04/14/2005 CITY OF GRAND TERRACE CITY COUNCIL MINUTES REGULAR MEETING-APRIL 14.2005 A regular meeting of the City Council of the City of Grand Terrace was called to order in the Council Chambers,Grand Terrace Civic Center,22795 Barton Road,Grand Terrace,California,on April 14, 2005, at 6:00 p.m. PRESENT: Maryetta Ferr6,Mayor Bea Cortes,Mayor Pro Terri Herman Hilkey, Councilmember Jim Miller, Councilmember Tom Schwab, City Manager Brenda Stanfill, City Clerk Gary Koontz, Community Development Director John Harper, City Attorney Lt. Hector Guerra, Sheriffs Department ABSENT: Lee Ann Garcia, Councilmember Steve Berry, Assistant City Manager Larry Ronnow, Finance Director Jerry Glander, Building & Safety Director The City Council meeting was opened with the Pledge of Allegiance led by Mayor Pro Tem Cortes. CONVENE CITY COUNCIL MEETING ITEMS TO DELETE -None SPECIAL PRESENTATIONS A. Proclamation- Child Abuse Prevention Month Mayor Pro Tem Cortes read the Proclamation proclaiming April 2005 as Child Abuse Prevention Month in the City of Grand Terrace encouraging citizens to join in the efforts to end child abuse. Mayor Ferr6 presented the Proclamation to Sue Taylor of San Bernardino County Children's Network. B. Proclamation-Blue Ribbon Week Mayor Ferr&read the Proclamation proclaiming the week of May 15, 2005 as Blue Ribbon week in the City of Grand Terrace in recognition and support of all peace Council Minutes April 14,2005 Page 2 officers and law enforcement agencies. C. Proclamation- Crime Victim's Rights Week Councilman Jim Miller read the Proclamation proclaiming the week of April 10- 16, 2005 as National Crime Victims' Rights Week in the City of Grand Terrace. D. Proclamation- Infant Immunization Week Councilman Jim Miller read the Proclamation proclaiming April 24 - 30, 2005 as Infant Immunization Week and May 2005 as Toddler Immunization Month in the City of Grand Terrace in an effort to increase awareness that childhood immunizations are one of the best ways to keep our children safe and healthy. E. Proclamation-National Volunteer Week Councilman Herman Hilkey read the Proclamation proclaiming April 18 -23,2005 as National Volunteer Week in the City of Grand Terrace and urge all citizens of the City of Grand Terrace to join in the effort to "inspire by example" in their communities. F. Foundation of Grand Terrace Results of the Visioning Session Report Jim Kina.President,the Foundation of Grand Terrace,22928 Palm Avenue,thanked everyone for attending his retirement party after working 36 years with the Gas Co. He was very overwhelmed with the whole process. He reported that the Foundation held the Visioning Session in November to gain input from citizens of Grand Terrace for the future of their city and it started with him asking everyone to close their eyes and pretend that they were on the 215 freeway coming North from Riverside,take the off-ramp and make a right turn into OZ. What does Oz look like. Then he told them to pretend they were at home and wanted to take their family out for an evening and to open the front door of their house and look out and what do they see. Dreaming is what followed. It is the hope of the Foundation of Grand Terrace that with help they can make some or all of the dreams come true. As a result the Foundation has gained insight into the types of proj ects that are,best suited to shaping the community of Grand Terrace. Participants broke into small groups for discussion and brainstorming. Award Design Contract - Bike Lane Project (Mt. Vernon Ave. West to Michigan) Patricia Farley. 12513 Michigan Street, stated that she pulled this item because she feels, as well as others in the community, that proposals and the selection process should be made much more public when the important decisions are being made by the Council. CC-2005-35 MOTIONBY COUNCILMEMBERMILLER,SECOND BY COUNCILMEMBER HILKEY,CARRIED 4-0-1-0(COUNCILMEMBER GARCIA WAS ABSENT),to award the Design Contract of the Bike Lane Project (Mt. Vernon Avenue west to Michigan)to W.J. McKeever Engineering in the amount of 10,840.00 and to bring back the design to the Council prior to the construction of the bike lane. 3F. Reject Liability Claim (Guzman) CC-2005 -36 MOTION BY MAYOR PRO TEM CORTES, SECOND BY COUNCILMEMBER MILLER,CARRIED 3-0-1-1(COUNCILMEMBER GARCIA WAS ABSENT AND COUNCILMEMBER HILKEY ABSTAINED), to Reject the Liability Claim submitted by Guzman and authorize the City clerk to notify the claimant of the action taken. PUBLIC COMMENT Barnev KarRer. 