in a franchise fee agreement.
Mayor Pro Tern Robles asked City Manager Duffey to confirm her understanding on all
steps that have taken place regarding discussions as to the establishment of a franchise
fee agreement.
Council, Member Reinarz commented on the length of time spent on the issue along
with the potential revenue.stream.
Council Member Hussey wanted the public to understand that the City has tried to
resolve the differences as it relates to this item without involving lawyers.

C. PUBLIC COMMENT
Robert Krause, Grand Terrace expressed his frustration with his inability to access Blue
Mountain.
Penny Radtke, Grand Terrace announced the Foundation of Grand Terrace is going to
be conducting Community Clean Up Day on April 22, 2017 in conjunction with Earth
Day.
Bobbie Forbes, Grand Terrace expressed her condolences on the loss of Council
Member Wilson's father-in-law. She also informed the City Council of the recent passing
of two other residents.
Jeff Allen, Grand Terrace stated a drone crashed into his bedroom window and asked
the City Council if any ordinance has.been put in place with respect to the use of drones
in the City.
Charles Hornsby, Grand Terrace praised the water company for its reliable service and
(� is opposed to the City establishing a franchise fee agreement with the water company.

D. CITY COUNCIL COMMUNICATIONS
Council Member Brian Reinarz
Council Member Reinar-z:attended the grand opening of a local business, The Cheer
Factory.
Council Member Bill Hussey
Council Member Hussey thanked everyone for coming to the City Council meeting. He
also attended the grand opening of The Cheer Factory.
Council Member Hussey also attended the Grand Terrace Little League opening
ceremony and gave the prayer. He also attended Grand Terrace High School's Battle of
the Bands and was able to see more projects, in depth, from Mr. Johnson's Engineering
class.
Council Member Hussey wanted to thank the San Bernardino County Sheriff's
Department for their quick response time in apprehending burglary suspects who broke
into a residence in his neighborhood. He also Wanted to thank the local neighborhood
watch and believed that the community working together helped the Sheriff's
department act so quickly.
Council Member Doug Wilson
Council Member Wilson expressed his appreciation for all of the condolences received.
on the passing of his father-in-law.
He attended the groundbreaking for a local animal hospital and enjoyed the excitement
of the family business, putting things together and creating something positive.
Council Member Wilson also enjoyed seeing the high school students demonstrate the
projects they created.
Mayor Pro Tern Sylvia Robles
Mayor Pro Tern Robles attended the Annual City/County Conference and enjoyed a
presentation given by Dr. Lucy Jones, a seismologist, who outlined the area fault lines,
gas lines and rail lines. She described how the Inland Empire's situation is more unique
due to the fact that our'mutual aid will need to come from other states and they will have
difficulties navigating to our location if an earthquake hits on the major fault lines in the
area.
Mayor Pro Tern shared her delight with the 'newest member of her family, a great-
grandson and she is expecting a great-granddaughter any day.

