12/09/2004 CITY OF GRAND TERRACE CITY COUNCIL MINUTES REGULAR MEETING-DECEMBER 9.2004 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers, Grand Terrace Civic Center, 22795 Barton Road, Grand Terrace, California, on December 9, 2004, at 7:30 p.m. PRESENT: Maryetta Ferre, Mayor Bea Cortes,Mayor Pro Tern Herman Hilkey, Councilmember Lee Ann Garcia, Councilmember Jim Miller, Councilmember Tom Schwab, City Manager Brenda Stanfill, City Clerk Steve Berry, Assistant City Manager Larry Ronnow, Finance Director Jerry Glander,Building& Safety Director Gary Koontz, Community Development Director John Harper, City Attorney Lt. Hector Guerra, Sheriff's Department ABSENT: None The City Council meeting was opened with invocation by Pastor Rick Doucette,Calvary The Brook Church, followed by the Pledge of Allegiance. CONVENE CITY COUNCIL MEETING 1. Special Presentation to Outgoing Council Member Don Larkin Mayor Hilkey presented outgoing Council Member Don Larkin with a Rocking Chair engraved with the City Logo and his name and term on behalf of the City. Don Larkin indicated that five years ago he was honored that the Council appointed him to fill a vacancy on the Council and was extremely honored four years ago when the citizens of Grand Terrace Elected him to the Council. It is his hope that he has discharged his duties properly. He stated that there were many decisions that needed to be made and at times they were very hard. He indicated that nothing was ever done personally to Councilmember Garcia even though it may have caused her pain and he apologized to her and indicated that she is a great Councilmember and good for the City. He stated that Council has to decide what would be best for the Citizens of Grand Terrace and feels that is what he has tried to do. He feels that politicians should not benefit by being in office. He feels that the Grand Terrace City Council Council Minutes December 9,2004 Page 2 truly represents those who live within the City. He indicated that he has donated his Council Stipend to one of the local charities since he was on the Council. During the time he has been on the Council he received very few phone calls and feels that most people are happy with the City and feels that it is truly a great City. He thanked the Staff that work hard and are dedicated to the City. He thanked his fellow Councilmembers and citizens. He thanked his wife for all of her support. He thanked God for giving him the strength and guidance. He gave Jim Miller the book Yurtle the Turtle. He also presented one to Councilmember Bea Cortes. He indicated that he plans on being involved in the Community. Councilmember Garcia, indicated that she will miss Don Larkin's sense of humor. She looks forward to working with him in the future. She indicated that it has been a pleasure serving on the Council with him and looks forward to a lifelong friendship with him. Councilmember Cortes,indicated that she has known Don Larkin for two years and respects him as a colleague and cares for him as a friend. She indicated that when she first came onto the Council Don Larkin immediately offered his assistance and truly appreciated the time he took with her. Mavor Pro Tern Ferre, stated that the Council and the residents of Grand Terrace have appreciated what he has given to the City and look forward to seeing him in a different capacity. Mavor Hilkev,indicated that Don Larkin will be missed and thanked him for giving so much to the City. 2. Resolution Reciting the Fact of the General Municipal Election Held on November 2, 2004,Declaring the Result and Such Other Matters as Provided by Law CC-2004-117 MOTION BY COUNCILMEMBER CORTES, SECOND BY MAYOR HILKEY, CARRIED 4-0,to approve the Resolution Reciting the Fact of the General Municipal Election Held on November 2, 2004, Declaring the Result and Such Other Matters as Provided by Law. 3. Swear In Newly Elected Council Members Brenda Stanfill,City Clerk swore in the newly elected Council Members Maryetta Ferre,Lee Ann Garcia and Jim Miller. 