11668 Bernardo Way, questioned how do you register apartments when the County already does this in Grand Terrace. He shared some pictures of some sidewalks that are a huge liability for the City and stated that they have been this way for a year and that the City hasn't done anything about them. Expressed his concern with the lack of openness at the meetings. He feels that honesty is the most important thing. When you hide behind closed doors and discuss things you give the appearance of dishonesty. He feels that having a bike lane on Barton Road is a bad idea and that they will interfere with parking and is a traffic hazard. Council Minutes April 14,2005 Page 6 Wavne Younonan, 22574 Van Buren Street, referred to an article in The Press Enterprise on the traffic control officer. He stated that in October he provided the City Council as well as the City Manager.and Assistant City Manager a package with a petition regarding speeds on the 22000 block of Van Buren. He had the residents on the street sign it and he drafted a letter that went with it that addressed his concerns with the increase of speeds. He did his own traffic study and the cars are averaging 15 to 20 miles-per hour over the 25 mile hour speed limit on that portion of Van Buren. He is sure the same thing is happening from Mt.Vernon to Michigan. The highest speed he recorded was 54 miles per hour in a 25 mile zone. You can't even back out of your driveway. The traffic is not even stopping at posted stop signs on Mt.Vernon at the intersection of Van Buren and Pico. He has seen people run the lights at DeBerry. He feels that this is a continuing problem. He requested additional enforcement on Van Buren both east and west from Mt. Vernon and also at the posted stop signs at Mt. Vernon and Van Burn and Mt. Vernon and Pico. Bobbie Forbes, 11850 Burns Avenue, announced that the Chamber of Commerce will be holding their monthly luncheon on Tuesday, April 19, 2005 at 11:45 a.m. Laurie Shearer will be the speaker. She invited everyone to attend. Bill Hays,22114 DeBerry Street,indicated that three times he has come in and asked about developers and he has either been given no information, false information, or outright lied to. He read a letter that was dated June 14,2004 that was written by Mr. Schwab. He referred to several articles about the OAC and expressed his concern and dissatisfaction with the lack of information that is available to the public. Wavne Youneman. 22574 Van Buren Street, Stated that Sgt. Mark R. Williams, USMC is a son of a lifelong school friend and that he requested that any items that were collected in Grand Terrace be sent to his troop in Iraq and they were. He stated that he returned on April 2, 2005. He received the packages by hand delivery. He stated that the items that were sent were distributed to approximately 20 individuals. He stated that the troops need foot powder's and body washes;phone cards by AT& T,powdered drinks, lip balm, sunscreen, granola bars, pop tarts, gum, hard candy, zip lock bags, and q-tips. He stated that he will pass on the address to staff where items can be sent in the future. He stated that all of the items are greatly appreciated. He stated that at the Community Clean-up day the disposal company would not accept e-waste. The new route manager indicated that they were unaware that they would be taking a-waste and that they had not made provisions to accept e-waste. He stated that he would be in Grand Terrace on Tuesday and he personally came by his house and picked up the televisions. The entire program was well organized and run,however,no one asked him for proof of residency. Mark Hoover, Colton Joint Unified School District Board of Education Member, 1212 Valencia Avenue, Colton, indicated that he is a member of the Board for the Council Minutes April 14,2005 Page 7 Colton Joint Unified School District, however, he is not speaking on behalf of the board he is speaking as an individual. He thanked the City of Grand Terrace for their continued support of the students of the Colton Joint Unified School District and the students of the community. The District and the City of Grand Terrace has a long history of cooperation and partnership and he looks forward to the continued relationship between the two agencies and he is also looking forward to a new high school coming in soon. He thanked the Council for their continued partnerships and cooperation and team work. Vicki Black.22163 Pico Street, stated that she along with Vicki