Mayor Darcy McNaboe
Mayor McNaboe also attended the City/County Conference and enjoyed Dr. Lucy
Jones' presentation. The thing that stood out were not only numerous fault lines but
those fault lines that intersect with petroleum, natural gas and water, as well as the
danger of fire and being cut off from water. Dr. Jones suggested the installation of shut
off valves for each of the systems to minimize the risk. Dr. Jones stated it was great to
have reinforced structures but a plan should be in place regarding the water
conveyance systems.
Mayor McNaboe attended a couple of breakout sessions: Sharing Economy and Local
Government pertaining to short term rentals in residential communities which can cause
problems for the neighbors. The City of Grand Terrace does have three short term
rentals and she believes that is something to keep an eye on.
Mayor McNaboe attended a presentation on police body cameras. The Rialto Police
Department discussed their program and believes due to .the fact that video cameras
are everywhere; their officers should have the ability to record video to refute excessive
force claims, which has been successful.
Christopher Thornberg, Director of UCR Riverside Center for Economic Forecasting and
Development provided an outlook on the area stating that California is growing faster
than the rest of the United States. One issue discussed was bringing more housing into
California. The Inland Empire is one of the fastest areas for economic growth. He also
stated that the median household incomes for the region have increased as well as
taxable sales.
Mayor McNaboe was able to have a conversation with the San Bernardino County
Assessor, Bob Dutton and he expressed his desire to speak at a council meeting and
talk about property values in San Bernardino County.
She also attended the ribbon cutting ceremony for The Cheer Factory and was happy to
see Jacqueline Ann who is a cheerleader fo.r the Ontario Reign hockey team.
Jacqueline is pursuing her passion to work with children and provide choreography,
tumbling, adult stretching, fitness and private lessons. Some of the teams will perform in
parades which will showcase the talent here within Grand Terrace.
Mayor McNaboe recently applied for membership on the executive committee on the
Joint Powers Insurance Association (JPIA) and was selected. The executive committee
meets monthly reviewing policies related to the JPIA program services and they also
carry out ex-aficionado responsibility for claims, budgets, bylaws, JPA and personnel
committees. She believes her selection will provide the City an opportunity on how to
best approach coverage for the City and take advantage of educational opportunities.
She attended the Emergency Animal Clinic groundbreaking and spoke with one of their
construction contractors. He could not say enough about his interaction with City staff,
specifically Sandra Molina. Mayor McNaboe thanked .staff for helping make this project
possible.

Mayor McNaboe attended a VIP reception with the State Attorney General at the
invitation of Assembly Member Reyes which took place at the San Bernardino County
College.
She attended a meeting, along with two Grand Terrace residents, with a Palm Springs
Neighborhood Watch. Its chairman spoke about.how his neighborhood had experienced
32 break-ins in a matter of weeks. The group decided to reconstitute its neighborhood
watch and have had much success. She stated that the Mayor attended the meeting
and stated that they had seen a 25% reduction in property crime that they attribute to
the neighborhood watch.
Mayor McNaboe stated that the 909 area code is running out of telephone numbers.
The PUC is looking at an overlay within the 909 area code with a different
implementation. For more information there will be public meetings held on April 4, 2017
at the Ruben Campos Community.Center in San Bernardino beginning at 6:00 p.m. and
on April 5, 2017 at the Redlands Community Center beginning at 11:00 a.m.

F. UNFINISHED BUSINESS
8. Professional Services Agreement with J.H. Douglas & Associates for Planning Services
Related to 40 Acres North of Vivienda Avenue
Planning and Development Services Director Sandra Molina presented the PowerPoint
presentation for this item.
Council Member Wilson stated he is surprised at the cost of this item as he believed the
City was attempting to keep the costs down.
Director Molina explained that staff determined the cost based on the .need for an
additional workshop.
Mayor McNaboe asked when General Plan will be reviewed.
Director Molina explained the General Plan was adopted approximately seven (7) years
ago so the City should set a date to re-evaluate the elements.
Mayor McNaboe asked if this process would cost less if it was part of a General Plan
review.
Director Molina stated not necessarily, it depends on whether or not there would be
changes to the map.
Anne Wade-Hornsby, Grand Terrace stated the property being discussed was originally
zoned agricultural and since it was re-zoned nothing has been placed on the property.
Ms. Hornsby would like to see the property include a green space.

Jeff Allen, Grand Terrace has .concerns about the cost of re-zoning the property as he
believes the City has to bear the cost. Additionally he asked who would be responsible
for the infrastructure upgrades needed for the increase in residents and would the City
have to assume liability for allowing construction of residences in a floodplain.
Bobbie Forbes, Grand Terrace believes there is only one property in the area 'that
needs the re-zoning. She stated that the other owners in the area-do not want the re-
zoning. She would like to see something happen with the property that is good for the
neighborhood.
Jeffrey McConnell, Grand Terrace explained that part of the property located in the area
is being sold. Other- property owners are interested in changing the area into
agricultural. He believes re-zoning the property would allow people to build mini-
ranchettes; property taxes would increase and believes the area would serve as a
destination location.
Mayor McNaboe asked ,Director Molina who would be responsible for upgrading the
infrastructure if homes are built on the property.
Director Molina stated the developer would be responsible for infrastructure
improvements.
City Manager G. Harold Duffey asked if the item will go before the City Council or
Planning Commission to re-zone the property.
Director Molina stated that if City Council .approved the. contract to move forward, the
consultant would perform workshops with property owners and the General Plan
Amendment, zone change, and development standards would be established. There
would be public hearings, .one before the Planning Commission to consider changes
and make recommendations and one before the City Council to evaluate the Planning
Commission's recommendations.
Mayor Pro Tern Robles stated that the City Council listened to public input about
whether this item should be prioritized which it has and doesn't see the need to re-
litigate. She stated staff does not have the authority to enter into a contract for $25,000
without City Council approval and that is all that is being. brought forward at this
meeting.

