05/14/1998 V CITY OF GRAND T RRACE CITY COUNCIL NUNUTES REGULAR COUNCIL MEETING-MAY 14, 1998 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on May 14, 1998 at 6:00 p.m. P FS Me Byron Matteson, Mayor Dan Buchanan, Mayor Pro Tem Herman Hilkey, Councilmember Jim Singley, Councilmember Lee Ann Garcia, Councilmember Tom Schwab, City Manager John Donlevy, Assistant City Manager Brenda Stanfill, City Clerk Bernard Simon, Finance Director Patrizia Materassi, Community and Economic Development Director Lt. Mike Howell, Sheriff s Department ABSENT: Virgil Barham, Building & Safety Director John Harper, City Attorney The meeting was opened with invocation by Dr. Paul Reed, Terrace Crest Baptist Church, followed by the Pledge of Allegiance led by Councilman Jim Singley. SPECIAL.PRESENTATIONS 2A. Proclamation - Mental Health Month, May 1998 Councilmember Hilkey read a proclamation proclaiming May as Mental Health Month in the City of Grand Terrace. Mayor Matteson presented the proclamation to Mr. Ed O'Neal on behalf of the San Bernardino Mental Health Commission. 2B. Proclamation - Water Awareness Month - May 1998 Mayor Pro Tem Buchanan read a proclamation proclaiming May as Water Awareness Month urging all citizens to be responsible water users and protectors. Mayor Matteson presented the proclamation to Mr. Gene Mc Means from Riverside Highland Water Company. 2C. Water Awareness Poster Contest Winners (Terrace View) Mr. Gene Mc Means from Riverside Highland Water Company thanked the Council for allowing them to have the opportunity to present the winners of the Water Awareness Month Poster Contest "Keep it Safe - Don't Pollute." He introduced Maryetta Ferre', Principal from Terrace View Elementary School who will make the presentation to the Council Minutes May 14, 1998 Page 2 children. Maryetta Ferre', stated that the relationship with Terrace View Elementary School and Riverside Highland Water Company is a great experience for everyone involved. She stated that each teacher from each class Kindergarten through Sixth Grade present four posters to be judged. The judges select first, second, and third place winners from grades first through sixth. Out of all of the first through third place winners a sweepstake winner is chosen and receives a$100.00 savings bond. Mrs. Ferre' introduced all of the winners from each grade and announced the sweepstake winner. Assemblyman Granlund made a presentation to the Council regarding AB 1776 repeal of the car tax. He stated that the State's economy is doing well and that releaving this tax will help to increase sales and in turn the local governments and the State will benefit from additional car purchases. As proposed, the Cities will not lose the money that they would normally receive from vehicle registration fees, it will be shifted from other funds, therefore local governments will not lose any funds. MSC Trainor, Advocate Schools presented a$5,000 check to the City of Grand Terrace to help with the celebration of the 20th Anniversary. CONSENT CALENDAR CC-98-47 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNC]LMEMBER HH-KEY, CARRIED 5-0, to approve the following consent calendar items: 3A. Approval of Check Register No. 051498 3B. Ratify 05-14-98 CRA Action 3C. Waive Full Reading of Ordinances on Agenda 3D. Approval of 04-23-98 Minutes 3E. Economic Development Division Progress Report 3F. CDBG - Senior Center HVAC Project 3G. CDBG - Authorization to Program Funds Resolution 3H. Temporary Street Closure for Block Party - Emerald Street PITRLW C'O DUM Halstead, 21894 Vivienda Avenue stated that he has been battling with the code enforcement division of the City of Grand Terrace over code violations on his property for the last several years. He stated that he no longer has resources to allow him to continue battling the City over this issue. He expressed his dissatisfaction with how things have turned out. LIM Community Services Officer reported that Grand Terrace Days will be held on June 13, 1998. She reported that T-shirts are on sale and can be purchased at City Council Minutes May 14, 1998 Page 3 Hall. KenKen_ idna, 12219 Pascal, stated his dissatisfaction with the City's efforts on enforcing the codes throughout the City. He feels that the enforcement of the codes should be lightened up. tP hanie Murphy Penn, 22512 Raven Way, stated that she is a long time resident of the City of Grand Terrace. She expressed her dissatisfaction with the enforcement of the codes and the way they are enforced. She feels that it is unfair that RV's are allowed to be parked on properties and tent trailers cannot. She urged the Council to allow the enforcement of codes to be more lenient. Michael Perry, 22512 Raven Way, expressed his dissatisfaction with the enforcement of the codes. Barbara Pfennig ausen, 22111 Ladera Street, commended the Council for standing their ground with Assemblyman Granlund. She feels that if the State is doing so well when do they start giving us back what they have taken from us in the past along with what we receive. She feels that there is a need to have codes for decency and to see that the community is a pleasant and safe place to live, however, she also feels that the community needs to be turned back to being a loving and caring place. Councilmember Hilkey, stated that Mr. Halstead had an opportunity to do the necessary improvements to his property and chose not to. He stated that Mr. Halstead doesn't always report all of the facts. He feels that the Council worked with Mr. Halstead to try and make things work. Councilmember Sineley, concurred with Councilmember Hilkey. He stated that the Council represents the community and that they will look into the code enforcement issues that have been brought before the Council. He urged the residents to be aware of people who support their cause that have political agendas. let phanie Murphy P=, stated that she feels that if residents are going to be cited for code enforcement issues that everyone needs to be cited, not only those that are complaint driven. Councilmember Hilkey, requested clarification on the difference between a RV and tent trailer. LAy Halstead, stated that he feels that he tried to address the concerns of the.Council, however, he feels that he was denied the due process. ORAL REPORTS 5A. Committee Reports Council Minutes May 14, 1998 Page 4 1. Historical and Cultural Activities Committee (a) Minutes of 04-06-98 CC-98-48 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY MAYOR PRO TEM BUCHANAN, CARRIED 5-0, to accept the April 6, 1998 Minutes of the Historical and Cultural Activities Committee. 