Doyle put together a yoga class for the City of Grand Terrace. She thanked the. Council for the opportunity to teach Yoga to the community. Vicki Dovle. invited those interested to the first Yoga class on April 20, 2005 at 10:00 a.m. It will be free. Tobin Brinker. Colton Joint Unified'School.District Board.of Education Member, 1212 Valencia Avenue,stated that he too is here as an individual this evening and is interested in what happens under the.closed;session.item. He is anxious to move forward with this project and it is his hope that they have a successful project. Patricia Farlev, 12513 Michigan Street, indicated that she read about the City charging rental properties an extra fee so that the City can make sure that they are following the codes. She feels that the City already has a large problem in not enforcing the codes and the codes that they do enforce are not consistently or fairly enforced. She feels that the City has a problem in not fairly and consistently enforcing codes,business licensing fees,people are not treated equally and the Code Enforcement Officer is often seen doing other duties that have nothing to do with code enforcement. Michael Townsend. 1245 Country Place,Redlands,stated that he is a new employee to the Colton Joint Unified School District as the Communications Manager. He has enjoyed his experience there over the past few months and is beginning to learn the people and the business of the district. He has had an opportunity to speak with many of the students and staff and there is excitement of the prospect of having a new high school. Dennis Bvas. Superintendent, Colton Joint Unified School District, 1212 Valencia Drive, indicated that he is speaking on behalf of the entire District and thanked the Council for their continued partnership of developing the new high school. It is their plan to bring forward a high school that will be in excess of one hundred million dollars. They are looking forward to this continued partnership the City Staff has 1 Council Minutes April 14,2005 Page 8 been working hand in hand with this. Citv Manager Schwab, stated that a Class 2 bike lane was brought to the Council about two months ago, however, it would have required the City to make Barton Road no parking. The Council objected to that and indicated that they didn't want to have a class 2 bike lane on Barton Road because of the parking issues that were brought up tonight. Staff went back and resubmitted the application as a Class 3, which does not prohibit parking. On-street parking will still be allowed where it is now on Barton Road. Driving over the speed limit is probably a problem on all up and down streets in Grand Terrace. Staff is looking at doing a comprehensive traffic study. We are receiving approximately $600,000.00 from the Highgrove developments for the impact fees. We are looking at doing some things on Van Buren that some people will like and some won't. We recently put in a speed hump on De Berry, some people like it and some don't. There is one traffic car in Grand Terrace and we try and have it spread around. 90%of the speeders on Barton Road do not live in Grand Terrace. In regards to the Outdoor Adventure Center, our current projection is for 2.3 million dollars of revenue on full build out. Things have changed since the original estimates. The public document that shows the Grand Terrace Partners,is called the ENA(Exclusive Negotiating Agreement),between the Redevelopment Agency and the developers. In regards to Mr.Megna saying that the OAC was his idea,it is true. When he was the Redevelopment Director for the City of Riverside he had an idea to do something similar to this and as our agent he brought that forward and it became something that the City was embracing. The City will continue to collect items to send out to the troops in Iraq. He will talk to Assistant City Manager Berry regarding the e-waste issue,he was not aware of that. He thanked the School Board members for coming to the meeting. He stated that the City has one Code Enforcement Officer for the entire City. The idea of charging a fee for rental properties has not been discussed by the Council,it is an item that will be brought to the Council. One of the items will be to charge those who have rentals for rental inspections. We will propose to take the program over from the County of San Bernardino and through the process it would possibly fund an additional code enforcement officer. When that time comes the residents will have an