4. Election of Mayor and Mayor Pro Tem Council Minutes December 9,2004 Page 3 City Clerk Stanfill indicated that the Position of Mayor and Mayor Pro Tem are now vacant and that the floor was open for nominations for the position of Mayor. Councilmember Lee Ann Garcia nominated Councilmember Maryetta Ferre for the position of Mayor. CC-2004-118 MOTION BY COUNCILMEMBER GARCIA, CARRIED 4-1-0-0 (COUNCILMEMBER HILKEY VOTED NO), to appoint Maryetta Ferre as the Mayor of the City of Grand Terrace. Mayor Ferre opened the floor for nominations for the position of Mayor Pro Tem. CC-2004-119 MOTION BY COUNCILMEMBER JIM MILLER, CARRIED 5-0,to appoint Bea Cortes as the Mayor Pro Tem of the City of Grand Terrace. Councilmember Garcia, feels that it is a special honor to represent the residents of Grand Terrace. She is looking forward to working with the Council and Staff on making Grand Terrace even better. Councilmember Jim Miller. thanked everyone who helped him with his campaign. He thanked his wife for her support and his Campaign Manager Gene Carlstrom. He feels that Grand Terrace is moving forward to an exciting time and he is looking forward to working with everyone and thanks everyone for their support. Mavor Ferre,indicated that she is very honored that the voters have placed their trust in her for another four years and is looking forward to working with her colleagues as well as the entire community to reach the goals and pursue the new opportunities that are available for Grand Terrace. She is very grateful to her many friends that were willing to help her with her campaign. This victory would not have been possible without them. She thanked her son Jeff and her daughter-in-law Pam and her two grandchildren Griffen and Kendall, her husband,her brother Michael and her dear friend Janie Garcia. She thanked the Council for appointing her as the Mayor and she looks forward to the j ob and she thanked the community and is looking forward to working for them and to their benefit. 5. County Fire Station 23 Recognition Awards Captain John Lansing, San Bernardino County Fire Grand Terrace Station, presented a plaque of special recognition to Ms. Fuertes, a teacher from Grand Terrace Elementary School. They also presented Dawn Earnskin with a plaque of special recognition for all of her dedication to the Grand Terrace Fire and Rescue Association. He thanked Don Larkin for his donation to the County Fire and Grand Terrace Fire and Rescue Association as well as all of the other Councilmembers that support them. Mayor Ferre;presented a plaque to Captain John Lansing who will be leaving the Grand Terrace station. PUBLIC COMMENT Wavne Younp-man.22574 Van Buren Street,requested community support for the troops in Iraq. He requested that the Council consider adopting a Marine Unit that is in Iraq. Barnie Karger. 11668 Bernardo Way,stated that if a tree is planted properly it won't destroy the concrete. He stated that the Council should be above suspicion. He feels that the median at Mt. Vernon and Canal was designed poorly and should be fixed. Bill Hays. 22114 De Berry Street, indicated that he would like his letter addressed to the Council be made part of the record as follows: To: Grand Terrace City Council December 9, 2004 Councilpersons: Hilkey, Garcia, Miller, Cortes and Ferr6 Re: Real Estate Negotiations in Closed Session Council Minutes December 9,2004 Page 6 In accordance with sections 54950, 54954.2 and 54956 and in compliance with statutory notes of section 54960.1 of the Ralph M. Brown Act. On behalf of the citizens of the City of Grand Terrace,I respectfully demand that the City Council of Grand Terrace from this day forward not only comply with the spirit of the Brown Act but also the letter of the law. This Council, even after acknowledging their violation of the Brown Act at public meeting in July and August of 2004, continue to go into closed session without complying with section 54954.5(b) of the act. You must disclose before you go into closed session, in compliance with section 54954.5(b) of the act"specify street address, if no street address, the parcel number or other unique reference. You must specify name of party not the agent with whom you negotiated. You must specify terms,price and terms of payment or both to the negotiator. Section 54957.7 (b) of the act states you must reconvene into open session prior to adjournment and shall make disclosures required by section 54957.1 of action taken in closed session. I direct your attention particularly to section 54950 the intent of the act and section 54959 of the act that states any violation that deprives the public of information is guilty of a misdemeanor. Thank You William A Hays 22114 De Berry Street Grand Terrace 909 783-7902 Bobbie Forbes. 11850 Burns Avenue, announced the First Annual Toy Drive on December 11, 2004 that will be held at California Skate. The Holiday Decorating Contest will also be held on December 11 as well. The winners will be announced in the Blue Mountain Outlook. On December 16, 2004 from 5:30 to 7:30, the Chamber will be hosting a winter mixer at City Hall. Patricia Farlev. 