NEW BUSINESS
9. Professional Services Agreement with Evan Brooks Associates for Preparation -and
Submittal of an Urban Greening Program Grant Application
Planning and Development Services Director Sandra Molina gave the PowerPoint
presentation for this item.
Council Member Hussey expressed his disappointment that some members of the
public left before they were able to hear about what the City has going on and the good
things happening in the City.
Mayor Pro Tern Robles thanked staff for their excellent work and she was very happy
that staff hit the ground running on trail and park needs for the City and what they
envision for the community.

10.Award of Contract for Traffic Signal Maintenance and On-Call Emergency Services
Director of Public Works Alan French gave the PowerPoint presentation for this item.
Council Member Hussey asked if Litton and La Cadena were listed in the contract.
Mayor McNaboe remembers that the City of Colton was going to maintain the location
and we agreed to give them funds.
Jeffrey McConnell, Grand Terrace suggested the City clean the LPR cameras located
throughout the City.
Mayor McNaboe asked if the City had:a program in place to clean cameras.
City Manager G. Harold Duffey stated that the City does not have one in place; however
the installer can be contacted to come out and clean the cameras. The City monitors the
cameras weekly.

11.Review Proposed Procedure and Direct Staff to Recommend Ordinance Revisions to
Implement and Issue Revocable Encroachment Permits for New and Existing Structures
in the Public Right of Way.
Public Works Director Alan French and City Manager G. Harold Duffey gave the
PowerPoint presentation for this item.
Council Member Wilson expressed concern about the City's liability approving a
revocable encroachment permit for a new or existing structure and how would the City
address the possible liability the permit could create.
Director French stated that the property owner would execute a licensing agreement
stating the owner accepts the liability for the object that could cause problems.
Council Member Wilson asked if liability became an issue,-would it'constitute a lien on
the property.
City Attorney Richard L. Adams, II stated the revocable encroachment permit would
provide indemnification on behalf of the City and would also have an insurance
requirement that would be recorded against the property. The revocable encroachment
permit applies not only to the current owner but any subsequent owners until such time
as the City revokes the permit.
City Manager G. Harold Duffey explained'certain circumstances where a revocable
encroachment permit would not be issued.
Council Member Hussey asked what the revocable encroachment permit costs.
City Manager Duffey stated the cost estimate would be brought back to City Council.
Council Member Reinarz asked about existing obstructions.
City Manager Duffey stated that the City . would determine when a revocable
encroachment permit would be required. If the City were approached as it relates to
ADA access, the City would need to comply with those ADA requirements.
Mayor McNaboe asked who would be responsible for removing an obstruction as it
related to ADA requirements.
City Manager Duffey explained that the property owner would be responsible for
removing the object out of the public right of way.
Council Member Wilson does not believe any obstruction should be allowed in the
public right of way other than benches or shelters for bus stops.
After reviewing a photograph in the PowerPoint presentation, Council Member Reinarz
asked why a homeowner would have to stop their wall six feet short of the sidewalk.

�- City Attorney Adams stated that the area from the sidewalk up to the fence is the City's
right of way.
Jeff Allen, Grand Terrace stated that his neighbor has a six foot retaining wall built in the
City's right of way and believes a lot of the older homes are in the same situation.