opportunity to come out and voice their opinion. ORAL REPORTS 5A. Committee Reports 1. Historical &Cultural Activities Committee a. Minutes of 03-07-2005 CC-2005-37 MOTION BY MAYOR PRO TEM CORTES,SECOND BY COUNCILMEMBER Council Minutes April 14,2005 Page 9 HILKEY,CARRIED 4-0-1-0(COUNCILMEMBER GARCIA WAS ABSENT),to accept the March 7, 2005 Minutes of the Historical and Cultural Activities Committee. COUNCIL REPORTS Councilmember Hilkev.sated that he missed the opening prayer and hopes that we continue to do them in the future. He questioned Mr.Karger if he receives invoices from the County for rental inspection of his rental properties in Grand Terrace. Mr. Karger.responded in the affirmative. Councilmember Miller,stated that people speed down his street,which is Palm Avenue. He , also stated that a lot of the speeders on residential streets are neighbors and it is.a big concern for him. He is looking forward to the Comprehensive traffic.study being completed. He stated that he owns-rentals and pays other cities for those rentals and he will wait and see what happens when it is brought out to the-public and-see what their opinion is. He believes that the Code Enforcement Officer is overworked and that we would need another code enforcement officer as this City grows,which it will. This may not necessarily be the way to fund it but we will probably need another one in the future. Mavor Pro Tern Cortes, suggested that the items that the guys need in Iraq, that Mr. Youngman reported,be included in the next issue of the Blue Mountain Outlook. She also suggested placing an article on the Blue Mountain Outlook regarding speeding. She asked that the meeting also be adjourned in memory of William Howard Souffel, Jo Ann Carlstrom's father. Mavor Ferre, indicated that there have been many events that the Council has been invited to over the past month. She attended the Volunteer Appreciation Dinner put on by the library. She also attended the Community Sunrise Service along with Mayor Pro Tem.Cortes and Councihnember Garcia that was held on Easter. She also attended the City/County Conference as well as other members of the Council. She also attended the San Bernardino County Gang and Drug Task Force Meeting at the beginning of the month. PUBLIC HEARING 6A. Resolution-Approving Tentative Parcel Map No. 04-03 and E-04-07 to Subdivide Assessors Parcel 276-421-06 into 3 parcels Jeff Gollihar. Staff Member, reported that the applicant, on behalf of Francisco Cacho, is requesting approval of the proposed Tentative Parcel Map to divide the subject site into three new parcels as follows: Parcel 1 is 52,920 Square Feet, (1.21) acres; Parcel 2 is 31,544 Square Feet,(0.72 acres);Parcel 3 is 28,920 Square Feet,(0.66 acres). Each new parcel will Council Minutes April 14,2005 Page 10 exceed the minimum standard of the underlying R1-20 Zone in terms of area (more than 20,000 square feet),required lot width(100),and required lot depth(150). He stated that the request is both consistent with the R1-20 Zoning of the site and the City's General Plan. The proposed new parcels are also compatible with the existing"lot pattern" and"lot sizes"in the immediate area. He stated that the applicant has not submitted any plans for future residential construction at this time. Any future residential construction will require the filing of a Site and Architectural Review application and another Public Hearing before the Planning Commission. He indicated that the Tentative Parcel Map is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) as a class 15 categorical exemption. The Planning Commission and staff recommend that the City Council approve the Resolution of approval for Tentative Parcel Map No.04-03(CountyNo. 16831). Councilmember Hilkev, wanted to make sure that all of.the Tentative Parcel Maps are consistent with the conditions"of approval. Mayor Ferr6 opened the Public Hearing for discussion.' Cvnthia Neighbors.22959 Grand Terrace Road,indicated that all of the Road improvements would have to be.completed prior to having a final map approved or bonded for all of them. She stated that they are asked to dedicate 10 feet of frontal property and expressed her concern with having to develop the frontal property prior to subdivision. She stated that they have to do what they have to do but they would like it on record that they are protesting the dedication of the property and development prior to doing anything to it. City Attornev Hamer,responded that the law allows for