12513 Michigan Street, stated that it has been very hard for her to sit and listen to the presentations. She feels that the Council should respect and be worried about her concerns. The Council is suppose to be representing her not shoving her off like a nobody. She feels that there is value to big,old,beautiful trees and that common sense needs to be used. She feels the Council should listen to the residents and not just go in and do as they please. Tonv Petta. 11875 Eton Drive, congratulated new Councilmember Jim Miller and new Mayor Maryetta Ferr6. He feels that some of the comments made about the Council are Council Minutes December 9,2004 Page 7 inappropriate. He sees a professionalism in the current council as well as the past councils. He feels that a level of courtesy should be given to the Council as well as those who come and speak at meetings. ORAL REPORTS 5A. Committee Reports 1. Historical and Cultural Activities Committee a. Minutes of 11-01-2004 CC-2004-124 MOTION BY MAYOR PRO TEM CORTES, SECOND BY COUNCILMEMBER GARCIA,CARRIED 5-0,to accept the November 14,2004 Minutes ofthe Historical and Cultural Activities Committee. COUNCIL REPORTS Mavor Pro Tem Cortes,requested an update on the meeting that was held between City Staff and SANBAG Staff on the signal synchronisation. Assistant Citv Manager Berry, indicated that staff did meet with representatives from SANBAG on October 24, 2004 which was to discuss the signalization project. SANBAG is coordinating approximately 300 traffic signals in the San Bernardino Valley. They are currently finishing up tier 1. Barton Road is included in Tier 2. This signalization would include the 4 existing traffic signals on Barton and the new proposed signal at Honey Hill, which is scheduled to be installed in Fall of 2005. It will also include the two freeway interchange signals at Barton and the 1215, which are controlled by Caltrans. The project will synchronize the lights,so during the peak time only,if you were going 40 miles per hour you would be able to go right through keeping the flow of traffic going. Mavor Pro Tem Cortes,she feels that we should acknowledge the efforts of Councilmember Hilkey with regards to this project. She thanked Councilmember Hilkey for doing a great job as Mayor this past year. Councilmember Hilkev. reported that the grass on the soccer fields is being ruined. He indicated that staff is working on fixing the problems. He feels that it is our field and we need to protect it. He received a letter from Barney Barnett requesting that Grand Terrace take a serious look at placing an underpass at Main Street and the Rail Road tracks. Citv ManaLyer Schwab.indicated that staff is already working with Riverside Transportation Commission to make sure that they are aware of the increased traffic of the new high school. They have discussed an overcross at Main Street. Council Minutes December 9,2004 Page 8 Councilmember Hilkev, stated that he received the recent Senior Newsletter and that the Crime Statistics were made available in it. Councilmember Garcia,thanked the Historical and Cultural Activities Committee for another outstanding Birthday Celebration. The Chamber is 42 years old and feels that Bobbie Forbes did a wonderful job of telling what the Chamber is doing. She would like to see all of the home-based businesses connect. She participated in the daffodil planting day along with some of the children from the child care center. She thanked the staff for all of the holiday lights throughout town. She wished everyone Happy Holidays. Councilmember Miller, feels that the Christmas lights are beautiful. He wished everyone a Merry Christmas and a Happy New Year. He thanked all of the voters that voted for him. Mavor Ferre,commented on the sign that says"Don't Even Think About Speeding in Grand Terrace." She requested that staff talk about the items that were brought to City Hall for the soldiers in Iraq. Assistant CitvManaRer Berm responded that the City is collecting cards written to American Soldiers as well as other items. The Foundation of Grand Terrace is paying for the postage to get these items to the troops. He stated that the City would be happy to have a special box for a specified group. The items will be sent January 17, 2005. Mavor Ferre, requested staff to explain Measure E. Citv Manae_er Schwab, indicated that at the next election of the City Council,which will be November of 2006, one of the Council positions will be designated as the Mayor. So in November of 2006 there will be an election for one Council Member position for a four year term and one Directly Elected Mayor position for a four year term. Staff is looking at how this will affect the Community Redevelopment Agency. PUBLIC HEARING -None UNFINISHED BUSINESS 7A.