2. Park and Recreation Committee (a) Minutes of 04-06-98 CC-98-49 MOTION BY MAYOR PRO TEM BUCHANAN, SECOND BY COUNCILMEMBER GARCIA, CARRIED 5-0, to accept the April 6, 1998 Minutes of the Park and Recreation Committee. 5B. Council Reports Mayor Matteson, stated that he and the City Manager attended the Blue Ribbon celebration through the Sheriffs Department. He reported that Grand Terrace Days will be held on June-13 and also on June 13 will be a flag pole dedication at Pico Park. Assistant City Manager DonkVy, stated that as a part of an Eagle Scout Project Cotie Sorenson has raised approximately $1,800 for the purchase of a flag pole. He received donations from various businesses and individuals. The flag pole will be dedicated on June 13 in conjunction with the closing day of the Grand Terrace Little League and flag.day. Mayor Pro Tem Buchanan, reported that he attended.the Friends of the Library Rare and Unusual Book Auction and felt that it was interesting and a fun experience. . He also attended the annual Art Show which was very well done. Councilmember Garcia, complimented the Historical and Cultural Activities Committee on their annual Art Show. She suggested that maybe some of the art could be displayed at City Hall. She reported that $12,500 has been raised from sponsorships for the 20th Anniversary Celebration. Anyone interested in becoming a sponsor of this celebration is encouraged to contact the City Clerk's Department. She also reported that the Garden Club will be meeting on May 20 at 3:00 p.m. at the Terrace Retirement Hotel. She reported that Mayor Pro Tem Buchanan will be the speaker at the Chamber Luncheon on 'May 19 and encouraged everyone to attend. C uncilmember Hilkey, complimented Pico Park. He reported that Arco Station has a great mechanic and is fair in price. He stated that there are some great businesses in Grand Terrace that everyone can and should take advantage of. Councilmember Sind ev, stated that based on Councilmember Hilkey's comments he now uses a local dry cleaner and commended him for all of his community support. - He reported that he attended the SANBAG meeting last week and that they will be looking Council Minutes May 14, 1998 Page 5 into the budget. An Ordinance of the City of Grand Terrace, California, Amending Chapter 13.12 of the Grand Terrace Municipal Code Regulating the Discharge of Wastes into the Sewerage System of the City of Grand Terrace. Mayor Matteson opened discussion to the public Barbara Pfennigbausen, 22111 Ladera Street, questioned whether there was any financial impact as a result of these revisions. Assistant City Manager DonlM, responded in the negative. Mayor Matteson returned discussion to Council. CC-98=50 MOTION BY COUNCH MEMBER GARCIA, SECOND BY MAYOR PRO TEM BUCHANAN, CARRIED 5-0, to approve the first reading of an Ordinance of the City of Grand Terrace, California, Amending Chapter 13.12 of the Grand Terrace Municipal Code Regulating the Discharge of Wastes into the Sewerage Systems of the City of Grand Terrace. UNFESISHEn BUSINESS - None NEW BUSENMS 8A. Code Enforcement Program Update Assistant City Manager Donlevy gave a presentation updating and reviewing the Code Enforcement Program. He stated that in October, staff presented a number of goals and philosophies to outline the implementation of the Code Enforcement Program and include the following: Education and Preventative Maintenance, Make the City aesthetically pleasing, healthy and a safe place to live, Obtain voluntary compliance through education and Utilize formal proceedings as a last resort. To date the program has progressed very successfully. The process has been thoroughly reviewed by both the City Attorney, as well as the Environmental Court Judge who oversees Code Enforcement proceedings, and has approved each element of the program. The City has also enacted a number of best practices for Code Enforcement. A comprehensive database has been established to track cases and the use of a digital camera helps both staff and resident to record violations. For the most part the approach is positive and proactive. The main goal is to treat people in a fair and equitable manner while keeping Grand Terrace an "aesthetically pleasing, healthy and safe place to live." 8B. Update of 1998-99 Street Maintenance Program 1 Council Minutes May 14, 1998 Page 6 Assistant City Manager Donlevy gave an update on the 1998-99 Street Maintenance Program. He stated that all streets have been inventoried and rated for condition. A preliminary report on recommended action has been developed for budgeting priorities and the Five(5) Year Capital Improvement Program is in the development stages. He reported that the final reports will be completed in June and presented to the City Council in July 1998 for the implementation of a five-year program. He also stated in an effort to move toward an aggressive street maintenance program, the 1998-99 Fiscal Year Budget includes a $406,000 Pavement Maintenance Program that will include paving. 8C. Accept Resignation - Planning Commissioner Ellis CC-98-51 MOTION BY COUNCILMEMBER SINGLEY, SECOND BY COUNCILMEMBBR GARCIA, CARRIED 5-0, to accept the resignation of Gerald Ellis from the Planning Commission and authorize the City Clerk to post the vacancy to advertise to fill the unexpired term.