these requirements and conditions. Cvnthia Neighbors, stated that she feels that it would be more appropriate to develop those improvements at the time she develops the parcel rather than when the final map is requested. Citv Attornev. stated that all applicants have the same requirements. Cvnthia Neighbors,feels that the requirements are unfair. She questioned if widening of the road is in the near future because she feels if they construct the curb and gutters and then the City widens the Road that it is a waste of money. Citv Manager Schwab, responded that when the road is widened it will be widened to its ultimate width, it will not be any wider. If you do not want to do any of the improvements you don't have to divide the property. The assumption is if you divide the property then you have the legal authority to split the property and sell it off. The city is requiring that those public-improvements be put in so that you don't sell the property later and then there is no mechanism for the City to get that individual to put in the public improvements. Council Minutes April 14,2005 Page 11 Cvnthia Neighbors, questioned if they decide not to subdivide the property and they do improvements on the house are they still required to make the public improvements. Citv Manager Schwab.responded that if they choose not to subdivide they do not have to do the improvements. Mayor Ferre closed the Public Hearing. CC-2005-38 MOTION BY COUNCILMEMBER HILKEY, SECOND BY MAYOR PRO TEM CORTES,CARRIED 4-0-1-0(COUNCILMEMBER GARCIA WAS ABSENT),to approve a Resolution Approving Tentative Parcel Map.No. 04-03 and E-04-07 to Subdivide Assessors Parcel 276-421-06 into 3 parcels. 6B. Resolution-Approving Tentative Parcel Map No. 05-01 and E-05-01 to Subdivide Assessors Parcel 276-401-01 into 3 Parcels Jeff Gollihar. Staff Member.stated that the applicant is requesting approval of the proposed tentative parcel map to divide the subject site into three new parcels as follows: Parcel 1 - 16,732 square feet,(0.38 acres);Parcel 2- 18,469 square feet,(0.42 acres);Parcel 3 -26,863 square feet, (0.62 acres). Each new parcel will exceed the minimum standard of the underlying R1-10 Zone in terms of area(more than 10,000 square feet),required lot width (60), and required lot depth(100). The request is both consistent with the R1-10 Zoning of the site and the city's General Plan. The proposed new parcels are also compatible with the existing"lot pattern" and"lot sizes"in the immediate area. He indicated that the Planning Commission and Staff recommend that the City Council approve the Resolution for approval of the Tentative Parcel Map No. 05-01 (county No. 17041). Councilmember Hilkev. questioned if there are any plans of widening Barton Road that would affect the availability of this parcel. Mr. Gollihar, responded that there is also a request for dedication of Road. The widening of Barton will have very little affect on this property. Councilmember Hilkev. stated that the sidewalk on Barton Road goes no where and it will never go anywhere and questioned if they had to have it. Mr. Gollihar,responded that Building& Safety/Public Works Director requested that it be included in the conditions,however, it could possibly be waived at time of construction. Mayor Ferr6 opened the Public Hearing. Patricia Parks.25849 Hudson Court,Loma Linda,indicated that she has a trust that owns the subject property. She feels that having the sidewalk on Barton Road is unnecessary and will Council Minutes April 14,2005 Page 12 be a safety hazard. Mayor Ferre returned discussion to the Council. CC-2005-39 MOTION BY COUNCILMEMBERHILKEY,SECOND BY COUNCILMEMBER MILLER,CARRIED 4-0-1-0(COUNCILMEMBER GARCIA WAS ABSENT),to approve a Resolution Approving Tentative Parcel Map No. 05-01 and E-05-01 to Subdivide Assessors Parcel 276-401-01 into 3 Parcels UNFINISHED BUSINESS -None NEW BUSINESS 8A. Grand Terrace Days Concession Stand Lottery Mayor Ferre did a random drawing and the following is the list of non-profit organizations that will use the concession stand at Richard Rollins Park for the Grand Terrace Days event by year. 2005 - Grand Terrace Area Chamber of Commerce 2006 - Grand Terrace Lion's Club 2007 - Grand Terrace Little League 2008 - Grand Terrace Community Soccer 2009 - Grand Terrace Woman's Club 8B. Public Comment Procedures City Manager Schwab, indicated that staff received a.request from Council to agendize a discussion on Public Comment Procedures. City Attorney Harper, provided a letter with his comments regarding public comment and its requirements under Government Code Section 54954. City Attornev Hamer,went over the letter he provided to the City Manager and the Council regarding his opinion on Public Comments per the law. Councilmember Hilkev,indicated that the reason he requested this item was because he wanted to see staff s response to the two people that spoke at the last council meeting that were duly noted. We were stopped from discussing and answering questions. He stated that he wanted the response to those questions in writing and he never received them so he felt that he had no choice but to place the response that the staff had on the agenda for Public Discussion so that it could be talked about in public. His concern is that we have stopped informing the public and he has a deep concern that the public know what we are doing. He feels that Council should be Council Minutes April 14,2005 Page 13 able to address the public if there is a simple answer otherwise the message that we don't want the public to know what is going on and that we are hiding things and he feels that it has to stop. He feels that they need to be more open and if it requires him to place everything that gets duly noted on the Agenda he will so that it can be discussed openly. Mavor Pro Tem Cortes, questioned that if during their Council reports can they request that an item be agendized. City Attornev Hamer.responded in the affirmative. Councilmember Miller,thanked the City Attorney for his comments. He feels that there are residents that take the time to come to the council meetings and they may have issues that aren't on the agenda for that meeting, however, they would like to have an answer to their questions. He stated-that in the past there was openness in the meetings.and he would like to see that again. He feels that there are times that the Council can answer questions without it being agendized at another meeting. ON Attornev Hamer,responded that the questions for clarification are allowed it is the discussion that should not take place. Mavor Ferre, stated that it is her role as the presiding officer of the Council to make sure that everyone is treated fairly and equally within the limits of the law. So as the presiding officer she has been doing that. If this isn't acceptable they can change it. She stated that she opens Public Comment and then once all ofthe Public Comments have been made then all of the responses to public comment will be handled. Staff has an opportunity to respond and then it goes directly into Council Reports where Councilmembers can respond briefly all within the limits of the law. - City Attornev Hamer, stated that the way the meeting was held was completely within the limits of the law and the more typical way that cities handle public comments. Councilmember Miller, questioned if Councilmembers can request someone that made a public comment to get back up and speak. Citv Attornev Hamer,responded that there is nothing unlawful to do that however, you need to stay away from dialogue. Mavor Pro Tem Cortes, questioned whether it would be possible for the responses to be included in the minutes. Bill Hays.22114 DeBerry Street,stated that everyone that got up to the podium at the Council Minutes April 14,2005 Page 14 last Council Meeting was addressed by the Council except him, he was duly noted and I guess duly noted means ignore this person or I don't know what to say. He indicated that he would like to see town hall meetings where there can be open dialouge. He stated that since Mayor Ferr6 has been the Mayor he has not received any responses. Councilmember Hilkev, stated that at the last meeting when people spoke and they were duly noted he questioned what that meant. He asked if that meant that the responses were going to be on the next agenda and the Mayor responded that is not what it meant. He questioned what happens next. He feels that what happens next is nothing. He feels that it has to be changed. He stated that he asked for a copy of the response and he indicated that he didn't receive anything which is why he asked for it to be placed on the agenda. If someone is duly noted,he wants the response to be placed on the agenda until the lines of communication are open. City Manager Schwab, stated that his response to Mr. Hays was sent and copies to the rest of the Council. Councilmember Hilkev, would like the responses made public to the entire community not just to that one person asking questions.
